What im observing is it is helpful to them to be able to talk about whats going on whether that be the vendors who its their livelihood or its vendors that this is parttime work and its part of their livelihood to people who were witnesses and were literally running for their lives. We want to stress that this is available to all victims whether you saw the shooter or did not. Whether you were at the garlic festival or whether you were a Family Member or someone was there. Staff here can also walk vips through the application process to access funds through the california Victims Compensation board. Its a program that helps reimburse for crime related expenses. Those include things like counseling expenses so this can pay for therapy with a Service Provider of the victims choice and pays for relocation assistance, wage loss, for medical expenses that resulted as a result of the crime. It helps pay for funeral burial costs in some cases. In addition to assisting the crime scene, the d. A. s office is conducting their own investigation because the shooting involved Police Officers. Thats something we have been looking at in terms of what bullets killed the individuals other than the shooter. One thing that i want to make very clear to everyone is that in my view,s who ever bullets killed those individuals, its the shooter who did this. If you are concerned about your personal belongings left at the fairgrounds, they will be brought over to rucker elementary. She went to school here on this campus in san jose at 6 00 tonight, her family will come out and tell us more about her. For most of the day, they were behind closed doors. Its been a tough one. At this home on a quiet san jose street, a seeminglyymth o visit today. But except for gee or dana, we could only guess at the grief within. She was that kind of person you would think is actually an angel. Everything she did was not for her. It was for everyone else. She tried to make everyone happy but herself. Reporter thats gee or dana speaking of his niese, caila who lost her life at the garlic festival shooting. He says she was probably trying to protect her family. She was the first one that stood up and she turned around to look at her family where they were and thats where she got shot. Reporter caila was a student here at ace empower academy, a Charter School in san jose. The family intends to hold a memorial here later tonight. They describe her as being shy but strong in spirit. The best of them all, gee or dana said. I feel really, really frustrated because i promised her i would be the one protecting her at any moment on everything. And the ingle day that i dont go with her this has to happen. Its painful. Its so the you cant really describe how bad it hurts. And thats her uncle giordano. We expect to hear from more members of the family later tonight, roughly about two hours from now. At 13, caila salazar was just about to celebrate her birthday. She had not gone to the garlic festival early that day. She had stayed behind to do chores. She was at the time trying to convince her parents to adopt another puppy for her. In san jose, Wayne Freedman, abc news. Thank you. This is the kind of pain that will not go away. Trevor irbe was one of the three victims. He moved to the bay area only three months ago from new york to be with his girlfriend sarah warner. They were there together. She escaped unharmed at least physically. Today in an interview, his mother told luz pena about the moment she learned her son was dead. I literally, my heart broke. And it nearly ripped out of my chest. To think my son that was so lock and kind and his goal in life was he was going to school for help people like this. I thought i was going to instantly die, my heart hurt. I thought i was having a heart attack. Well have more of the interview coming up on abc7 news at 5 00. The News Conference at the Gilroy Police department is just getting under way. We appreciate good afternoon, everybody. We did provide handouts that have some of the information written down for you. But ill give you some additional stuff. As far as updates on our investigation. As of this afternoon. The investigation is obviously ongoing. Its going to be ongoing for quite a long time. But we are making some progress. For instance, today this afternoon we started a process to try to start getting vehicles back to people who had their vehicles that are within that crime scene area and so as they clear certain areas of the park and threw make those vehicles available, theres a process where people are being reunited with their vehicles by getting escorts in. So thats a positive for those that have lost their vehicles into the park. I told you yesterday afternoon at the press conference that we were executing a search warrant on the suspects car that we found parked just northeast of the park. And that has been completed and i know some of the reports included that this gentleman had purchased the weapon that was used in the shooting and he had also purchased a shotgun. So we knew that he was associated with those two weapons. During the search warrant of the car, the shotgun that he had purchased was located so weve now accounted for both of the weapons that we knew he had purchased recently. Also i was asked a question yesterday regarding a bag of ammunition or a bag in the creek, and yesterday we had a very large number of people from the Santa Clara County search and rescue, sheriffs deputies and the fbi that did a very detailed sweep of the creek from one end to the other. I can confirm that they did locate a bag that had additional ammunition in it in the creek area when they were doing that sweep. I want to talk a little bit because we keep mentioning that we believe there may be a second subject involved. But we werent sure at what the level that persons involvement was. We have no indication that he was actually a shooter but we had several people