54yearold man who appears homeless and using a walker at the corner of mason and eddie streets in San Francisco. He got stuck beneath the trailer as it dragged him to fifth and market streets. The driver of the big rig kept going till police pulled him over at the corner of broadway and front nearly two hours front. He remained there speaking with investigators till noon. This mornings accident is the 20th fatality on San Francisco city streets this year, a number that includes pedestrian and bicyclists and drivers with the tenderloin rankings as one of the citys most dangerous areas. The San Francisco metropolitan and commission had investigates in the neighborhood today looking for clues as to what might have happened. Were looking to see the crosswalks clear, lights properly timed, can you see all the track signs and markings. The rig belongs to a Company Based in stockton. San Francisco Police say they did not arrest the driver. Instead, they detained him. He said little getting into the patrol car. Back live, were still waiting for the name of that victim before releasing it. Pending word from the San Francisco police department. They continue their investigation. We spoke with the metropolitan transportation commission. They dont want any accidents like this on the street of San Francisco. Often in many cases though not necessarily in this case, they say speed is a factor. In San Francisco, wayne freedman, abc7 news. Thank you. In the east bay, both oaklands Police Commission and the federal monitor overseeing the department are recommending that five officers be fired for their roles in the shooting death of a man last year. Body camera video captured the confrontation between officers and joshua pollock in march of 2018. Police received a report that he had a semiautomatic gun. The officers claim they fired at him after he refused to drop the weapon. Tonight, the Union Representing the officers release a statement saying the commissions decision is obviously borne from a desperate politically driven need to prosecute Police Officers regardless of the facts. And we are getting our first look tonight at body camera footage from a deadly shooting involving San Leandro Police last month. Drop the machete. Officers first encountered anthony gome mez holding a cha machete on north boulevard. He dropped the weapon and then stood on the porch of a home. Officers ordered him to walk toward they will but he refused order orders. He pointed a piece of wood about the same size as a handgun. They are investigating the deadly shooting. The muni and b. A. R. T. Stations are back open today after being closed most of the day because of a water drainage issue. Water from two leaks poured down from the muni line onto the b. A. R. T. Platform around 5 30 this morning impacting thousands of riders Lyanne Melendez has more on exactly what happened. Reporter well, it has reopened. Thats the good news, just in time for the commute. Had it not reopened this is what i would have done. My muni station is the castro station. Which means outbound. I would have then had to take b. A. R. T. Behind me right here at the embarcadero. Travel to the montgomery station, then i would transfer to the muni station again at the montgomery station. Not a big deal, not a big hassel, but im glad it reopened. At 3 27 this afternoon, the first muni passengers made their way in and out of the embarcadero station after hours of being closed. Heres how things unfolded. Just after 4 30 this morning, our assignment manager began recording water cascading on to a b. A. R. T. Train at the embark dare role station coming from the muni line above as they were testing their Fire Suppression system. Its really a sight to see. I mean, lots of scurrying about, people in yellow vests telling everybody to be careful, stay dry. Stay out of the area. Heres paul rose muni spokesperson. And in that test, our drainage system malfunctioned causing the trackway and platform to flood. Reporter this was a routine test they do at all the stations. That Fire Suppression system looks like this. Water runs through the main line located at the edge of the platform that transfers water to federlines that then distribute that water to sprinkler heads between the tracks. They be as i a huge purpose. This is really to help insure that if there is a fire underneath the train or on the track where were able to suppress it with water. When they went to drain the system, two leaks, one seen in this picture, began spilling water onto the muni tracks and on the b. A. R. T. Train and platform below. I realized oh, theres something wrong. There was like water dripping on my shoulders. I was like oh, theres something wrong. I had to check twitter. Reporter he was late to work. While b. A. R. T. Eventually resumed service at the em baker darrow station, muni had to repair the leaks by capping them. Inbound trains will not stop. Reporter instead, muni passengers were diverted by taking b. A. R. T. B. A. R. T. Is giving you a free ride to montgomery station. Reporter muni is still trying to determine what caused the leaks in the drainage system. So giants fans also very happy right now. Remember, a lot the of them come from the east bay. They get on b. A. R. T. , get off on the em baker darrow and take muni to the ballpark. Theyre very happy. Im looking around me. A very busy em baker darrow station. Im live in San Francisco, Lyanne Melendez, abc7 news. Thanks a lot. Just about anyone who drives along interstate 80 in albany has seen albany park hill. It sticks out amidst all the buildings in that area. What many people dont see is a 20foot cross in the middle of the park. Its been there actually since 1971. But now theres a new wrinkle over whether it should stay because it sits on public land. News anchor eric thomas is live in albany tonight with the story. Eric . Reporter dan, if youre willing to hike about 200 yards up this dirt path here in albany hill park, you can get an upclose and personal view of that cross. Heres one thing everybody involved can agree on. Nobody expected this to get to a federal appeals court. This cross display violates three separate constitution the prohibitions against government against religious. Before the ninth circuit of appeals this morning, the city has been locked in a legal battle over this cross which sits on public land inside a cityowned park on an hesment owned by the local lions club chapter. The city wants it moved. Our idea was to have a plaza that the Christian Community could use at easter and christmas, but that could be used by other faiths and nonreligious groups at other times. If you want it moved, pay for the move. Attorney bob nickles represents the lions club which erected the cross back in the 70s when this was private land. It was later sold to the city. The cross is lit up during religious holidays like christmas and easter but in 2016, the city had the power temporarily cut off. They say for safety, the lions club said it was for spite. Nickles says the city had ample time to address this in the 70s. The city thought they were cheated, thought they had a problem. They had five years to address it and did nothing. After the power was shut off, the lions club sued the city in federal court where a judge ruled the cross was unconstitutional and the city should take it down or sell the land. City attorneys call the ruling ambiguous and appealed to a threejudge panel after the of the ninth circuit. At todays hearing they brought a pastor who agreed with them. To have a shining cross shining down makes an assumption everyone beneath that cross believes in the same thing. So how much would it cost to actually move the cross there . Well, the lions club attorney estimates about 1 million give or take. But neither one of those groups wants to pay that amount. Are expecting a ruling from the ninth Circuit Court of appeals in about three months. Eric thomas, abc7 news. Thank you.
