But first a late night shootout at a hotel in south san jose injured two San Jose Police officers and the man who fired at them. Abc seven news south bay reporter Dustin Dorsey has more on what the early investigation revealed about the suspect. But first, dustin, how are the officers doing . Larry and kristen, we are happy to report that both officers are in stable condition after being involved in a shooting that involved a man with two felony warrants out for his arrest, 1 or 1 officer spent the day in the hospital with life threatening injuries. But the entire city is thankful that both are expected to survive. Our officers families got the call they always dreaded and prayed. Would never come, and we got a reminder of the courage it takes to put on the badge every day. Knowing you would give your life to protect the city you love. Some relief knowing two officers will survive after what was a dangerous night in south san jose. Acting chief paul joseph says sapd responded to this extended Stay America Hotel at 1030 thursday night. A woman called 911 to report a man with a Domestic Violence restraining order was trying to get in the room. Police say 33 year old san jose resident Kevin Briones had a warrant out for his arrest for possessing a firearm while on probation. They say he was recorded on an officers body cam walking away from the womans room on the third floor. He was carrying a duffel bag. In less than one minute after officers first contacted the suspect, he retrieved a stolen handgun from the duffel bag and fired at the officers. The suspect fled, running away from the officers while continuing to shoot multiple rounds at them. At least one officer returned fire and struck the suspect. Both officers were hit during the gunfire. One suffered minor injuries. The other officer suffered life threatening injuries but is expected to survive. You could go to this call a thousand times and nothing ever goes wrong. And the thousand and first time is this one. And unfortunately for this officer, with less than one year, just about one year of experience, that horrible day was last night. Police say briones jumped out of a third floor window to escape after being shot by officers, but he was quickly arrested. Inside that room, he was trying to get into a mother and her three children, chief joseph is thankful they and the officers all survived the night. I cant imagine what his motives would have been other than to do them some serious harm. And its just fortunate that our officers arrived in time to intervene. And they took that harm. The harm was to them and not to this Domestic Violence survivor in those children. And those two officers are two of the five that have been shot in the line of duty for San Jose Police in the last 15 months, san jose mayor matt mehan says more needs to be done to keep these repeated offenders from committing crimes and get guns off the streets to support officers and keep our entire community safe. New ruling from the California Supreme Court could have a big impact on how police do their jobs, Community Groups say its an important step to prevent overpolicing, but some Police Unions say its going to make it harder for police to do their jobs. Abc seven News Reporter anser hassan with more a new ruling by the California Supreme Court may change how Police Interact with the public. I think its a very important decision. Sujin kim is a managing attorney at the San Francisco public defenders office. She says with this ruling, the Supreme Court of californias finally recognizing instances of overpolicing, especially in communities of color for, you know, innocent behavior, just being in the a certain neighborhood, and characterized as, criminal, the court finding it, acknowledged that fact on thursday, the court ruled to restrict grounds under which police can stop and hold people for questioning. It stems from the case. The people versus marlon flores. The only thing he did was he was standing by a car at night, you know, in an area that the police deemed to be high crime area and would not was seeming to avoid Police Interaction. The court ruled that police cant detain someone on the street just because that person tries to avoid contact with them. In her opinion, associate Justice Carol corrigan writes, before an officer can compel compliance with the show of authority, articulable facts must support a reasonable suspicion of criminal activity in the absence of such facts, the person is constitutionally protected and empowered to go on his or her way. In an email to abc seven news, tracy mccray, president of the San Francisco Police Officers association, writes, this is another example of californias criminal Justice System working to protect criminals. She writes, observing the actions of those we encounter is a critical part of police work and has never been grounds alone for an arrest. Obviously, Police Officers do have a lot of discretion on the streets. They still do have a lot of leeway. Theres a lot of ways that you can interpret reasonable suspicion. Doctor Francis Ramos is with Communities United for restorative youth justice or courage. Shes encouraged by the Supreme Courts ruling, especially because, as she points out, a routine police stop can quickly escalate into a pat down or detention. We are going up against somebody who is armed and who we have seen has the full support of the state behind them in terms of treating the average person, however, they think they should be treated in the east bay. Anser hassan abc seven news. Its been two weeks since College Campus protests against the war in gaza began. The first demonstration started at columbia university. The encampments quickly spread across the country to other schools, and this week, there was violence at some of those protests, including the one at ucla. More than 2100 people so far have been arrested. This is since april the 18th, with 250 arrested just yesterday. Abc News Reporter and wynn with the latest overnight a clash between police and protesters at Portland State university, with the building now forced, will be used against you. Authorities clearing out the psu library for a second time. Police say at least 30 people arrested. This comes as disturbing video from ole miss shows a crowd of