Ga. Law Firms Get New Chance To Fight Unpaid Rent Suit
Law360 (March 1, 2021, 8:30 PM EST) -- The Court of Appeals of Georgia on Monday said two law firms shouldn't have been barred from a rent payment dispute with a company that subleased them office space, saying Atlanta Life Financial Group Inc.'s practice of accepting reduced or no payments complicates the facts.
A unanimous panel said the terms of the sublease may have been waived because of Atlanta Life's payment flexibility with its subtenants, The Hatchett Firm PC and Durham Law Group PC. The decision overturned a lower court's grant of summary judgment on Atlanta Life's allegation that the two subtenants breached the sublease.
