Pete, good morning, and tell us about this charge and what the guilty plea means. It means he will shortly be appearing in federal court to say to the judge he agrees to plead guilty, and that hearing will be happening any minute now. Its one charge of lying to the fbi about two separate conversations the fbi says he had with the Russian Ambassador a week apart, on december 22nd the fbi said he asked the Russian Ambassador to delay or defeat a pending u. N. Resolution, and a week later he asked the Russian Ambassador to moderate russias response to the sanctions the Obama Administration imposed against russia that very day in response to russias meddling in the election. The indictment here, the information, the Court Document says on january 24th, he was interviewed by the fbi and falsely denied he had those two conversations with russias ambassador. The charge is a felony. It does carry a fiveyear prison sentence, but its unlikely that flynn will see anytime in prison, because the signal is that he agreed to cooperate with Robert Muellers prosecutor in the special counsel investigation, and it looks to be a deal, and each side gets something. He gets what is, in essence, a minimal charge. This is the least the government could have charged against him, given all the other potential legal exposure, and he has cooperated and will have to continue to cooperate with Robert Muellers investigators. Any sentencing, generally, pete, would come after that investigation is complete. And i want to go to kristin welker. Good morning to you. Has the president been informed of this and what is the fallout there . Reporter one white house official tells me President Trump has been notified, but theres no details on specifically how that happened. We are working our sources here. I can tell you to put this into context the russia probe is the single issue that looms over the white house, and its an issue that gets under the president s skin than any other issue. Some have told me in the past they worry flynn could give information that could be damaging to the president. The pressure had been intensifying around flynn in recent weeks. Federal investigators gathered enough information, as we reported several weeks ago, to bring charges in the investigation of flynn, and it comes after lawyers for flynn notified the president s legal team that flynn would no longer be sharing information with them. That was the first sign flynn was cooperating. Flynn was fired after just 24 days on the job for lying to the Vice President about his contacts with the Russian Ambassador during the transition. President trump hasnt spoken about flynn recently publicly, but during an interview months ago with our lester holt the president called flynn a very good person, undoubtedly they are watching these developments closely here at the white house. The Court Documents say that he met with fbi agents january 24th that, is four days after donald trump became president. Prosecutors say he lied to the fbi about two conversations he had with the Russian Ambassador to the u. S. On december 22 nld the fbi says he asked the ambassador to delay or defeat a pending u. N. Security Council Resolution and then a week later prosecutors say he asked the ambassador to moderate any russian response to the sanctions that had been announced that day by the Obama Administration against russia because of meddling in the election. The fbi says he lied to agents and that means he broke the law. Now its sang will count. It is a felony. It has a maximum sentence of five years in prison. But its doubtful flynn will get any prison time when he sentenced which will happen months from now. This is a plead deal meaning both sides get something. He gets the least the government could have charged him with. The fact that there is this deal means the government gets something. Hes already been cooperating with Robert Muellers prosecutors and as part of the deal hell agree to continue to do so. In fact, if he fails to continue cooperating, the government could seek a harsh sentence and the prosecutors could always file other charges. The basis of this charge is the same conduct the Donald Trump White House cited in firing flynn from his job on february 13th. The white house said at the time he lied to Vice President pence about those conversations. Savannah . Now, people all over the country are recalibrating, including right here at nbc talking about what is acceptable in the office and what absolutely is not. Endless cases involving big stars, disturbing accusations of Sexual Misconduct blanketing our newspapers, social media and televisions. Matt lauer fired over allegations. Charlie rose off the air. Harvey weinstein taking a leave of absence. Reporter but far beyond hollywood and new york, everyone seems to be rethinking the American Workplace. Ive seen a lot of men on their best behavior. They see men in power and hollywood actors and comedians like, you know, everything is happening and theyre getting fired in a split second. Reporter with Sexual Harassment and abuse in the spotlight, men and women are facing important long overdue conversations about what is appropriate and what is not and where the line is. Things that are blatantly harassment to me, then there are things that were, you know, hey, we used to be able to say these things together and now its harassment. Reporter men and women are reevaluating their own conduct and past events they witnessed or participated in questioning whether a past action has ed a line. Exploded into all professions, politics, silicon valley, restaurants and banking. Online the metoo spreading like wildfire with women of all races and ages