Senate Majority Leader Mitch Mcconnell said the trial is expected to get under way by next tuesday. He made it clear the president s suggestion of dismissing the charges outright is highly unlikely. Classes today are canceled. The chief prosecutor in st. Louis is suing her own city, its police union, and others alleging a racist conspiracy thats meant to push her out of office. Police say shes just not good at her job. Abcs Steve Osunsami has the details. Reporter there is the woman in the center of the storm, kimberly gardner, st. Louis first black prosecuting attorney. In a bombshell lawsuit she accuses the city and police union of a racist conspiracy aimed at stopping her from doing her job. The suit is so important because the people of the city of st. Louis who represented me will not be intimidated. Reporter heres another first, black prosecutors from across the country, all of them women, came to st. Louis to support her. Every prosecutor here has had similar experiences to kim. Reporter gardner is part of a new wave of elected prosecutors who have pledged to make the Justice System more fair to people of color. She immediately stopped prosecuting small marijuana offenses and is refusing to try cases involving more than 40 arresting officers who she feels arent trustworthy. But her critics point to her highprofile case again the governor, an investigator she hired charged with perjury and evidence tampering. Gardner dismissed the charges against the governor but a special prosecutor is looking into her office. Theres no way for her to prosecute criminals now. And i think shes destroyed her ability to be prosecutor. Reporter we spoke with the police union, and they tell us they are absolutely not racist, and they think that this lawsuit is without merit. Steve osunsami, abc news, st. Louis. Steve also did a longer version of this story for nightline that aired last night. It was really interesting because he talked to the head of the police union there in st. Louis and asked, what do you think about these other women who came here, these other prosecutors who came here, essentially to back up kim gardner, to share their experiences, and really throw their support behind her . Most of them were black women. And that, the spokesman for that police union, on camera, had no shame saying, you know what, tell them to go home, tell them we dont need kim gardner, we dont need them basically saying shes just not good at her job. It was good tv. This is obviously not the last weve heard of this. When it comes to miss gardner, she was elected. And she ran on a campaign of trying to root out corruption and other things. So the critics are saying, those who support her are saying that this is just a byproduct of that and people are coming for her.
