This morning we are learning new details about the attack as President Trump ramps up his criticism, first the suspect. He fired in federal court late wednesday. There are new images showing him inside that home depot. This is where he rented the truck to use to run people over. We now know that he planned to continue that attack along to the brooklyn bridge, but he wrecked the truck before he got that far. Federal agents say that they found isis propaganda on his phone. We are also hearing from the first time from the family of one of those victims, jimmy drake, says right there that jimmy drake says that his son visited the bike path almost every day. When normal people take a coffee break he took a bike break and thats when it happened. And yesterday President Trump says that he thinks the suspect should get the Death Penalty. We also have new details this morning on the Police Shooting in San Franciscos castro on halloween. We have learned that an armed carjacking may be connected. Police say the car that officers approached on halloween night was stolen, after the shooting in the Castro Police say two women and a man car jacked a super cab at gun point near that shooting scene. Police found the cab abandoned on oak wood in the mission. Back in the castro one witness describes the violence that unfolded. Down the hall to make sure that we werent going to be hit and, you know, trying to think about what are we going to do, then it was enormous Police Presence immediately. I saw a guy down on the street. This morning the officer remains in critical condition. Police say the suspect is also in the hospital with lifethreatening injuries. This morning two rolex robbery suspects are off the treats in the east bay. San Leandro Police have released their booking photos. Police say larry ward and Henry Johnson now face multiple charges. They include robbery and assault with a Deadly Weapon. Police say that they robbed people of rolex watches once in july and again in september. Overnight we looked deeper into the crime trends in san leandro, the latest numbers are from september robbery using a firearm is up 2 compared to this time last year, assault with a Deadly Weapon is up 34 . A total Violent Crime up 7 . This morning questions still linger about what caused last months devastating wine country fires, today three more families are expected to announce lawsuits against pg e claiming their company caused the wildfires. Today in the bays kris sanchez live with what we could learn later today with a planned News Conference. Good morning. Reporter that News Conference is coming up in about five hours, laura. We expect to learn more about those three families joining the fight, what they say is to hold pg e responsible for those north bay wildfires. Now, those three families joined 12 other victims in suing the Utility Company for what their lawyer calls gross negligence in failing to maintain equipment, including downed power lines that sparked, and for allowing vegetation and trees dangerously close to power lines. The nbc bay area Investigative Unit has been following this part of the story for the last month and you can find a timeline of some 20 incidents in the time frame of the fires under the investigative tab on the nbc bay area website. Now, in regard to those north bay wildfires, as you likely know by now, 43 people died in the fires, 6,100 homes burned, 2,000 outbuildings those would be garages and sheds and whatnot, 150 commercial buildings burned as well. All of the fires now 100 contained. A lead attorney for the three families joining that suit against pg e also represents many of the families in the warehouse fire of last september. We expect we will get an update on that legal fight as well. Kris sanchez, today in the bay. Happens today, a San Francisco Supervisor Committee will meet to try to hash out new regulations before marijuana becomes legal statewide at the start of the year. Supervisors are working on a way to regulate sales. They also hope to create a workable permit process and some kind of city sponsored equity program. Bart is trying to get the word out, please stop jamming the doors, otherwise cars and sometimes entire trains are taken out of service and they end up here in one of barts maintenance yards. A bart technician at their concord location showed us yesterday how passengers rushing for the train can force the door off track or dislocate the rubber seal. In august alone bart had to take out around 9300 cars for servi because of impatient commuters. You are in a race to get on that train, you dont want to wait that extra 15 minutes. Totally understandable, but what were hoping is that keep keep in mind if theyre stuck in our door or force a door open that thats going to have a longterm impact that literally is going to impact the time of thousands of people, its going to take one of our cars out of service unnecessarily and create a more crowded environment. The doors on the nextgen trains wont pocket like the existing ones, the doors will be on the outside making them more durable and soundproof. The mothers boy called Police Monday after she says hernany cam secretly caught the suspect striking and even shaking the boy. The video was obtained by our l. A. Sister station, also seems to show the nurse even kicking objects at that boy. Its so sad to see. He needs around the clock care. Santa anna police say the boys mother installed that nanny cam after he started acting out last month. Taking on a pharmaceutical company, chuck norris and his wife are going after several Drug Companies after they say she was poisoned by a chemical used in mri. The norris are going after 11 Drug Companies with a multimillion dollar lawsuit. This is a copy of the lawsuit that was used that was filed yesterday in San