sharing their experiences. But the creator of that social Media Campaign to says the guidelines workplaces have in place have not done their job. There has to be accou accountability for the victim and the perpetrator has to understand this is zero tolerance. This behavior cant happen. A recent gallop poll shows that one in three women are worried about being sexually assaulted, but theres a generational gap with younger women more concerned than those who are older. Still, everyone can agree the workplace is going through a seismic shift. Any time there is a big power shift. Any time there is a sudden change, it can feel unsettling. That doesnt mean it is the wrong thing to do, but it does mean we shouldnt expect to be comfortable. In a matter of months, anger has boiled to the surface completely upending places of business in a way america hasnt seen before. Hopefully we can have a thoughtful conversation and tina, ill start with you. This is a moment. A cultural moment and it feels in this moment that everything has changed. Do you think it has and is it a permanent change . Were in the middle of a general revolution which was the largest oneday protest in american history. Lets not forget that. Finally, women are really saying, enough is enough. Its been a year of women saying, enough is enough. We have played nice for too long. How many times have we talked about women in the pipeline, women, you know, are going to be empowered. Women are going to transition to places of power and they really are still stalled, in many ways they are stalled. A sense of being stalled and women are just tired of it. Tired of being told there is this idea eventually theyre going to come into power as opposed to being the ones who are talking about it all the time. Because having that power means you change the norms. Thats what you need to do. Its not rocket science. There were ten men on Harvey Weinstein companys board. No women. Its insane. We wonder if this is a generational thing, you guys. We bring you two in because you are ceos of the skim, great company. The stuff, i remember kind of putting up with as a young reporter. The jokes and innuendo and things i just laughed off. I wonder if you guys feel that, have that or tolerate anything like that . Yes. You do. To be honest i think, i hope that those things change. I hope that this causes that change. But we started out in the business ten years ago and all of those things happened. It was clearly a line between the assault that we both had which was horrific but the innuendo and being put in situations that you shouldnt have to be put in in the workplace. Absolutely. I heard someone recently, we were socially who said, we worked in finance and didnt understand what everyone was talking about because doesnt work with any women. Think about what that statement means. Women probably do and you dont even realize, why are women not actually surrounded . Because they probably didnt get that job. Why were they not in Computer Science classes and not getting into that pipeline to begin with as you referenced. I also think the millennial generation, we all watched mad men an era so far away and look at this behavior. That could never happen. As danielle said, there is certainly that line where there is Sexual Assault which is criminal in many cases and then there is what happens when its just sexist behavior in the workplace. Ted, i turn to you because you are a man who works in this area and youre doing good work. And men need to be a part of this conversation. Yes. What is your message to them . Well, first of all, i want to say that we really our heart goes out to the victims and i think about, when i think about the women who had the courage to come forward and think about all the women in the margins of the margins and the domestic workers, the undocumented worker, the women who is working in the low paying job and all that theyre being abused and the disrespect that is happening there. So, men have to, as women are finding their voice, men have to find our voice, too. Its really up to us. Its not going to end unless men become part of the solution. We always draengz theaddress th from intervention. Our work is to go upstream to prevention where it never happens in the first place and that bridges men. We have to be different as men, while most men are not abusive and do not intentionally discriminate against women, we are silent about the abuse. We are passing these things down to our boys. We did a survey for our curriculum and surveyed boys and different ethnicities. 81 of boys do not know what consent is. High school boys. That explains Sexual Assault in the military. That explains Sexual Assault on College Campuses and boys are no means try harder. Lets talk about punishment. If someone is accused of this, what should the punishment be . Do they never work again . Tell us what you think that bar is, tina. Well, clearly, because were in the throws of a revolution, a revolution is bloody at the beginning. So, well see some damage. Very severe punishments, which is what were really seeing with all these huge careers just going. Legacies going. Theyre exsponged. But i think it will change very quickly because as Companies Realize that to harbor and nurture and cover up a sexual pred predpredatator who is a big tic that company or down the line an effective worker it is too much of a liability to tolerate it. As that happens, i think youll find that you dont have to be as severe because it wont be happening as much. I think there is people just laws can change very quickly when theres money at stake. Whats tricky and we, unfortunately, dont have the time to really get into it, its