Our investigation in San Francisco exposed how some landlords used that eviction to wrongfully kick out potentially hundreds of rent controlled tenants. Often to bring in new tenants willing to pay more in rent. The loophole was huge and left open. We have a tenants right attorney who believes the same loophole is used here. Its very under funded as a program. So nobody has any legal. Shes a managing attorney for a tenants right group providing legal services. Landlords know they can get away with it. Theres no way the city was going to enforce it. They know were working with the city attorneys office. Reporter michelle bird is in charge of that. Has anyone checked if the owner or relatives moved into the home . We have not had the ability to go out and verify that and enforce it. Reporter in fact, she acknowledged her departments own recordkeeping made it nearly impossible to determine the number of owner move in evictions, legitimate or fraudulent. Why cant the city say how many of these have been happening . We havent been categorizing them. Reporter she said it will change in the coming months as they take on a reform effort thanks to our reporting across the bay. Shes been working with city leaders that would require landlords to file paperwork each year to verify theyre living in the home instead of renting to someone new.
