The second inmate who escaped from the palo alto courthouse earlier this month is back behind bars. U. S. Marshals arrested john bivins today in san leandro after he and another inmate bolted from a courthouse in a brazen escape. Joining us live in san leandro with the details on that. Marshals staked out the place all night long and made their move first thing this morning. Isabel bridgeford boek up this morning to an unexpected sight in san leandro. When i came out of the room at 8 00, there were a whole load of cops out here. Reporter they were here to arrest 47yearold john bivins. Nearly three weeks ago bivins and 46yearold Tramel Mcclough were being held without bail after robbing a verizon store. They were leaving a palo alto courtroom when they managed to get away, hopping in a waiting getaway car and elaborate escape. They then jump flood a van a few blocks away and vanished. Mcclough was captured last tuesday at a walmart in stockton. Investigators say bivins was there, but despite being shot at by police, bivins got away after trying to run over a deputy u. S. Marshal and chp officer. The manager of the fairmont inn says bivins friend checked in yesterday afternoon and u. S. Marshals arrived a few hours later. The Hotel Manager says they turned bivins power off, hoping he would come out, but he didnt until this morning. Thats when marshals made their move. Investigators say bivins resisted arrest and eventually was taken into custody. Its pretty crazy. Its just a crazy thing that happened, like, i would never have expected a criminal to be in my hotel tonight. Reporter im told additional charges could be filed against bivins, including escape, felon in possession of a firearm and attempted murder of a federal agent and a state peace officer. San jose police say it happened at a normally quiet business park. Around 4 30 this morning, police got a call of a person suffering from a gun shot wound. The man was found behind a building in the 2,100 block. He was taken to a hospital where he later died. No suspect or motives are known at this time. This is san joses 29th homicide in 2017. There were 47 homicides in the city last year. The driver of a car that plunged into the oakland estuary today did not survive. The drivers been identified at 68yearold paul sheerer of alameda. The oakland foirmt tweeted these pictures of that car being pull out of the water. Its not yet clear what caused that crash. Reporter neighbors near lilac and oleander avenue say they saw a large Police Response in their quiet neighborhood late friday afternoon. An unusual investigation now involving the u. S. Postal service. On friday afternoon, a parcel was delivered to a resident in Bay Farm Island in alameda, california. That parcel did detonate. At this point, its an ongoing investigation. Reporter Police Dispatch audio suggests a woman living at the home opened the package and it exploded. One person suffered non lifethreatening injuries. Santa clara police say a man flew a drone over levi stadium and the Oakland Coliseum to drop leaflets on to the crowd. They said something about free speech on them. The fbi, chp and local police immediately started locking for the man responsible and they found him in oakland, flying drones near an airport is not allowed and santa clara city code prohibits flying one within 500 yards of levi stadium. Congressman john conyers announced today hes leaving the committee but he is not resigning from office after an allegation of sexual misconduct. The 88yearold conyers still denies he fired an employee for refusing to offer sexual favors and looks forward to vindicating himself. The announcement comes after days of internal pressure for conyers to step aside, particularly from House Minority leader nancy pelosi. We are strengthened by due process. Just because someone is accused, was it one accusation, is there two . John conyers is an icon in our country. Conyers settled a Sexual Harassment case brought by a former staffer in 2015. The michigan representative is the longestserving member of congress. A followup now to the legal shutdown over who will head the Consumer Protection financial bureau. The Deputy Director filed a lawsuit to block president trumps choice of a new director. English, the temporary director was appointed to the position by the outgoing head suing the president over his appointment of mick mulvaney. While in congress, mulvaney voted to kill the bureau altogether. Now its not clear who is going to be leading the bureau. Tomorrow, english or mulvaney. Under the law that created the agency, english should lead but the president argues a different federal law makes mulvaney the rightful head. Happening now, evacuations are underway near an active volcano in eastern indonesia. The mount agung volcano has been hurling ash and smoke miles into the air. Former clients say the billiondollar company mishandled their reports of Sexual Assault and a spokesperson for the chain tells us tonight the incidents occurred over a span of 15 years and 125 million massages, but one incident is too many. The company is now evaluating how to strengthen its policies. In october, the nbc bay area Investigative Unit first revealed that some certified massage therapists in california who have a series of complaints and even arrests are allowed to continue practicing and the regulating service does not disclose that information. We investigate stolen guns across the country and trace them to the crimes where theyre used and the communities they affect. And relatively calm conditions right now in san rafael after already an inch of rain has fallen. Stolen guns are used in crimes around the country every day. Senior Investigative Reporter Stephen Stock teamed up with our other nbc stations and for the first time traced those thousands of stolen guns across the u. S. We analyzed records covering almost a half million stolen and recovered guns coming from across the