the gray area. Everyone knows assault is wrong. Thats not a close call. Our generation is talking a lot about. We have been talking to so many men in the last few weeks who are like, how do i interact with women . We recently were at a conference where we know these men for years and people were scared to hug us. But youre our friend. Dont be scared. On one hand im happy that these questions about the gray area are being asked and it has to be a conversation with men out there and on the other hand, i feel like in a lot of circumstances, you know when youre making someone uncomfortable. And especially going in the holiday season, you know, we had questions about holiday parties, there are things you know not to do. You absolutely know. Accountability is the key and also between men because that same man whos sex yaem ually harassing the woman at the workplace is the one who is saying, hey, check her out. All of those things. As men we have to speak up and say, thats not cool with me. We are not going to behave that way. The cool factor is important but an uncool thing to be an invitation to men. An invitation to do things differently. To change our culture and it really starts with a lot of internal honesty among all concerned. Thank you so much for this discussion. Its important. Well keep it going. And now well go over to al. Lets take a quick look and show you what we have. Wet weather making its way to the southwest. Things relatively dry in the Pacific Northwest, although we are seeing more showers make their way in and basically were looking at a day that well have some cooler conditions back through the Pacific Northwest and into the northern plains. Were coming on the air with Major Development in the russia investigation. The news that President Trumps former National Security adviser Michael Flynn has just pleaded guilty to a charge of lying to the fbi. About conversations he had with the Russian Ambassador to the United States last december after trump was elected. Elected president. Flynns plea entered in court is the latest and strongest indication he may now be cooperating with special counsel Robert Muellers investigation into the Trump Campaign and its dealings with russia. Flynn who resigned as National Security adviser in february after serving just 24 days, is now the fourth trump official to be charged in the mueller investigation. Nbc News Justice Department correspondent Pete Williams is following all this and has the latest from our bureau here in washington. What do you know . The fbi says that he lied to the agents twice in a meeting they had four days after the president was elected january 24th about his conversations with the Russian Ambassador. They say he talked to the ambassador once on december 22 nld, urging the russians to either delay a vote in the u. N. Regarding israel and then a week later according to prosecutors flynn denied that he met with the russian or talked to the Russian Ambassador again about trying to get russia to moderate its response to the u. N. Security council or rather to the Obama Administrations decision to impose sanctions that were announced just that very day against russia because of meddling in the elections. So by denying the conversations, the fbi says he broke the law. Now its a single count, its a felony. Its a maximum sentence of five years in prison. But its doubtful, lester, that he get any prison time for two reasons. Its a plea deal. It means both sides get something. He gets what is in essence the least serious charge that the government could have been brought leer but the government in return muellers prosecutors get his cooperation. So this is a sign that hes already been cooperating with them and he has to continue to do so because if he doesnt, they could ask for a harsh sentence or file additional charges. You have to ask one other question here, lester, and that is why would he lie to the fbi about conduct that is arguably probably either not illegal or potentially violated the law of the logan act thats never really been prosecuted in modern times for talking to the russians before the president was inaugurated . The question here is why wouldnt he tell the truth about these conversations . Was he trying to cover up for someone else . Did someone else tell him to talk to the russians . Did the president , for example, tell him to do this . So thats one question undoubtedly that muellers prosecutors will be getting to with him. He wont be sentenced now for months. So that gives the government additional leverage over him to get his continued cooperation, lester. And, pete, walk us through this. You covered these sorts of things before. How do these deals go down . Does the person say ive got x, y and z or ive got something good if you give me a lesser charge ill tell you what it is . The government would go to him first. The prosecutors would go to him first and say you got exposure here. We believe that you lied to us. Were prepared to charge you with a lot of other things unless you can agree to talk to us. So its a dance between initially his lawyers and the prosecutors and then at some point he makes what is in essence a prosecute, okay, if we get this deal, heres what im prepared to tell you. And they would try in other words, they wouldnt give him the deal without knowing what theyre going to get in return. Thats a point. All right. Thank you, pete. Well go back to you in a second. Lit me go to Kristen Welker at the white house. The president had spoken out in support of general flynn some time back. Do we expect to hear from him today . Its possible, lester. Heres what we flow so faknow s. President trump had been notified that