>> that's right, it will convene three hours from now, 10 a.m. pacific time. the first big fight is already on, the rules of the road. senator majority leader mitch mcconnell is planning to really fast track this process. >> meanwhile, a new poll shows how americans are feeling about the whole thing. 51% said they want a conviction and the president's removal from office, 49% support his acquittal and 69% want it to include testimony from new witnesses. >> as this is all unfolding in washington, the president is attending an economic summit in switzerland. question have all of the angles covered start with peter alexander. >> good morning to you. this impeachment trial begins in a few hours with opening arguments set for tomorrow. but not after a debate and vote, likely more than one, with rules that republicans lay out a plan to speed through the proceedings with marathon days, possibly 12 hours each. democrats are already complaining it's deeply unfair, it is in their words a national disgrace. the rules, they say, are being hidden from the american people. ahead of the impeachment trial, keeping a close drama on the eye back home. >> we're meeting with the most important people in the world. the other is just a hoax. the witch-hunt that's been going on for years. frankly, it's disgraceful. >> reporter: at the capitol completing their final walk-throughs the president's defense team serving as prosecutors. the blueprint allows each side 24 hours confined to two days a piece to make their case, meaning with an expected start midday tomorrow arguments can go late into the night, early the next morning. democrats are outraged, accusing republicans trying to rush the process and hide it from the american people. >> there's now concern leader mcconnell is going along with trump's cover-up, hook, line and sinker. both sides are previewing their position. in a 110-page briefing, the president urging the senate to acquit him immediately. and asking them to pursue investigations into the bidens, withholding military aid, they argue the president did absolutely nothing wrong and the charges of abuse of power and obstruction of congress do not meet the congressional threshold for removing a president from office. >> the framers of the constitution did not admit impeachment on grounds like abuse of power or obstruction of congress. and they introduced and set very specific treason, bribery or high crimes and misdemeanors. >> reporter: the comments from alan dershowitz, now part of the president's legal team, seem to contrast with his comments about the clinton trial in 1998. >> certainly doesn't have to be a crime if you have somebody who completely corrupts the office of president and abuses trust and poses great danger to our liberty, you don't need a technical crime. >> reporter: dershowitz explaining the about-face monday night on cnn. >> you were wrong back then? >> i'm saying i am much more correct right now having done more research -- >> much more correct? >> reporter: the democrats say they overwhelmingly prove he did abuse his power and saying he attempted to cheat in the election and bury his evidence when he got caught. >> to say he did nothing wrongfullies in the face of -- not only the truth -- but flies in the face of what i think republican senators know to be the truth. >> one thing to watch for the defenders might try to dismiss the trial outright by raising the effort on the floor. it's highly unlikely that effort would pass. if this trial is put on a fast track, it could wrap up before the state of the union, savannah and craig, just two weeks from today. >> peter alexander, thank you. from outside let's go inside the capitol, where we find casey hunt right in the middle of the action. good morning. >> good morning to you. this day is the display, pageantry. over the weekend they took things out of the closet and dusted them off and put them in the senate chamber for what is about to unfold. they put them in the well of the senate. we can show you what that looked like last time around. it was pretty crowded. the floor of the senate is not necessarily as big as you might think. for the senators, it's going to be a lot like a very long day at school today. you may remember the cubbies you may have had or kids had when they go to kindergarten. senators have to put all of their electronics in there before they walk out to the senate floor. they're prohibited from having them. they're prohibited from talking to each other and from reading anything not related to the trial, that's officially on imprisonment. we don't expect anything like that to be enforced but they're breaking the law if they get up to go to the bathroom. one of the challenges, of course, staying aaway. there will be a special desk with candy for that. and this is activity picking up on capitol hill, the hallway all the way down to the senate chamber where all of this is going to unfold starting in a few hours. >> kasey, thank you. we're joined by claire mccaskill, former senator and rich laurie and msnbc analyst. great to see you. >> good morning. >> because the fight is off and running, senate majority leader mitch mcconnell fast-tracked this process. both sides, you