Several people on that committee, marcus, want mueller to rosenstein is the Justice Department official who appointed the special counsel after attorney general Jeff Sessions recused himself. Today before the house judiciary committee, facing questions about democrats from the russia investigation and from republicans, questioning whether the investigation was biased against President Trump. Rosenstein defended mueller. I believe that based upon his reputation, his service, his patriotism and his experience with the department and with the fbi, i believe he was an ideal choice for this task. He would go on to the defend the fbi as well. The president says the fbi is in tatters and some republican senators have been very critical of fbi agents. Rosenstein testified the fbi agents he has worked with are some of the finest people he knows. Yesterday, President Trump tweeted a message about senator Kirsten Gillibrand of new york, saying she came to my office begging for Campaign Contributions and would do anything for them. Of course like many of his colleagues, theyre still stunned, theyre shocked, theyre saddened by the unexpected death of mayor ed lee at the age of 65. You see folks walking up right now. Were going show you guys this memorial outside here where you have flowers set up and notes saying how much they miss the mayor who has passed. But we did speak with supervisor mark ferrell as he was walking in and he told us they expect another emotional day. One of the toughest days hes ever had to go through, but he wants to reassure residents that the city and their officials have everything under control. Look, yesterday was one of the most surreal days ive ever had in my life, and i think for all of us inside of city hall, you know, the important thing to make sure that San Francisco residents know we have a succession in place. The city is functioning, fully functioning and will continue to do so. You know, the politics will follow, but right now i think it continues to be mourning the loss of our friend, the leader of our city, our mayor. Last week, the meeting ended with no decision. Now to the Oakland Hills fire we brought you as breaking news yesterday morning. We still dont know what caused that dpier that started monday night. This was at a home under construction. In total, two homes were destroyed and eight others were damaged. It was a Quick Response from the firefighters that kept those flames from spreading out of control. Thousands remain evacuated as firefighters try to make headway on that massive thomas fire. Cal fire is putting containment at 25 . The number of structures destroyed or damaged as surged past 1,000. Most of the evacuation orders have been lifted for ventura county. The fire started nine days ago and has since burned 236,000 acres. Heres a story that will make you smile this morning. Actually getting our first look at two orphan Mountain Lion cubs now at the ownland zoo. The cubs about 4 months old were found in Orange County two weeks apart. Scientists will test their dna to find out if theyre related. And anyway may be, an adult female Mountain Lion was found dead from an apparent car accident. Both cubs are reportedly doing well, the zoo says the Mountain Lions are the most at risk in the nation. Sevenday forecast now up at the bottom of the screen showing more days as we see some very chilly mornings but we will have some warm afternoons. If you are planning to go out to christmas in the park, it is going to be so comfortable, at least for the middle of the day. As soon as the sun sets, temperatures drop like a rock. Its going to be in the mid50s at 7 00 and it continues to go down from there. We know its been really dry but lets talk about how much rain were lacking here. So far santa rosa has measured over 6 inches of rain for the water year, but thats not quite near normal. We are only about 73 of normal for the water year. San francisco only getting half of the normal amount of rain. Were doing the worst in san jose. Weve only measured about 1 1 2 inches since october first and we are lacking almost 2 inches of rain so we are at about 45 of normal and our percentages continue to drop off because of a very stagnant weather pattern. By next week, it looks like well start to see some changes here. High pressure moves out towards the east. We can see by the swirl of the clouds here that there will be an area of low pressure moving in. That will bring more clouds, cooler temperatures and onshore flow and slight rain chances. Each now as we look farther out it, looks like those rain chances are drying up. At least we will see a bit of a change in our pattern here and that will allow for some rain to possibly move in. We stay in the 60s over the next few days in San Francisco for the highs, upper 60s inland. This is close to the Alameda County courthouse and weve been watching these live pictures from nbc bay area skyranger overhead. And that is a police crew there actually suiting up. It looks like theyre going to try to approach this item, what looked like some sort of rolling bag, like a suitcase found near a stairwell. Were going to keep monitoring what is going on there this morning. Just wanted to keep you aware if you are in fact in that area. 12th and oak street in oakland. A search underway for a