So is it time to pull back . Reporter lots of people out for some fun in benicia tonight. Last week an employee tested positive for covid19. The owners decided to close the doors again for 14 days. Thankfully it did not spread through the whole restaurant and its because of the safety precautions and the masks and the gloves. Reporter with the number of new cases in california on the rise governor gavin newsom is pleading with you to take precautions. Were seeing an increase in spread as more people mix, as the economy opens up, as more people are out and about. Wear a mask. Reporter sailor jacks isnt the only restaurant in benicia to close after reopening. Next door a note on the door a staff member tested positive for covid19. In marin county the buckeye roadhouse stopped take out and Outdoor Dining after staff got sick. Bay Area Health Officers are monitoring developments closely. What im looking at most closely is surges into our hospitals. Reporter in marin county dr. Matt willis says a surge in covid19 hospitalizations will force Health Officers to pull back on reopening. The Health Care Capacity to manage that influct of cases, that would be the trigger for us to certainly stop moving forward anything we had planned to move forward and in fact begin to reclose things that might have already been reopened. Reporter willis is hopeful people will continue to take precautions and restrictions wont be necessary. The owners of sailor jacks are ready to get back to work, but with coronavirus in the community they say safety comes first. Were always going to put the safety of our staff and guests first. Well, here are the latest numbers. Alameda county, 130 new cases since yesterday. Thats more on one of the highest days so far. Contra costa county has 69 new cases. Santa clara county has 105 new cases. This chart tracks cases from the last 30 days. This is santa clara county. Cases dramatically rising at the end of last week. You can see a peak of 9 cases last wednesday. Contra costa county shows cases steadily climbing and including 101 cays in one day. Despite these numbers the county prepares to reopen higher risk businesses including gyms, nail salons and bars next week. And some residents in Contra Costa County cant wait for these businesses to reopen, but some Business Owners are hitting the pause button. Reporter its been months since hes been able to glove up with his clients and run them through their paces at his boxing gym. For those ready to come in and weve got a pretty good response from everybody waiting to come back. Reporter to get ready hes marked up the gym floor with tape to ensure proper physical distancing. Only one client will tee allowed in a station at a time and hes got equipment to wipe down the equipment after each use. Contra costa county Health Director ana roth told infections among 20 to 50yearolds are among those increasing. Im concerned about my employees, about myself. Three North Eastern states are teaming up to try to stop the recent surge in covid19 cases. People visiting new york, new jersey andconduct from covid19 hot spots are being asked to quarantine for 14 days upon arrival. Now, there are eight states on the hot spot list. You can see them in red. They are alabama, arizona, arkansas, florida, north carolina, south carolina, utah, and texas. California is not one of them. People from these listed states are not barred from visiting the northeast making this move mostly advisory. The happiest place on earth will stay closed for now. It will replace the officers with peacekeeping ambassadors and critics say that will take them away from their beats on city streets, but supporters say taking armed officers offcampus will make schools safer and set an example of what safety looks like on campuses. School counselors, more nurses, librarians, it looks like making it a holistic environment where it supports families and children. Someone else whos supporting this move warriors head coach steve kerr. He tweeted this out tonight saying tonights decision is a step in the right direction. Today san jose mayor sanlocardo unveiled a nine step reform plan he would like to see implemented at the Police Department. The plan includes banning the use of rubber bullets which officers used last month responding to a protest that got out of hand and wants to change the way allegations of Police Misconduct are handled and wants to see more diversity in the department. The police chief is reviewing the proposals. A hate Crime Investigation is under way after racist and threatening graffiti was found. It was painted on a wood panel outside a restaurant in vallejos Blue Rock Springs park. The message also included a swastika and a racial slur. The police chief called the vandalism, quote, evil and despicable. The department is reviewing evidence which could lead to an arrest. And another hate Crime Investigation. This one in union city. Police believe someone spray painted a mans car with racist graffiti and smashed the front window because he had signs supporting the black lives matter movement. This happened as the car was parked sunday morning. One of the officers who responded helped remove the graffiti himself. Well, they jumped into action to save a babys life. A fathers day two San Jose Police officers will never forget after responding to an emergency call at a familys home. Reporter the image is frightening. Two San Jose Police officers performing cpr on an 11 month old baby boy. Dispatcher told us he wasnt breathing and he wasnt conscious at the time. Reporter the call came in around 10 00 a. M. On fathers day. Baby is laying right there and crying on the pavement and people vunding him. Just took over the scene. Reporter the officer joshua immediately started chest compressions while officer martinez gave the boy breath through a cpr mask. Martinez