that thought he was with another person. That investigation into that piece of this has been high priority for us. Because we want to put the community and peoples minds at ease as to whether or not theres actually another person out there they need you to be worried about. Our investigation is leading us more and more to believe that there was not a second person involved. I dont think i can say that with absolute certainty at this point because were still following up leads because people who say i saw this or that, we want to follow every single one of those leads all the way through. We have been able to track his movements around town leading up to the incident. Including multiple Different Stores and locations that he visited prior to engaging in this shooting incident and in every single one of those cases, weve been able to retrieve video and he was by himself. He was not with anybody else. So that is sort of supporting the thought now that he acted on his own. But again, i dont want to dissuade any witnesses or people that saw things or have any information from continuing to come forward because we dont want to rule that out as at least a possibility until weve exhausted every single lead that is provided to us. I think thats really all the updates that i have for you. You know, i would continue to ask for the communitys patience because this is a long process. You know, that crime scene area is acres and acres and so i know its inconvenient for some folks. I also want to encourage witnesses to continue to come forward to continue to visit the website that is set up for downloading photographs and video. And any information that somebody has no matter how irrelevant it may seem could potentially be very, very important. And oh we want to continue to encourage people to call in. I know theres more people that im sure saw things that are watching this and please, please continue to do that. And thats thats what i have as your update for this afternoon. Im going to turn it over so we can get a little bit more of an update as to personal effects and the evidence collection process going out at the park. Thank you, chief. Good afternoon, my name assess care fair the deputy special agent in charge of the fbi in San Francisco. We continue to provide assistance to the Gilroy Police department and the city of gilroyen at District Attorneys Office here. We continue to try to understand who the shooter is, what motivated him, and if he was aligned with any particular ideology. You hear me talk about ideology. Thats important because depending on how he might be aligned or not aligned that has different legal and investigative implications and takes us down varied paths. Again, depending on that ideology. Were still reviewing social media. We are doing forensic evaluation of Digital Media. Were continuing to conduct joint interviews with the Gilroy Police department. I want to talk a little bit about evidence response and where we are with that. We have a fairly sizable presence as of today. Working the crime scene, working in the hospitals, working at the coroners office. We have roughly 40 evidence response personnel technicians working in the field. Doing three dimensional mapping of the crime scene. Working with the victims in the hospitals, working with medical staff. And also working at the coroners office. The crime scene itself, i will tell you, is going to take anywhere from three to five more days to process. Its much more vast than we thought. Every day we proceed a little further and make more progress and realize its going to take just a little bit longer. I would ask everyone to be very patient with that. Its very important to us that we work as quickly as possible but at the same time, we have to be exceptionally deliberate, methodical, be exceptionally detail oriented in the collection of that evidence so that the could withstand the scrutiny of for example, a trial later on if that need be. I want to talk a little bit about personal effects. This is very important to us. Theres a lot of personal effects on scene. We want to get that back to the public as soon as possible. For us, what that is going to require is going through and dividing from the totality of items out there what are personal effects and what are evidence. As we determine certain items to be personal effects and have no evidentiary value, we will package that and we will bring that to the Family Assistance Center which is located at Rucker Elementary School at 325 santa clara avenue and we expect that we will start doing that commencing that tomorrow. There will be a Public Notice that is put out. If you go to the fbi. Gov San Francisco website, you will see a victim assistance application. So anyone who is at the event and believes they left personal effects at the event can go to our website and fill out a survey providing their name, other contact information, and what they believe they left at the event itself. Again, as the chief mentioned photos and videos that would go to fbi. Gov forward gilroy. Fbi. Gov forward gilroy. Thats all have i for now. Thank you. Well open it up for a few questions. Go ahead. Reporter chief, what was he doing beforehand you . Said you have video of him. You were tracking him now. At this point. What was he up to . I dont have a lot of specific details, but he went shopping at a number of stores in town. I could not tell you what he was i dont have that level of detail what he was purchasing but most stores now have video. So the investigate hes have been able to retrace you know back. Theyve been going back from the time of the incident and they have him in several of our local stores on video. Reporter do you think he was buying things for this attack . I dont i dont know. These the search warrant executed the apartment he had been living in that showed some of the things that they seized were empty shotgun and rival boxes a gas mask, empty