>> harris: we have breaking news inside a federal courthouse in delaware. the prosecution now has rested its case and we're told both the defense attorneys and the prosecution attorneys are in a side bar right now with the judge. we can confirm president biden's son, hunter biden, will not take the stand in his own defense for gun felonies he is accused of. the defense and prosecution again have rested. that means the case could be in the jury's hands as soon as today. i'm harris faulkner and you are in "the faulkner focus." hunter biden arrived just ahead of today's 8:15 a.m. start. the usual family entourage including jill biden and james and valerie were there. in the first five days of the trial witness testimony came from hunter's ex-wife, two of his ex-girlfriends, one of whom is also his brother's widow and his grown daughter, naomi. they deeply, deeply detailed personal and emotional, they dove deep into the first son's drug use and abuse. hunter biden as you know is accused of lying on this federal form. look for yourself. he tried to deny his drug use when he was buying a gun in 2018. you can see he checked the box that says no to the question using -- about using and being addicted to illegal drugs. that has been the defense up until now. very odd. his attorneys are arguing that prosecutors have not offered evidence their client was on drugs the day or when he bought it. a lot of people disagree with that. >> much of the testimony has been that you didn't see him on that day. you don't know he was using on that day. testimony he was using right up around that day and so it requires a little bit of circumstantial evidence for the jury to find guilt beyond a reasonable doubt but seems like there is plenty of evidence where they could draw that inference. a bit of an uphill battle for the defense. >> harris: andy mccarthy says this about hunter's choice not to testify. >> i think looking at his potential sentencing guidelines it looks to me like even if he gets convicted here he has a good chance of avoiding a prison sentence. that calculation can change if a defendant takes the stand, so i think it is a smart move. >> harris: let's begin with senior national correspondent rich edson outside the courthouse. a lot of activity in wilmington, delaware moments ago, rich. >> a lot of activity. this morning hasn't gone as we had expected. there has been a lot of private conversations with the judge ongoing now, by the way. the prosecution has rested. earlier the defense had rested and right now the attorneys are conferring privately with the judge to figure out the next steps. we could very well have closing statements by both sides today and jury deliberations by the afternoon. after the prosecution -- defense rests this morning the prosecution called a rebuttal witness erika jenson. she was assigned a case last year to connect hunter's drug use to the time of the gun purchase. prosecutors were trying to establish that hunter was here in wilmington, delaware, on october 16th, 2018. that was reboutal to hunter's daughter's testimony friday suggesting that perhaps he was up in new york at that time. declining to testify for hunter means it could move to a conclusion quite quickly. prosecutors alleged in october of 2018 hunter biden was a drug user who purchased or possessed a gun and swore on the federal form he was not a drug user. they produced witnesses and passages from his own audio book to try to prove that case. called his ex-wife, ex-girlfriend. sister-in-law hallie and who hunter had a relationship with after beau died in 2015. the defense has drawn testimony that none of the witnesses actually saw hunter use crack the week and a half he possessed that gun. as for what happens next here, after the jury deliberates at some point, whether we get to final statements, closing statements today, hunter biden is not finished with the legal process. he has got a court case dealing with his federal tax cases in los angeles. that is scheduled for september 5th. note president biden was asked if he has ruled out pardoning his son. he said yes. back to you, harris. >> harris: rich edson, thank you very much. paul mauro, attorney and fox news contributor. you worked in the d.a.'s office as an attorney. with me now, hunter biden got so much protection to hide a key piece of evidence. the laptop in a moment. that turned out to be a lot. i want to read a line out of the telegraph, a headline. they interviewed or per her testimony zoe keyston, he smoked crack every 20 minutes on a hotel binge. they have to prove there was a time when he wasn't doing drugs. how do they prove that? >> pretty difficult. so i any as a lot of the commentary has gone on the network here the defense strategy is two-fold. we've all heard jury nullification. elicit enough sympathy from the jury to say irrespective of the facts we aren't going to go for a conviction on hunter biden even if it's not a unanimous acquittal, a hung jury is all they need. they are banking on that one person i'm not going to go there. as you and i were talking about what i then question and haven't heard this elsewhere, why the prosecution didn't ask for an anonymous jury. in this case, if that -- you know this case is going to be held in biden country. you know that there is the possibility of some subtle coercion outside of the purview of the jury. >> harris: you are being kind. >> why not say i want an anonymous jury. it happens in mob trials and things like that. you don't want the jury to be influenced by outside factors. >> harris: you said the defense is going to go for jurors' sympathy. well, they see his stepmom every day and relatives showing up and you made this point about jill biden. >> right. she is in court and in my mind taking notes. she is not the lawyer. and they see that, all right? we have to remember also the president of the united states visited one of the key prosecution witnesses here. so there is something around this thing that wreaks we're in biden country, remember that. jury was chosen quite quickly. they are im paneled and in there. it is a small state. >> harris: can i make a couple of comparisons that we saw with president trump in new york, something different than