Weve also got this this morning, the department of justice deciding to appoint a special council to the hunter biden investigation as the doj drops his case in delaware and his lawyers insist the plea deal which fell apart was negotiated fairly. Hear what senator ted cruz told maria. All of this on the heels of a possible fourth indictment of former President Trump, this time in georgia, which could come as soon as this week. Well, it is time for the hot topic of the hour, House Oversight chair james comer blasting the hunter biden special Council Appointment writing in a statement, he says, quote, this move by attorney general car l garland is part oe justice departments efforts to attempt a biden family coverup in light of the committees mounting evidence. Maria asked texas senator ted cruz about this yesterday on sunday morning futures. Maria who has the upper hand from your standpoint in terms of the constitution, is it the special council, dave weiss who may be able to freeze all information flow to congress or is it congressional lawmakers and congressional investigators who have unearthed all of this evidence . Its both. The allegations are that hunter was selling official favors from daddy when he was Vice President of the united states. This is often discussed as hunters business dealings. This was not hunters business dealings. This was joe bidens business. Hunter was the salesman but the product was joe bidens personal favors and that is if true corruption at the very highest level of government. Cheryl this as Hunter Bidens legal team is responding to the justice departments decision to drop his case in delaware. They are arguing that the settlement was negotiated fairly and in good faith had with prosecutors. Thats a big question mark there. I want to point what the wall street journal writes in an oped, they write Merrick Garland belly flopped again to the 2024 campaign. Honestly, this is amazing. Were talking with the special council, the goal of the special council, theyre supposed to be impartial, not supposed to be interested in the outcome in favor of the government. What does that mean when we have someone wh has actually stalledn investigation to the point where it surpasses whats required in order for somebody to prosecute it. From delaware, the state, the home state of the president , and theres other incidents theres a lot of suspicion with weiss. Were questioning why did we choose weiss. Theyre not supposed to be federal officials. Thats kind of in the law it. Cheryl theres been a lot of back and forth too. You know, mark, he apparently lobbied for it and then he was denied but then this week Merrick Garland makes the appointment. Again, why him . And in particular, i think the criticism of weiss is the tax charges, felony and gun charges, that was such a sweetheart deal. Hes the special council now . To charises points, they were dragging their feet until the statute of limitations expired on the big time charges. Thats absolutely ludicrous. You look at the appointment of david weiss. Its almost like you would think on the surface level republicans might be okay with it because you have a trump appointed attorney, you finally have the special council investigation, but this is its tainted, right . We have a guy who brokered the sweetheart deal, we have a guy who was dragging his feet on the felony tax charges and it seems more and more so today that we are living in a twotiered justice system, right . I mean, you have one party which they get nailed and then youve got another party that can kind of skate free and do whatever they want but as we look at the special council investigation, i hope hes going to be as thorough and as fair as it should be. That remains to be seen whether or not that will happen. Cheryl in particular, because and the journal writes this as well, this is politically convenient for weiss and garland, means both men can use the excuse of an Ongoing Investigation to refuse to answer any questions from congress. Thats the big story here. I think Merrick Garland is going to get exactly what his goal is out of this which is to bury as much as possible and drag this out past the elections which ultimately theyre trying to do here. Cheryl theres also this, democratic congressman dan goldman blaming former President Trump for Hunter Bidens plea deal falling apart. Watch this. And thats why this plea agreement has broken down, because of the threat of Donald Trumps weaponization of the department of justice if he were to become president. Cheryl what do you make of that, is that correct. Were talking about a threat of donald trump weaponizing the doj but what were experiencing in real life is the reality of the Biden Crime Family weaponizing the doj. So you cant have your cake and eat it too, guys. I mean, unfortunately, this is already happening and i think what President Trump would intend to do is do everything he can to level the Playing Field and make sure that if there were crimes that were happening, because theyre talking about 20 plus Million Dollars now of deposits that the biden family has received. If you not only look at food prices, but you look at fuel prices, the average fuel price today, 3. 84 a gallon across the united states, almost 1. 40 greater than when joe biden came into office. Bidenomics is doing nothing to help the average American Family deal with these increasing prices. In fact, i argue it actually added to inflation. Cheryl i wanted to ask you as well as were looking at the effect of gas prices on households, this gallup poll, 67 said this caused financial hardship, looking at diesel energy, wholesale gasoline, jet fuel as well. I want to move on to the issue of china and the oil market. I think we need to be very concerned about the growing relationship between china and russia. I can tell you that they mean what they say, when xi jinping talks about having his military ready by 2027 to take taiwan, we need to take him seriously. That means we have to focus on our relationships with countries in the indopacific. In fact, i just got back this morning from visiting with countries there to make sure our relationships are strong because were going to need that in order to deter china. Theyre very serious about this and i can tell you a leadership in the executive branch needs