the white house is not yet officially kplencomment. Were working our sources. The russia probe for context is the single issue that looms over this white house larger than anything else. Its also what gets under the president s skin more than any other issue. The revelation that Michael Flynn will plead guilty to lying to the fbi will undoubtedly be met with concerns among many of the president s inner circle who have told me in the past that they worry flynn could reveal information that could potentially be damaging to the president although officially the white house said flynn does not have any information that could hurt the president. Now flynn was Foreign Policy adviser and the Trump Campaign and transition all before joining the trump white house. He was one of the president s first high profile top advisors. So he knows a lot. This come after nbc news reported weeks ago that pressure has been intensifying around flynn. Federal investigators had at that point gathered enough evidence to bring charges in their investigation of flynn. It also comes after lawyers for flynn last week notified the president s legal team that flynn was no longer share inform they had been doing regularly. That was our first sign that flynn was cooperating with investigators. Flynn just to recap is under scrutiny for the foreign lobbyi lobbyi lobbying work involving turkey and russia. He lied about the contact during the ambassador during the transition. President trump hasnt spoken recently about flynn but during an interview with you months ago, the president called flynn a very good person and then back in march mr. Trump tweeted this. Mike flynn should ask for immunity in this is a witch hunt by media. The president has consistently tried to cast a russia probe as a witch hunt, a hoax. But this development is yet another potential complication in that narrative. Lefter . It may be too early to know, kristen, but there are congressional investigations looking at some of the same matters z this affect those at all . It will certainly be of interest to congressional investigators. Lester, we should note that New York Times overnight reporting that President Trump pressed some members of the senate Intelligence Committee to essentially wrap up their investigation into russia. Again, underscoring this motino that this complicates his agenda. So this will undoubtedly factor into the investigation on capitol hill as well. Let me get Pete Williams to weigh in on that same question with regard to the congressional investigations. Do they is there any sharing between the information they glean versus what the mueller team is getting . Well, its pretty limited. Thats been a source of frustration for members of congress. But the government doesnt want to basically get information to congress that could jeopardize their investigation. If they tell members of congress what theyre learning, and theyve been doing some of this. It started with come. Its continuing with mueller. But the problem here is if you tell congressional investigators something and they start asking witnesses about that, then it begins to color what potential witnesses might say. So there is some cooperation. But its limited. All right. Let me bring in our political director and mod rater of meet the press chuck todd. How does this we dont flkno what he is going to sachy. But how might this affect how much the white house wants to say and this presidency . Mike flynn, you know, the president the reason bob mueller has a job as a special prosecutor is the president was desperate to protect mike flynn. He has gone out on a limb for mike flynn. The whole point of naming mueller is because went after james comey and asked for leniency on mike flynn. The president has acted as if hes very concerned about what mike flynn knows, what he may have to say. So, look, by the way, the president has himself this has been a pretty he ee radic week for the president. If you back time this to when the president himself found out that flynns lawyers were no longer cooperating ten days ago, since then, the president s been on a terror, if you will, on various issues not just attacking, you know, normal opponents but all over the place. I think the president is clearly rattled by this development. There are those who admired this president for his unfiltered way of talking and dealing with various issues. In this case, are some of those moments now about to come back and bite him . It is. You have the already the one tweet we talked babout earlier. We have the interview with you with what he has said about the firing of comey which in and of itself only added to the potential long list of pieces of evidence that mueller has on the president potentially obstructing justice here. So, look, it is i think thats why you havent had seen the president tweet yet. And this in this case, it looks like the president is listening to advice that says think first before you tweet on this one. All right. I want to bring in Andrea Mitchell right now. She is joining us on the telephone. Can you give us a little more insight into the conversations that were the subject of these charges today in terms of what was lied about and what the nature of the conversations were . Yes, indeed. There are two conversation thats are critical to this. Both were in december of 2016. One on december 22nd which was the Russian Ambassador and ambassador kislyak and that conversation flynn is acknowledging that he lied to the fbi subsequently about his telling the Russian Ambassador he wanted russia to go against u. S. Foreign policy, obama policy at the time, and pose or actually defeat a pending u. N. Resolution that would have