President trump has a leadership moment, but seems distracted by the russian investigation, rattled by the democratic memo challenging republican allegations of misconduct i in the russia probe. Mr. Trump sent out five tweets, felt the need to call into fox nis news to say there was no collusion, say there was nothing wrong and blame election interference on president obama. Everybodys looking, there is no collusion. No phone calls. I had no phone calls. No meetings, no nothing. There is no collusion. Phone calls by the way is a new denial for the president as far as the specifics are concerned. The president may have reason to be rattled. In the last ten days, the Mueller Probe intensified with more indictments and guilty pleas. But the nra is in the hot seat, with more than a Dozen Companies cutting ties with the nra, the nra calls it a shameful display of political and civil cowardess. Still you have a president with a plus rating that says he is open to new gun radestrictions d going further than republicans went after sandy hook. There are few things more polarizing than the gun debate, and both parties must now decide what, if anything, their bases can support or stomach. They want to do things you wouldnt believe, including taking your Second Amendment rights away. Caught between a growing movement of grieving parents and students. How have we not stopped this after columbine, after sandy hook . And his conservative base. The nra, theyre friends of mine, they backed us all. Theyre great people. This week, mr. Trump appeared open to modest gun reforms, including a bill that rewards states that improve reporting to the background check system. A ban on bump stocks, though that would likely be challenged in court, and raising the minimum age to buy an ar15. Were going to work on getting the age up to 21 instead of 18. The nra opposes that change. Faced with protests and boycotts, several republican lawmakers, including floridas governor, are bucking the gun lobby. We will require all individuals purchasing firearms to be 21 or older. Just like on immigration, where a long white house listening session produced little action, the devil is in the details, and mr. Trump has so far refused to talk legislative specifics, instead pivoting the debate to arming teachers. The teacher would have shot the hell out of him before he knew what happened. And thats not the only talking point mr. Trump has borrowed from the nra. We Must Immediately harden our schools. I want to harden schools. Harden. Harden. Harden, hardened schools. According to a pew poll, twice as many gun owners said they contacted a public official on the issue of guns than nongun owners. But there are signals, republicans in suburban districts may sense a change in the political climate. A florida congressman whose district mr. Trump won by nine points came out in favor of an assault weapons ban friday. I spent my life trying to defend this country, and i cant stand to see the weapon that i carried in defense of this country used to kill kids. Still, most red state and rural democrats are wary of the gun issue, worrying it will energize the republican base. Five senators who caucus with the democrats voted against assault weapons ban in 2013 and theyre on the ballot this year. And democrat connor lamb, running in pennsylvania special election where voters go to the polls in two weeks made it clear he does not want to run on gun control. The majority of americans who tell pew and other pollsters theyre in favor of banning assault weapons, you do not support that. I do not support that. Joining me, senator pat toomey of pennsylvania, the republican leader of the last bipartisan effort in congress in attempt to reform gun laws that didnt pass. Senator, welcome back to meet the press, sir. Good morning, chuck. Thanks for having me. Let me start with your bill and what we know about the shooter down in south florida. There was a lot of information the School System had, there was a lot of information that were called into authorities about the mental stability or instability of this young man. Right. But theres no part of the law that would have mandated that information make it into the background check system. How would your bill deal with that . It wouldnt. You know, the fact is the bill that joe manchin and i introduced and still support, chuck, it is not going to solve all problems and never suggest it would. One of the challenges we face is what to do about someone thats clearly mentally deranged but havent acted out in a way that allows you to adjudicate them as dangerously mentally ill or havent committed a crime. Clearly in this case, there were all kinds of warning signs that were advertised, right . They were communicated and nothing was done. Thats a problem. I think theres an important discussion to be had about a temporary restraining order on somebody thats evidencing some serious dangerous behavior, there would have to be due process so it couldnt be used as a weapon against someone inappropriately, but look, our legislation i think would be constructive, i still support it, but i am not going to suggest it would solve all problems. I guess the question then is should School Information be temporarily put in the system. So for instance, he was expelled. Just the fact he was expelled, do you put that in the system for a fiveyear period so that, you know, he can be caught in the system and maybe an