But see, i feel its certainly as a christian, one thing that we learn is that jesus christ is the way he says i am the truth and the life and the way the way to eternal life. Some parents of children at some schools in the uk are angry and concerned enough to seek to sue the uk government. Im joined now by dr. Fascinating topic. Suing the government of the land. That sounds like a big step. It is. Sounds like a big step. It is. Does that happen . Well why does it happen . Lets lets ask the country. Why . Why . How could this have come to pass . Why would parents who are for the most part struggling with the cost of living , who have to manage living, who have to manage households, who have children with various pressing social, psychological and emotional needs , who hold down at least needs, who hold down at least one job, who may be going through all of the personal difficulties that any family is going through at any one time. Why would they decide on a sunday afternoon that, you know , well just sue the government 7 , well just sue the government . It doesnt make any sense. And its not one parent whos just a troublemaker. It isnt its not one parent whos just a troublemaker. It isnt three troublemaker. It isnt three vexatious litigants. Its these vexatious litigants. Its these are hundreds and hundreds and hundreds of people who across the country and may i say also outside of the national jurisdiction, are are rightly royally cheesed off and obviously , the litigants in the obviously, the litigants in the case that im working on are not in the hundreds and thousands , in the hundreds and thousands, but they certainly represent the hundreds of thousands. But they certainly represent the hundreds of thousands. And in hundreds of thousands. And in communications that ive received recently, there are people in australia, new zealand, ireland , canada , the zealand, ireland, canada, the United States who seek to start similar class action. So i think we might be seeing the beginning of an International Grassroots movement. Do they come as far as you can assess the situation from a specific group or or is it no cut across class creeds and cultures and population . And this is what one of the most interesting things about it. So we have an educational sector that prides itself and pndes sector that prides itself and prides itself on being inclusive and much of the damage and the mischief that is being made in our educational sector is being made in the name of inclusive city. And we had mary black recently of the snp talking about people who raised questions about trans gender rights as White Supremacy without a single thought for the many, many, many , many, many many, many, many, many, many people of faith and colour in this country who do not subscribe to mary blacks worldview. Who and i want to see mary black and i challenge mary black actually on this program to talk to a jewish schools, to mosques , to imams, to community mosques, to imams, to Community Leaders of faith, to talk to people who believe in darwinian natural selection, who are secular humanists, to talk to people who are, you know , from people who are, you know, from from from completely different cultures and backgrounds than her own and just say to their face that they are White Supremacy exists rather than , supremacy exists rather than, you know, doing this easy lay easy anti intellectual and ultimately socially divisive virtue signalling we are now seeing a perennial Grass Roots Movement in this country that is denved movement in this country that is derived from every single class, cultural , religious derived from every single class, cultural, religious and ethnic background. And it is also being background. And it is also being watched internationally because the uk is often seen as the as the uk is often seen as the as the as the as the as the leader , lets say, legally in in what is permissible in law, at least within the commonwealth and the common law jurisdictions. So you know, there is a Grass Roots Movement building of parents and it is an International Movement and i think governments across the western world need to need to take heed of what these parents are saying because they are not coming from extremist or or partisan or, you know , or partisan or, you know, theyre not theyre not coming from some sort of single issue. Its not its based on the fact that they feel that the school and the government now manages their relationship with their own children in wherein lies the whence comes the motivation , whence comes the motivation, evenif whence comes the motivation, even if, as you say , across the even if, as you say, across the board, theres opposition to this and protest about it, where where is the push coming for this controversial, lets say, material all targeted at the youngest children . Why . Why . Why . I dont i think so. We have this i keep banging on about this. People whove whove watched previous odious things that ive said will will be bored probably by this constant reference to the third sector, the charity sector. But it seems to me that this idea of the external stakeholder, you know, gives and gives all sorts of people this absolutely fabulous opt out because if you have a stakeholder, theyre not technically