declared israels settlements in palestinian territory illegal. In other words, the Obama White House and state department were going against benjamin netanyahu, were opposing israel in this and by abstaining and planning to abstain and he sidelined with netanyahu and Michael Flynn was in touch with russia getting russia to go against u. S. Policy at the u. N. Behind the scenes. The second that he is 5 00 flojinflo acknowledging is december 29th. This was after president obama had sanctioned russia for meddling in the election by expelling dozens of diplomats, you Russian Diplomats from the u. S. And by closing [ inaudible ] one in new york, one in maryland and one in suburban washington, d. C. And this was a conversation that he denied to the fbi where he clearly was overheard by u. S. Intelligence telling the Russian Ambassador that they that putin should not overreact and slu not expel diplomats because the Incoming Trump administration would reverse the obama sanctions. So that is why very suspiciously at the time we all reported on nightly news and elsewhere that the putin failure to retaliate against obamas sanctions against russia was highly unusual, in fact, unprecedented. Lester . But were those conversations in and of themselves illegal or in a gray area or was it the fact that he was not truthful about them is the bigger issue . They you might have made an argument of the logan act or treason. But thats never been prosecuted. You could argue it was improper, unprecedented for an incoming president to go against an outgoing president s Foreign Policy. I dont think any very many lawyers would argue you could get a conviction for. That the fact that he lied about it is the issue and that is why he is pleading guilty because he became in legal jeopardy. Perhaps the overlying issue of whether or not there was collusion on russian meddling is the back of his mind. One doesnt flow his motivation for lying. Perhaps he didnt want to acknowledge contact about the election and the sanctions because of what a hot potato that was. But youre right. If he hadnt lied, maybe they would have gotten him on Something Else and maybe a less serious charge which is not registering as a Foreign Agent with turkey but youre absolutely right. Its the fact of the lie that, again, has caused the problem. And thats what weve seen in the past. All right. This hearing, the guilty plea being uttered here a few minutes ago in the courthouse. I want to go back to Pete Williams right now. Hes been reading through some of the documents really to all this. What you are seeing that is standing out . Very interesting things are in these documents. The government says and basically laying out the case against Michael Flynn that he first contacted the Russian Ambassador, the first conversation was december 22nd after egypt introduced this security Council Resolution about israeli settlements. According to the documents, a very Senior Member of the president ial Transition Team directed flynn to reach out to officials from foreign governments including russia to learn where each of them stood on the resolution and try to get them to delay or defeat the resolution. And it says on december 22 nld 22nd he contacted the Russian Ambassador and said the Incoming Administration opposed this legislation and asked russia to vote against it. Then it says on december 28th that, is six days after the earlier conversation, the ambassador called Michael Flynn and this was the day before the Obama Administration announced the sanctions against russia for its meddling in the election. And then it says the next day flynn called a senior official in the president ial Transition Team which was meeting down in florida at the resort at the trump resort to ask what if anything he should tell the Russian Ambassador about these sanctions that had been announced. And flynn according to the documents and this president ial transition official talked about the sanctions including the potential impact of the sanctions on the Trump Administrations Foreign Policy goals and according to the documents, this transition official who is not identified in the documents and flynn talked about the members of the team and how they didnt want russia to escalate the situation. Immediately after that call, flynn called the ambassador back and asked russia not to escalate the situation and only to respond to the sanctions in a reciprocal manner. Then it says after talking to the Russian Ambassador flynn talked to Senior Members of the president ial Transition Team about those conversations regarding the sanctions and russias decision not to escalate the situation. Also the team, the defense team for Michael Flynn has now issued a statement, a written statement. He is not talked which is not unusual in a situation like this. But the written statement says, ill just read it. It is short. After over 33 years of military service to our country including nearly five years in combat away from my family, and then my decision to continue to serve the United States, it has been extraordinarily painful to endure these many months of false accusations of treason and other outrageous acts. Such false accusations are contrary to everything i have ever done and stood for. And then the statement goes on to say, buit i recognize the actions i acknowledged in court today were wrong and through my faith in god im working to set things right. My guilty plea and agreement to cooperate with the special counsels office reflect a decision i made in the best interest of my family and of our country. I accept full responsibility for my actions. Lester . So where do the dots connect based on what you just the information