extra interview by the fbi or extra interview by authorities if he attempts to purchase a weapon . Im not sure expulsion from school is sufficient. I imagine there could be all kinds of cheating on a test, for instance, i dont know what kind of circumstances might cause expulsion that doesnt suggest this is a dangerous person who shouldnt have a Second Amendment right, so im not sure thats the right criteria. Look, the problem is we have a lot of gun sales in America Today for which theres no background check whatsoever, and this is one of the things senator manchin and i are trying to address. Lets at least require background check for all commercial sales. Thats what the legislation attempts to do. By requiring background checks on sales at gun shows or over the internet. Our legislation would encourage states to provide the information to the background check system so the information would be there. And we also create a commission to study these massacres, mass violence. I think it is overdue, i hope we can succeed with another run at it. John cornyn, number two republican in the senate has a fix nix bill, hinting that whether it is your measure or something that the president wants to put out there raising the age on getting an assault weapon to 21, that it doesnt have the votes in the senate. Is he right . Does your bill not have 60 votes . We dont know the answer to that, chuck. I spent a lot of hours on the phone and communicating in other ways with colleagues this week. I think there are some members who were not supportive in the past who are reconsidering. Havent got anyone that said yes, sign me up, pat, but there are definitely members that are reconsidering. The president s expression of support for strengthening the background check system is constructive. The president can play a huge and in fact decisive role in this. I intend to give this another shot. Let me ask you this. On the idea of raising the age on assault weapons from 18 to 21, are you personally supportive of that . Im very skeptical about that because the vast majority of 18, 19, 20, 21yearolds are law abiding citizens that arent a threat to anyone. So im skeptical about that. Im willing to hear the other side on this. But im skeptical. What about the ar15 specifically, is there an argument to be made something that powerful, you could make an exception for hunting rifles, but that one, that powerful . Heres the problem, chuck. Theres a lot of hunting rifles as powerful as an ar15. The difference between the ar15 and commonly sold rifles is cosmetic. Its got a grip under the barrel and it is painted black. That doesnt change its lethality. Want to ask about failures of Law Enforcement in south florida, whether the fbi or Broward County sheriffs office. Does that in your mind reinforce the notion that the background check system needs to be fixed, you need another failsafe because you cant always count on Law Enforcement to be there or does it reinforce the notion that more people need to be armed . These are not mutually exclusive, chuck. I think this is a case where an armed guard appears to have really failed to do his job, best that we know so far, i think we need investigation on that, but certainly i dont think that would be the typical response of an armed guard and certainly is not the typical response of Law Enforcement and trained First Responders we have all over the country, so i think having properly trained, capable people in vulnerable settings will enhance security, but i still believe we absolutely should tighten our background check system. I think both are sensible steps. Youre open to having some teachers be armed . Under some circumstances, i leave it to the individual School Districts and states. I will tell you in pennsylvania there are School Districts where there are a number of teachers extensively trained, theyre exmilitary, they would be comfortable and they would be suitable. I certainly wouldnt impose it on a school that didnt wish to do that. I want you to respond to something the nras Wayne Lapierre said in a speech over the weekend. Here it is. The elites dont care not one wit about americas School System. This growing socialist state, dreams of manipulating school children, to squeeze and squeeze information about their parents. I sense your anxiety and you should be anxious and you should be frightened. Do you think the nra is playing a constructive role this week . This is the first ive heard and i dont know what else Wayne Lapierre said, that strikes me as a little conspiratorial in tone, but again, i dont have it in the full context. Overall, theres been a boycott that has gotten traction, and the nra seems to be more defiant than wanting to talk about the fact that hey, a lot of people want to have a different conversation on guns. Look, i mean, i disagree with the nra on this position. The nra once held the position that i held which is that background checks at gun sales and any kind of commercial sale are appropriate. The nra changed its position on that. I disagree with them. I think it would be terrific if the nra would come back to where it once was, and that would be very constructive. Finally, have you been guaranteed your bill will get a vote . No. You know, ill be speaking with senator mcconnell about that this week. You know, time on the Senate Schedule is precious, especially with our democratic colleagues chewing so much up over noncontroversial