I reasonable doubt the whole idea of blaming institutions, and i blamed almena because i felt that i could at least i could at least grasp on the idea that he was given a lease and he didnt read the whole thing, and he purposely violated and lied. Reporter but two women felt otherwise and they stood their ground until tend. Almenas attorney said he hugged one of those women after the judge declared a mistrial for his client. Police closed off a lot while they figure out what happened. Nbc bay area Sergio Quintana is life at the crime scene. What do we know so far . Reporter janelle, i can tell you that according to an employee at the food max here, when he arrived on scene this afternoon, he noticed that there was a body laying right besides that white ford explorer. Thats where the San Jose Police department has their crime scene unit right now. When we arrived this afternoon, we actually noticed there was a bunch of Police Officers taking pictures of a car nearby. Emergency crews were called here for a report of gunfire. They arrived to find a man laying on the ground suffering from a gunshot wound that. Man was rushed to a local hospital where he died. People we talked with who were still trying to do their shopping describe a very busy crime scene here. It was difficult to get into the parking lot. When we drove by, we saw a body that was covered, and we drove into the one by the motorcycle, because thats the only entrance. Everything else was blocked off. Reporter police have not released any further information on the victim, and they wont do that until they notify his family. Right now Police Officers do not have a motive in this shooting. We have new information tonight on the investigation into the dive boat fire in Santa Barbara. The sheriff says it appears the 34 people who died all died from smoke inhalation. They were sleeping in tight quarters when the fire broke out above. It trapped all 33 passengers and one crew member below. Due to the intense fire that occurred on the vessel, all of the recovered remains have suffered varying degrees of fire damage, which requires dna analysis to confirm the identities of the victims. Investigators moved a barge and crane into place, but operations are suspended because of bad weather. They will resume when its safe. 33 of the 34 bodies have been recovered. Investigators are using stateoftheart rapped Dna Technology to identify the remains as quickly as possible. They have i. D. d 18 of the victims so far. All 34 families have been identified. We are learning more names, and two more are from the bay area. This woman graduated from uc berkeley earlier this year. Also from singapore, he owned a masters and doctoral degree from stanford. He worked at point cloud. His father says he took up diving two months ago. Theres also a personal connection to the conception for actor rob lowe. The dive boat from our hometown of Santa Barbara was the site of a horrible tragedy where 34 people lost their lives in an unspeakable fire. Ive been on the boat many times and i cant imagine this tragedy. Lowe is teaming up with california strong, an organization that helps provide Financial Assistance to victims. 100 of the proceeds go to families in need. Janelle . Firefighters from Alameda County are heading north to fight a fastgrowing wildfire there. The Red Bank Fire is burning near the Shasta TrinityNational Forest north of chico. It was sparked by lightning yesterday afternoon. The fire spread to 7,300 acres and is only 7 contained. Mandate evacuations are in place. Something is not right. Thats what some people who live in the west winds Mobile Home Park are saying about the death of their neighbor. The woman is disabled and she died when her home caught fire. It was literally a torch shooting up on the right side only. When we went to the back door, it was only black smoke. It was all the black smoke was waiting to escape. They might have more people to question more people that we might be able to glean more information. A man who opened fire on a freeway is behind bars. Ricardo lopez shot at someone on 280 in san jose after midnight on wednesday near the 7th street offramp. By the time chp arrived, lopez has driven away. The officers eventually found the shooter. Officers arrested him for attempted murder. Oak police beefing up patrols looking for illegal side shows. Police will have helicopters patrolling from the air. Anyone caught joining or participating in a side show could be cited and arrested. We have new video of a hiker rescued today north dakota marin county. This video shows rescuers flying the man to safety. It started yesterday when the man took a hike alone and got lost off trail. A friend called the Fire Department for help and the search began. People on the ground found the hiker near stinson beach. The helicopter gave him a lift and an ambulance took him to the hospital. After a full night of being lost, he was ultimately okay. Frustrated and terrified, thats how people are describing their experience living next to a homeless encampment. Each time we saw people and families having to dodge the homeless, who often take over the entire sidewalk. Were being tortured by them, ill say that. The clerk at the quick stop says that crime is blatantly. He says a homeless person robbed a soft drink delivery guy at gunpoint outside his store recently. They all come over there, steal whatever they want, take it, they never pay. I witnessed many people openly shooting up in front of Police Officers who, frankly, can only cite in that situation. An Airline Mechanic appeared in court today after intentionally messing with a plane. It happened in july on a flight from miami to the bahamas.