suspected arsonist. Fire crews battle another freeway fire in the south bay. This happened near the 280101 interchange. This is the latest in a series of fires set since saturday. Nbc bay areas anser hassan is in where reporter another set of fires along another stretch of freeway in the south bay. This time near the intersection of 280 and 101. It appeared some trash and some shopping carts had been set on fire. Reporter no one was hurt, no homes destroyed, but fire investigators say they have evidence to suggest these spot fires are the work of an arsonist. We can say definitively at this time is that this one appears to have been intentionally set. The possibility that it may lead to additional fires over the weekend. Reporter this weekend, 12 fires were set on saturday. There were reports of another six fires on sunday. Then came monday morning with two more fires, it brings the total to over 20. They dont have a suspect, but they say theyre getting close. There are people who have been able to provide some information about a potential or possible suspects or people who may know some information about who is starting the fires. So these are all things that are part of the active investigation. Now, one person was detained on monday, but he was released because there wasnt enough evidence. Investigators tell nbc bay area that they have no other leads. They are asking anyone who might have driven by the fires to call chp or the San Jose Police department and Fire Department if you have any information. In may, Garcia Torrez was convicted of killing lamar in 2012. After the sentencing sierras father had a strong message for his daughters murderer. The only thing we can hope for is that prison will be hell for him and that what he has done will eat away at his brain like a cancer while he rots in prison. Sierras mother also spoke and addressed the fact her daughters body has never been found. Heres what shes asking Garcia Torrez. Im asking him to come forward where sierra is to give us the real closure that we deserve as a family. Sierras parents add they can take some solace knowing Garcia Torrez cannot kill again. Just released death certificate for Charles Manson is shedding some new light on his cause of death and failing health. Manson died of cardiac arrest accompanied by respiratory failure triggered by colon cancer. The certificate notes that the cancer had spread to other areas of his body. Manson died november 19th at a bakersfield hospital in the central valley. The 83yearold had been serving a life sentence for orb straighting the 1969 killings of pregnant actress sharon tate and eight other people. The man accused of trying to attack new york city commuters makes his First Court Appearance food. Akayed ullah faces federal terrorism charges. Police say he strapped a pipe bomb to his body hoping to detonate it in the transit package. It failed and he was injured. Three other people have minor injuries. Trouble at the highpriced Millennium Tower in San Francisco. Is the sinking tower triggering a fire hazard . Translator the fire marshal is now getting involved. Investigative reporter jaxon van derbeken, who broke this story about the sinking tower last year, exposes the newest problem. This building is not as safe as we all were being led to believe. Reporter thats Millennium Tower condo owener Paula Pretlow talking about what shes just learned about the sinking and tilting tower. Pretlow spent a year fighting to get this full version of a report on mysterious odors in her unit. It was done by consultants hired by the Homeowners Association. The odors, it turns out, are a symptom of the apparent failure of the towers metal and glass facade also known as a curtain wall because it acts alike a curtain at the edge of the structure. The consultants found pretlows curtain wall pams are separating from the buildings structural frame, creating gaps that will allow odors or even smoke and flames to travel between floors. The consultants cited the buildings tilt as the likely cause and concluded this condition may be more widespread than these two test areas and may be present in the entire stack. We recommend further investigation of this issue. They also issued this ominous warning. These openings represent a breach in the fire and smoke safety barrier, which is a life and safety hazard to the occupants. Reporter pretlow only saw those conclusions recently because they had been blacked out of the original report she was given last december. Pretlow took her concerns to the Fire Department, which told us it is investigating. Weve also learned that just last week, crews removed facade panels as part of a homeowners investigation. The Homeowners Association declined to comment on our story, citing mediation talks with the Millennium Towers developer. Its a huge problem. Reporter larry karp, a geotechnical expert, says the buildings uneven settlement could easily strain the glass and the curtain walls at the base of the tower. It depends on how theyre attached, when theyre coming apart. The fact its coming apart is inevitable. Its just a matter of time. Its going to get worse. Reporter millennium officials also refused to comment for this story, last month they filed suit against the texasbased curtain Consultant Firm over the whole issue. San