Sheriffs office. They tell us this morning that yesterday they did arrest main who they believed looted one of the homes evacuated up there within the fire lines. Cal fire tells us another firefighter has been injured. In spite of that, they are making progress and containing this wildfire. Who was killed monday in napa when his water tender went off the side of the road. Here in the Santa Cruz Mountains, no fatalityings, thankfully, but a sixth firefighter hurt over the night. The fire did not spread last night. Its still at 270 acres. Containment has bumped up from 5 to 10 . A fresh crop of firefighters have moved on to the front lines. Theyre moving to the front lines to relieve the men and women who have been out here no over 24 hours. Cal fire expects to make significant progress today with the fresh legs out there on the lines and another wave of air attacks expected sometime this morning. They do not expect the fire to go beyond deer creek and bear canyon. We want the surrounding community to know that this fire is really burning in the area that it was projected to be burning in. We are we havent had unexpected fire grows to threaten other communities. The folks who are really concerned about, you know, what theyre seeing from the fires up north is not is not anything that we expect to happen down here. Reporter now, when we spoke with Santa Cruz County Sheriffs Office about that looting arrest, they tell us they are helping to investigate the cause of the bear fire. They cant tell yet if it started with a structure and spread to the wildlands or the other way around. We know the fire has destroyed four structures and forced the evacuation of 150 homes. Rain clearly, we need it bad here in the bay area. Soon our wishes will be answered. Meteorologist kari hall has been tracking the welcoming changes. Kari. Right. Dont expect a whole lot of rain here. We are just going to have that chance and some spotty showers moving in by tomorrow evening, but weve been all choked out by this very unhealthy air quality. Its. So smokey. As we go through the day, that continues. For the south bay looking at unhealthy air quality all the way up towards the north bay. Smoke as weve had some light and variable winds. Here is our system that will be moving in for tomorrow. One more day of completely dry weather, by tomorrow evening well start to see that rain move in to the north bay. As it does so, were going to see some of the heavier showers there by late tomorrow night and starting to work its way into San Francisco and the east bay. Look at the timeframe, 19 00 p. For tomorrow morning. Tomorrow, raining lightly across parts of the bay area. Lead us into a wet friday morning commute before we have some dryer conditions for the weekend. Well continue to track that rain. Well talk about how much we could see once the system moves in. Thats coming up. The latest on the north bay wildfires where the death toll rose again and now it is at 42 confirmed deaths. There is some good news on that fire fight. Officials telling us they should have nearly all the fires in the north bay except the atlas fire fully contained by friday. 213,000 acres have already burned. Wow. Nearly 5700 homes and businesses were destroyed. 97 of pg e customers have their power back, and cal fire did allow 6,000 families back home yesterday as well. Officials expect all gas service to be restored today, too. Plenty of Unanswered Questions as far adds the cause of the north bay wildfires at this point, but a family that lost is all during the wildfires is now filing suit against the party they feel is responsible. Nbc bay area pete suratos joins us live from santa rosa. And, pete, i know you spoke with the familys lawyer. What are you learning this morning . Reporter good morning to you, marcus and kris. Yes, i did speak to the familys lawyer, and he told me that he filed the lawsuit yesterday and he didnt mince any words. Hes placing the blame of the devastation weve seen here from the north bay wildfires, hes placing the blame on pg e. Its important to point out, guys, the cause of this fire is still under investigation. There a ways away from determining the final cause. As far as this lawsuit goes, hes representing two clients in santa rosa. They lived in that coffey park area. Their names are wayne and jennifer. Theyve lived in santa rosa for more than 30 years. Their house is completely gone, burned to the ground as a result of these wildfires. Their attorney alleges in the lawsuit that pg e broke state and federal regulations by having nojt of a highfire danger in that area, but did nothing to prevent its equipment from igniting the dry grass. This comes just days after pg e released the statement theyve officially notified california regulators of eight separate Electrical Equipment failures. Declined to say what caused those failures, but going to assist with a review of wildfires with the appropriate agencies. As far as why he is representing this family and while theyre filing this lawsuit so soon. We feel its important to get this litigation moving because there is going to be a lot of procedural matters that need to be taken up before we can start really getting into discovery. So we felt its important to get the litigation going. Reporter now, downed power lines are being investigated by cal fire as the cause as at least one of these north bay fires. But the lawyer did tell me in our phone conversation that more than a dozen families have already contacted them as far as representation when it comes to this investigation, but hes going to be joined by that family that i mentioned that filed this lawsuit. Senators Dianne Feinstein and Kamala Harris are raising concerns about the federal Emergency Warning System in light of californias deadly wildfires. Arguing that the current wireless Emergency Alert system is inadequate when it comes to targeting specific locationings. Sonoma county leaders have told nbc bay area that they did not send an alert blast in the early moments of the tubbs fire because the coverage was too wide and they did not want to create mass panic among people who did not need to evacuate. Police in san jose are investigating a stabbing death that happened outside of a school. We