says the boy wasnt choking on anything and no one knew why he had stopped breathing. Both officers say their training immediately kicked in. I didnt have too much time to think. When i was thinking about was trying to get all my right equipment which was the cpr mask, and i just moved into action, put the mask over the babys mouth and nose and just gave the breath and thats all i was thinking about. Reporter then the sound they hoped to hear. After the first round of the breath you could start hearing him cry a little. Reporter the young three year veteran officers had saved the babys life. Many are calling them heroes. But both give credit to everyone involved saying it was all in a days work. The officers tell me they visited the boy at the hospital and hes in stable condition. Palo altos Police Department finds itself on the defensive kwet again after a lawsuit was filed today in federal Court Alleging an officer violated a residents civil rights when he made a late night trip to get a doughnut. Senior investigator found that officer has been the focus of several questionable use of force incidents in the past. Reporter this latest lawsuit follows only weeks after we learned the fbis Civil Rights Division out of oakland is investigating palo alto pd and the officers who pulled another resident from his home over a suspended drivers license. And we learned the local da is reconsidering criminal charges in that case as well. This video is at the center of the latest civil rights lawsuit just filed against palo altos Police Department. On the left is store Surveillance Video from happy doughnuts. On the right newly released Police Body Worn body cam footage. Julio can be seen going to the store late at night to get his son a doughnut in july 2019 when hes confronted by palo alto officer. I should have just stayed home. Reporter he tells us he doesnt remember anything from that night but the video shows him attempting to walk away from the agent as the officer tells him hes being detained because hes on probation. The video also shows him pushing him against the fence as he holds onto that fence he slams him to the ground in what the officers report later calls an arm bar take down. The video shows him going limp as his head hits the concrete. He was taken to the emergency room where doctors diagnosed him with a fractured orbital bone. In the video it looks like there were doughnuts flying when he grabbed me. Reporter in his report his report says he thought he saw a drug exchange. No drugs were ever found. The police forwarded the case to the das office for review for possible charges for resisting arrest, battery on a Police Officer and being under the influence. But nearly a year later he hasnt been charged with anything. The best thing we can continue to do to try to deter that behavior is keep filing these lawsuits. Reporter he just filed this civil rights lawsuit on his behalf against palo alto pd. In terms of the lawsuit at some point perhaps one Police Officer not just in that agency but other agencies will look at that and say i dont want to be that officer on the news. Come on out or were going to kick the door in. We dont need a warrant. Reporter thats also the agent yelling in this 2018 video captured on another residents Home Security camera. The video shows Police Officers pull alvarez out of his home over suspicions hed been driving with a suspended license, all charges that were later dropped. The video also shows Palo Alto Police sergeant the supervisor on the scene slamming alvarezs head into the cars windshield. And now the fbi is investigating palo alto pd as well whch while federal and city officials will not comment documents from last fall show that federal civil rights investigators requested the entire alvarez case file. I think that having the fbi essentially watching over this case is going to send a message to other officers that, you know, their buddy who happens to be assigned to internal affairs isnt going to be the only person thats scrutinizing their unlawful conduct going forward. I will hold this team accountable when necessary, and i want the community to continue to hold us accountable. Reporter appearing before palo altos city council on february 25th just before the covid outbreak chief Robert Johnson promised transparency while some angry residents expressed their frustration with the Police Department. This is unacceptable. We cannot get better unless we get out of denial. Reporter but Chief Johnson continues to refuse to answer any questions from nbc bay area about either of these cases. And it took more than ten months for his department to release his body camera footage. The departments use of force report from the july case was not completed for more than five months after we started asking questions. In the use of force report he told investigators he had been in a fight earlier before the incident with the agent. The report dated december 11, 2019, determined the officers force, quote, appeared reasonable and within policy. But it also found discrepancies between destefonos report and the video. Im not naive to the fact weve been subject to some very serious allegations over the past year. I want to assure you that i take these allegations extremely seriously and misconduct will not be tolerated. With that fog holding on so strong at sf right now i definitely do think as we head through tomorrow morning anyone near the bay, the coast, the peninsula or the north bay is going to have to deal with some patchy area of fog and low clouds, but take notice south bay you had some sunshine. Also the trivalley some sun, and 60s. San francisco will start off at our coldest at 59 degrees. So we start with the fog as i talked about then by the afternoon well clear out for most of us away from the coast to that sunshine. Temperatures dont budge much.