Francisco. It alleges that the chemical called gadolinium was injected into gina norris to improve the quality of her mris. She said it left her weak, tired and debilitating bouts of pain. Chuck norris said he had to pay almost 2 million in outofpocket expenses to help his wife recovery. The u. S. Food and Drug Administration says that there are no there is no evidence that the harmless that this is harmful. We reached out to all the Companies Involved and we have heard back from one of those companies in San Francisco and the statement reads, quote, mckesson is aware of the lawsuit and is currently reviewing the complaint. This one calls for the ban of bushing cass in america. There were ads that targeted liberals as well like one that supports black lives matter. The point of these ads was to inflame passions and divide america. In one case a rally to support the man shot by police in minnesota, gland dough castile drew hundreds of supporters and counterprotesters, the whole thing was set up on facebook by russians. Other news, President Trump is expected to name a new fed chair today, we believe it will be jerome powell. He was nominated by president barack obama to the board of governors, though hes a registered republican. The analysts weve talked to say he will probably continue the feds current policies. Assuming he is confirmed we will say goodbye to janet yellen who is well thought of by just about everybody, she is a former berkeley professor. We dont know her plans but, who knows, maybe her husband and she will move back to the bay area. North bay expecting temperatures in the mid 60s today with some breezy winds starting to pick up at about 10 miles per hour. Our jogging forecast in san mateo or anywhere along the peninsula, it will be a chilly start, we will be in the upper 40s by 6 00, as the sun rising you get out there and get the adrenaline going its going to be in the upper 50s as we go throughout the day. Santa clara county supervisors will dilate a new colin in i can to shore up medical services for young people. Leaders have been pushing unsuccessfully for a private inpatient facility. Right now those options are limited for adolescence in Santa Clara County. We will see a nice flow of winds coming in from the north and also a mix of sun and clouds and then here we are tomorrow morning and we start to see the spotty rain moving in and at times there will be some breaks, but some showers off and on between tomorrow and early saturday with a break by saturday afternoon that will also be with us with another round of rain on sunday afternoon into late sunday night. So we may see this off and on not only for the weekend but early next week as well. We will talk more about this coming up in a few minutes but mike says things are on schedule at the bay bridge. The crash cleared 680 for fremont. We could see even more construction in San Francisco with developers pushing for an upgrade to a popular street in the city into today you can get your chance to weigh in. Today in the bays pete suratos joins us live from powell street with the latest on this proposed project. Good morning. Reporter good morning, marcus and laura. Folks will get a chance to look at this powell Streetscape Project later today. I will get to that in a moment. The follow is to make things even more pedestrian friendly along the butty air of powell street between gary and ellis. We have a map we can show you guys showing where this redesign would take place. If all goes as planned it would begin in 2021 but of course still needs to go through an approval process. As far as the redesign goes between gary and ellis it would feature added lighting, wider sidewalks and a flat curb level. This was part of an 18 month Pilot Project to make powell streetcar free. This area is car free that were talking about and that project was made permanent in july. This change to a car free street reduced traffic volumes by 60 reducing the likelihood of auto pedestrian collisions. The idea behind that was to make things more pedestrian friendly and now they want to add on those improvements. Snfca will hold open houses at 12 00 and 6 00 today in the city but there is still an approval process. Their board will have to approve the project in january. Live in San Francisco, pete suratos for today in the bay. Developing in colorado this morning, authorities are still searching for whoever shot and killed three people at a walmart in thornton. About 15 minutes north of denver. Overnight we just got a first listen as some of the audio from dispatchers. We have a shooter inside the store. Were still getting further we have had multiple calls. [ inaudible ] down inside the store. [ inaudible ]. Police have released surveillance images of a person of interest. You can see them right there on your screen. Now, officials also released photos of the car they say the suspect drove away in. It is a red mitsubishi mirage. So far detectives say that they do not think the shooting is terrorism related. As of right now what weve been what weve determined is that its random as of right now because there was no direction or anything like that as the witnesses stated, the person came in and just shot towards the group. Now, witnesses say he simply walked inside the walmart and opened fire. 5 34. Developing right now, police in dublin are investigating reports of a student assault that started with racially charged words. The parents of a 14yearold africanamerican girl at Dublin High School say their daughter heard students using a derogatory term and asked them to stop. Thats when they say a white 14yearold boy punched her in the mouth and gave her a concussion. The incident happened last week. The district would not comment directly on the incident due to privacy concerns, but did