***VO*** The lawsuit ***VO*** The lawsuit against the city of Boston brought by the family of a man killed in a police-involved shooting... WILL continue. A federal judge dismissing the city’s motion to dismiss the case.. 41-year-old Juston Root was killed back in February after allegedly pulling out a fake gun at Brigham and Women’s Hospital. Police pursued Root to a shopping center on route 9 in Brookline. That’s where they fired 31 rounds at him in three seconds. His family says, police were NOT following proper protocols ***SOT*** ***CONT VO*** The family contends police need better training on dealing with people with mental illness.
