know that the cause of death was strangulation of this poor child. these are the men who were charged. their venezuelan enter in the country illegally. you are about to hear jocelyn's mother alexis on what's been taken from her. she said she was a teen mom herself and fought to keep jocelyn and she fought to raise her and now she says she's fighting fighting her for her daughter again. >> she was monsters took the opportunity from her and from our family watching her she is still my firstborn i was a teen mom i fought for her. twenty-seven though still fighting for her and i just remember she foy lived and set the court in houston with the latest on the legal front. hey nate. >> reporter: hey martha. so jocelyn nungaray's family expressed some relief when the judge set bail for franklin jose pena ramos at $10 million. one of the 20 '08 legal venezuelan migrants charged with murdering the 12-year-old girl. prosecutors plan to ask for the second bail about to be the same for the second suspect more. they describe the mic and slight risk at astronomical. we also learn more disturbing details about what prosecutors allege chapman they say after the murder peña and his codefendant approach their boss at their construction shop and asked for money to leaked on. prosecutors also say pain, yeah, where soaring an ace gps ankle monitor during the murder and got that one border actual agents arrested and released peña three weeks before the murder. a district attorney and said prosecutors are waiting on test results before deciding if this is a death penalty case. >> should those tests produce evidence that would support a charge of sexual assault or should other evidence be brought forward that supports charge of kidnapping, both underlying defences would make this capital murder and these individuals death penalty eligible. >> peña is codefendant johan jose rangel martinez will appear in court tomorrow two days before johnson's funeral. here's a bit more of what she said earlier. >> she had such a bright future ahead of her and i knew she was going to go very far. i know she is going to make a difference for this world for all children and now it's my job to make sure it continues to happen. >> reporter: it is heartbreaking. today in court prosecutors say peña admitted to kissing jocelyn while claiming his codefendant was more physically aggressive [ cheering ] >> martha: that's one way to do it. let's bring in former utah republic congressman and oversight committee chairman now fox news contributor and david former state senator paid to have both of you with a spirit david let me start with you. what do you think he is trying to achieve here over this weekend with this appearance? >> i think at desperate times call for desperate measures that's really what you see here. when a candidate gets flustered and frustrated and desperate they start using antics like that. yes i think at rallies some people obviously hard-core based and excited when using that type of language. it shows that passion period something jamaal bowman is really known for but it's unfortunate. i mean if you know or meet him he is a pleasant guy advice in person. and this is not the characteristic you would want to portray. but the big problem is he is running against george latimer. candidates are usually running against yourselves in a race like this but he is also cooked to face george latimer was also popular. over 80% of the district and westchester is supposed to the bronx. he's got some problems going into tomorrow. >> it's an interesting district with different constituencies obviously in different parts like all of them. george latimer obviously sees it as an opportunity. so he came out and said this. watch. >> i think there's been a lot of criticism while debt made by my opponent which is unfair and accurate but i think i get very -- i don't get to lose my temper and have the right to carry on a certainly. it's must-see tv that's for sure. >> martha: ross ctv, chasing you're take? >> that political rally is a little different then the political rallies we have in utah i can tell you that. i get concerned about the messaging with the messaging there because he is railing against the american policy advisory committee. what you don't hear congressman bowman talking about is america. you don't hear him talking about the idea that we have hostages being held by hamas. that's what you don't hear from the progressives. what you hear about is anti- israeli sentiment and that is what is so deeply concerning. >> martha: you know, it's interesting, bill mar over the weekend was talking about the attempts president biden has made to sort of choate two different constituencies to strengthen his support among black voters et cetera. here's what mar had to say about the effort is going. >> he said what does democracy have to be ten times better than anyone to get a shot. it seem like pandering to me. black voters under 15. he led by 80 points in 2020 and now by 37. still a lot but you've lost 43 points. off the key constituency. >> martha: david does he make a good point? >> he makes a point but i thank the other point you have to realize is that many people are just not involved in this election right now and recently it's hard to believe i know we are focused on it almost every hour but a few research polls show four out of ten americans are not engaged. that's why president biden once these debates this weekend wants to to make sure people recognize , you may not be superman all the perfect candidate but this is about a choice. a choice between joe biden and all trump and that has to come into picture to make sure this is a clear option >> martha: that maybe -- i think when you see that kind of swing at a 43-point swing that the won of a lack of engagement to me. that a move. i mean if people were engaged the jaspreet singh, of course, i'm going to vote for him again but that's engagement i would say, jason. >> the problem is joe biden doesn't personify a future. what are you going to do for these communities? how are you going to lock down the border? how are you going to drive down inflation? how are you going to tackle the high price of housing? and you has no play -- work, what is joe biden's plan to tackle inflation? nobody can tell you because he doesn't have one. >> we can go through a lot of -- the levy of things that you can -- the chips act, the -- >> what he's going to do, that's the point that he doesn't talk about what he's going to do. >> exactly that.