speak to us about school policy. We dont tolerate that behavior and we take it seriously and we absolutely go out of our way to make sure that were correcting that behavior in one norm or another. The girls parents say the boy received a threeday suspension but they want him expelled. When they never heard back from the district they went to police skroo the kate steinle murder case continues today. Yesterday a revealing interrogation video of the suspect Jose Garcia Zarate was the focus. He was questioned using a translator. On the tape he offered three different versions of what happened during four hours of questioning. At one point he denied he was on the pier, he then said that he was shooting at a sea lion, he changed his story again saying that he stepped on the gun and it went off accidentally. Here is how the defense attorney explains his clients responses. Ive seen a lot of videotapes of interrogations and its very common that people do not want to started a hitting to things until its proven and demonstrated to them. New this morning, no new Charter School for san jose. Last night the Santa Clara County board of education denied a bid to include a second school. Opponents had concerns about the impact it would have on the districtsness ifs. Continuing coverage now of that breaking news we first brought you yesterday on today in the bay, you might remember this video this morning those repairs are still under way after this fire along the train tracks in san jose. Now, the wooden trestle is part of the tracks that carries Union Pacific trains across the willow creek. It could be days before its fixed. Investigators say a transient started the fire. As we reported yesterday as well this will not appreciably affect the [ inaudible ] traffic and that was the case yesterday and continues for the morning commute. I will talk about the commutes over here. One starts coming out of the altamonte, thats one of the first ones to show slowing, 580 westbound your typical slowing there, the bay bridge toll plaza we do have the metering lights as well. A new clash over the bridge that iks at that you over the napa river causing slowly out of vallejo over the lake highway and a live look we will also show you how things are shaping up across the san jose area. We want to show you northbound 101 with no major problems the volume of traffic its that first burst we often see that will last you about ten minutes. Do you know whats inside as well, the weekend. I can see it just over the horizon. Might be a good one to stay inside cozy. I think at times we will have some rain but there will be opportunities to get outside and it looks like for saturday the afternoon will be the best time because the rain will mostly be during the morning. Its going to be a cool day, though, and mostly cloudy skies, temperatures only in the upper 50s along the coast so not the best beach weekend. We will see another round of rain moving in on sunday with highs staying in the upper 50s as we get a blast of slightly cooler temperatures rolling into the bay area. If youre planning to go ice skating on saturday in San Francisco union square its going to be once again cloudy, our best chance of rain early in the day, but if you head out there early in the afternoon to the evening you should be fine, only some mist and drizzle. Russian river valley at times spotty showers, but there will be breaks and temperatures reaching into the upper 50s for friday and saturday. Monterey its going to only be in the upper 50s and those morning temperatures down to 45 degrees for sunday morning and if you think, hey, i will escape the rain and head to l. A. , you will only be able to do that until sunday where our temperatures will stay in the upper 60s so were going to have some rain and snow in the sierra and there could be quite a bit of snow so bring the tire chains, the winter emergency kit. If you will be going that way and we will only see those temperatures in kirkwood reaching into the upper 20s, some gusty winds and the possibility of up to two feet of snow. So its going to be Pretty Amazing if youre able to get there and maybe stay there for a few days. We will take a look at todays temperature trend for san jose, thats coming up in three minutes. New this morning firefighters investigators an Early Morning fire that destroyed several cars and a trailer in a south bay backyard. Happened a little after 2 00 this morning on loss hermanos court in logan hill. Firefighters tell us there was a lot of debris in the yard. Luckily no one was injured. Also new this morning a California Family is safe three days after pirates attacked their boat in the amazon. These are images right here you are about to see of the hartow family. The mother is from sacramento. The family has actually been living in south america for five years and Authorities Say that the gunman held them hostage after boarding their boat sunday in the amazon river delta. The couple and their two daughters eventually got away and they were found yesterday in Good Condition in brazils northern jungle. And in fire ravaged Sonoma County the cleanup is really just getting under way. Its happening a little later today, the epa will address the efforts to remove hazardous materials, they will show off some of the equipment now being used and the containers that are being brought in to store the hazardous waste. Todays event takes place in windsor. New this morning Santa Cruz Police say there were fewer arrests on halloween this year but the number of citations went up. We look flew some of the numbers overnight. Police arrested 18 people for things like public intoxication, outstanding warrants or other drugrelated offenses. Well, 42 or officers wrote 42 citations in all. Officials say about 9,000 people were downtown