have 24 hours to make your cases and have to do it over four days. that makes for two very long days for democrats. and for republicans. do you think that's fair? do you think that's hurting the democrats' ability to put on their case? >> it's an outrage. it's an absolute outrage. >> why? >> i can hear the wailing all the way from washington last night when this came out. can you believe if you came to jury duty when the judge said you're going to hear evidence at 2:00 in the morning. there's no excuse for this to start at 1:00 in the afternoon and go until the middle of the night. this is important stuff. whether you agree or disagree with the president, there's no excuse for the senate to decide this important evidence, for both sides, is going to be heard in the middle of the night. >> rich, do you think it's a shrewd move by mitch mcconnell? or is he playing games? >> he and the president want to get this over with as quickly as possible. it's hypocrisy on the democrats' side, where they expedited the impeachment in the house. now, they want to slow up the trial because it will be awkward for vulnerable republican members in the senate. clinton impeachment, there were three days. there will be two days here. we'll know what the democratic argument is. and the fact of the matter is, whether it's two days, three days, four days. the outcome will be the same. >> correct me if i'm wrong, it starts later in the day because the chief justice has business across the street in the supreme court in the morning, because he has a day job. that why it starts late? >> and the senate likes to keep the mornings open for potentially any other business. >> could it be a favor for the democrats, to tighten their case, not go until 1:00 in the morning. but do it in a shorter timeframe? >> in that regard, the lawyers who present these cases and the democratic house managers are like everyone else, they like as much time as possible to finish their homework. i think this will be seen by the public, they're clearly rushing this. the other that mitch mcconnell is doing, where the trial and the political strategy intersect, is he is drawing the partisan war into this morning. everybody is waking up to a trial, a rare thing, a president on trial. it's a huge and intense partisan battle. he's gotten that over the rules, before we get to the real debate, whether witnesses will be heard. >> it is an ongoing partisan debate. the other big issue is the question of witnesses. they're going to vote on witnesses later. the president's team put out a trial brief. and there's an irony there, rich. on the one hand, they're saying, there's no firsthand ever that the military aid or the white house meeting was withheld. at the same time, they don't want to call witnesses. doesn't that put them in a box? >> the best republican case is on witnesses, what most senators believe but won't say. we know what happened. it was wrong. we don't think it rises to the level of removal. there's a contradiction of the democratic case say, we knew enough to impeach but you don't know about enough about our judgment to render impeachment. >> there are senators who do face election in swing states, purple states. will this be a tough question for them not to allow witnesses? >> the vast majority of americans want the witnesses to be heard. more evidence has come to light since the house finished its process. keep in mind, impeachment is not a trial. it says there's enough evidence for the trial. the trial is where you have the witnesses and the documents. and the notion this white house is doing everything it can, including strategizing, if bolton is called, how they do it out of the public eye. that's really, i think, not going to sit well with most americans. >> when you look at this, there will be arguments about the facts, which you just alluded to, and also arguments about the law. one of the arguments republicans are making is abuse of power is not impeachable because it's not a crime, it's not a federal crime. and there's been division over that issue. >> legally that is not true. there have been many impeachments, including of nonpresidents and there are nonfelonies, meaning something bad you would do because of the power the government gave you. a police officer, judge, president all have those special powers that might not be literally a technical crime under the law. why that's not legally true, there's a larger defense the president has here, which is if this was so terrible, if this was such a high crime, why am i only being accused of using my foreign policy powers? if you have to go into my mind for what i did in foreign policy, how bad can it really be? we will see that argument with or without witnesses. on the flip side democrats will continue to say if you're abusing presidential powers, that's one of the most substantial abuses possible. >> where do you stand? >> i agree with what ari said. the brief makes a good case if there's prior presidential impeachments have stark violations of the law. if you don't have that, you have a subjective area when you try to read the president's mind. >> you think abuse of power is sufficient basis. we've seen actually lawyers who work