nominees, but if weve got 60 votes, then i think that would be a compelling argument to have a vote and i think we would. Let me ask you this. You heard senator toomey, he wants to expand that background check system for all gun purchases. Whats wrong with that . Listen, my heart is breaking for the families in florida. I have kids that go to public school. We had a School Shooting here in kentucky. I am a legislator in a position to do something. But if i came home after proposing some of these things that are so unserious and disingenuous that some of my colleagues are proposing as solutions to School Shootings, i couldnt face my wife or my children. But ive not been in that situation of a School Shooting. So this week, i talked to two survivors of columbine, and one of them, evan todd, related to me his story of being in the library when the two shooters came in. He was the first one shot. He hid under a desk. They found him and he pleaded for his life. Then he escaped from the library, ran outside, there were two police behind a shed who had taken up a position. They werent going in. He tells me that he forgives the adults, legislators, administrators and the police, because they couldnt foresee what was going to happen at columbine, but he said, you know, its a shame. Here we are 20 years later, it is still happening, and people are rolling out the same Old Solutions that will do nothing. And he supports my bill, called the safe students act which repeals the federal Gun Free School zone act. Whats wrong with having multiple failsafes . You have people that say we dont want to infringe on anybodys Second Amendment rights, but whats wrong with expanded background check, whats wrong with more cops at high schools . Well, you know, i wish that background checks stopped criminals or stopped School Shootings but they dont. They failed in texas with the church shooting. They failed at columbine. Wait a minute the background check system is flawed, isnt that the issue here . Absolutely. We dont put information in it. Were not putting enough information in it. Youre trying to put lipstick on a pig. You can put all the information you want in it, but the shooter in connecticut who stole his mothers firearms and shot her before he committed the crime isnt going to be stopped by a background check. Neither were the two perpetrators in columbine that got other people to buy the guns for them. One of those straw purchasers went to prison for that, talk about the handgun, 21 age. The guy that went to prison was 22, he sold a handgun to one of the perpetrators that was 17. Look, people, criminals are going to get a hold of guns. What weve got to look at is whats the solution . The solution frankly, you can put more guards at schools, if you have one guard, it is probably a waste of money because youre just endangering the guard unless you have two guards, and anybody thats in security profession knows that. But what you need are some of the teachers who are armed, 98 of mass public shootings happen in a gun free zone, and we labeled our schools as gun free zones. We need to take the labels off, put our kids in that 2 category of being safe instead of being in that 98 vulnerable category. Let me ask you this. Majority of the country disagrees with you. You have 65 some percent in a recent poll, that in general, the public would like stricter regulation of gun sales in some form or another. Youre proposing weaker. I understand that. Youre from a rural state. Let me ask you this though. Shouldnt that youre in a bubble there. 65 of the country disagrees with you. Do you have an obligation to legislate on behalf of them at all . Youre in a bubble. If you take out new york and california, 8 of americans have concealed carry permits, and the people watching the show now, a lot of them are getting ready for church in middle america, putting their guns on, millions of them. Theyre going to be carrying guns to church and family dinner after that and theyre going to be safe. So all of these things, these hypotheticals that come out of the bubble in d. C. Or new york city, what if this happens or that happens, we dont have to ask what if this happens. People are carrying every day. What i go back to, what are you so opposed to expanding the background check system . Why do you make this argument that says well, if you just pass more gun laws, it wont matter, criminals get it. Then why pass laws. Why pass laws on drugs and murder . We should pass my law to repeal the Gun Free School zone act, call it the safe students act. But look, those are false senses of security, like evan todd from columbine, hes disgusted at the proposals because they wouldnt do anything and in ten years were still going to have School Shootings unless you propose real legislation like President Trump proposed that would allow teachers to be armed. But youre in favor of that, but opposed to raising ar15 to 21 . Thats ridiculous. Think about this. You had a ban on assault rifles in 1999 when columbine happened. The assault weapons ban, socalled ban, lasted for 94 to 2004. Columbine fell in the middle of that. The assault weapons ban would do nothing to stop School Shootings. 84 of mass public shootings involve a firearm other than an assault rifle, socalled assault rifle. I understand that. But going back, do you think the background check system why bother with it at all . You know what, it is flawed. 