Mercedes, want to start with you the father is charged with two counts of seconddegree murder, four counts of involuntary manslaughter, eight counts of cruelty to children and potentially additional charges. So i ask you, could charging parents possibly prevent these horrible murders in our classrooms . Prevent them and also how difficult is it to apply parental responsibility . That is such a great question it is such a key question the united states is grappling with after the decision that came down back in april. They were found to have been guilty of involuntary manslaughter for giving the instrument the dangerous instrumentality to their childhood then killed multiple classmates in his school. Its a very much like the circumstances we have here. We have someone this child did exhibit some Mental Health issues the fbi had investigated last year with his father but they were online threats the federal investigators wanted to see if there was any connection. See that im going to get into that. Excuse now get into that part of the bill but i am asking you specifically, do you think applying a parental responsibility could deter or prevent some of these shootings from happening in the future . It is a difficult to charge them . Is very key for prosecutors who are looking to prosecute these types of cases if there is a deterrent because Thats Part of the discretion one part is to go and seek the prosecution of the individuals were charged with criminality. The second part is will this lead to the deterrence . One could certainly hope so there would be deterrence there saying there is not a correlation between prosecuting parents for the criminal acts of their children. First is going and seeking some kind of deterrence to ensure this is not happened in the future. There are reports out there saying its not a correlation but the crux at the very essence of that one would hope there would be deterrence. Many people and this is speaking for many people around the country, they are fed up with these types of shootings they want a deterrent if the deterrent does come through looking to prosecute the parents who are giving access to a bunch of their children, then maybe thats only to do it. Well, speaking not legally im not an attorney whether there is some foreseeability as illegal people would say or other preknowledge that she would have been of the tell authorities before this 30 Minute Call that was made to the school, perhaps. I cannot speak to that from a legal perspective. What i can tighten up unfortunately love the stories we have covered over the years, Hind Sight as they always say is 20 20 part you do not like to be critical of people on a pathway who are trying to do their best but is something we need to learn from. And as mercedes was starting to say back early this year with the fbi receiving an anonymous tip on a website called discord for the School Shooting threatst that led the fbi to refer to the atlantic office to send it off to Jackson County Sheriffs Office soon to the doorstep of the grays and interviewed them theres a Video And Audio them of doing such. The police seemed to be comforted by the fact the father it seemed to be steadfast in the sun didnt do it and the Sunset Son said he didnt do it. In retrospect the first breadcrumbs ive not seen the threat if there is probable cause they could have seized and seen whether those postings came from him which may have been more of a chilling effect on this bright certainly to tip off the authorities for their part to go further on its School Officials in the county adjacent to where the school was for the shooting took place were notified and apparently the state social services for Children Family services were involved at some point. Whether or not it connected with this threat or maybe they were just there because of other family issues, we do not know. There are a number of tripwires along the way here. Why they were not all threaded together or something we need to look at. It certainly echoes a lot of things we have seen in the past. It went last year the terrible shooting of 18 people in maine where the army had seen behavior by this individual yet authorities, even of the interview that person were not able to g given the red Flag Law of the state were able to seize his weapons. Legally through Due Process per theres a number of cases weve seen over the years where we need to have this thread between police, Family Services, Psychologist And Health professionals to really get a handle on these potential individuals who are committing these crimes. Arthel you laid out so many leads the potential leads, Bread Crumbs leading to the doorstep of so many of these unfortunate horrible heinous crimes that have been happening in our classrooms and other places with the mass shootings. And so i ask you this is not in any way to come down on Law Enforcement but i have to ask you why . Why is it that all of these leads are never strong together to avert something like this . Why . Everyone wants to know why it didnt Law Enforcement do something in advance . In my view that this is for bill im sorry. In my view there are a couple of things. One is the legality, that legal issues that perhaps prevent that. Again the probable Cause Issue and some other illegal issues regarding access to medical records et cetera. Those laws also play into by police themselves are not the Social Workers. We consider police doing Social Work out of the doing it every day by interacting with the public. But some of these things fall back to both Health Professionals and other Family Service members and sociologist to follow up on a Daytoday Basis but police cannot really do that effectively day today. Arthel i have to move over too mercedes but those psychologists, those of Family Therapists you are mentioning they are inundated with caseloads. So there has to be some way. There im not sure what it is i dont have the answer they dont have the band with or necessarily the time to report every single issue and followed with every single issue. Im not so sure. But clearly something needs to be done to have a cohesive approach to this problem. Mercedes, let me go back to you now. The mother reportedly warned his staff at the school of an extreme emergency. So if proven to be the case, should the Staff Member who took the alleged Call Bear any actionable responsibility . Or does it matter when the mother made the call . That is such a great question. And i myself and my partners do defend schools that are facing these type of active shooter incidents. And you are exactly right. If there is some proof the school had noticed an active shooting may take place they had to have taken some precautions. Its not leading to criminality necessarily but there may be civil lawsuits that flow from it. So those are calls to the school especially the call that came from the mother 30 minutes before the shooting where it was extremely urgent, what precautions were taken . Were classrooms told to lock their doors . Were officials in the school but they were actually there trained to stop these types of active shooters. It has been reported there were at least some Security Presence in the schools. What instructions were given to them . All of those steps whatever steps the school may have taken following the Phone Call will be heavily scrutinized. And if there are any failures and having secured the classes and the students that can lead to some civil liability and lawsuits.