ammunition boxes, bullet proof vest. Electronic devices. Do we have a sense how premeditated or well plan this had was or he was planning something in additionings to this, as well . I dont know that im really prepared to comment on that because i dont have enough of the detail. It certainly seems to me that it was preplanned. But how long and how widespread and whether there there was any additional component of the plan, i just dont know at this point. [ inaudible question ] videos as you are worried about your personal information being share later on or as far as immigration stotts related to being a witness, i tried to work very hard in our community to put our community at easy about that. We dont ask somebody what their immigration status is. Were not really concerned about that. Thats a federal function, and were a Police Department and were investigating a crime. And i certainly would hope, i think if you were to talk to anybody in our community here in dil gilroy that weve worked with that they could tell you that were good to work with and that they should not be concerned about that. Reporter can i ask you a question . You were asked yesterday for people to offer up some pictures they have taken at the fair and also if they have any information to share with you. Have you gotten anything yet or there any use on the leads . We have. Weve had a number of submissions both video and still. I have not seen them and have not received the analysis of those just yet. Reporter is there any reason to believe he may have been targeting minorities . With the shooting . We have no reason to believe at this point that he was targeting any protected characteristics of or any class. Reporter with no preliminary motive and the suspec deceased, how difficult will it be to actually determine motive . Well, i think that is going to depend on a number of things. Principally, review of Digital Media historically has been very revealing in terms of somebodys mindset. Ideological beliefs, intentions. Weve got to get into the computers, the towers, the thumb drives, the phone to get a holistic picture of him, who he was in touch with, what sentiments and thoughts he shared with others or hes cataloged for his own consumption. How longing will that take . The answer to that is it depends on how quickly we can get into the phone. It also depends on how the ease with which we can enter into any of the other Digital Media. Is there an early indication. Not at this point. The did you link to the Instagram Account . I cant comment on that because i dont know the answer. The presumption is yes, i understand what youre asking but dont have at affirmative answer to that. Briefly, be so i can understand, how are they doing [ inaudible question ] i do believe that it was the initial three officers that engaged the suspect when this occurred. You know, i placed them on administrative leave. I just did not want to put them in a position of having to come back to work and deal with all of this. You know, i think its a very emotional thing for them. Its one thing to be involved in the shooting but then they were also in the middle of the carnage of the people that were shot and then immediately went into you know, the rendering aid mode. And those two things combined i think for anybody is a very difficult thing to go through. Hold on just a minute. Chief in, release tols california ab748, have you seen that particular evidence and do you plan on meeting the requirement related to that . Yeah, you know, as far as the release of video, thats a New California state law. And i had one brief conversation about that this morning. And im going to having to really look into how were going to be able to meet that because the volume, i dont know what it is yet but im assuming the volume of video is going to be significant and the video that weve released previously to California Public records act requests has required us to go through and redact uninvolved parties out. Quite frankly for a department our size, i dont know how were going to do that yet. Have you seen the video. I have not seen any of the video, no. Obviously you had a lot of heros out there that day. A lot of that information out, is that right . I suspect that the video is going to give us, yeah, i believe undercover officers that were. The three officers involved were fully yumed officers. They were on what we call a road team whose responsibility is the to the rove a certain area of the park to deal with any issues that come up. Will you be releasing the names of those officerses and are they veteran officers . Rookie officers . My second question, you said are you talking about like downtown gilroy . No, i think it was more the big box stores. But i dont have a list. I just heard that they tracked him. I couldnt tell what you stores, but my impression was that it was local big box stores. Reporter and officers, veteran officers. Im sorry. They are all veteran officers. And the question as far as reesing their name, you know, i probably will be do that. I havent decided when we would do that. I would really prefer to look after the best interests of those officers and get them the help that they need and then make that decision but killed expect that we will release their names. Is there any reason to believe that any of the victims may have been hit by police and fire . There is no indication of that at this point. In the i mean obviously thats something that i was concerned about that i thought about. At this point, theres nothing in the investigation that leads me to believe that thats the case, but theres still a lot of work to be done. The question for the fbi agent. This is the same tool, this website that you used for the Boston Marathon bombing and the las vegas shooting. Can you talk about what you receive from the public and what you actually do with that information that you ingest . Thats a good