The fbi and Sheriffs Office had been called in for specialized search and rescue help. Meantime police say it is possible, but doubtful, that there will be any other arrests made in what is now a homicide case and we are expecting an update later this morning from santa cruz police. Reporter its hard obl that the fate of no he is two families, that of the officer and that of the convicted killer now dependent upon the plans of just two people, but two of those jurors who delivered a conviction told the judge they have to get back to their lives. The family of val low Police Officer jim capoot has been waiting for closure ever since he was shot following a bank robbery. That was in 2011. The family of the though convicted killer henry smith has maintained that the wrong man went to trial in the first place, but today the judge has to declare a mistrial or convince those two jurors to put their lives on hold just a bit longer. The trial itself lasted a month. The penalty phase expected to take several is for weeks along with weeks of preparation, but one juror reminded the judge of a move out of state coming up next week, another told the judge of a planned vacation. Ordinarily that would just mean bringing this an alternate juror who had sat through the rest of the trial, but there are no alternate jurors left. They have all been seated or released. What happens if there is a mistrial . The judge can seat an entirely new jury for just the penalty phase but legal experts tell us that that is relatively unheard and that cr an appeal so the families could see this this whole thing start all the way from scratch. Police say they pulled someone over for a drug bu. That person this a dog who reportedly charged at the officers. They then shot the dog in the ear. It survived. The good thing was after he charged and our officers discharged the firearm the owner was able to regain possession of his dog and calm the situation shoo now, the dog did not bite the officers. Its now being treated by animal control. A follow up this morning on a devastating string of teen suicides on cal train tracks. Cal train is joining the city of palo alto to replace four miles of fencing on those tracks with new taller fences. Thats what they decided in that Community Meeting that you just saw video of. They are also testing heat seeking cameras which would alert officials when someone is on the tracks. An Early Warning would give responders time to stop a train or get someone out of harms way. This happened back in january on a highway 101 bypass project in willits. Three workers were injured after a 150 foot section gave way. Cal osha says caltrans and two contractors committed serious worker safety violations. All are being ordered to pay 165,000 fine. Around 3 00 yesterday afternoon a man asked to test drive a van at a dealership in concord. He and a salesman drove around for a bit and then the suspect asked if they could drive to his home in pittsburg to show his family. The suspect eventually crashed and was taken into custody. Even if he had gotten away reportedly left a copy of his drivers license at the dealership before that test drive.