what we're seeing about biden country in delaware. first of all, it would seem that sequestering this jury wasn't really a problem because it moved so quickly. trumps stretched out for six weeks. we would argue detailed information from strippers and sex film workers that didn't have anything to do with the charges in the case. and this the witness's testimony did. look how quickly they wrapped this up. is that a good thing? does it work well for the defense and prosecution? >> the prosecution in this case made a good case. they have a lot of strong evidence. quite pointed, as you say. there wasn't a lot of extraneous stuff. comparing it to the bragg case is apples and oranges. the bragg case is a unicorn case. i've never seen anything like that and i think it is no revelation to the audience it's appealable for all those issues. >> harris: speaking of unicorns that they said was russian disinformation. >> very unfortunate we had 51 of our supposed intelligence leaders come out against that laptop calling it russian coercion. >> harris: after first denying it even existed. the f.b.i. had it all along. >> you have to say to your? chris wray said they had it for a year and didn't want to influence the election. why wasn't that put out there, both sides republican and democrat deserved the truth about that laptop. that's what we pay them for and that should have come out. i have to say president trump is under the executive, the f.b.i. president trump at the time in the midst of an election should have said christopher wray you work for me. you will give a press conference tomorrow. i won't influence it but tell the american electorate is it legitimate or not? look at the economy, optimal color is green, you hear me say that every day. trump gained 15 points in that time. congressman james clyburn of south carolina down played the numbers saying i don't think black voters have left the fold. i don't know what's going on with the polling taking place here. how can the polls get that so wrong? >> well, i think what biden needs and we haven't seen it so far, harris, is a program to revitalize the economy, to bring down prices at the pump and the grocery store, and most of all to acknowledge the pain that people of color, african-americans, hispanics, asians -- >> harris: all americans, everybody. >> yes. i was speaking about the minority vote but it is all americans. so far we haven't heard it, harris. and it is a tone deaf reaction from the white house that i think is explaining what we pick up in our polls, too, which is a precipitous decline in biden's support with minorities. >> harris: i think it's, you know, generous of you to describe it as they are not seeing it. of course they are seeing it. they are manipulating what people know about it. tammy. >> yes, i think this is what is kind of striking is you look at a poll like biden's loss of 30 percentage points. you could argue as senator clyburn is if it was five points or something within a margin of error, my goodness, while we all look at polls with a grain of salt the fact is it's a shocking trend. that's the kind of thing you can see in polls that matters. and they are going back, it seems, to the we don't believe the polls, which is a mistake. and i think part of that mistake is rooted in that they thought their constituencies of people of color, women and gays have all been trained long enough to vote a certain way no matter what else was going on. and they now do not know how to adapt when those people who are supposed to be zombie voters actually realize and care about their own lives based on policy. >> harris: you know who hasn't been kind of groomed along the way to vote a certain way, those people who will be their first and second time voting. young voters and leaving biden, too. allies have launched a new super pac called won't pac down. it's efforts are targeting the youth vote to democratic strategist james carville who hasn't made a secret of his feelings. >> we have a choice to make no november. it isn't a choice that i was crazy about. our action was very public that i thought that president biden should not run for re-election. but he did and it's him and trump. >> harris: talk about distancing yourself from the candidate. concerns over biden's age and fitness were on full display in france this past weekend. the marking of d-day. the president looked confused many times. capped off the visit with this special gaffe. >> president biden: there is a new horizon, a sense of some within the country wanting to let that slip. the idea that we become semi isolationists now and that idea we had to wait all those months just to get the money for iraq because we were waiting. it just -- it just not who we are. it is not who america is. >> harris: it's also not who iraq is. he was obviously talking about ukraine. look, mistakes get made. but this president is profoundly gifted in making mistakes that count. >> if i could -- i want to add in this regard. what we think about james carville's concern about how you appeal to young people and people of color, how about just doing things that help the country? how about doing things that help very basic issues, the economy, the border, crime that you actually behave in a way that indicates and pass policy and do executive orders that help improve people's lives. this is not brain surgery. you can be joe biden and you don't have to be the democratic party figure how to micro manage these leastist groups and make everyone happy just do your job and you would be fine. >> harris: doug. >> yeah, i would say that there is an additional problem with younger voters, again all younger voters, which is the candidacy of robert f. kennedy, jr. who is running against what carville was talking about, the lack of a good choice, the failure of the system to deliver. >> harris: democrats didn't want him and made it very difficult for him to stand in the room. let's not forget that part. >> no, and they are still doing it harris and they will continue to do it because they are afraid he will pull votes away from joe biden especially with younger people. and until i think tammy is right. i wish she was wrong. i can't say she is wrong. there needs to be a program