Reporter in a landmark ruling the judge ordering Johnson Johnson to pay 575 million for, quote, false, misleading Marketing Campaigns increasing addiction and overdose deaths. The decision a sign of hope to families ravaged by the epidemic. Nothing is going to bring my son back but this victory allows his death to stand for something. Reporter gail and craig box are among those who testified at trial. Their son austin was a linebacker at the university of oklahoma who started taking painkillers after a back injury. The young man was hooked quickly and then died of an overdose in 2011. The states lawsuit alleged Johnson Johnson created a public nuisance and demanded more than 17 billion. The company used pseudoscience and misleading information that downplayed the risks of opioids. Reporter Johnson Johnson denies those claims and has vowed to appeal. Now to the nursing home outrage in florida where several employees are under arrest facing criminal charges today. Investigators claim employees failed to act quickly enough to save 12 elderly residents. This morning, four employees at this miami area nursing home are accused of playing a role in the death of 12 of their patients. It went without airconditioning for days after losing power during Hurricane Irma in 2017. Doctors say some of the patients body temperatures reached 109 degrees. Police arrested the Nursing Homes head administrator on duty at the time as well as the head nurse and two other nurses. We dont have any airconditioning. Reporter investigators say the nursing home did not evacuate patients as temperatures were rising even though a fully functional hospital was just across the street. These people were very fragile. They didnt want to leave. They were confused. You know, most of them have, you know, alzheimers and things like that. Reporter administrators at the nursing home blamed the Power Company saying electricity at the facility was not restored quickly enough. David frankel, who represents the head nurse, said employees did everything to keep the patients cool, even bringing in small air conditioners and fans. They were calling fp l. They were calling the Emergency Operations center from the Governors Office and they were calling the governor himself. They called the Governors Office. They called eoc for assistance, however, the calls were never returned. Reporter the office for then governor rick scott disputes those claims saying someone from the Health Department returned those calls and urged nursing home employees to call 911. Scott would go on to sign a new law requiring all Nursing Homes in the state to have backup generators. In a statement scott says, im glad these people are being held accountable after their inexplicable failure to call 911 when people were in need. They were calling for emergency help. They were promised they were going to get help, and they were abandoned. Investigators will announce the charges later today. Lawyers say the head nurse and administrator are being charged with manslaughter. The other nurses will likely face lesser charges.