3 million people, law abiding citizens were denied a purchase since this has been put in place, but only about 1 in 1,000 are prosecuted for trying to, quote, buy a gun illegally. The reality, most of those 3 million, 99. 9 of them are law abiding citizens denied a purchase because the background check system is flawed, doesnt have the right information in there, has false information, and disproportionately is biased against minorities if you can get the information from the atf, you would find that out. Well, we have no gun research in this country at all because congress in many ways prevented that from happening. I have an inquiry into the atf to get that data. Area, this is how they reacted to some of the gun reforms the president is proposing. I dont believe the school should have a policy of arming teachers. Some people willing to be armed is a reasonable request. I dont think anyone who goes to buy a gun needs it light trin and there. I agree in raising the age, because i dont think, my son, when he was 18, i would never give him an ar15. Again, i want to reiterate, that was cpac conference attendees. The nra, theyre getting hammered here on this boycott. Its been effective i think because they have not shown a lot of empathy in the last ten days and even cpac attendees have noticed. Theyre tone deaf, and theyre going on talking points that they have had for a while and they need to update those. Now we have a president whos a republican, hes a trumpican. Certainly he can lead here, this is a moment for him, and i think a deal could be done. There could be, why am i a little skeptical . Because we have covered this forever. I think you and i remember talking right after sandy hook and you said, this is it, theyre killing ki ing kinderga weve got to do something, and i remember you said nothings going to happen. I never feel like more of an american than when i listen to the gun control debate. Because what seems to obvious and what seems to rational and yet you just had a conversation between the two republican guests who you had on there talking about nipping at the edges and its all stuff that we all know at the end of the day is probably not going to do that much to change anything. Still if you cant anything that tiny, this tiny, tiny, tiny stuff, how are you going to get anything real . You were there at sandy hook and you saw manchintoomey, i think the reason why manchintoo many my failtoomey failed becau Governor Scott was in a situation where he is actually taking a position that is contrary to the nra. Its easy to imagine sitting afternoon this table saying Governor Scott is never going to take any action on this, you know why . Because hes running for the United States senate. The fact is he is taking a position on this because he is running for the United States senate. Im not particularly optimistic that this congress is going to get anything done, but we are starting to see the politics shift in a way that makes me more optimistic about the future. If nothing changes this time, the debate has shifted. Theres no question that the debate has shifted, but the problem is that we focus on the nra which is out of touch, old school, old talking points from the 1980s. But the matter is, whether its a republican dominated congress or a democrat dominated congress, theyre not taking these votes. But when they do the reality is that these laws stay in place. But the problem is, we sit here, we west coast, east coast elites talk about this and were probably in sync, we agree with Governor Scott, we agree something needs to be done. The wrong is there are a lot of actual americans who live in places that dont agree. Do you think democrats want an incremental its interesting, base democrats, will they accept incremental progress or will they kill it . Heres whats interesting about this debate is that the vast majority exists on the republican side. Many have pointed out that democrats from argued that for the first two years that obama was in the presidency, it couldnt get pass. But were focusing on the wrong thing, but the dynamics here, democrats do portray that they are not in the right place. The question, what impact does that mean what does that mean for democrats, what should we do when we confront a candidate like connor lamb. Connor lamb is in western pennsylvania paying one thing and heres the senator saying, oh, lets do something. We have reached a tipping point, in society we reach a tipping point. In a marriage you reach a tipping point, and here in the gun debate, we have reached a tipping point. But then beyond that, eventually what youre going to have to see here, what is going to happen Going Forward here . I believe at 1some point, republicans are going to have to figure this out, and we have a president that can lead here. We have a data point coming out on march 24, people are already talking about this National March on washington. Im very curious to see if we are going to see thousands upon thousands after people coming up were talking about it too, when youre talking about a tipping point, at some point, you have to ask whether the voices of these kids, these kids that are going to the capitol, who are standing before the white house who we have had change, a republican member of congress came out for the assault weapons ban. The march is great, i agree with you, i think we have reached a tipping point, we all agree on these issues, is this going to solve