united states. No one has ever done this kind of tracing of missing pieces on this scale publicly before. Because of this effort, we now have a better idea where these guns come from and where they end up. Its something that ill never forget, that ill never stop thinking about. Dylans brother rory was murdered in 2012 during a south bay crime spree involving a stolen gun. Emotionally, you know, for my parents, it was completely devastating. Reporter dylan and his brother rory grew up in campbell. Dylan served in the air force in iraq and carried a gun with him constantly. I would say that rorys death caught me more off guard than any roadside bomb in iraq could. Reporter yet he cant understand how guns continue to be left out in the open in the u. S. For thieves to steal. There is almost no talk about it. Reporter no talk about a stolen glock model 23 handgun taken from Riverside County in 2010 and two years later used in a crime spree that left a san jose Police Officer wounded and dylans brother rory dead. I dont worry that more families like mine will suffer, i know more families like mine will suffer. Reporter to get a sense of how widespread this problem of stolen guns is. Nbc bay area and more than a dozen nbc stations across the country teamed up with the Nonprofit Organization the trace to find out how stolen guns circulate around the u. S. I was numb. Reporter dylans family is just one of 63 different california families we found in our data whose loved ones have been killed since 2010 in Crimes Involving a stolen gun. I know other families are going through what im going through. Reporter we obtained records from more than 1,000 Law Enforcement agencies in 36 different states plus the district of columbia. Nearly 850,000 gun records in all. While the fbi says 2 million guns have been stolen or lost in the last ten years, our data is incomplete because some agencies, including San Francisco, oakland and los angeles Police Departments all refused to share their records with us. Even so, this data for the first time publicly shows how often stolen guns travel around the country from region to region and later show up connected to other crimes. The word is out. These guys are going after the guns. Reporter kevin okeefe is chief of Operational Intelligence for the u. S. Bureau of alcohol, tobacco, firearms and explosives in washington, d. C. The numbers and the trends were see indicate that this not going away. Noticeable increases in the last several years. Reporter the data we complied Shows Networks of stolen guns that travel throughout the country fueling other crimes. For example, guns stolen during a series of brazen robberies in the carolinas and near the atlanta area were later connected to crimes in syracuse new york, nashville, and chicago. Atf is the only federal Agency Responsible for tracing guns used in crimes. These are all boxes that have been received. Reporter they do it all here at the atfs National Trace center in martensburg, west virginia. Where the Program Manager gave us a rare behind the scenes tour. There simply is not national raj industry or database of gun ownership in america. Were only responding to requests for guns recovered in crime to try to identify the first retail purchaser. Reporter our data shows thousands of guns travel long distances. We found guns stolen from taco ma, washington, ended up in crimes in san jose and san diego. Guns symptom from Santa Clara County and oakland were later connect to crimes in baltimore, maryland. These guns move very quickly so it could be from a matter of days to sometimes 15, 20 years later. These guns are still being recovered in crime. Guns are not perishable. They dont wear out and disappear. Reporter we found more than 23,000 stolen guns nationally that were later connected to other crimes, including at least 1,500 serious Violent Crimes such as murder, rape, robbery and assault and battery. Not so much surprise me as it does alarm me. It seems to be a growing trend. No one wants to see firearms stolen from anybody. Reporter larry keene is Senior Vice President for government and Public Affairs for the National Shooting sports foundation, a trade association that supports proposed legislation to increase criminal penalties for people who steal guns. We think that sends a strong deterrent message to the criminals that are out there that might be thinking about this. Reporter keene says gun owners should secure their firearms but stopped short of saying they bear some legal responsibility for any crimes later committed with their stolen guns. Its important to keep in mind that, you know, theyre the victim of a crime. But we encourage people when their guns are not in use that they should be secured and made inaccessible to on authorized user. Though they would not agree to an oncamera interview, in a statement the nra said, quote, a law that requires report aj of stolen or lost guns is not punitive. It does nothing from preventing crimes from being committed and only serving to further victimize other lawabiding persons after theyve been robbed. How do you stop this . We ask that everybody partner to realize whats not going on and not make it easier for the bad guys to get at these guns. Reporter dylan says his brothers death is all you need to know about the impact of stolen guns on our communities. Punishing folks that, you know, lose their weapons. Its as simple as that. You wouldnt leave a child alone. If something happened to that child, youre responsible for that child. So what is the difference here . Federal officials tell me they think our project is an important one because they want the public and Law Enforcement to know more about the flow of stolen guns across the country. By law, the atf cannot share their data with anyone. Even local Police Departments like San Francisco and oakland do not have access to this data except when they request it on an individual case by case basis.