on the economy, on inflation, and on the border that is rational, nonpartisan, and responds to people's concerns. if joe biden doesn't do it, i don't believe he will be reelected. >> harris: well, i don't believe it is going to happen. anything could happen. we're less than five months out. we'll cover it stem to stern. with young voters, again, tammy, you are so right. they don't have a habit of voting yet so what they do this time democrats had better pay attention to. great to see you both. thank you. keeping you updated on hunter biden's federal gun trial. both the prosecution and defense officially rested so as we were starting the top of the hour it just happened. the judge start evidence to read jury instructions after a side bar with the judge and, quote, up until the point about deliberation. she says after those partial instructions there will be a lunch break and then closing arguments will begin and the jury is likely to get the case and start deliberations later today or first thing tomorrow morning. in other words, this is going very quickly. we'll bring you more of the news out of the courtroom as soon as it happens. nearly a week into president biden's executive order at the border one governor there says it has already made things much worse. we said it would. he turned on a spigot, remember last midweek wednesday i believe it was we had 10,000 people come across the border. his executive action is doing nothing but making things worse. we can see that on the cameras. new memo is now out telling some border agents, specifically to the san diego sector but shared, which illegals they can simply let go and just a hint, no, they did not all go through checkpoints and not all here legally and they would never qualify for asylum. we'll get into it. a daring hostage rescue in gaza where anti-israel protestors are raging outside the white house. which side is she on? it's not hard to pick a side here. trey yengst is in tel aviv covering a busy weekend in israel. that was some heroism to go get those hostages, trey. >> good morning. it was certainly the happiest weekend in israel since the war began. four israeli hostages were rescued and now home. tears erupted across the country in the streets and beaches in tel aviv. israeli civilians at a hospital were reunited with loved ones. embraced and laughed and cried. new video reveals part of what they were doing during that operation to save these israelis. special forces engaged in intense gun battles with hamas militants storming two apartment buildings in central gaza. helicopters later took the hostages to safety. one mother describes what her reunion was like. >> we are very happy to see he is healthy. he looks healthy, looks happy. infinitely happy he is back home. we are infinitely happy to see him. >> for israelis it was a day of hope. palestinians a day of death and destruction. the health ministry says nearly 300 people were killed during the operation. videos showed a hospital overflowing with injured and dead patients. on the raid over the weekend there was a major political shake overnight. two members of the israeli war cabinet resigned from the emergency government. >> harris: quickly before i let you go. i want to explain exactly why there were civilians, innocents is our vice president called palestinians caught up in all of this. it is war and war is hell but they were in the way of what was going on because hamas put them there. it is my understanding that they went into a refugee encampment area and hid the hostages among them. what can you confirm? >> yes. hamas has been holding the hostages in heavily populated areas and the refugee camp looks more like a small area within a city. there are high rise buildings as high as you can build them inside gaza and this area is populated with tens of thousands of civilians. israeli special forces were operating in this area and we understand according to the israelis that the hostages were being held in houses that were linked to members of hamas but civilian homes. this illustrates how complex an operation that it was. certainly the israelis are going to answer some of the questions that we still have about the ratio of civilian deaths regarding this operation. but when you see people holding flags of hamas and wearing the head bands of the brigades they aren't making a distinction between hamas and the palestinian people and it is a critical distinction what they talk about what's taking place on the ground in the middle east. >> harris: those people are trapped and hamas is willing to let them die so they can protect their human shields and hostages belonging to multiple countries. very sad, very sick. it is war and this goes on. by the way, we're waiting to see if hamas actually accepts the cease-fire deal. that would give up their position so we'll cover it. trey yengst, always a great job from you. the legacy media are picking the side you may assume a "washington post" headline more than 200 palestinians killed in israeli hostage raid in gaza. the associated press gaza's health ministry says 274 palestinians were killed in israeli raid that rescued four hostages and it went on from there. >> it is appearing to be a high civilian death toll. would there have been a warning to those civilians for them to get out on time? >> well of course we cannot anticipate israel to be warning ahead of a raid to extract or save hostages. >> did you factor in the loss of so many palestinians in this operation? >> i would be very cautious at accepting any numbers and figures that hamas are putting out. every civilian life lost in the war is a tragedy. >> harris: pushback in a pair ever editorials. israel's righteous rescue. hamas started the war with a massacre, took the hostages, hid them in crowded civilian areas and when israel freed them hamas responded with heavy fire including rpgs. people are condemning israel. it makes us wonder if the west has lost moral disturnment and instinct of self-preservation. hamas could not survive without enablers around the world. in "focus" now is ron johnson sitting on the homeland security committee. we all have a heart for the people in every war, innocents being caught in the middle of it. but