I think its but polling numbers that barely registered paired with opponents flexing much more fundraising might let congressman swalwells campaign to sputter to a stop. Were only running for one reason. To win. And then make a difference. Not a vanity project. Not to write a book. Hes a nice guy. Got nothing personal against him. At lunch tables and local streets today, locals told me hes a goodman but either too partisan or too bland for the role. Cnn, fox sometimes and all he does is bash the president of the united states. What was your reaction when i told you about a half an hour ago Eric Swalwell bowed out of the president ial feel . Humorous. I mean, i was shocked when i he was running. And so it doesnt surprise me at all. I did think that he was going to last a little bit longer. Swalwell says hell run for reelection to congress in 2020. And the congressman has not made up his mind as to who he will endorse among the frontrunners. Raj and jess, its an interesting moment today, the congressman said at that President Trump is the best political puncher ever and whoever the democrats nominate will have to be someone who can hit back. This town of roughly 1700 people sits right on top of the quakes en center. Right now, what Everyone Needs is water. The red cross is delivering food and water and the community is pulling together. Two men at the center of the ghost ship trial says it was an idea, his idea and he told the jury hes the only man responsible for the tragedy. Tears rolled down his eyes as Master Tenant derek almena felt morally and spiritually responsible forat killed 36 people. Melissa colorado was in the courtroom and has more about his testimony and it was emotional. Reporter it was emotional, jess. This was the moment that the jury has long been waiting for. Derek almena has sat quietly, silently in that courtroom more than two months. The jury finally got a chance to hear his voice. He says the past two years in jail has caused him to be sad, heartbroken, tired and unhealthy. He says hes been in solitary confinement and at one point he said i feel death. Now, a defense attorney asked him if he feels any responsibility for the deadly warehouse fire, almena said yes. He said, quote, i instigated something, i built something. Im responsible for having this idea. Almena then shifted the blame to the owners, the family who h not been charged in the case. He accused family of illegally subdividing their property. He claimed the ghost ship warehouse initially had no electricity and no water. Almena said when he asked the landlords for help, they laughed at him and refused to pay for any renovations. His attorney, tony sara says things will get tougher for almena when the prosecution gets their chance to grill him. Hes going to have to persevere under, from my perspecti perspective, as much of an attack they can amass. I think were ready for it. And as i said, im pleased with his testimony today. Almena prosecutors are going after him again tomorrow. Any idea what tactics theyll take . Reporter to answer that question, you got to look at the weight of the prosecution grilled the codefendant max harris. They played the Police Body Camera video where you hear max harris lying to people saying nobody lived in the warehouse. Were likely going to see that play out for derek almena. His defense Attorney Says derek al men is going to tell the jury it was the landlords who forced him to lie to police, to lie to authorities because they allegedly did not want to pay for the necessary renovations, the upgrades to get the building up to code. Again, its a good reminder for folks that the family has not been charged in this criminal case. This trial is winding down. Thank you very much. Newly released video of a Police Shooting involving an ax wielding man. This happened two years ago. Officers responded to a bomb threat in san jose. Today the officers body cam video was released. Were going to this door down, dude. Police responded to the call, they saw smoke coming from an apartment unit. They kicked open the door to find a man with an ax. They repeatedly ordered him to drop t he refused and started moving toward them. The officers first tried to taser the man. When that didnt work, they opened fire killing him. The d. A. Determined it was lawful. The video was released under a new Police Transparency law here in california. Up next, he brutally beat a mother to death. Now hes set to walk free. What a family from contra cost a county hopes keeps him behind bars. The reason so many more projects are happening in san jose. Im chief meteorologist jeff ranieri. Just a cool 66 in san jose right now. Well show you whats ahead this week and when things eventually start to heat upcoming up in seven minutes. How long should a killer be held in prison for a convict in contra costa county, the answer depends who you ask. Steven burr was sentenced to 15 years to life for beating and strangling his wife in 2006. Tonight the parole board says he should be released after 13 years. Nbc bayaande is in martinez where the victims family is reaching out to governor jodi . Reporter thats right, raj. When burr was convicted aicus killing courthouse, the victims family had hoped hed never walk the streets again. But tonight, they are furious he soon may be set free. Its outrageous. I mean, i just cant believe it. They would consider the state of california would consider releasing him. Reporter she cant believe her sisters killer could soon be out of prison. 