The race is too close to call but President Trump is falsely claiming victory and blasting the election as a fraud and joe biden is currently leading in popular and electoral votes as we await results from pennsylvania and michigan and wisconsins results. President trump wants them to stop counting. The Biden Campaign fired back accusing the president of trying to strip americans of their voice. Abcs faith abubey has the latest. Reporter overnight former Vice President joe biden in wilmington, delaware, energizing a car rally of supporters. We believe were on track to win this election. Reporter biden so far performing as expected as the vote counts roll in across the country. It aint over until every vote is counted. Every ballot is counted. Were feeling good. Reporter the former Vice President boosted by wins in Traditional Democratic strongholes and the pacific west coast taking california, oregon and washington and in a surprise outcome, biden now leading in arizona. Well, i think we would have liked to see an earlier evening, certainly would like to have some answers now but at the end of the day, the day started off with bidens campaign saying we got to keep the blue wall, keep that in mind as we go throughout the day. I would have liked to see some of the senate races turn, quite a few surprises in terms of trump bringing out new voters to really match what bidens team did in early vote and really the energy we saw out there. A lot of news out there, a lot of data well look through but not where we hoped to be but more to see in the election. It means that our country has more healing to do, mona. There is more reconciliation, i believe that people are waking up to it this morning. One you see the vote of wanting this newness, get control of covid19 and another part you see less regulations but two americas as well. Thats when the fights really start is that, you know, getting a recount typically isnt that hard. The question becomes how long does it take, when does it stop, et cetera and that is exactly as you point out what happened in florida. The question there became how much recounting do you do . Because there was an automatic recount in florida back in 2000. But then there became questions about particular votes, undercounting votes, overcounting votes, those became the questions in florida so it almost became like a round two of the recount and i think thats what the risk is here from the legal perspective is you get to that point as well. Terry, i want to bring you in. The clock starts ticking, it is ticking right now, the Electoral College is slated to meet i think on december 14th and that means the states have to be prepared to send their elector, usually called that safe harbor, the week before and could start bumping up against that with legal challenges. Theres been talk since bush versus gore that that structure which was from a 19th century federal law is just too short for the recounting youd have to do in the states that were talking about in a country this size especially if we do several of them but that december 8th date is that safe harbor date. The governors of states have to certify a slate of electors to congress and congress if theyre in by that deadline must accept those electors as legitimate. They might have some wiggle room but basically thats what the law says. The Supreme Court used that date in 2000 to stop the counting of votes in florida. Can you go past that deadline and it Means Congress will decide whether or not the slate of electors you send is good or not. So tick, tick, tick, the clock is ticking. I think as a legal matter, it also becomes important who is ahead at the end of the recount which i think is a very important point to make sheer. You can argue that, you know, well, wait a sec. There may be additional votes to count, et cetera, but from a per spepgs point of view when but to court you dont want to be the one who is fighting to try to catch up. You want to be the one who is starting from the point where youre ahead so you can constantly be fighting against additional recounts and so where we land at the end of whatever the first recount is in terms of the numbers will become very important even if its razor thin close. And it is razor thin close right now, jon karl, i guess thats appropriate to the year 2020. Its unbelievable. Its totally appropriate to the year 2020. Here we are at the end of this Election Night looking at a race that is as close as it can possibly be coming down to possibly recounts in multiple states and in the case of pennsylvania and michigan, we may be several days out from knowing any kind of a decision. My home state of pennsylvania as predicted seem to be the linchpin so the keystone state, i guess, all eyes are on it. My thoughts are that im really proud of americans for the most part on how we got through yesterday and of my Law Enforcement brethren in the Homeland Security field, we saw some physical skirmish, very unfortunate did you didnt see any shootings. Doesnt seem like anything too far out of hand so at least yesterday and last night we had a pretty smooth experience. But i now see that theres planned protests and any time that happens theyre good but they also provide an opportunity for escalation so hoping to watch for it today and the following week as all these close Election Results come in that we dont have any kind of violence. Well, thats an understandable instinct in some ways but in another way its the absolute wrong recipe because it can throw a little bit or a lot of gasoline onto some tense fires, so to speak met toaphorically i states like pennsylvania, philadelphia and in portland in places that might not be elector rally important well see disgruntled protests so i hope he keeps the rhetoric in check and allow the lawyers and Campaign Experts to handle some of that while he gives a message of calm because this is not going to be decided, you know, any time soon. And, tom, i want to ask you since youre coming from a Homeland Security perspective and background when it comes to the concerns leading up to the election and russian interference and outside foreign interference into the election it seems like the systems really held up here . Well, you know, weve got a really dispersed or decentralized system which can make for a nightmare in some instances but it makes for a really resilient system in this instance and so, you know, for a foreign nation to throw us off by actually changing the vote count would have been very difficult, if not obvious, obvious ploy we would have seen and recognized so looks like we got through some of the cyberconcerns here, not because we did nothing, a lot of people working hard behind the scenes from cybercommand through dhs and all the state and local levels, youre right, though, it seems like we had a burst pipe in georgia that caused more problems than internet exploitations so happy to see that.