brought you this story as breaking news on today in the bay. Right to the rear of caroline Davis Intermediate School in the 300 block. Police were not saying much this morning. People in two homes did agree to talk to us. One on camera and were learning from them that this may have started as a fight. And nbc bay area photographer was also on the scene early this morning, even before fire crews, saying cpr was being administered immediately. Pd confirmed it was a homicide investigation. Police told us the victim who they have not identified was pronounced dead at a nearby hospital. Now, detectives focus their attention this morning on three cars parked across the back of the school here. Right across the street from a community center. The crime scene, however, was broken down when parents alived with their children for classes this morning so they did not have to get interrupted by this. Neighbors said they didnt hear anything unusual outside, but detectives at about 2 00 this morning told them it started as a fight that broke out between two men. I wasnt able to see anything. I asked what was going on and they said there was a fight that broke out close by and one guy didnt make it out. Reporter san jose pd had this blue subaru toed away from the scene just after 7 00 this morning. Nbc bay area ran a check on the registration and the last previous owners told us they sold it just a couple of weeks ago. A Police Spokesman has not responded to our request for interview so were not able to learn how that fight started. They also have not released the name of any possible suspect. We also ran a check to see how many homicides happened this year. This is the 28th homicide so far this year in san jose. That compares to 37 at this time last year. As johnsons body was arriving back in florida on tuesday, democratic congresswoman says his widow received a call from President Trump. In that call, wilson says the president made inappropriate comments about johnsons military commitment and service. Basically, he was saying that he was sorry what had happened, but hoping even though there husband gave his life for this country sarcasm she said sarcastically he said, but you know he must have known what he signed up for. The new laws were set to go into effect at midnight. This version restricts visitors from several countries, including iran, north korea and venezuela. Reporter this Hotel Manager brought his family in from canada for a week of vineyard visits. Bad times. We had to evacuate to the city. We spent three days there. Reporter she has asthma and has spent most of theivation indoors. I want to see this beautiful city. But its tough. It is tough. Reporter while improvement in the weather is expected soon, there is added concern over the toxicity of the burn, particularly in the scorched earth where homes once stood. Our goals and objectives in recovery now currently is helping to get the debris cleaned up and moved out. And the air quality is moderate for most of the bay area. Still unhealthy for sensitive groups in the north bay and in santa cruz as well. Kari, waiting for the winds to blow it out a little. If you do have breathing problems, you should really limit your time outside and wear a mask. Weve been telling you over and over again, if you feel any symptoms whatsoever, do not be afraid to seek some medical attention. We do have some very unhealthy air quality here. At times you cant even see the hills. As we take a live look outside in san rafael, not so bad right now in that spot, but earlier this morning in San Francisco, it was really bad, especially with that fog rolling in. It trapped a lot of that smoke close to the surface as well. Getting a little bit better here, but as our temperatures are still quite cool we will have some of that smoke settling into the valleys. 56 degrees in San Francisco. 55 in oakland and now 61 degrees in san jose. So looking at how much cooler now it is compared to yesterday, these numbers are very nice. Up to 17 degrees cooler now in santa rosa than it was yesterday at this time, and most of the bay area is at least 10 degrees cooler so were making some progress here. Its all thanks to the shift in the wind now bringing in more of an onshore flow and a lot more humidity this morning. Our high temperatures today, also lower than yesterday, reaching 74 degrees in milpitas. Expect high and low 80s for the Interior Valley and east bay and and oakland up to 70 degrees, 70 in redwood city. And the Marina District seeing a high of 65 while mill valley can expect a high of 75 degrees. Then we talked about the incoming rain that were expecting for late tomorrow evening, still up around portland right now, but bringing some pretty decent amounts of rainfall there. It does get wider as it moves farther to the south. Once it hits the mountains farther to the north of us, we expect that rain to continue to weaken. Here is a look at the timeline. At 6 00, we start to see some showers moving into the north bay tomorrow evening and then as we go into late tomorrow night into early friday morning, that rain push noose the south and the ea. Sunrise on friday and our wind shift from the north, bringing in cooler temperatures. Some of the models showing the possibility of getting about a tenth for a 1 4 inch of rain. Looks pretty good. In San Francisco, cooler temperatures staying with us through the next several days, 60s in the forecast and warming up next week. When jesus campos arrived to the 32nd floor of the mandalay bay hotel, he was thinking those gunshots he was hearing were drilling sounds. He was struck by a bullet shortly after. Thats when a building engineer arrived on the floor, campos quickly made him take cover, saving his life. Here is part of that interview on ellen. There was a female that came out and i told her to go back inside, it wasnt safe. Yes, cal fire tells us that the fire activity on the lines was much calmer last night. Today, they expect to make significant progress in containing and putting out these fires that are burning in the deer creek and bear canyon parts of the Santa Cruz Mountains. As you can see, theyve got fresh legs heading out to those lines. Another wave of air attacks expected this morning and the relatively decent weather. This morning at 7 00 briefing for firefighters, cal fire announced the bear fire is still at 270 acres. Containment now at 10 . A division chief tells us a sixth firefighter was hurt last night. In the hospital being treated for Second Degree burn for their hands. Expected to be okay in the long term. Cal fire has called for more air attacks this morning, that will include choppers and tankers. They dont expect the fire to spread outside deer creek and bear canyon. 