>> i think it is between ron desantis and nikki haley. haley hit all points of concern to americans. she shed light on why we need to support our foreign allies to stop the spread of communism and set a feasible and pretty reasonable solution to the abortion argument, which could unify the country. ron desantis was pretty strong on the southern border and spoke heavily about labeling drug cartels as foreign terrorist organizations and treating them as such. drug cartels are destroying the united states and our communities and that has to be dealt with accordingly and now. >> todd: former president trump absent from the debate, held a rally instead. trump has 42% support from ispanic and 22% from black voters. we've seen this trend for a while, these numbers are different level. here is trump's message last night. listen. >> we are a nation that has lost confidence, will power and strength. we are a nation that has lost its way, but we are not going to allow this to continue. >> todd: aj, why is trump resonating more now with minority voters? [ all snoring ] this is going to wreak havoc on overtime approvals. anything can change the world of work. from hr to payroll, adp designs forward-thinking solutions to take on the next anything. answering a multitude of questions about her father's finances and the family business. >> the former president's attorney alina habba joins us now. thank you so much waking up early. a very busy day yesterday and all throughout the week. we don't see ivanka trump a lot anymore. she is much more of a private person and she was called into testify yesterday. what was that like. tell us what happened. >> i think, let's start from before she came into testify. i think there was some frustration there because she has been dismissed from this action. and many people don't realize that. because the judge proceeds as if she hasn't as if there is no statute of limitations and a lot of things decided by the appellate division. and he just regards it. so she came in though. she was great. she really was epic on the stand. just stoic, answered the questions directly. was very factual. the facts are good for us. sos itan uneventful day. i think that's why it was pretty quiet in the press. there were no fireworks. >> todd: interesting. the a.g. rested their case. you are directed verdict. that's lawyer speak for throw this thing out because the a.g. did not prove her case. what are your arguments? >> that's right. well, i guess to save them for a couple hours from now and i would tell you to attention. but, most importantly, every case has certain elements that you have to prove. one of the biggest elements is intent to defraud. you have to show intent and reliance. we are talking about sophisticated banks. we are talking about deutsche bank and i said if i gave you a number and say mar-a-lago is worth a number. they will take a number and say let my people do my vetting. they have some big lawyers. some big firms. smart people working for them. they do their own vetting and they say okay we want a personal quarantine because you have a lot of cash. let's take that and then we are good with it. here's the deal. they're putting their nose into private business' contracts. imagine a world where now you guys have a being extra. i'm going to put my nose into it and use a consumer fraud statute to do so. that's what we're dealing with. they failed to meet their case primarily because the only person that had any testimony, not surprisingly about the president was, michael cohen. he folded on the stand when i cross examined him. he lied under oath. and, as i said yesterday, he really should be prosecuted for what happened in that courtroom with me. >> ainsley: after the former president testified, letitia james came out of the courtroom and said justice will be served. much the question does still remain. i believe even the judge said that there is really no victim in this crime. >> there is no. >> carley: alleged crime. >> it's not a crime. it's a civil suit for damages. she is using -- don't forget, they tried to bring a criminal action and the d.a. backed off and said there is not enough there there. latisha in my opinion a very desperate human being who sits in the courtroom. i have watched her. she doesn't participate or sit at counsel table. she doesn't practice. she just sits there and taking notes on what she is going to say outside. she says the same thing in her blanket statements because she doesn't have real facts. he lied and no one is above the law. michael cohen you are not above the law and letitia james you are not above the law. you wasted taxpayer dollars and the world is not being fooled. >> todd: one thing not being talked about enough when you listen to people on the other networks your team and the president looks to me like they're baiting both the a.g. and this judge to say really stupid, stupid things that on appeal, if you end up losing, are going to get this case reversed. is that the strategy? >> i can't answer that question. i will say i don't think you have to bait these people. i just don't think they're making intellectually wise decisions. and there's a record. and the record already speaks for itself. >> carley: really quickly before we move on because i want to talk to you about something else. what's going to happen in court today and when does this all wrap up? >> today today is a really important day. we are going to move for a directed verdict saying that they have rested yesterday. you didn't prove the elements of the cases. certain -- this case should be dismissed. it should never have been brought. now, would this judge -- i think he is going to give us an ear? no. we have to make a reasonable doubt row, again. we are going to do so. and we will see what happens after that. we will start our case in chief on monday and bring up our first witness. >> carley: there you go. all right. >> todd: i think you saw she is a pretty good lawyer. she didn't take any of my typical cross-examination questions. she is on the gate. i will let you play lawyer on a different case, if you will. hunter biden, brother of joe biden, jim biden, all getting subpoenas. >> yeah. >> todd: if you have hunter biden in a deposition, you are deposing hunter biden under oath. what are you asking him? >> about the money. follow the money. you always have follow the money. it doesn't lie. he lies but money doesn't lie. they have a paper trail. you see marjorie taylor greene putting up pictures and a beautiful chart somebody on fox put up saying the money went from here to here to here to here. shelteringexactly there it is. sheltering it doesn't matter money doesn't lie. then there is the images, unfortunately a big trail of images, certain personal issues he has going on. minors, drugs, trafficking. things likes that coming up. i'm waiting to see when they start treating them like they treat us. no one is above the law. show me no one is above the law. there is no way that the biden crime family has not received money from the ccp. we know it. it's a fact. that's a prosecution. that's something we need to go after. i'm going to ask them about the money. i'm going to ask him what he knew about the money, about his sister-in-law and those things we now know and then probably show him pictures because pictures don't lie. >> carley: lawmakers may be able to do just that we do have pictures of the checks and there has been a lot of investigation. the only thing missing is linking joe biden to any sort of influence peddling, but those things could come out in the future. we'll just have to wait and see. >> come here every day before going to court. >> if i get hair and makeup done. >> carley: all before 6:00 a.m. thanks for joining us. >> todd: the fact that you are in trial, we appreciate it. with that. >> carley: "fox & friends" starts right now. have great day, everybody. >> the elites that have put us here, they don't care. i have will fight for you. > restore faith in
