This is kind of bizarre the more we learn about whats going on here. This morning he offered to change his plea to guilty. His lawyer dropped that bombshell on Day One of Jury Selection which was supposed to be Today And Tomorrow and opening arguments all set for monday as far as the group does government new. And then this. If charge the president s son with dodging more than A Million dollars in taxes and a big nono filing false returns. All that could add up to 17 years in jail the jail if convicted prosecutors say instead of paying taxes this period he spent his money among other things on Adult Entertainment and various women in Adult Entertainment. Some of this is just raising quite a few questions. Lets go first to our Chief Correspondent on the Scene Jonathan Hunt live at the courthouse. What were hearing from you and your Producer Raising a lot of questions about whats going on in their, what can you tell us . Metro vancouver, yeah, there are a lot of questions, its been a thoroughly bizarre day, we has been getting our first inclination this may be an unusual day when Hunter Biden arrived in court today. In every other hearing in this Case Parking Grant by a Secret Service we other than Ine Courtroom itself but today Secret Service dropped them off curbside and he walked in and flanked by Secret Service agents holding the hand of his wife melissa and followed by one of his lead attorneys abby loyal. Then Abby Lowell dropped the bombshell saying his client Hunter Biden was going to change his plea to guilty in what is called plea. Thank goodness we have Jonathan Turley on deck but essentially what biden is accepting is according to Abby Lowell and this is a quote, biden concludes that if he went to trial then he would be convicted beyond reasonable doubt but at the same time he is still asserting his innocence. Thats the basis of an offered plea. The Lead Prosecutor in this has objected to it on for Half Behalf of the doj saying Hunter Biden is not innocent. Hunter biden is guilty. So we now have this standoff if you like in court the defence saying we will plead guilty under these very strict conditions of an orphaned plea. The doj to the prosecutor saying no, we dont accept that. Now judges curse he is in court or has been in court talking about how he believes it should be handled. It looks like they are essentially going to come back tomorrow and the judge will tell us what he thinks of this. One important Note Martha is at The End of the last session about starting about to start in 7 minutes, but at the last session ending, the judge apparently said the court does not need the Governments Approval to accept the Alford Plea that doesnt indicate he will take that route and say im ignoring the doj objections and i will except the Alford Plea case closed but it does mean he obviously has that option in mind so its really interesting point we are at now as he mentioned Hunter Biden was facing up to 17 years on those nine charges that include three felonies. The question would be if this sort of plea is accepted or if indeed there is a Plea Deal further down the line now, what sentence he would get and whether of Course President Biden might pardon him or commute that sentence and i know you will talk more about that later martha. I am a criminal Defence Attorney and i think that they have placed Hunter Biden in the worst possible position. I mean they could have reached a Plea Agreement months ago when they had something to offer and by waiting until the very last minute they are guaranteeing he gets very little benefit from a Plea Deal. Also, Alford Plea are not so rare in the criminal justice system. It was surprising to see them pursuing it i may have pursued the same thing but i have never in my career ever heard of an Alford Plea thing proposed without speaking to the ossicular. Speaker04 hand. Thats a Jump Scare in the middle of a courtroom before a judge and is not a good idea. The prosecutors have a big role in this. 17 of State Cases and up in Alford Pleas. Fivecent of federal cases and up in Alford Pleas are no contest, please. These are something that come up occasionally but ive never ever heard of any Defence Team walking and without first telling the prosecutors. I think its one of the reasons there was a very fast opposition from the prosecutors. They are clearly missed and i am not sure i blamed them. It so interesting to me, its possible i mean this defendant, Hunter Biden who Abby Lowell has just said one of the reasons they are in recess is so that he can explain to Hunter Biden when entering the plea means. First of all this is a yellow log graduate, Hunter Biden, dont know why he would not understand all of those. Secondarily a, is a possible in your mind knowing these players that this is all being pushed by Hunter Biden . That Abby Lowell wanted to go a different Course And Hunter woke up today and said no this is what were going to do. I will say i am accepting a guilty plea but im not actually guilty and were gonna drop this bombshell today. It vary well could be the client driving this because it seems to have all the planning of a collapsing bridge. I just dont see why anyone would take this course of action but i certainly dont think that a lawyer needs to have these please explained to him. The problem for hunter, yeah, the problem for hunter is the snow all looks contrived to the judge. You just told the judge you dont think youre guilty so if he rejects the Alford Plea then you have to come in if you want to avoid trial and say okay i plead guilty and accept guilt after yesterdays saying i dont accept guilt. None of that is going to help with sentencing. The expectation is the justice of the apartment will ask for gel time and i think its likely if they ask for it they will get it from this judge. So once again they couldnt have positioned themselves in a worse spot and going into this the sensing. Keep in mind if they simply reached a new deal after the first one collapsed they could have had a global agreement of all these cases. Now he is going as a convicted person on the Gun Charges so thats another aggregator. Martha sentencing scheduled for november. Let me ask, i not sure how this ended up so im hoping you do. When the Plea Deal fell apart in june, Abbe Lowell contested that and said you cant do that. This Plea Deal is set it was agreed upon by all parties. To my recollection, thats still where he believes. Is a possible that he could use that and he could say, look you guys jumped apart this Plea Deal we put together in good faith with both sides. And now youre going to do for us is agreeing to this Alford Plea, is that possible . Its possible but the argument that were making about that being a viable literary was rejected by the court for good reason. Part of the problem is when that fell apart in the