More than 150 victims of the historic coyote creek flooding plan to file a complaint against the city of san jose, Santa Clara County, and the Santa Clara County Water District. This comes almost exactly a year after the devastating flooding. Today in the bays kris sanchez joins us live this morning, one of the hardest hit areas to explain what the city is trying to do to prevent this from ever happening again. Reporter hi there, laura. You saw those aerial images. Those are stark but you compare the water up to this point where im standing right here in the rock springs neighborhood. Those homes here behind me you can see a year later they are still unlivable. Now it was a shocking sight when the coyote creek breached its banks forcing firefighters to rescue them by boat. Some residents didnt even know they were in danger until the water was up to their doorsteps and the firefighters were knocking on their doors. On that day we asked the same question a lot of those folks did which is why werent they ordered out sooner . Why didnt they know . That is one of the reasons the lawyer for the 150 families plan to file a civil complaint against the city of san jose, the Water District and Santa Clara County. That complaint alleges negligence and breach of duty. Last february mayor sam liccardo was quick to concede there was certainly and clearly a failure in the system. He has outlined some of the changes the city has made in the year since. They include an improved Warning System that includes a system to send text notifications to anyone in the area even if they dont sign up for them. Also expanded training for the people who live in floodprone areas like this one and the volunteers so that no one is caught off guard. Also enhanced communication with the santa clara Water District clarifying who is responsible for what. The Water District has raised the levee height and lowered the water level in anderson reservoir, which was part of the reason coyote creek flooded. Theres been an ongoing clearing of coyote creek as well in order to improve the water flow. Now it is not clear if this will address all of the things the homeowners would like to see, the folks who will file suit against the city, the county and the Water District today but we will be asking them. It would include military and domestic spending and would Fund Disaster relief for wildfire victims. Not all democrats are onboard including House Minority leader nancy pelosi. Critics say that deal leaves out immigration reform. Well remember who was with us and against it. The deal doesnt have everything democrats want. It doesnt have everything republicans want. It has a great deal of what the American People want. Now the senate is expected to vote on a plan today. If it passes it would move to the house and hopefully be passed before midnight. It is 6 08. The number of homes sold continues to fall. As it has for five years people arent selling. A vast majority of people who retire in Silicon Valley stay in their homes instead of downsizing. Now longterm residents are pushing for new ballot measure that would cut shortterm rentals by 75 . Take a minute and look at this new video showing a truck crashing into a bakery. It turns out the Business Owner does not hold a grudge here later taking a photo with the driver. It crashed into the bakery in maryland yesterday. Investigators say the driver lost control because of icy conditions there. Several customers were inside at the time. The good news here all of those people were safe and the baked goods were spared. Again, the owner wasnt angry and even took a picture with the man and gave him a cup of coffee. A drowsy driver . I dont think he was drowsy. Icy conditions. That is a good lesson in forgiveness. Our temperatures are starting out with low 40s for much of the bay area as you get ready to step out the door. 50 degrees in palo alto and 54 degrees in San Francisco. Some spots milder and as you get a look at the sevenday forecast at the bottom of the screen our temperatures will be cooling off but were still on track to set some records in a couple of cities across the bay area. Weve had a lot of Widespread Records set the past couple of days. I think santa rosa will set a record, that old record is 74 degrees. The forecast is 75. Oakland looks to stay below the record as well as San Francisco. In napa, san jose and livermore, 76. The record is 78. Well be very close and were still talking about beach days so im giving you the forecast. If youre heading through summit and its going to be in the mid60s by 10 00, 73 degrees. A great temperature to have lunch outside on the boardwalk. And still a lot of dry weather in the forecast. High pressure keeping those storms further to the north, and that High Pressure also giving us some clear skies and some light northerly winds. Always clockwise and its also giving us at times an offshore flow, so that gives us that warm desert air moving into the bay area. Over here now just about a half hour from highway 4 down to the slowdown through richmond and berkeley and, of course, the berkeley curve. Now its true kmart is owned by the same Parent Company as sears but she was baffled she couldnt return a sears. Com purchase to a sears store. So they turned to us for help. We scratched our heads and then we reached out to sears for comment. In a statement the company said the store should have allowed the return, and the situation might have been just a training issue. Yes, when we spoke with mayor sam liccardo in san jose on the 18th floor of city hall behind me, he noted while much of Silicon Valley has prospered in recent years many people have not benefited. You talk to anyone who is scraping by to pay their sky high rent. Tonight at his annual state of the city address. Mayor liccardo will address the rebuilding of the police department, the fast growth at the hospital and the affordability crisis in the valley. You need to make more than 200,000 just to afford a medium priced home. The mayor will focus on his plan to build more than 25,000 Housing Units over the next five years. 10,000 of which will be priced for lower income households. I was just speaking at the high school in san jose and heard far too many stories of kids whose families are being evicted from apartments because they cant pay rent. Worried about whether theyll be able to go to college because they cant afford it. About the widening gap here in the valley. We have to do more. Tonight the Oak Grove School District Board of trustees will discuss where to draw the new neighborhood Boundary Line that determines which school the child will go to. They need to be redrawn after the district decided to close Del Roble Elementary School and glider. Those closures are due to declining enrollment. How many citizens and local governments weighed in on the massive stanford expansion. Public comment is closed and the county is addressing the concerns. Here is who went on record. The Planning Department got 184 comments from private citizens, 18 letters from public agencies, and 12 letters from Nongovernmental Agency organizations. These groups range from governments to transit agencies. By law Santa Clara County must address every single one. As kris sanchez reported stanford is permitting for a permit for a sprawling redevelopment project spanning nine jurisdictions and 17 years. It would include 2. 3 million feet of academic space, more than 3,000 units of housing for students, staff and faculty. The plan is to finalize the Environmental Review with response to Public Comments coming some time this summer. It appears the Major Development tied to the giant may be ready for the move. It would create 1,300 Housing Units along with office and retail space. The state Lands Commission would also have to sign a deal on this. Dash cams in 3,000 cars and studied 700 crashes. 10 of drivers had been dozing before the crash. Aaa says thats much higher than federal estimates. Plus, people should get seven to nine hours of sleep every night. If you cut that time by just two or three hours, aaa says the risk of you getting in a crash while tired at the wheel is four times higher, equivalent to the risk of drunk driving. It affects all of us. What were trying to underscore is the increased awareness and get out the message people need to prioritize sleep.