question. Thanks, josh. The tool originated just subsequent to the boston bombing because of the volume of videos and stills that came in. Were talking about the hundreds of thousands. We need aid tool to process that information. That will go back to our fbi headquarters where it will be colocated. It will be analyzed by teams of analysts and agents back at our headquarters to try to pull together some mosaic to give us an Accurate Appraisal of what might have happened, the time flow, the people flow, show how the shooter came in and how he moved throughout the crowd and provide other evidence, video documentation. Reporter [ inaudible question ]. Before the shooting . I dont have that information. Speaking of can you clarify where the suspect entered the festival . So i have not personally been out there. So im going based off of briefings that i get. But it sounds like the movement would have involved his car was located northeast of the Festival Grounds. And it sounds or it seems reasonable that what he did was moved up through that creek which is pretty heavily wooded. Theres also Running Water in it and made it down to a fence line because the entire Festival Grounds was fenced in except for the egress and points into the festival. And then some used some tool, i dont know what tool to cut a hole in the fence. Thats how he gained access into the Festival Grounds. You mentioned that a shotgun was recovered from the car. Was any other key piece afc evidence recovered from there and the house searched yesterday, was there anything recovered from there . Well, the search warrant on churchill, i havent gotten a briefing on what they recovered from there. The car the only thing i was concerned about was the shotgun which is what they gave me. I dont know if there was anything else relevant that was taken out of that yet. Would you comment on status of the people that were injured . Have they been released from the hospital . As far as the victims, i dont have a current status. I was given a status earlier actually this morning that several people had been released, some people were still in the hospital. And i dont know the number but there was someone that was still in very serious condition, maybe more than one. Anyone critical. I dont know. So do you know how much ammunition the suspect had with him, how many shots may have been fired or the kind of Tactical Gear . I do not know that at this point. Let me i want to close because i need to get going, but just for the press, for all of you, ive gotten requests from probably just about every news agency in the country for can you do this, can you do an interview. And i want you to all to know that im not not doing those because i dont want to. But as you can imagine, we have so many people and so many things going on. That is chief scot smithee wrapping up a News Conference. The major headlines today is police do not not believe that there was a second person involved doing any shooting along with the who was later killed, santino lega florida. They believe he acted alone based on his whereabouts earlier. They mentioned the search warrants on the vehicle yesterday, they did recover a shotgun. Now they say both the weapons he had recently purchased have been recovered and they also found a bag with ammunition in it that was recovered in a creek area. They drenled that area and did find it. Perhaps that was just lost as i was making his way up the creek to gain access to the Festival Grounds. Three fers involved in the shooting placed on administrative leave. And at this point, its probably going to take longer than initially anticipated to do the search and Supreme Court scene because theyre talking about five to six acres that they need to cover. Youre looking for bullet fragments, for any other evidence. This is a wide expanse. The other complication for all the individuals who were fleeing is getting the belongings back to people even something simple like getting their car back to them. If your handbag is in one place where you cant drives the car but you dont have the keys. So thats another whole separate part of the process that the police have to go through in this case. Fbi says it could take three to five more days to process that scene. We continue to monitor that. The News Conference is ending. Reporter larry and ama, you just heard the police chief talking about that certainly warrant that was executed on the gunmans vehicle. Were standing in that exact spot where the vehicle had been found yesterday. This is the 7500 block of laurel drive and you can see off in the distance that is investigators with still processing the scene even though avik has since been move. And just behind those investigators, that is the creek bed that you had heard the police chief talking about. Its possible that be this gunman had made his way down that creek bed over the water where he was able to be gain entrance to the garlic festival. Tonight, confusion from those closest to him as to why. A man identifying himself as the legan family trainer who didnt want to speak on camera says his heart breaks for the victims and also for the gunmans family ho says he loves like his own. Confusion and unanswered questions. The l. A. Times reports another family friend called the gunmans brother after the shooting and that he was looking for him, not knowing his brother was the gunman. Today investigators continued processing the scene where his vehicle was found one and a half miles from the festival. His rifle purchased in nevada. Deputies in the Small Community of walker lake searched a house where they believe legan lived. One neighbor remembered seeing him around. Used to see him walk up and down the road to the mailbox or walk down to the lake, stuff like that, but never said hi. Might have said hi to him but never got to know him or anything liking that. More answers and and also you heard the police chief talking about the Surveillance