government, theyre not technically the school and theyre not technically qualified , theyre not qualified, theyre not technically accountable in law. And so but they have been given whole cloth of this power and this authority and this expertise to interfere with what they think children should know and learn and so on. And when parents do push back and say, hang on, you know, im not sure now that this this makes any sense legally, morally , sense legally, morally, politically, whatever theyre there is just this wall of silence because the schools can always say, well, its the experts, the experts will say, well, its the school. And the school will say, well, go to the you know, go to the local authority , go to the ombudsman, authority, go to the ombudsman, go to the, you know, the department for education, and they say, well, hang they will just say, well, hang on, we saw this on, its the school. We saw this with covid, way. You with covid, by the way. You know, the judicial review know, when the judicial review was against the was brought against the government for closing schools down, the government said, well, the discretion, the schools had a discretion, didnt they . Could decide didnt they . They could decide whether the their whether to close the their schools or not. It wasnt a governmental decision. But of governmental decision. But of course, every school in the country thought it was a government decision. It to, you know, when it comes to, you know, children invited to children being invited to reconsider facts reconsider the biological facts of who they are when it comes to sexual practises you know, what is the what is the what is the why is there a belief that the youngest of children need to hear this . Where is that . We never used to do this. No. Why . Never used to do this. No. Why . Why has it why has it evolved in that way . Why the youngest of us are being encouraged to think about things that i would have thought ought not to be a concern them for years to come. We do seem to have had a problem. Dont we . I dont know if you think this, anna, since the last few decades. And of course i would this, but as course i would say this, but as weve moved from weve gradually moved away from religion religion, religion, rejected religion, weve rejected a lot of what various religions and i dont just mean christianity, but various religions have said are the Building Blocks of society , the Building Blocks of society, the Building Blocks of society, the disciplines and the protections that are set up. And these have been set up over centuries saying, look, this isnt a good idea. That is a good idea. And weve kind of thrown out the baby with the bathwater. So were now at the bathwater. So were now at the stage of going, oh, anything goes. I stage of going, oh, anything goes. I mean, literally now, anything goes. And thats not helpful for anyone, particularly children. Does the law specifically say about this, you know, youre coming this, know, youre coming at this, youre sue, youre to youre going to sue, youre to going the government. Youre going to sue, youre to goiiwhat the government. Youre going to sue, youre to goiiwhat the glegal� nent. Youre going to sue, youre to goiiwhat the glegal position in what is the legal position in relation to how you go about, you know, challenging the establishment about whats going on . Are you specifically speaking about gender ideology , the idea about gender ideology, the idea that a child is born in the wrong body . Lets focus on that because we could go off on all sorts of tangents about what is taught under the rubric of the case that i am involved with in relation. Its specifically to relation. Its specifically to the role that schools play in encouraging and i use the word encouraging and i use the word encouraging and i would also use the word promotion of the idea that you could be other than you are. So if youre a boy, you are. So if youre a boy, you could be a girl. If youre a girl, you could be a boy. Or if youre a boy or a girl, you could actually play around with this and actually thats something that you should genuine only consider. You shouldnt passively accept shouldnt just passively accept that may be people your that there may be people in your class trans or gender. Class who are trans or gender. You should pass you yourself should pass should actively actively consider actively pro actively consider your relations with your your own relations with your body you are being given body and you are being given very positive signals. Is that very positive signals. Is that it is a good idea to reject your biology, your puberty, your masculinity , your femininity, masculinity, your femininity, whatever. Now now that is promotion of an idea and youve asked where its coming from and youve asked what the legal position is in terms of the parents, the parents are making the claim. I think its good law that you cannot promote such a contentious notion. You cannot. Contentious notion. You cannot. It is so contentious. Its not just content. Its from a just content. Its from a secular scientific , normative, secular scientific, normative, darwinian perspective as as Richard Dawkins has has just come out and supported the position for secular humanism and science. But if