francisco supervisor aaron peskin believes the City Department of building inspection should be pushing to verify the reports findings. Not only do all of the condo owners have the right to have that information, but the city should have that information so that we can impose the kind of fixes that have to be imposed. Reporter as if the tilting, sinking and stinking were not enough, pretlow says her windows are now leaking. She says she just wants someone to take all the problems seriously. This is a serious issue. And i think the city and all parties involved need to recognize it and something needs to be done. Looking for mount hamilton, we can see the layer of the smoke, and this is exactly what weve been talking about. We say its a spare the air alert day, and that means you should limit your pollution if you can by catching Public Transportation. All of its just being trapped and pushed down by High Pressure. And you can see that layer thats being created creating the smoke in the valleys. Right now our temperatures are in the mid50s. At least for san jose in palo alto, its still in the upper 40s in santa rosa. So a slow recovery from those temperatures this morning. Look at the south bay with our high temperatures today in east san jose, expect a high of 67 degrees. Milpitas, 64. Also be at 64 in walnut creek. Oakland, 62 and 62 in daly city. In San Francisco, 60 in in the marina district. Looking at a high of 64 degrees in napa. Its crazy to talk about beach days, but weve had some really nice ones. Very comfortable at half moon bay. It will be into the mid to upper 60s this afternoon, but onces winds begin to pick up, at about 3 00, temperatures will drop off really fast. And also the menorah lighting tonight in union square and its going to be at 55 degrees in San Francisco. All clear skies throughout the night. Very nice night for that. As we look at the next several days, still High Pressure keeping our rain chances away. And then as we go through wednesday of next week, computer models going back and forth on whether or not well actually get some rain out of this, but it looks like we could at least have a slight chance. This one showing a wave of some rain moving in by wednesday to thursday as well as friday. Some really good news here. Hopefully well get some snow in the sierra right before christmas. It involves a simple m now to a story getting a lot of attention on social media. It involves a simple message written hastily on a note pad thursday night. The author of the note is a firefighter with the san diego Fire Department who has been fighting on the front lines of that lilac fire. Megan from our sister station in san diego has the story. Reporter we were thinking it was on fire, there is a hole to the outside. I dont think they would have done this. This is what lindsey and michael came home to friday afternoon. The ceiling above their bedroom collapsed. Leaving huge chunks of drywall on their furniture and floor. Go pack up. Here i go. Reporter the two of them were at work when the lilac fire broke out, and for almost two days they didnt know if their home had survived. As we approached the front door, we saw this little piece of paper what looked like a boot mark. We noticed something quite unique. The palm trees were all on fire and they were spitting embers and palms were burning all over everywhere. Reporter those embers had imbedded themselves inside the attic of their home. The fire captain kicked in their front door and sent firefighters in to knock it down. The mess we left from our boot prints to where the hes line was dragged through. Reporter hours later, ernie valdes did a final walkthrough to verify the fire was out. Really quickly i felt i still had my note pad, my pen and do ied to leave them a quick note. We started to go through the house a little bit and found that note. Oh, actually, i kept it. I keep it in my wallet now. So the note from the firefighters saying, sorry about the door and the ceiling. Had to get in there to save the home. So san diego fire, good luck. Reporter touched by the simple gesture, lindsey posted the note on social media, looking to thank the firefighter who wrote it. Theyre saving our home but then theyre also, like, you know leaving a little note. It was special. I didnt write the note for specific recognition. I didnt at all. I didnt expect this at all. I wrote it because i wanted someone to understand why we caused the damage we did, even though their home was still standing. Very nice gesture, though. The damage to the home estimated at 65,000 and not all of it will be covered by insurance. Theyre planning on reaching out to the strike team that saved their home and of course thank them with a note of their own. And with the gift that just keeps on giving, socalled railway angels paid off ten different orders for customers in san jose. Its always such a cool thing. It happened again this year at toys r us. Struggling to buy gifts for 20 kids in foster care. He said since he was adopted as a child, he was hoping to pay it forward. Last night, someone paid off the 320 bill he had on lay away. There are people in the world who ask for nothing in return who just want to help people make a difference in their lives. And after tonight, this has restored my faith in people.