for the president be on all sides of that issue. that will be a live one. how are senators going to do without talking for 12 hours straight, as a former senator? >> it will be unbelievable to watch if they can actually sit for almost 12 hours. >> claire and ari, thank you very much. up next we will look at the trial and comparison to the president 20 years ago. a lot of the same characters on different sides of the issue. it's an interesting look back. and we will have special live coverage of today's proceedings starting at 1:00 eastern time. >> savannah, thank you. also this morning breaking, a dramatic surge in the cases of the deadly mystery virus that's now being screened for here in the u.s. now we're learning a little bit more about how it spread. nbc's janis mackey frayer is in central china where the virus originated. janis? >> reporter: good morning. most of the cases have generated in this hospital here in wuhan, ground zero. and it's showing up in other cities including thailand and south korea. the concern, how to stop it from spreading? a scientist has confirmed it can be transmitted between people and in one case one person infected 14 health care workers. so there's a scramble to contain this at what is the busiest time of the year for travel in china. literally hundreds of people are on the move for the lunar new year. the world health organization is holding an emergency meeting to determine whether this outbreak is now an international public health emergency. guys, back to you. >> janis mackey frayer there in china. let's bring in dr. john torres. some people are comparing this to sars, which claimed the lives of about 280 people back in the 2000s. what are we dealing with here? >> it's the corona virus that affected the sars patient, the same thing. the big difference is the response. back in the sars virus, chinese officials kept it silent for a couple of months and allowed it to spread. here they're jumping on it quickly, sending messages to their staff and jumping around the country saying let us know if you have cases. >> we're talking about it in the u.s., something confined to asia at the moment, but the fear is with the lunar new year and travel and people come into contact with one another and it spreads. >> that's how it spreads, close contact. you have to be living with someone or taking care of the sick. but this is the chinese lunar new year. an estimated 400 million will be traveling in and out of that country or different parts of the country are even internationally. that's why they're checking people, looking at the questions have you been to this area or exposed? good morning, it is 7:26, i'm kris sanchez. right now police are still on the scene in gilroy where sources tell our damian trujillo that a man tried to run his girlfriend over with his suv. happened at about 4:00 this morning along day road near santa teresa boulevard. the couple had an altercation and the woman hid behind a fence to try to get away and that is where she was hit by debris and taken to the hospital. no updates on her condition at this point but we do know that police have detained one person. although we don't know whether or not that person is tied to the incident. getting mr. trump's lawyers argue, the president did nothing wrong. thens of thousands of gun rights activists flooded the virginia capitol yesterday and they're urging state lawmakers to reject the sweeping measures that restrict firearms. virginia's governor hoped to avoid what happened in charlottesville in 2017. a dad had to prevent from getting involved in his son's wrestling match. the referee blew the whistle moments later, a man runs out and knocks the wrestler to the ground it was the other boy's dad the man was charged with assault and disorderly conduct meanwhile, we have new developments and archie as a family can compensate, if scotland yard will continue to give that security, how they pay for it >> reporter: and perhaps, most importantly, when will they return to britain? there's been a lot of talk about what they might do going forward, possibly setting up a production company maybe making some kind of deal with netflix, following the obama model. but for now technically they're still hrhs, they're still working royals they're not officially stepping back until the spring, which suggests maybe possibly they might be back in this country in the next couple of months. guys >> one of the reasons, of course, maybe the main reason they left, had to do with the media coverage they got in great britain. can they really expect it to be a lot different in canada? >> well, the privacy rules are really, really strong here, in part because of harry and william. and in the days they were growing up, those privacy rules were put in place to protect them for the large part. now they're moving to a place where those rules don't apply. i think it's interesting if you look at the coverage over the past year or so, never once did we see a and cad id shot of meghan walking the dogs when they were living in windsor. now we have not only seen meghan walking the dogs but harry arriving at the airport, meghan taking off at the airport to one of her events last week. things