you found in those documents . Where might they lead . Well, the question is who in the Transition Team was he talking to . Undoubtedly, hes already told muellers transition sorry, muellers special prosecutors about the conversations. And theyre going to want to know more about the president s role in all of this. Did the president ask him to do this . Did the president direct people in the Transition Team to have flynn do this . Thats where the dots go. And undoubtedly muellers team already has a good deal of information from Michael Flynn about this. Or he wouldnt have gotten what is in essence a pretty sweetheart deal here. Because one of the documents says, lester, that in addition to other things that flynn did wrong as it says march 7th of 2017, he filed several documents with the Justice Department about representing Foreign Agents and made full statements in those documents falsely stating he didnt flow whether or to what extent turkey was involved in a project that he had been working on that was focused on improving business organizations, confidence in doing business. And he omitted that officials of turkey provided supervision and directions over this project that he published an article in a newspaper. So they could have charged him with that too. But they chose not to. All right. I want to go to Kristen Welker back at the white house. Kristen, any update now on when we may see the president . Are you hearing anything from the west wing . Of no update on whether we play see the president , lester. We do flow that he is going to be meeting with his secretary of state Rex Tillerson as well as his defense secretary james mattis today. Right now no plans for that to be something that reporters can capture and take pictures of. But well undoubtedly be pressing for access to him today. I can tell you, lester, i spoke with someone who is very close to the president who describes this develop ment as very, very bad. It underscores the fact that this will cause significant concerns within this west wing, within the inner circle about what Michael Flynn might know and what he might say. And now that we have this statement from Michael Flynn saying that he is in fact cooperating with investigators, that will undocumentedly just add to all of those concerns. Now, this is all developing, lef lester as there are significant things going hoinld the scenes here at the white house including a mounting report about the fact that the secretary of state Rex Tillerson may be on his way out in the new year. Yesterday the white house pushed back against those reports but when the president was asked about them, he didnt exactly deny it. He said the secretary of state is here. That was his only response. And then, of course, this lunch that hes having with the secretary of state today. So there is already some internal discord going on. These headlines adding to all of that. All right. Thank you. Back to chuck todd. This administration had been hoping to celebrate passage of a tax bill which may or may not happen today in the u. S. Senate. Now facing this. How does this affect the dynamic between the president and his own party now . Look, it doesnt impact. Its already been a shotgun marriage at best anyway. I think youll see a bunch of republicans right now try to speed up their attempts to get the tax bill passed and this president to sign it. Then i think youll see a lot of distancing. I want to point out something. You were talking about connecting the dots to Pete Williams here. This could bring remember who was directing in the National Security aspects of the transition. It was the president s soninlaw, Jared Kushner. The Vice President elect at the time mike pence was in charge of the transition. Bui but he was in charge of filling the domestic part. Jared kushner was doing the shovel diplomacy and had his hands in all of this. So keep an eye on all things Jared Kushner when it comes to who specifically that ordered mike flynn to do this with the russians when he said it was the trump transition. Well in this case, does that mean mike pence . Does that mean the president elect or could it mean Jared Kushner . All right, chuck, thanks. Kristen welker, you have news there . Ty cobb, his lawyer who is working on the russia probe just releasing a statement. Let me read it you to. He says today Michael Flynn a former National Security adviser at the bhous for 25 days during the Trump Administration and former Obama Administration official entered a guilty plea to a single count of making a false stantement to the fbi. The false statements that the white house officials resulted in the resignation in february of this year. Nothing about the guilty plea or the charge implicates anyone other than mr. Flynn. The conclusion of this phase of the special counsels work demonstrates again that the special counsel is moving with all deliberate speed and clears the way for a prompt and reasonable conclusion. Now, of course, that is what the president and his legal team are working toward. I can tell you that once ty cobb started working with the president here at the white house, his philosophy has been to be very forthcoming with information, with documentation. He has said he wants this wrapped up quickly and believes that is the best way to make this happen. So the talking point from the white house is that, look, this is one step closer to this investigation being concluded. But, of course, again, the very real concerns within the president s inner circle of what exactly will Michael Flynn say and will it in any way harm the president or those closest to him including his soninlaw Jared Kushner as clubbihuck tod talking about.
