The judge writes that the requests are, quote, far too broad and amount to an improper Fishing Expedition into general discovery. They seek information on topics that are not relevant, end quote. I think trumps attorneys have been arguing that for a week now, have they not, with Stormy Daniels . Yeah. We just spent two days with them trawling the entire ocean of lurid details with Stormy Daniels. For this judge to express concern that maybe this is a bit too broad really, im sure, produced a couple of muffled chuckles in the room. Pomerantz is an interesting character because he was brought in to make this case. He and another prosecutor resigned after bragg decided to throw a flag on the case. Remember, braggs predecessor declined the theory. Pomerantz and his colleague pushed it and bragg also had misgivings. Pomerantz did a Public Campaign to Pressure Bragg to bring the charges. His own office told him you shouldnt do this. This is still under investigation. You are a former prosecutor. You are undermining your own office. But pomerantz was unrepentant and it worked. Bragg knuckled under and brought the charges and why they wanted to bring him forward. I am not surprised by the judges ruling. But coming after the Stormy Daniels catastrophe, the r rationale is a bit glaring. Martha it feels like the things the defense brings forward will all be part of their appeal case if there is a conviction in this case. Would this be substantive in terms of an appeal that this witness was denied when other witnesses could also be considered broad . It will be cited. This is going to be the weaker of the challenges because it is very hard to knock a case out on selective prosecution. I have tried it as a criminal defense attorney. It is very hard. Judges dont like to get into motivations. Show me there is no crime here. They can, there is no crime here. The reversible errors are mounting in this case. One of the earliest ones was this judge allowing the prosecutors to make repeated references to Election Violations suggesting that trump committed Campaign Contribution violations. He did not. But thats the more likely grounds for reversal. Bill jonna, i dont mean to cut you off. Well get your comment. They just refed trumps comments before he went into court so here is the video and well bring up the audio and listen together. Wretched assault on the rule of law. He said my concern is not just protecting daniels, my concern is protecting the integrity of these proceedings as a whole. The reason the gag order is there is because the judge said he cant trust trump to go after the witnesses while they testify. And therefore the prosecution does not share the witness list with the defense, with one exception, Michael Cohen who will be there monday and that just happened right now. The judge says i cant keep filing the guy. I cant shut him up. If you want to protect the integrity of the proceedings you have to let the lawyers on both sides deal fairly and he can tab throw trump in jail and shut him up and allow Defense Attorneys to get ready properly for each witness. Jonna, am i out there or would you please answer what we consider todays stupid question . No, its not a stupid question. I have to begin with what integrity . This case has had none since day one. Weve got 34 unsupported charges. We had the prosecutions case officially jump the shark with two days of Stormy Daniels completely irrelevant and unnecessary salacious testimony. Here we are purposefully waiting for monday to call Michael Cohen so the trumps team does not have the weekend to prepare after the star of his direct examination. There is no integrity to protect here. This is just more of the same. This judge trying to shut up donald trump for no reason, for no valid reason essentially. The prosecution knew what their witnesses were going to say and adds to the whole feeling that this was not brought because they wanted to seek the truth. This was brought for political purposes. The good news is, we are coming down the homestretch, right . Were getting ready for the finish line and if anybody thinks Michael Cohen is going to have a smoking gun, theyre wrong. He will be the clown at the end of this rodeo, more Entertainment Value than anything else and thats it. But at least that will be the period at the end of this long runon sentence. Bill stand by.