40yearold diana basham was strangled and beaten to death in her home in 2006 by her husband steven burr. After deciding to leave him. Burr used her 14yearold sons trophy in the attack. He severed her liver, i mean, was demolished. Rificrime. Reporter a judge sentenced him to 15 years to life in prison. But now just 13 years later, the parole board has found him suitable for release. It was shocking. They made the decision in less than ten minutes. Shes started an Online Campaign urging folks to help her family appeal to the governor to block the release. This is not justice. To be released after such a short time for murdering somebody. Reporter theres another woman suffered the same fate as her sister if burr is left out. Hes left two boys motherless and left her without her best friend. I love my sister. I wish she was still with me. Reporter now, this decision isnt yet final. The parole boards legal staff must still review the case. Then the governor will have the ultimate say. The governors staff said in a statement, as is the case with all parole decisions, the case will be thoroughly reviewed and evaluated on its own merits. They tell me a final decision may not come until midoctober. Reporting live, im jodi hernandez, nbc bay area news. Thank you, jodi. If you live in san jose, repairs are coming to a street near you. This year, san jose will make over 280 miles of streets. The most its ever done in a single year. But the price for fixing years of neglect could be months of pay pain for drivers. David trujillo is live in san jose. Damian, thats one of the first streets on the list of repairs. Reporter it is jessica. Theyll be here the rest of the a new entire top layer of the layer in the coming days. This is a major project. One of many the city will see in the coming months after years of neglect. Crews began tearing into flint avenue early this morning, scraping more than an inch of asphalt off ground. Like many streets in san jose, flint was in disrepair. I have brand new tires on my car. You dont think i like to go through it . No, i dont. Reporter now, thanks to funding sources, like the measure which voted approved in november, crews will repair 280 miles of streets this year. By comparison, in 2013, the city was only able to work on ten miles and the streets desperately need it. On a scale zero to 100. The average is a 66. That would be called a fair condition. They have to defer projects, like roadwork on the 101 alum rock overpass because the cost of maintenance has skyrocketed. Unanticipated amount of increases primarily due to increases in the prevailing wage and the cost of materials. We projected increases, just not the amount weve seen. Reporter in one case the price for sealing the streets with new asphalt shot up by 81 compared to last year. This is a big part of this project. No parking signs. The city knows that its a hassle. Its an an inconvenience for a lot of people. If you see the sign out in the front much your street, move your car, otherwise it will be pelted by flying gravel if not towed. In san jose, im damian trujil o trujillo. Neither one sounds good. Both options are bad. Its worse to be towed, right . More expensive. Jeff is here to kick off our week. Were officially midsummer with nice crisp hot weather. Super comfortable weather the next couple of days. Eventually well get heat in the microclimate forecast. Lets take you outside to the microclimate weather today, tonight and it was all about 70s back into the inland valleys, which is usually a lot hotter this time of year. The ocean breeze going strong. Currently 62 degrees right now in San Francisco. Well have 50s moving in later on tonight. As we take a look at the fog, you can see right here at the immediate coastline, tomorrow morning, 7 30. Over to the inland valleys, not too hot. 82 in antioch. 82 in concord. 79 in napa. San jose, at 76. Closer to the bay, oakland 69. Half moon bay 59 and San Francisco at 64. Looking really good after the hot weather in june, we come. Lets look at the longrange smu p wondering whats to forecast and what youll see as we continue throughout this month, only a 33 chance of above average temperatures. The techadvanced nissan leaf. The best selling electric vehicle of all time. This is nissan intelligent mobility. This is something weve discussed and dismissed for years. Talking about earthquake insurance. Should we reconsider, especially after whats happening in southern california. Its a complicated question. We wanth thnumbers for us. Scott, lifoia dont have earthque insurance and not sure whether they should get it or not. Its true, raj and jessica ka. A conversation a lot of people are having. Less than 20 of californians have earthquake insurance and whats worse, many of those homeowners think theyre covered. With homeowners and renters insurance policies do not cover earthquakes. Those policies are sold separately through the cea. California earthquake authority. Premiums vary based on the age and value of your home. We used the cea calculator to estimate premiums for somewhat typical home in san jose. Well say one that was built in 1995, costing about 1. 