when you hear our reporter say some of the hostages were being held in civilian homes that had direct ties to hamas, how on a battlefield in the world could you separate that out? >> good morning, harris. the reality is you can't. people have to understand and remember it was about 70 percent of palestinians that voted to put hamas in charge. it was hamas that broke the cease-fire by slaughtering 1200 israeli civilians. hamas that took the hostages, hamas that hides its weapons and themselves among civilians and hostages as well. there are innocent civilians but probably complicit as well. how do you separate it out? again, i think this war, my guess is it could already be over were it not for the interference of the biden administration trying to hold back israel from completing what must be completed, which is the destruction of hamas, they start moving forward in terms of how will gaza be governed? the longest the war draws out more people will get killed. >> harris: the politics of this for the prime minister netanyahu and israel and two cabinet members is being talked about today. they have left because of leadership decisions, we don't know exactly why. you are there and in the know on the hill. what's going on? >> again, i don't want to engage in discussing israeli politics. that will be up for the israelis. i have a sense the vast majority of israelis support the current government. they found what happened on october 7th abhorrent and recognized their survival is at stake. the only people talking about genocide are the palestinians, hamas. it's not the israelis. so again you have to look at the reality situation. israel has to do what has to be done, destroy hamas so they can hopefully at some point in time live in peace. it's the palestinians that refuse to recognize israel's right to exist, palestinians that talk about genocide from the river to the sea. that's what they are talking about. >> harris: well, and desecrate the white house grounds. they have plenty of support on america soil as we put those pictures back up again. senator, last week president biden suddenly decided to do something about the border chaos, five months before the election. and just last night fox obtained a memo from customs and border patrol sent to agencies in the san diego sector. it told them to release people from all but six countries in the eastern hemisphere. release the illegal immigrants that they knew they didn't qualify for asylum coming in between the checkpoints in many cases. homeland security secretary alejandro mayorkas defended the president's order. >> the bipartisan deal was rejected once, we pressed for it again, it was rejected a second time, and then we developed this and have implemented it. we're at a very early stage. our intent is to really change the risk calculus of individuals before they leave their countries of origin and incentivize them to use the lawful pathways that we have made available to them and keep them out of the hands of ex employ tateive smugglers. it is early. the signs are positive. >> harris: what signs is he talking about? almost immediately the numbers of people crossing got bigger. >> right. i don't know what the secretary is talking about. the fact of the matter is bipartisan deal rejected because it codified most of democrats open border policy and weakened a president's authority to secure the border. the real tragedy here had president biden done nothing, just the successful programs that secured the border in place, we wouldn't be talking about an immigration bill, setting up illegal immigration system. taking care of the daca kids. that was already on the table during the trump administration. unfortunately president biden won and wants an open border. he opened it up and used the presidential authority trump used to secure the border to open it back up and had the authority all along and now all he is doing with his executives orders is political cover and codifying his own border policy. >> harris: you said it twice. had biden done nothing. well, the israel/hamas war you said would probably be over at this point. israel is continuing to do what it has had to do since october 7th. if he had done nothing on the border, which we know he is a professional at. he said he couldn't do anything. he did and made it worse. your last word. >> president biden's administration, democrat policies, the radical left's ideology is destroying this country. so those are overt actions they're taking weakening america and making the world a more dangerous place. they need to be defeated in november. >> harris: senator ron johnson, thank you so much for being in "focus" today. good to see you. >> have a good day. >> harris: "the new york times" actually put what they call biden's tall tales under the microscope. that shouldn't have been hard. how much did they have to magnify it, by one? >> well, i think certainly this league is majority black and there is a large percentage, different studies that have been done, believe it or not, on what percentage of the league is also gay. and we know caitlin clark clearly is white and has a serious fiance boyfriend and she is straight. and i think there is an element here that is impossible to miss where you have a largely black lesbian league that doesn't want to welcome a white straight woman who is getting all of this attention and all of these accolades into their league like you ordinarily would. i think there is a lot of analogies in sports that would apply. let me give you a good one. when tiger woods came into golf, he brought a brand-new audience to golf. tiger woods is nowhere near one of the 12 best golfers in america right now but he elevated the sport to such an extent that if you had a golf tournament, you would want him there in a heartbeat because he would bring an audience. phil mickelson grew because of him and signed for live by the same reason. one of the best draws. that's true of caitlin right now. she is still elevating and i think one of the 20 or so best players. >> harris: we'll see how it all shakes out. appreciate you touching on some of the tougher issues to talk about. that's what the players and coaches are talking about right now. how can they not?