you are , you and science. But if you are, you know, from the abrahamic faith traditions, it is utterly nonsensical and is also unacceptable. So, you know, unacceptable. So, you know, were talking about a niche idea that actually strikes at the very heart of what it means to be human for hundreds and of thousands of people in this country and possibly millions and i would say billions across the world. So the legal position is that schools cannot be just casually promoting this idea in in in with children giving them the seeds and the fruits to say, yes, this is something that i should be i should be embracing because , of course, the because, of course, the consequences of it are detrimental to families and to the child in all sorts of ways. Claires a parent and she has concerns about this material. Weve been discussing a while ago. Now she discussing a while ago. Now she learned that theories about sex and gender disputed theories were being taught as fact to her teenage daughter. And she asked the school to let her see the relevant teaching materials. Claire, did you know what you were getting into . Really, when were getting into . Really, when you asked to see these materials . Well, 7 well, i . Well, i had 7 well, i had an . Well, i had an inkling because because at my kids primary school, they were an early adopter of the education, the relationships , and sex the relationships, and Sex Education. And and they had taught there some things that i found very controversial. So found very controversial. So telling the kids, for example , telling the kids, for example, that there are now many more than two genders that you need to call all historical figures by the gender neutral pronoun they so we dont misgender them. And so id made i made a complaint about that and i really thought it would just be over very quickly. And the result was that i was presented with a lot of materials and the new guidance that was going to be coming in. So this was back in 2017 and that all of this was actually what was supposed to be happening. And so i had an inkung happening. And so i had an inkling that something was going to quite wrong with to go really quite wrong with rac finally came on rac when it finally came on stream , which was in 2021, it stream, which was in 2021, it became active. As for all became active. As for all schools. So i had became active. As for all schools. So i had an inkling, but i didnt i didnt expect the pushbacki but i didnt i didnt expect the pushback i would get from well, from everyone really, from the school, from the providers , from school, from the providers, from even including the department for education and i also wasnt prepared for, you know, the well, the way that the parent would be treated who was complaining about this was, was your daughter upset by what she was being taught at school . Was being taught at school . Yeah, well, its you know , its yeah, well, its you know, its just one lesson and she sort of takes that in her stride, i guess. But certainly she both my kids would come home and say, you know, present these ideas to me and say, is this right . And why am i learning this . And think what was perhaps the biggest problem for them was that it was just clear that they couldnt voice their own opinions in these lessons. It was clear what was meant to be thought and said. And, you know, for many years, actually, i dont think my daughters really contributed to their lessons as they should. Be they should. Be bear with me clear. I our guest in the studio as you as youre probably aware, anna, why what would be the justification for a school saying no to a parent asking to see what the material which was being used to educate her child . What whats the stance that a school can legally take . Well, theyll be told by the provider that this is protected by copyright , provider that this is protected by copyright, simple as that. But but if its being shared with the children , then is that with the children, then is that is that the only and the and the bullet proof get out that a parent is not allowed to see it because as a copyright, i mean that could surely that could stand for any material about any subject. Yeah. Yeah. Look, we are in absolute no mans land here. The providers have created a situation mission akin to the no mans land that existed in world war i when there was , you know, opposing there was, you know, opposing sides fighting and barbed wire, you know , creating this zone in you know, creating this zone in the middle where nobody knew what was what. And who was who and which side was which. Weve got this situation now where the schools have been created as a sort of liminal zone because of these Third Party Providers who keep creating a lack of clarity around what is what is being taught, whether its lawful and who can see the material is and why they can or cant see the materials and what is a what is a parent, what materials a parent can actually object to and what a parent can take their child out of a particular class on the basis of what laws and what mandates and what guidance. Its all been left up to up for grabs on the particular issue of gender ideology , we had gender ideology, we had a consultation in 2018 about whether gender, self id was lawful and the british