2 million. It came to about 3300 a year for the premium with a 15 that means is if the house was totally destroyed, youd spend 180,000 out of pocket to rebuild. The earthquake insurance policy would pick up the rest. You can lower the premium by increasing the deductible. Renters can also apply for quake coverage as well. We ran the numbers through the same calculator. Its much more affordable. For a 100,000 to cover losses to belongings and the calculator, its going to cost you about 40 bucks a month, 490 for the year. Rates can be higher or lower depending on the options that you choose. This is a big one that often gets overlooked. If an earthquake causes a fire, state law says homeowners and renters insurance must cover the fire damage. What if its flooding . What if it breaks a water main that floods your house . Even if you have earthquake insurance, can doesnt cover flood damage. You need separate Flood Insurance to get that covered. If youd like to calculate the rates, go to nbcbayarea. Com, just searchar link to that calcr there where you can check it out as well. Back to you guys. Good information. Lot to digest, though, scott. You bet. Up next at 6 30, congressman Eric Swalwell, as wee first reported, dropped out of the race. How does this impact the race for the white house . Our political analyst larry gehres ten has answers. Cleaning up your commute. Fewer needles on b. A. R. T. , you may not be happy with the reasons why. The message fro the house nancy pelosi who threw down the gauntlet today. The nations most powerful democrat met with reporters in San Francisco to outline her strategy for passing hr1. A socalled peoples act of 2019. Mark matthews was with Speaker Pelosi and joins us with the details on essentially election security. Mark . Reporter raj, hr 1 passed the house last january. But its gone over to the senate side and Senate Majority leader Mitch Mcconnell has so far refused to even take it up. Good morning everyone. Reporter Speaker Nancy Pelosi came to the podium vowing to take on republican lawmakers and the president over russian interference in the u. S. Election process. He just said if they offered help again, he would accept it giving a green t. Unacceptable. Reporter pelosi led the house to pass sweeping ballot security legislation, providing 600 million to upgrade Voting Systems making election day a National Holiday and requiring every president ial candidate to submit ten years worth of tax returns. Republican Majority Leader Mitch Mcconnell has so far refused to take up the bill on the senate side. We have news for him. This legislation is alive and well in the public. Were going to make it just too hot for him to handle burying this legislation. Reporter california secretary of state, alex padilla said that californias Voting System ought to be the model for the nation with paper ballots and verified paper trail and Voting Machines that are not connected to the internet. Meaning they are not vulnerable to cyber attacks. The defense of our elections must be a top priority for all of government. Reporter in response to a question about the president s effort to include a citizenship ques o Speaker Pelosi pulled no punches. This is about keeping you know, make america, his hat. Make America White again. That was Mark Matthews reporting from San Francisco. As we told you at the top of this newscast, east bay congressman Eric Swalwell is out. Hes the first major candidate to drop out of president ial race. Larry gersten joins us now. Weve been talking approximate this since day one. I imagine his chances were slim, we know that. Did he run to get his name out there locally and publicly. Did he have any belief he thought he would win . Its hard to get into his head. Its hard to believe that he thought hed win. And as to why he ran, well, there there are a number of possibilities, to get notability as you said. Another perhaps to get an appointment at a cabinet level if the democrats should win. And the third, to reinforce hist should he decide to run for reelection. Those are three possibilities th work . Getting a cabinet position with the white house. He went at joe biden at that first debate. But all is forgiven. Once somebody wins, especially if its a democrat, all of the terrible things said against each other, who remembers . Look at the trump situation for a great example. That doesnt hurt him at all necessarily. One thing that was in the forefront for swalwell, every day that goes by that im not in my district campaigning for reelection is one day closer for an opponent to step into my place instead. Sure. That had to weigh heavily most of all. What happens now with the president ial race . One is down. Still a crowded field. The next debate at the end of the month. Several people ready to take his place. A half a dozen are thinking they may be close to the 1 level along with 65,000 signatures. Montana governor, seth moulton, congressman from massachusetts and our own tom steyer who has a tremendous network and would have little difficulty securing 65,000 signatures like that. What happens in terms of money . Do the people in terms of swalwell not raising enough money. Other people can take that money now . Now how much money other people will take. Somebody drops out, its not because their low standing in the polls. Its because they dont have any money. They dry up. You need money for staff, for transportation, pay for the volunteers. We go on and on. You run out of that, you run out of time and run out of the swalwell, to wrap it up, says hell run in 0 for congress again. No one stepped up. Very hard to believe. Incumbent generally do well. Secondly, someone like swalwell, has attended his district very well. He was critical of pete stark, his predecessor. No, hes in good shape and wanted to make sure he stays in good shape. I think we can assume its a great likelihood hell get reelected. You brought up tom steyer. The billionaire from San Francisco may be jumping in. Hes produced several paid ads like this one pushing for President Trumps impeachment. In january, steyer former hedge fund chief, ruled out a run for president. Hes now reportedly telling associates hes launching a campaign. The white house is fighting back against those calling the Border Detention Centers inhumane. As outrage grows at the federal Detention Centers, President Trump is disputing the clamgs. Government watchdog reports describe overcrowding and women, tears coming down their faces as they talked about being separated from their children. About having no running water. Im going to start showing