At issue is the fate of the five frozen embryos made by finley and lee back in 2010. Three years later, the couple split. Finleys attorney went first, and he called lees cancer a red herring, she doesnt have cancer any more, its a separate issue. Focusing on the consent waiver signed before freezing those embryos. On page eight of that form, you can see language that if a couple divorces, the embryos can be discarded. Finleys Attorney Says this was both of their intentions that day that this was an agreement not just with ucsf, but between the two of them, he counted the words we, us, our showing up some 160 times. In the meantime, lees attorney has countered that the support is not a legally binding contract with lee testifying as a doctor herself in her experience the form is an advanced medical directive, hospitals sometime ignore these forms and you can change your mind. Weve been tracking the fire conditions across the bay area, with the rocky fire continuing. The good news is the wind forecast brings it down to about 15 as we head toward thursday. But the temperatures will be going up, and we still have a lot of clouds rolling in throughout the day. Just moment before the caltrain sped through. Timing everything and it was life saving timing. It was dramatic and it unfolded at the intersection of mary and west evelyn streets in sunnyvale. Nbc bay areas cheryl hurd talked with one of the deputies. The caltrain versus car collision was caught on tape, and quickly posted to youtube. A zwriver was on the tracks stopped illegally. When the train came through the intersection and struck the vehicle. The car was unoccupied. But if these two deputies were not at the right place at the right time, the driver may not be alive. Theyre conducting enforcement in the area while doing so, they heard a collision. He appeared to be under the influence. Thats yet to be confirmed. The deputies knew a train was coming. One of the deputies ran down the tracks and tried to stop the train. The other pulled the driver out of the car to safety. The deputies gave the train certain signals that we have. The deputies that work for the Police Bureau received specialized training. They did not hesitate they acted. Had they not acted who knows what would have happened. A jeep comes careening out of the car wash. A jeep shot across several lanes of traffic before it came to a stop in marin county. Terry mcsweeney has details about this crash. Glass on the ground, part of a bus stop shelter is missing, 150 feet of noubarier separating northbound from southbound 101, all because a 1999 Jeep Grand Cherokee like this one roared out of the car wash saturday with an employee inside. At some point the accelerator on the vehicle became stuck, despite the vehicle being in neutral. And the vehicle accelerated out of the car wash. Look at how far away that system is, when you think about how long it takes to get to hawaii, in an airplane like four hours and youre going like 500 miles an hour, this gives you an idea of just how far away that tropical system is, and its affecting our weather this afternoon into the next couple days, it looks like this stays as a Tropical Storm, moves just to the north of hawaii, will not have a direct impact on the islands and it weakens over the next couple days. Meanwhile, here we have mostly cloudy skies throughout the day, and then some clearing as we go into tonight. The next couple days, it really doesnt have much of an impact there, because our temperatures start to warm up as we get more clear skies, but then there will be another system moving in, that could give us a slight chance of lightning heading into thursday. Friday rather. Between now and thursday, our temperatures will be warming up. Today in the south bay it tops out at 80 degrees. Up to 87 degrees on thursday, the peninsula will go from 76 degrees to 83 degrees on thursday, San Francisco not much of a huge change there but the upper 60s and into the lower 70s by thursday. 86 degrees in the north bay, 77 degrees in the trivalley will be in the lower 90s, if youre starting to make those plans to get outside already this weekend. It will be really warming up as we head toward the end of the weekend.
