Its a scenario weve seen before. A crucial difference this time the officer was wearing a body camera. What it shows you may find disturbing. Abcs tom yanis on the scene in cincinnati. Reporter an officer of the law turning himself in after a routine traffic stop caught on a body camin cincinnati went terribly wrong. This is without question a murder. Reporter it was yet another of those routine stops that has become all too familiar. Get out of the car i will light you up. Get out reporter on white Police Officer, an unarmed black driver, another tragedy unfolding in just a few frantic minutes. Stop, stop reporter it began july 19th 6 29 p. M. Like so many other past incidents, what happened next might have been forever unclear. But this time one crucial difference. University of Cincinnati Police officer ray tensing is wearing a body camera. He has just pulled over 43yearold sam dubose for driving without a front license plate. Why dont you have a license plate on your car . Its in my glove box. Do you have your license on you . Yeah. Reporter the officer spots something on the car floor. Whats that bottle on the floor there . Reporter dubose hands the bottle over but doesnt produce a license. Tensing keeps asking. Appearing to grow impatient. Do you know where the license is at or what . Yeah, ive got a drivers and stuff. Im going to ask you again, do you have your license on you . I have a license. You can take down my name. So you do not have your license on you . Reporter officer tensing reaches for the car door and asks dubose to unbuckle his seat belt. I didnt even do nothing. Reporter dubose appears to put the car in drive and the car appears to move and then a split second and the situation escalates. Stop stop reporter moments later the car, now out of control, rolls away. The vehicle came to a final stop at the corner of rice and valencia streets. Dubose was pronounced dead at the scene. Minutes later, on police radio, this is how tensing describes what happened. I almost got ran over by the car. He took off on me. I discharged one round. Struck a man in the head. Reporter a Police Report showed tensing later claimed he was he was being dragged by the vehicle and had to fire his weapon. After the shooting officer tensing was placed on administrative leave awaiting investigation. Today as the body cam video became public an angry prosecutor demanding justice. Ive been doing this for over 30 years. This is the most asinine act ive ever seen a Police Officer do. By releasing the video theyre basically saying to the public, this wasnt frivolous. This wasnt a rush to judgment. Reporter today, tensing was indicted on one count of murder and one count of voluntary manslaughter. If convicted he could face 15 years to life in prison. Following the indictment tensing was dismissed from the university of Cincinnati Police department. It is hard to understand why the officer pulled out his gun in the first place. Reporter officer tensings lawyer tonight told nightline that he believes a murder charge is unjustified by the facts of the case and his client intends to plead not guilty. The lawyer for the family saying that the officer was out of line and went too far. He had the right to stop him, no question about that. And he had the right to interact with him. What he didnt have the right to do was to completely overreact to what he did to sam. And then take out a Service Revolver and shoot him. Do you think the officer was ever dragged . No, not at all. He raentwasnt. Reporter county prosecutor deetors say hes treating officer tensing as a murderer. He should never have been a Police Officer. I know my proand i know that he wouldnt be running from Law Enforcement and then once i heard what he was getting pulled over for, i thought it was a false report immediately. Reporter lawyer mark owe mira showed sams previous arrest record shows hed never resist arrest. Hes been arrested before. Never had a problem with an officer during any of those arrests. Why would all of a sudden he change his entire life philosophy and decide this is the officer im going to resist and run away from . Rather, i think this is squarely and solely on the shoulders of mr. Tensing. Hes no longer an officer and doesnt deserve to be one. Reporter the family hoping that justice will be served. Wow, my brothers not here. I cant even process that. I was just with him like two days before this happened. Reporter heres what we know about the officer in the video. Officer ray tensing is 25 years old. Hes been a Police Officer for more than four years and was hired fulltime at the university of cincinnati in april of 2014. In a performance evaluation last april obtained by abc affiliate wcpo officer tensing had no record of prior misconduct. In the officer safety sections tensing was graded 4 of 5, superior for maintaining control of weapons at all times, maintaining control of a situation, and prepared to use necessary force. In the comments section his evaluator wrote, tensing maintains control of his weapons and of situations hes involved in. The death of dubose is the latest in a series of recent incidents where Police Officers have been accused of using excessive force. With the presence of video cameras becoming more common, its no surprise theyre capturing more violent encounters at traffic stops. Walter scott in north charleston, south carolina.