to call this for what this is. This is an incredibly serious threat. You cannot underplay it. You cannot believe that capitulating to xi jinping somehow is going to change his behavior. Its not. He means exactly what he says and that is he is going to be prepared to take taiwan by 2027. The White House Asking Congress for 40 billion in new funding. Theres 24 billion for ukraine, theres 12 billion for disaster relief. I think we can agree some of that money is needed for hawaii. Only 4 billion for the border and the fentanyl crisis, only 4 billion when new york cities about to spend 12 billion on migrant shelters. Axios is reporting part of the border money would go to a temporary Housing Program for my grand families. That would give them more freedom. Your thoughts on the fact that billions more goes to ukraine when only 4 billion is going to our border . Well, it just goes to show that theres mixed up priorities with this administration. We need to be focusing on the border. I want to understand too the proposal they have for dollars going to ukraine. Listen, i am adamantly in support of helping ukraine against this unprovoked attack from russia but i want to make sure we understand where every dollar is going there. There shouldnt be a blank check going to ukraine and there should be a reflection of the priorities of this nation first and foremost with the proposals that come to us from the white house and its pretty obvious this one does not reflect what the priorities of this nation should be. As you can see t dow is up 61, nasdaq up 57, s p up by 10. Were going to get retail sales out tomorrow. Economists expecting a rise of four tenths of a percent month over month. Well get a lot of big numbers this week from the retailers weve been following, home depot is out tomorrow. Weve got target and tjx on wednesday, walmart comes out thursday. Joining me now Lpl Financial chief global strategist, quincy krosby. Lets start with the retailers. Thats the big question here, especially when we get down to targets an and walmart. Last quarter we find out from walmart everyone is going there for groceries, higher income individual is shopping at walmart. What does that tell you about the health ha health of the consumer . The consumer is much more deliberate. Were seeing foods prices going up, gasoline prices going up. It means consumers are being more deliberate, more careful. Theyve got backtoschool spending but the question will be its just as you said, the higher income have been going to walmart. Are they going into the other aisles where the margins are higher . Thats going to be an important question for the analysts and the market. Maria mark tepper is on set with me today. Quincy, i have a question for you, the analysts on the street, people sitting at home have been expecting a recession now it seems like for at least two or three quarters. It still hasnt happened. Economic data is still coming in above expectations. The markets up 16ish percent yeartodate. And then the fed fund futures are expecting five rate cuts next year so who is right here . I mean, is there a recession that is possibly going to happen at some point over the course of the next three to four quarters . Or are we going to navigate a no landing kind of situation here . You know, youre absolutely right. I mean, the Second Quarter closed at 2. 4 . Right now the atlanta fed now of course is fluid has us at 4. 1 for the third quarter. Hardly a recession. And the labor market, thats key for spending which is 68 of the economy. If we lose jobs, if the fed keeps raising rates, we dont know, we dont think so, but they might go ahead and raise rates again. If they hit the labor market, Consumer Spending is going to come down and that would lead us into a recession but right now we are sailing through almost easily but the question is, ive got to add this, if retail sales are very strong, does that push the fed towards pushing rates up higher in order to slow down demand . Cheryl so thats okay, thats an interesting point youre making here. I go back to target and w walma, walmart, excuse me, and home depot, the biggest retailers in the nation. Were also going to be hearing from the july fed minutes, were going to get those on wednesday. Goldman sachs expects the first rate cut from the fed in the Second Quarter of 2024. Do you agree with that . So much depends on the data. I dont think the fed knows when theyre going to do it. The question again becomes whether or not they believe that prices are going to continue to rise. And they simply dont know. For goodness sakes, they didnt even know when transitory was going to end, correct . So how do they know when theyre going to cut rates . They are data dependent. But the one thing i do know is that the market is more data dependent than the fed. The market is focused on every data release, especially when it is inflation related. And when the minutes come out, i think what youre going to see is that there is a debate, we already see it out in the press, publicly, between the hawks and the doves. There is a divide between the two groups now, more than ive seen publicly in a long, long time. Cheryl interesting. Well, the minutes are probably going to show more of that, to your point. Before you go, real quick, where are you putting money right now. We like the treasury market, we like Investment Grade corporates, theyre doing extremely well. In terms of the equity market, industrials keep chugging along. Defense spending is up. Infrastructure spending globally with American Companies participating also doing well. And industrials continue to chug. Were keeping our eye by the way on the energy sector. We have seen that the service names, schlumberger, halliburton, all climbing higher and now youre starting to see big integrated names starting to move higher along with higher oil prices. Were watching that, looking very closely at it. Cheryl thats interesting of. Youre making a play on rising oil and energy prices. Thats an interesting point youre making because obviously thats bad for the economy, thats bad for headline Inflation Numbers but on the investment side its a good thing. Well, yeah, there is a major dichotomy between the two but that is the economy is not the same as the market, the market is not the same as the economy. Sometimes