middle of the courtroom, the defence stood up and said well just rip it up. Many of us who have done criminal cases thats not usually the words you want to use when your client is facing an absolute Lead Pipe Scent case against ten. So they ripped it up. The department of justice later accused the biden team have not seriously engaging in negotiations for a new Plea Agreement. That also maid no sense because they didnt have anything to negotiate with. He was going to head to convictions and likely jail so they just they should have done this last year. Martha yeah, while all of this they thought at one point it was all going to go away with this Plea Deal that the judge basically called ridiculous because it would have exonerated him from that situation and future legal prosecutions. What do you make of all this . High martha its a disservice to The American public to be honest with you. When someone comes before the criminal justice system, the public needs to know whether the person is found guilty or not guilty. To allow someone to come forward and claim innocence and then also resolve the charges, is not going to end there. This case would proceed through Sentencing Process and beyond where you would have a defendant saying hes always been innocent and the judge allowed that to go forward. The american public would not have any of the principles that are implied in sentencing liked turns to the general committee community, to tear deterrents for the individual and criminal wrongdoing. Is disservice to the public if its allowed to continue. Martha it seems like its another example of Hundred Biden just expecting that he should be treated differently than everyone else. By k okay well i will come to a guilty plea here but i dont want to walk around the rest of my life, you know, feeling like i did anything wrong. So thats what i want as part of The Steal. Let me just, mr. Shapley, his alleged expenses here it goes back to the period you investigated and these things stood out to you as not legitimate, legal tax behaviour. It goes to expenses broken down and he received more than 1. 2 million and financial support and it was used to pay for various expenses but he didnt choose to use that money to pay his taxes during that period. Take us all back to what was the early red flanks to you and what happened when you raised these issues and said i dont care about the name on the top of this Return But Something doesnt smell right here. Sure yes. He developed this case and it was based on a lot of data that we had internal with irs. As the case got assigned in delaware, it really became apparent early on in early 2020 that they were not found in lower processes. We had Search Warrants ready to go, we had other investigative steps when we wanted to take and each time we got close to some of these other things we had to look at in this case whether it be fair or other charges we got pushed back every single step we took. I took it internally into irs senior leadership and they ignored the issue. Then ultimately it required me to seek counsel. Bringing the stuff forward and i think the steps the doj has taken has proven they didnt do the right thing in the first place. On May 15th 2023, David Weiss Office was offering the defendant and on prosecution agreement. Of course that morphed into the sweetheart Plea Deal that fell apart. Ultimately for this defendant to be charged with a Gun Charge and Tax Charge, the same Tax Charge rode up in the special Agent Report were charged or it goes to show the doj is proving what they did initially he was wrong and shouldnt have taken Two Of Us to ruin our careers to bring this forward to The American people. Martha and now youve testified that u. S. Attorney David Weiss who was, you know, the top person on this basically went to him and he said but this is an up to me. This goes above my head. He claimed that he never said that to you, is he lying . Even as testimony to congress he admitted that after President Biden biked in united States Attorney in Washington Grace declined to bring charges and d. C. Key requested that special Charging Authority and he wouldnt say in his testimony that was denied but when you answer something in and not given it, your denied. Its an odd plea but its not entirely unique within the court system. The judge put him under oath the last few minutes and he is explaining to him that if he proceeds with the socalled Alford Plea he gives up all of his rights to a trial. The prosecutors are objecting to this and are telling the judge that biden has to agree to all of the facts placed in evidence by the government. We are waiting for her reeling from the judge and we could get it Today Martha it might slide ten tomorrow but were always the at a critical point martha. Martha very interesting. So Thats Part of what he was in the Understanding Process on, you know, if you want to do this Alford Plea you have to agree to this in terms of all of these findings from the investigation. Martha one of the things that stuck out to me was he said he wanted to lower the corporate Tax Rate as low as 15 for companies who make their products here in the united states. If you want to make your product with parts that come from china in particular its going to cost you a lot more to do business but if you take the step of bringing right home and bring it here youll get a very low corporate Tax Rate what was the response to that and you think its a good plan . Its definitely a possible plan i think was positive. I have to go back and look of the transcript which i just read again. The way i understood that is he is going to lower the corporate Tax Rate from where it is now thats no doubt about that, for everybody. If you want the extra bang for your buck, so to speak. If you want the extra bang for your buck, so to speak, thats where you cant be doing the business overseas and building stuff overseas and outsourcing. I think most people think that its a legitimate thing to do and also something again its a price to pay. They look at what Kamala Harris has not really proposed but whats leaked out about her plan which is a lot more regulations and taxes that they look at this and theyll take Donald Trump and gave the week. What i found interesting was he articulated in detail the democratic plan and the economy with much more detail than Kamala Harris had so far. This was the President Nominee on the other side. Is not rally it was very policy oriented. And i think that this version well do well if we see it on Tuesday Night if we see this version of the former president in terms of expended to people, some of these ideas are difficult to break down. You got to impact. Martha and its easy to say oh, i will get 25,000 off if i buy a House Right but its more nuanced to understand the impact of these thanks on the Bottom Line.
