quickset the whole purpose for him have an agency called ocr the agency that informally ran its sole obligation is to make sure federal funds are not used to support discriminatory behavior. it does this on a whole host of other issues that need situate with anti-semitism. now we come a, at the brandeis r filing complaints and the biden administration says it's waiting for complaints but the fact is they don't have to wait the secretary of education has full authority to conduct self-directed investigations on his own any time he turns on the television or opens a newspaper and sees what is going on. and if he turns on the tv at all or reads the newspaper then he has got to know that his education department funds are going to support these activities and it has to stop. mark: i saw a brief almost passing statement by hammett which he says they're going to start to look into this and so forth. i guess what bothers me is certainly going to start to look into this. you were at the department of education. i believe there was an executive order signed by president trump i believe you're one of the main authors of that executive order. so you saw this coming. president trump saw this coming. you began to try to do something about it before joe biden took over. what did the biden administration do with this executive order or this document or this regulation that was intended to address to some extent anti-semitism on our campuses? or some kind you mention that it's important and timely paid the biden administration claims they have not rescinded the trump executive order on commenting and tyson tis and be that they've rescinded many of president trump's other orders this else enforce it and effect but there is no indication they are really using it the way it needs to be used. they have promised the white house i as promised of the unifd agenda that it will issue regulations that will codify and extend president trump's executive order on combating anti-semitism but it has now twice delayed the regulations that has promise. currently they are self-imposed extended deadline is december of this year that is just a next month but they are not talking about it there's no mention in the recent report to congress. there is no mention of it in the national strategy on anti-semitism get it supposed to be here next month i think we should be asking where is this an prm this notice and has been promised over and over again we need to see action from the education department. >> what exactly did executive order to do that president trump signed? i don't believe any president has signed an executive order like this and combating anti-semitism is that correct? >> tones average at anything like that we saw significant policy advance under president george w. bush we saw some good action under president obama. with the president trump we saw something on a precedent about with president biden we have seen some good words but not yet real action for the executive order in combating anti-semitism signed by president trump was a game changer. it made very clear that jews, jewish students are protected under title vi of the civil rights act of 1964 that was important it had been informally understood as a guidance letter i offered in 2000 for the first of its elevated to the level of executive order. more importantly president trump directed ocr and other agencies to use an important definition the so-called pirate working definition and all applicable places. you might think a particular definition cannot do very much but it does make clear not every criticism of israel's anti-semitic. but some activity some conduct against jews relating to israel and we are seeing jews being a beaten up, followed, harass, et cetera. some is anti-semitic to provide specific standards for dealing with it. without the standards without the tool ocr is rudderless they really didn't to take the trump executive order and turn it into something more durable. a regulation that simply says what president donald trump said. >> kenneth marcus when we returned my question to you is why are they doing these things? i do not see why they can't initiate even at 19 dealing with the horror shows we are shooting on american college campuses the authority of justice has the authority sent over racism african americans it certainly has the power to some extent with respect to sow the most outrageous anti-semitic activities. the problem might be in parts of the perpetrators we are seeing now are more on the progressive side politically within colleges and universities that may be a problem. the vita ministration is generally been more effective of anti- semitism and racism coming from the rights of course they showed they should call it out everywhere. what it calls out more effectively forcefully and formally when it comes to the left as well. i think the problem with anti-semitism is when it is systemic, it is ubiquitous. it's taught, it is funded which is what is happening on the radical left right now and in colleges and universities and beyond you have students for justice in palestine. you have islam g how to groups. you will have funding network involved in all of this. you have international answer inc. we have care. this is what it has produced. while all of this is going on they talk about islamic phobia. were talking about islamic phobia not because it's ubiquitous or systemic of the united states are talking about to take attention off of the anti-semitism which is a pouring out into the streets. which exists in over 200 colleges and universities. just by tenured professors and so forth. this is why think the attorney general of the united states would say something to do something more than he has the last comments from you sir?