150 homes remain evacuated. Four structures destroyed. A woman who lives around here told us this morning she spoke with a man who lost his house monday night. He was saying to me he was in santa rosa and youre in napa, two days later lost everything, and then he lost everything. Now, this morning when we were in boulder creek, a town nearby, the Santa Cruz County Sheriffs Office told me they have arrested a man they believe looted one of the homes evacuated in their area. The weather always a huge factor in fighting the wildfires and there is good news on the horizon. The rain is back in the forecast. Lets go to meteorologist kari hall. We are so looking forward to that rain. And even the cooler temperatures that are here out in advance of that system. As we look at the temperature trend around the bear fire area and the Santa Cruz Mountains for the rest of the day, in the upper 60s for this afternoon and the wind speeds very light, coming in from the northwest and more westerly for the afternoon. And then here is the system that is going to bring us the rain. Still well to the north of us, but making some progress here. It will be in the bay area late tomorrow evening into early friday morning. With that, we will have a pretty good chance of rain, especially in the north bay as we are still trying to get some containment on those wildfires in napa and sonoma counties. Start to see the rain moving in in time for the evening commute and continuing into early friday morning. But as it moves into the south bay and east bay, a lot of that rain will be lightening up. We are not expecting as much here as we will see in the north bay, still a lot of moisture and some improvement in our weather as we fight these wildfires. Well talk more about that coming up in just a few minutes. Thank you, kari. One person was injured after a shooting on 580 in the east bay. Happened just after 9 00 in castro valley. A 21yearold man tells chp a black sedan pulled up beside him and started shooting. He did go to the hospital, but he has been released. The police have not located the suspect and the case is under investigation. The shooting shut the freeway down for several hours overnight. Happening now, a search is on for a man wanted for murder in san jose. It happened nearly a year ago tuesday. 31yearold Joseph Miller as the possible killer of alfred perez. 51yearold perez died after a brutal beating. At the time, police say they didnt know what led up to that killing. Now police say it may have started with a fight that turned deadly. Quick thinking and fleetness of foot may have saved two San Francisco 49ers from being robbed early monday. After the game in d. C. On sond. Ray Ray Armstrong and ruben foster were reportedly at a San Francisco nightclub in union square. The players allegedly got bat vibes from a car driving nearby so they handed their jewelry off to friends and had a Security Guard escort them out. Thats when they say the men in that car approached them with guns drawn. The two ran off and got away unarmed harmed. The 49ers say we are aware of the reports regarding the robbery and thankful no one was harmed. Ruben and ray ray have been and will continue to be cooperative with any police investigation. Now to north korea. As tensions ratchet up on the korean peninsula, former president ial candidate Hillary Clinton commented on the trump administrations diplomatic efforts on chinas role in the crisis. Reporter as the former secretary of state, Hillary Clintons words are going to be listened to very carefully anywhere in the world, but especially here in seoul, south korea, and thats as tensions have really ratcheted up in just the past couple of months between the United States and between kim jongun and the north koreans. With the fate of millions resting on a diplomatic resolution to the crisis with north korea, it should go without saying that cavalier threats to start a war are dangerous and shortsighted. They cant continue to, you know, do less than they could to tighten economic pressures on north korea. And at the same Time Discount the real threat that south korea faces and the lives of south koreans. And she said that if the United States were to back down off of this 2015 deal, that the United States would then be facing Nuclear Threats from two countries, from the north koreans and the irans. New at 11 00, olympic Gold Medalist Mccullough Maloney said she was sexually abused by former olympics doctor larry nassar. Began when she was just 13 years old and lasted several years. Nassar, a longtime doctor for usa gymnastics has been accused of assaulting at least 140 girls and women. Nearly all say the abuse happened during medical appointments. Authorities are investigating a heartless crime, targeting a napa victim who nearly lost his home in the fire. Sunday night, thieves targeted a Tattoo Parlor in heyward. Surveillance cameras show the three men breaking in. Sims lives in napa. Last week he was ordered to evacuate, but instead he stayed and had his wife take his treasurures star wars figures to his heyward store. Thats also where the business collected 12,000 for north bay fire victims. Now the money and most of the star wars figures are gone. Its tough. I thought i was doing the right thing, and to wake up monday morning i still havent seen my family. I still havent even you know, and i get robbed, you know . Its heartbreaking. Tim says that he posted fire and fundraising updates on social media and now he wonders if that drew too much attention. Alameda county sheriffs deputies are now investigating. Well, in mendocino county, 8,000 evacuated residents are finally being allowed to go back home. But many are returning to ashes and a long road to recovery. Nbc bay areas joe rosato jr.