for whats known as the largest single informal gathering in that city. Oakland mayor libby schaaf will be giving her state of the city address tonight. Whats different this year, the mayor will be giving her speech at an islamic cultural center. These are pictures the mayor posted on her Facebook Page earlier this year. You can see here at the Islamic Center at lake mare receierritm. She wants to make sure tonights address adds diversity, inclusion and compassion. Tonights speech starts at 6 30. Mayor schaafs address will be met with protests. The city is closing some facilities early because Union Workers plan to strike. The city will be closing all head start centers, parks and rec facilities, after stool programs, Senior Centers and libraries at 2 00 this afternoon. Workers who are protesting say that they have no input in changes of working conditions. Weve seen judges in both the Bowe Bergdahl trial and the travel ban look at what the president said on twitter and in the case of the travel ban it lost in court in part because of trumps tweets. The president initially [ inaudible ] sending Sayfullo Saipov to guantanamo without trial. The white house yesterday said they still consider him an enemy combatant which again would significantly reduce his right to a trial. The president also said he thinks our system of justice right now is a joke. Take a listen. We need quick justice and we need strong justice. Much quicker and much stronger than we have right now because what we have right now is a joke and its a laughing stock. And no wonder so much of this stuff takes place. Now, there are a number of issues with this. Number one, the Justice Department thats a joke is the same Justice Department investigating the trump campaign. When asked about the Comment White House Spokesperson Sarah Huckabee Sanders said the president didnt say american justice was a joke but rather he said people say it is. We will have some much cooler temperatures moving in and we are getting ready for a series of cold fronts to move in to bring in some rain across the bay area. We start out with dry conditions this morning as we take a live look outside in oakland, i think by tomorrow morning we will start to see some light rain moving in and we may have to turn on those windshield wipers. So today make sure theyre working and they are going to be able to clear off that windshield before that rain comes in tomorrow. As we look at the sevenday forecast at the bottom to of the screen you see dry weather today and we may have a couple of mor dry days next week, but its about to start to get pretty soggy here. Our temperatures as you head out the door in the low to mid 40s in some spots, but we will be reaching into the low 60s by later today, upper 60s for the south bay and 69 degrees today in concord while San Francisco and halfmoon bay will be up to 62 degrees. We start out this morning with clear skies and a cool temperature so make sure you grab a nice warm jacket and you will be comfortable wearing pants all day long. No need for the shorts or the flipflops or anything like that, we are back to our fall gear. As you get ready to head out livermore for the school day, walking to school its only going to be up to 47 degrees and then we will start to see the temperatures getting a little bit more mild for today but it wont be all clear and sunny, you will have more clouds in the mix as this storm system approaches from the north. We will start to see a little bit of some rain by tomorrow morning, more of the hit or miss showers and then as we go into the day we will continue on with times of rain. It wont rain the whole day but we will get a more solid line of showers moving in by tomorrow afternoon into the evening, clearing out by saturday morning and then by sunday morning we will start to see another round of showers moving in. So once again it wont rain the whole weekend but there will be some soggy times that we will have to deal with and our rainfall totals may reach in the south bay up to a tenth of an inch, we will be watching out for the possibility of i think in most spots up to a quarter inch of rain. We will not have the really heavy downpours. And we fall back this sunday morning, setting our clocks back one hour. So even though we lose an hour, maybe you will just want to stay in bed a little bit longer and get your rest. What california officials are doing, theyre wishing for a safety review of the oroville dam, theyre reviewing t the goal is to identify needed upgrades after the spillway collapsed earlier this year. Federal, state and private experts will be involved. Officials do say they have finished repairs to make sure that spillway holds through the coming rainy season. The safety review is to be finished by september of 2019. Nurses say there have been a, quote, erosion of care conditions at Kaiser Permanente hospitals. Today in the bay reached out to Kaiser Permanente and received this statement, Kaiser Permanente Northern California and the California Nurses Association began bargaining a new contract in midjuly. The current contract expired on november 1st. Kaiser permanente is bargaining in good faith to reach an agreement that supports our Nonprofit Mission to provide high quality affordable healthcare and serves the interest of our nurses. New this morning it turns out many seriously ill patients and their loved ones do not have living wills. Researchers from the Kaiser Family foundation surveyed nearly 1,000 adults, only a third had their healthcare wishes in priegt. Less than half had designated someone else to make medical decisions for them in case they are not available to do that themselves. The survey also found patients were much more likely to have their treatment wishes honored when they were in that written form.