students taunting one protester. Law enforcement appearing to urge her to walk back towards the barricades. For other protesters were not arresting kids. Instead. In new york city, authorities clearing out encampments at nyu, at least 13 people arrested. And just down the road, the nypd also arresting 43 people at the new school. A good operation. No one got hurt. President biden speaking out, urging for peaceful protest. Theres the right to protest, but not the right to cause chaos. Sources say the white house is working to improve Campus Safety by providing Additional Resources to Law Enforcement to protect jewish communities, and by cracking down on antisemitic acts across College Campuses and when abc news, washington. And now you have more protests that are being planned as graduation ceremonies start to get underway. Yeah. Here in the bay area, weve been monitoring encampments at uc berkeley, stanford, San Francisco state and sonoma state. Abc seven News Reporter tim johns is here with the very latest. Tim. Yeah. Now, in contrast to some of the scenes weve witnessed on campuses in places like new york and los angeles, the encampments here in the bay area have been comparatively quiet and respectful, and University Administrators tell me they dont think these encampments will have an impact on commencement ceremonies. The tents are still up at university encampments around the bay area, from San Francisco state over to uc berkeley and stanford up to sonoma state. Students steadfast in their protests of the israelhamas war and calling on their schools to act. This right now is really a moment in history, truly, i believe, at sonoma state university, the encampment is now entering its second week. Students there making demands similar to other universities, including things like having their school divest from companies that do business with israel right now, were just listening. We want to hear clearly what they are and then think through how we can be responsive as a campus to that. In contrast to scenes at other universities around the nation, encampments here in the bay area have remained largely peaceful. At uc berkeley, protesters tell us they believe most of the encampments around the country are the same. They think its the varying responses by universities that have caused the different outcomes the university has uh to uphold this. Kind of idea that they uphold, like free speech values. Uc berkeley is known for its free speech values, quote unquote. Earlier in the week, representatives from the American Civil Liberties union visited the protest area at berkeley. The organization saying they wanted to inform the students what rights they have while protesting and what would be illegal. The First Amendment and california constitutional protections for free speech are incredibly powerful, but they are not absolute. With things remaining relatively quiet, both sonoma state and uc berkeley say they plan on having graduation ceremonies as normal, even though they tell us they are prepared for all scenarios. Uc berkeley has long experience with protests, activity at graduation ceremonies over the years. Theres always some sort of protest, so we are prepared for this year. We know that there is a good chance that will happen now. A spokesperson for uc berkeley also told me that the university has created a new buddy system in recent days. The idea behind it is that any person who feels uncomfortable crossing the campus can have a partner walk with them to wherever their destination may be. A Study Released just today shows gas stoves increase nitrogen dioxide exposure. So much so that it may exceed World Health Organization safety limits. Researchers looked at 100 homes across the u. S. Including several in San Francisco. They hooked up equipment that monitored the air that showed nitrogen dioxide, not only lingers in the air for several hours, but also spreads from kitchens to other rooms. Exposure can lead to a variety of health problems. As a stanford doctor explained during a virtual meeting, this chemical in and of itself can cause spasms in the lungs. It can lead to wheezing and then lead to protracted wheezing. And asthma can also make any respiratory disease like emphysema or asthma or infections in your lungs much worse. Children are particularly vulnerable to nitrogen dioxide exposure. The chemical has been linked to 50,000 cases of pediatric asthma, according to that study. San Francisco Mayor london breed has an idea to build a better bay area. She wants to create californias First Entertainment zone to help revitalize downtown. Not unheard of to see rain here in the bay area in may as a matter of fact, we get about a half an inch to an inch on average tomorrow. M, getting up to about 3031 miles an hour. 10 a. M. Still pretty gusty out of the south southwest. And then as we head into the afternoon, the winds will remain on the gusty side going into the evening over 30 mile an hour winds. Calistoga there 34. So definitely will be accompanied by the wind which will make it feel colder anyways. And then here comes the rain saturday at 5 a. M. In the north bay. It is spreading by 8 a. M, most of the bay areas getting wet. 10 00 in the morning we will see those downpours and as we head towards 1 p. M, your scattered showers in the north bay. But look at this pretty steady rain. East bay down towards the santa cruz mountains. The scattered showers continue into the afternoon and the evening hours, but youll see plenty of sun for the afternoon evening behind that system. Her mothers family boat refugees from vietnam used the stars to navigate to safer shores, and now the immigrants daughter is about to launch into an even vaster, unknown space. It has always been my dream to be an astronaut. We met up with amanda at the Liberty Science Center in jersey city, new jersey, a fitting backdrop for the 32 year old getting ready to make history as the first woman of vietnamese descent to go into space. Being the first vietnamese woman is to let every young vietnamese girl know that we belong. Its a dream that almost didnt come true. I, during my last semester at harvard, was raped. But juju, the worst thing that happened to me wasnt being raped. It was being betrayed by americas criminal Justice System.