Video that was collected from some nearby sforpz here today in this area, weve been able to get a little bit closer and see that a bunch of homes here do have surveillance cameras. Atf agents were going door to door yesterday looking for that Surveillance Video hopeful it would answer that is question whether or not this gunman was acting alone or was alone when he was here. The young men were 2018 graduate rafz tam high in mill valley. Newly released Court Documents state elder and natale went to a popular neighborhood with bars and restaurants this past friday allegedly looking for cocaine. According to court records, they contacted a local, the man on the bicycle shown on Surveillance Video and he introduced them to a dealer who took their money. When the deal went bad, the california teens ran away with the man on bikes backpack. The backpack owner called police and they listened as he called natale and elder using whats happen. They arned a meeting at the street corner. The Police Commander said they respond to complaints like this often. People asking for ransom for what they stole. Thats why the two officers responded in plain clothes. In court records, the surviving officer states they showed their police id cards and identified themselves as Law Enforcement or car bin narey in italian. Police say gabe doubted the men were officers and the fight began. Natale struck an officer with his fist and he would ser admitted he stab add the second officer. Today the commander said the surviving officer did not have time to react and did not want to the shoot the suspects in the back as they ran away. The officer saw his partner mario rega. Rega died from 11 stab wounds later at the hospital. The fatal encounter with police lasted less than four minutes. A porter spotted the teens running back after 3 00 in the morning. From video, police were able to track them back to the hotel, room 109 and Court Documents police say they found the murdee style knife drenched in blood hidden behind a ceiling panel. And then the third one is we need to bring on board a new police chief. Okay. These problems are tied together. And some of them are completely yeah. Rol. So the homeless issue can often lead to crimes on the cars. How you have a lot of moving parts here to coordinate. We do. And youre right. The homeless issue is much bigger than b. A. R. T. Its a regional issue. Everybodys got to be there to provide their piece of the solution. B. A. R. T. Is there. This last Board Meeting the b. A. R. T. Board authorized us to go to Homeless Outreach teams in all five counties intercepting the homeless, trying to point them in the direction of services. Weve expanded our elevator attendant program which wases in twos downtown stations to four. I think were making the right decisions and the right steps to deal with it, but youre right, theyre all interlinked. We did a story i think last month we were providing some focus on our coverage on b. A. R. T. It showed the end of the line. Thats where a lot of the homeless were gathering at sfo. Any progress on that front in particular . Yeah, i have had some very positive discussions with the airport down there. And what we can do with the homeless down there and were going to be entering into an agreement to try to address that, certainly one piece of the homeless equation is hardening of the stations. Higher railings, securing the swing gates, that type of effort to make it a little harder access into the stations. And as you said, theyre connected. So i think theres some progress being made there. How about fare evasion . I know youve increased the heights in some stations. Has that been as effective as you hoped it would be . Yeah, we think so. You know, youre never going to get fare evasion down to zero. Ro would n b w to get it to value of it. I think the railings going to five feet locking the swing gates and we have two pilot projects under way right now at richmond and at fruitdale. Theyre pilots. Were testing the functionality out. Were not dumping a bunch of money into them but seeing if we can get some solutions there that work and then if theyre working then we can address the aesthetics and implement it systemwide. I assume that you talk with transit officials in other sfepz everybodys got the same problems pretty much. Is there one that you want to try to pattern your b. A. R. T. Efforts . Who is doing it like exceptionally well in terms of fare evasion and these other issues . I think new york city does it exceptionally well on fare evasion. Their system wouldnt be, you couldnt pick up their system and drop it into our system because the capacity requirements through our fare gates. So if we went with that system, it would cut it in half. Then wed have had to have a whole budge more fare gates. There are systems out there that are doing a nice job. I think quite frankly, i think b. A. R. T. Is on the cutting edge. Our system is old. And were making changes to it, but as far as reliability and getting the trains out there, i think theres no better system in the worlds than b. A. R. T. Okay. This is a huge job, and i just want to convey 0 people exactly what youre running here. I didnt realize these numbers till i saw them. 2. 4 billion budget. 3600 employees. And you serve over 400,000 people per weekday. Its ginormous. Whats it going to take to improve the reputation . Whats your goal . I think youll see some immediate its kind of shortterm, medium term, longterm. Were working on the short term with the homelessness and fare evasion. In february, this february, a few months down the road, were going to go to all tencar trains which will make a huk capacity difference across the trans bay and up and down the east bay. Then longterm, were looking at solutions as the transbay corridor capacity taps out, what do those solution sets look like. Ing you have an enormous job and thank you for taking time. My pleasure.