some of these Detention Centers because to the press. On twitter, President Trump called reports of overcrowding and unsanitary conditions, phony and exaggerated. He has not said when hell allow the media to inspect the Detention Centers as you saw. While his friends include president s, royalty, celebrities and highprofile attorneys. But not billionaire Jeffrey Epstein is accused of running an underage sex trafficking ring. Wall street financier pleaded not guilty to federal charges today. Hes already a registered sex offender after pleading to charges back in 2008. In that case, epstein spent 13 months in jail as part of a widely criticized plea deal. During a weekend search, federal agents hauled evidence from his new york mansion. Evidence including nude photographs of what appeared to be underage girls. The u. S. Attorney who will prove the controversial 2008 state plea deal is also being scrutinized tonight. His name is alexander accost a and hes now President Trumps labor secretary. He so far has not commented on the case. Thats not necessarily good news. It appears many addicts are trading heroin for fentanyl. Last july, they picked up more than 4,000 needles from the civic center and other stations. About 500 needles from the same painkiller thats smoked. In emeryville, a heated debate over pay about to come to a head. The city now has the highest minimum wage in the country at 16. 30 an hour as of last week. The increase is the result of a Wage Ordinance passed in 2015. It requires an increase each year. Now Small Businesses say they cant keep up and many are considering leaving town. Tomorrow, Emeryville City Council will vote on whether to repeal that ordinance. They can decide to put it on a ballot and let voters decide. Up next at 6 00, more electric cars on our california roads. A bold plan from a local lawmaker. Well tell you about it. Its no ordinary day for our family at dennys. Its crepe day a Family Tradition we started about 22 minutes ago and now we can continue that tradition at home with free dennys delivery. See you at dennys. Com that leave therea lasting impression. Mixed reviews so far. Some drivers are worried this will create more traffic on the side streets. The better question is, whats it like to be sitting at a cafe table right next to street traffic thats rolling past . It happens in plenty of other cities. Oh, yeah. This guy posed for a selfie. Right. You cant pose for a selfie during the running of the bulls. Listen to your wife. It is a decision that nearly cost him his life. As Jaime Alvarez stopped for that selfie. He was gored in the neck. Were joined with the rest of that story. Being told by jaime himself. Jaime alvarez is an attorney at the public defenders office. He said when he was knocked down and gored, he was trying to get a video of his run. He says if it hadnt been for a stranger to pulled him to safety, he would likely be dead. Jaime alvarez didnt travel to spain to run with the famed bulls of pamplona. He went to watch his son play soccer. The excitement was too much for him to ignore. Despite warnings from friends and family. I wasnt even sure i was going to run. My wife didnt want me to run. My friends said dont run, dont run. I guess i was stubborn. He ran with the bulls ending up in the plaza we are stopped to take a selfie after he thought all the bulls had passed. Thats when a bull weighing more than 2,000 pounds proved him wrong. I turned and it was like a truck or a car just hit me and the side of my head. My neck and i saw blood. I could feel my neck opened up. I was stunned. Excitement turned to fear as alvarez started losing blood. Thats when a stranger grabbed his arm and pulled him to paramedics. Likely saving his life. After two hours of surgery, alvarez is now recovering at a hospital in spain where doctors say its stunning that he lived. Went straight back, i probably wouldnt be here. It went straight up. Thats why im here. Thats what alvarez expects to make a full recovery. He has no intention of ever running with the bulls again. In san jose, marianne favro, nbc bay area news. Were happen that i jaime is okay. Hes going to come back to the bay area and be okay. It is a cautionary tale. When your wife says dont do something, shes thinking clearly. I think he should run with the bulls and not do the selfie. I dont think thats going to happen. The selfie threw him off. The selfies fault. How are we looking now . The weather might have thrown you off a little bit today because its cooler than average. Overall, very beautiful outside. As we get a look at the microclimate forecast tonight, well take you down to the south bay. Lots of blue skies this evening. Currently 66 degrees after a high of only 72. Normally 80s and low 90s. Usually par for the course. Were way off that. As we move later on tonight, low 60s at 11 00 and eventually 50s. Notice the cloud cover starts to increase as we move into early tomorrow morning. Thats part of fog. Definitely its going to be in place through tomorrow morning. If youre doing any commuting at 7 30 in the morning, expect that to the peninsula. Best chance of low clouds moving inland over contra costa and alameda counties from milpitas up through hayward into fremont. Towards walnut creek as well. By the afternoon, we get sunshine inland and you have the fog back there at the immediate coastline. Overall, be ready for that fog to start. Temperatures will be nice and comfortable. Upper 50s and low 60s from the south bay to the trivalley. Well start off with 60 in the east bay. San francisco, 56. To the north bay, 57. Now the ocean breeze is one reason why temperatures will stay down. But the second thing thats going to help to keep us cooler is a system thats out here offshore.
