This is the second time its happened since summertime. A car hit twog bikes. Unfortunately, a very narrow road. That stretch of road has been the source of controversy for years. This typically is the driest time of year, but aside from the light rain thursday and friday, again, we need a lot more than that to really bring it into this years fire season. Below us here, i saw what looked like the sunrising from the earth. Reporter that sun was the rising flame tearing through neighborhoods down the hill. I rang the bell. We gathered in the church. We prayed a prayer for times of trouble. Reporter so, the brothers prayed and waited. When they could, fled. All the houses had been burned up. Reporter a stones throw away from the buddhist monastery escaped the flames down a treacherous back road. When we left, we werent sure we were going to have a monastery, flames all arnound. Reporter the fire chews through homes killing eight people. For a week, no one knew the two monasteries survived. As neighbors sifted through the ashes of their houses, residents of the two monasteries were allowed to come home. Today, prayers returned, different religions, one message of thanks. Grateful that we had a home to come home to. I was so sad that our neighbors didnt. Reporter flames came within 1,000 feet of the monasteries. Both were untouched. Quiet and still. Federal agents attempted to remove undocumented immigrants with unprecedented resolve. California has gone in the right direction offering opportunities to undocumented residents. Larry joins us. I mean, where do we start . Why is this such an issue . Fundamentally, this is about the struggle for power and government over undocumented immigrants. If you are President Trump, deporting of undocumented immigrants is a key component of his platform. Many view them as criminals, as welfare abusers. Others believe that undocumented takes american jobs. Its a different story, however, in california, where most residents, 2. 3 million undocumented immigrants as hardworking people that contribute to the economy and culture. In a poll, get this, 85 of californians agreed that undocumented immigrants should be allowed to stay in the united states, legally. Now, thats the goal, in a nutshell, between the state of california and the Trump Administration. Wow. Then its not surprising to note that the state Legislature Passed and govern brown signed a bill making california the first sanctuary state in the nation. We are used to sanctuary cities in the bay area. How has that affected the tension . I cant imagine that would go over well in d. C. Doesnt help. Right. No, seriously, for the president , the move really was not to throw gasoline on the fire. He maintains that only the federal government is authorized to handle immigration matters and sanctuary states and cities obstruct that. California, a sanctuary state is a much needed additional layer of political and physical protection for undocumented immigrants. Okay. So, explain how that sanctuary state law works in california, then. Its a good question. Look, the concept of a sanctuary stems from the european idea that government would welcome refugees. Refugees and others seeking safety from unjust persecution. The california version touches on that model. The new law will largely keep state and local Law Enforcement agencies from sharing information about undocumented immigration agents, unless those individuals have been convicted of the one or more of 800 listed state crimes. Federal agents will be able to question Illegal Immigrants held in county jail. Only to gather personal immigration information. The idea here, then, is really to protect immigrants living in california illegally from federal that includes innocent people who may be convicted of serious crime. Thats where it stems. Still a little bit confusing because the president and attorney general, Jeff Sessions argue that californias new sanctuary state status violates federal law. So, is that the case or, you know, who has it . Theres a reason for the confusion. As a general rule, you are dead on. The management of immigration policy lies with the federal government. As a general rule, the federal government can punish states and localities for breaking federal law. For example, in 1984, when Congress Passed a law establishing 21 for alcohol consumption, state that is failed to comply didnt get highway money. How far the government can go in harnessing sanctuary cities may be another matter. About a month ago after chicago declared themselves a sanctuary city, Jeff Sessions got to work to slash federal funds as punishment for the action. The city sued and a judge blocked sessions as unconstitutional. Thats why some of the confusion. Very interesting. I know you dont have a crystal ball here, but which side is likely to prevail . Will california be able to keep the sanctuary status without suffering punishment . Yeah, thats the question awaiting an answer we dont have right now. Lets be clear, there is no federal law preventing states and cities from creating sanctuary states and cities. Then, again, the federal government is constitutionaly responsible to protect the rights of people to equal treatment under the law. Both are long standing american values. The question is which one is more important than the other . And the likelihood is we wont know for sure until the question is settled by the u. S. Supreme court. So many sticky questions these dais.