people overwhelmingly said it isnt. And that is why Nicola Sturgeon is now no longer persona grata because she sent a man , a because she sent a man, a rapist, into a womans prison. The whole of scotland and the whole of england and the whole of the uk and the whole of the world. The civilised world is agreed that you cannot declare yourself a woman as a man , as yourself a woman as a man, as a sexual predator, and go into a womans prison. The world has agreed on that. But when it comes to the schools, the world suddenly is not agreed and we have no laws. Suddenly no clarity about if a child decides that she is a he or he is a she. The teachers, the providers, the parents are all put into this limbo. The government is silent. The department for education throws up its hands and we are suddenly left with limbo suddenly left with this limbo land where anything goes. How can right that we are very can it be right that we are very passionate about what adults can do, we are suddenly do, but we are suddenly indifferent about what children can do, what the laws are that apply can do, what the laws are that apply to children. But as you say, you know, the passion, i think, seems to be currently, certainly among certain teachers, a fervour to reduce skate children from a very young age out of normality and into, frankly, anything , it and into, frankly, anything, it seems. And it does seem to be theres just seeds of confusion being sown with this. And other subjects bear with us. Claires going to stay with us. Basically claire, if youre still there, i hope you are. Did you canvas hope you are. Did you canvas opinion amongst other parents at the school . Were you alone . Warrior or was the or was your feeling echoed. Feeling echoed. I was very much on my own. Um, i guess you know, we i live in lewisham , south east london. In lewisham, south east london. Its a very liberal minded area and i think the majority of parents who i knew were keen on social justice theory, they were keen on being good to trans kids in perhaps the most straightforward and obvious way of inclusion and so when i asked some questions , for example, at some questions, for example, at the pta , quite a lot was done to the pta, quite a lot was done to actually prevent my questions reaching the school to silence what i was doing. And yeah , my what i was doing. And yeah, my opinions werent welcome , but opinions werent welcome, but i must admit im surprised. Must admit im surprised. Im surprised with the answer i would have. I would have expected that you would that you would encountered like would have encountered like minds. Having you having minds. But having you having said that, you then do . Said that, what did you then do . You know, what you mentioned you know, what has you mentioned the date of what have you the date of 2017. What have you done since. Done since. Well, it was in 2021 that the that the curriculum really got going. That was when the company or charity came in to teach my child. And they were an outside child. And they were an outside provider. And my instinct was i wanted to see what they had taught her because the things she was describing didnt really match what i had been told would be taught. And so i basically asked to see their lesson plan and their slides. When that and their slides. When that wasnt forthcoming, i made a freedom of information request to see that, and that was denied as well. So i went to the ico, thats the information commissioners office. They also said it was okay for these things to be secret or kept under commercial secrecy. So under commercial secrecy. So i went to next the first tier tribunal to ask the court to overturn what the ico had said and in june i just lost that case. And, you know , its really case. And, you know, its really kind of quite shocking in a way, because what the judge concluded was that a degree of commercial secrecy in the classroom rooms was probably acceptable and that this kind of separates the experience of parents from their kids. Yeah a remarkable result. Thanks. Thanks. Claire and i have to ask as well, what happens next . You know, you see, im going to sue the government. Whats the process and when would fruits that be born . Would fruits of that be born . Well i mean, youve got large numbers of parents now. This isnt just one child here. One child there, one parent there. There are very many parents who are experiencing things that in law we would say is similar on the facts, similar on the facts. You have parents coming with stories that are not identical to other parents, but the facts are the same. There is clear evidence, and we know this from the pubuchy and we know this from the publicity that weve seen over the last few months, that there is social contagion here and of course, you can attribute that social contagion. For example, children saying that they are now identifying as something which may have all sorts of implications for their mental and physical health. You could attribute that to social media. You could attribute that to tiktok, you could attribute it to all sorts of cultural trends. But there is undeniable evidence that schools are promoting this idea and therefore contributing to this social contagion. And it is having detrimental effects on children.
