The confrontation quickly escalated with one deputy using the taser on him four times. A short time later, he died. A pathologyist maintained it contributed to his death. Now they are refusing the use of force policy. The new policy does not allow deputies to use a taser more than three times against one person, unless there are exceptional circumstances. Virginia islas said it is too vague. Exceptional circumstances need to be defined, especially when it comes to the use of these lethal weapons. Reporter the new policy also limits each taser hit to five seconds and specifies where the deputies should aim. The new policy also addresses target areas and provides that when feasible, officers will make reasonable efforts to target lower center mass or if available, the back. Reporter but what if three taser strikes arent enough to stop a suspect . The San Mateo County sheriff says his department is investing in other options. It will be loaded with a lesslethal blunt projectile. Reporter some are not convinced the revised taser policy will save lives. This stems from a recent lawsuit and nbc bay area investigation that raises a lot of questions about officers targeting people in palo alto because of their race and imcome level. Stephen stock has been digging into this issue in one of the bay areas most exclusive cities. We obtained this video recording from a residents Home Security camera, as well as police audio recordings from the officers themselves. All of it raised questions about the policy, procedures, training and even the culture at palo alto pd. The video ends in a confrontation and use of force that was never officially reported, and it was all over a misdemeanor traffic ticket. Tucked in among the upscale homes of palo alto, Buena Vista Mobile Home Park stands out. Residents here are more affluent. He has called it home since he and his family moved here from mexico in 1997. Two years ago, alvarez installed this Security Camera outside his front door. I put the camera out for people, not forepeop people who steal, but for police. Reporter he doesnt feel secure when the police come knocking, something theyve done many times over the years. Alvarez does have a history of arrest, including several duis, a burglary and an old grand theft charge. But he says his recent treatment has escalated beyond anything he ever imagined. Reporter alvarez says he was standing in his driveway when Christopher Conde approached. I know youre driving with suspended license. How do you know whos driving . I didnt remember t. Reporter the camera seems to capture the officer saying he didnt know who was driving. The officer calls for back up come on out or were going to kick the door in. Wow, do you have a warrant . We dont need a warrant, come on out. Im coming out. Come on [ bleep ]. Reporter one of the backup officers to arrive is veteran palo alto Sergeant Wayne bennetten. An openended blow to the head. 15 seconds later, sergeant is shown slamming him into the windshield. My face went to the windshield. Youre going to be bleeding a whole lot more. Reporter alvarez says the blow split his lip and chipped his tooth. This is his attorney for the criminal charges and the civil lawsuit. Captured the brunt of the misconduct. Reporter he says officers had no legal basis to detain alvarez to begin with, let lone break down his door and rough him up and lock him up in jail for two weeks. Remember, this comes from charges of drive on suspended license. He did not know whether or not his license was suspended. And he did not know whether he had been drive the vehicle. Reporter a judge agreed. Later all charges were dismissed. The Attorney Says even more troubling, the Police Report does not even allude to any use of force during the arrest. The record shows none of the violence that alvarezs Security Camera shows. No use of force report was filed either. Theres no mention of any of those acts that amount to use of force, and its dishonest and a lie. Reporter theres more that was said off camera, listen to what Sergeant Benitezs body cam mic captures. Reporter his message appears clear. The bodyworn microphone also captures what appears to be Sergeant Benitez mock beiing alz for being gay. My word to them is that is not how things should happen here in palo alto. Reporter retired judge cordell is an independent police officer. She also happens to live in palo alto. When palo altos own Police Auditor turned down other request she agreed do review the case for us. Everything about this incident, from the hollering, the yelling, the violence, the use of force. The failure to report it, and then the audio in the aftermath that showed absolute explicit bias. Every bit of it was bad. Reporter nbc bay areas Investigative Unit reached out to palo altos police chief Robert Johnson as well as each of the individual officers involved in the case to get their side of the story but declined comment citing the pending lawsuit. Im calling upon the chief of the pal owo alto Police Departm to respond. They are palo alto residents. Let them know that they are safe in this community, because from what i saw, i dont think thats it at all. Now in a response to the lawsuit filed in court, attorneys for the city of palo alto as well as the attorney for sasht benitez deny the claims. The city manager did release a statement to us late yesterday saying while, quote, the city does not comment on matters in active litigation, the public should know the police have procedures to investigate misconduct thi misconduct thoroughly and hold officers accountable. Officials tell us benitez is on leave and the others are still at work. Heres policy that says they are required to report any use of force, including a hit, a kick, a punch.