the problem . Thats we have a debate about what we can all do politically to make the kids go away and to make the lobbyists go away, but what is going to solve this problem . And the answer is nobody wants to talk about that because its unpalatable in the United States. Its also cultural and Mental Health i think is going to be where this debate is going to go. But you cant do one without the other. Thats back to the whole nibbling around the edges things again. There was an oped said that the question in this connor lamb race, are we willing to live up a golden opportunity to enhance our chances in the midterm elections by voting against somebody who doesnt support assault weapons bans. Thats something the republicans are going to have to ask themselves. This weekend we saw this houses response which includes the fbi surveillance of carter page and rebuts republicans highly publicized memo alleges bias at the justice department. Theres several fronts we should operating on, first of all the thought of these kids, they get no nra money, theyre just out there telling the truth about what happened, which i hope is going to be a seminole moment in our country, where we get congress to act on some sensible gun legislation. And then you have websites linked to russia that are immediately within hours putting out fake things through bots, saying these kids are paid actors. Okay, so, come on, administration, but those sanctions in place, they went after russia because they were messing around in our american elections, separate from the bot front. These are the most sophisticated companies in america, they have brilliant people working there, maybe it mean they make less profits off of ads and other things, but they have got to put the resources into facebook and twitter to stop these bots from dominating these accounts. There are russian bots that are posting how do you insentivize it in congress holding hearings, pushing them and pushing them, people realizing these are fake people. Should they be fined . In a superfund disaster, should facebook and twitter face fines if they fail to purge itself of bots, for instance after the government finds out . I think that would be a great idea, but then you need a congress to act. And there are too many people who are afraid of doing Something Like this because we know these tights are popular, everyone loves putting recipes, cat videos, its a great thing, but at the same time theres an ugly side of this, and somebody said that there was systems set up without alarms, without locks, and big surprise, bad guys are coming in and m manipulating people. And thats whats happening and worst, literally committing crimes when they tell people they can text in and vote. And we know that russian rubbles were spent on ads, coming out of this latest indictment that the russians spent a lot of money on paid ads, thats much simpler to regulate, chuck. You know why . Tv, your station has rules in place right now regarding media and print. They have political ads and they have to disclose them so the press and other candidates can look at these ads and figure out where they are and what they mean. You represent a state with some rural areas, i think at the im iron range, i can only imagine their views on these gun laws, like in minneapolis, its going to be a different story. As a leader in the democratic party, how do you strike this balance where some of your colleagues, like right next door, heidi hidecamp is never going to be able to vote for an assault weapons ban. But some think thats an outrageous decision. What do you say to the base. I was up on the iron range two days ago and i was quite surprised when your host there talked about tipping points, thats where we are, i have a number of proud gun owners and we have a hunting culturculturei always think would this hurt my uncle dick and his deer stand, but what these people are saying in the last few days, they asked me to strengthen background checks, they understand as law abiding ungoe inine ining gun o to make some changes and we need to reassure these kids that theres going to be some action. Congress didnt have the courage to pass a simple gun control bill. I dont think youre going to see that happen again, i want to see senator toomeys bill come up for a vote. I would like to see an assault weapons ban come up for a vote and i would like to see what we do on domestic violence. Theres been a lot of Law Enforcement errors that have been discovered in the shooting itself, particularly whether its the fbi. What are the fbis misses here and what do you attribute it to . I would like to look at the details here because i think someone made a major mistake without reporting it to the fbi field office. In addition to that, you have an armed sheriffs deputy outside of the school, didnt go. Has now left that department. But you literally had 23 reports about this particular killer to Law Enforcement over the years. So they clearly had its not just fbi, its also what was going on on the local level. Well, do you attribute anything is the fbi got the fbis taken a lot of heat lately on a lot of ways, is this well deserved . It sounds like this was something that has to have a major change in terms of how they do their operations, if something was reported to a call center and then didnt go to the field office to be checked out, thats a mistake, but again, 23 reports to local Law Enforcement as well.