it overlaps, sometimes it doesnt. But the point here is, its going to show up in Consumer Expectations of inflation. It has pulled back. But food prices climbing higher, gasoline prices climbing higher, the fed is going to see that inflationary expectations on the part of the American Consumers is going to rise accordingly. They dont want to see that because it gets entrenched if it stays too long and its hard for the fed, any central bank, to unwind that once expectations keep climbing. Cheryl yeah, again, theres a lag effect there, i agree with you. I dont think weve seen the full effects of the rate hikes that weve already had. Yeah. Fox weather correspondent max gordon joins us live now from maui with the latest. Our big question, obviously, are these fires still smoldering, is there still smoke to be seen on the island . Reporter yeah, there isnt necessarily smoke to be seen, though some of the fires are not fully contained, firefighters putting out the hot spots. A lot of questions swirling why the fires started. No official word on why just yet. A new Class Action Lawsuit puts the blame on hawaiian electric, saying they kept winds electrified amid high winds and red flag warnings for high fire danger. The company said they dont comment on pending litigation and theyre focused on restoring electricity. The states governor says an investigation is needed. Ive authorized a comprehensive review of what happened in the early hours of the fire and the hours thereafter. We will build back together, we will find out what we could have done to prevent such loss of life. We are bringing the full force of government to try to do all we can to alleviate suffering. Reporter the local government here still limiting access to the town of lahaina, devastated by fire. Saying it is unsafe and the thetheyrerecovering bodies. Theres an overnight curfew with access during the day limited to residents and people with hotel reservations, more than 2700 buildings were destroyed, the vast majority houses. With so many people without homes, the need is immense. The county estimates around 4500 people need shelter, government and nonprofit organizations are distributing aid. Some say theres too much red tape and help is coming in too slowly. My plea to the government, the state, fema, everything is dont say well youre a church organization, were not going to work with a church organization. And like you said, were running up against the statute of limitations especially for the gun charges so we should expect those to be filed sooner rather than later but for hunter biden, those are much more serious because the diversion he had and the agreement he had would have gotten rid of the f felony for l gun possession, now he would be facing a felony charge in that case. I wonder why now. It seems to me i was calling for a special council for the last couple years in the hunter biden case because i think it wasp wai think it was appropriate. Im not sure if weiss can be trusted especially when the government and hunters attorneys have agreed to such a sweet heart deal in the past. Im not sure this is going to do justice. But i do want to bring in charisse trump, shes got a question for me. The regulation states the person appointed as special council those be outside of the u. S. Government but david weiss is attorney for delaware. So how does this work . Hes a District Attorney for delaware. How does that work, how did they side step this issue . Well, were not sure that this isnt kind of a way to make the special council and make weiss somehow have to trip over that in the future. I mean, im not sure we can trust Merrick Garland to do things not only by the book but also for a reason that is in the best interest of justice. I think as a former prosecutor and obviously having sat in the chair that Merrick Garland is sitting in right now, i know that we made decisions, when i was there, you know, that were only in the interest of justice and on behalf of the American People and we took that very seriously. Merrick garland seems to be willing to make political decisdecisions at least from my perspective, including a special council that may violate the regulations. Obviously, if you assume that hes doing the right thing by appointing weiss as special council, you have to also assume that they thought through the issue and want to give him broadened power in order to pursue possibly charges regarding the foreign crust practices act and foreign corrupt practices and and Foreign Agent registration act. Those are very serious. I cant figure out why now. It doesnt make any sense. I would love for Merrick Garland to explain to the American People why hes doing it right now. Cheryl many are saying its a political move by Merrick Garland. I think part of this is the judge this may be a way to circumvent the judge who basically called out the sweetheart deal that whys negotiated and said no, this is ridiculous. No average american any average american would be thrown in jail for what hunter biden was accused of, especially on the gun charges. But i do want to ask you to move on to another issue here. A fourth criminal indictment against former President Trump could be issued as early as this week. So youve got the georgia grand jury, they may begin hearing evidence against the former president today. Former georgia Lieutenant Governor jeff done kin confirming hes going to testify tomorrow. Heres what he wrote on x. Quote, republicans should never left honesty be 34 mistaken for weakness and youve got end pent journalists independent journalists saying Fannie Willis is required to testify. What do you expect from all of this, in particular from your experience. I think the timeframe is what were all curious about here. Yeah, obviously in georgia the investigations been going on for quite some time. Sounds like theyre going to finally present the case and try to bring charges, but as i was reading about this and as i listened to commentary, i think its very interesting theyre using the racketeering statute that has typically been used against mobsters and organized crime and this is another case like the january 6th case that recently was indicted where they used laws that were never intended for this purpose, that the legislature in georgia never would have contemplated that this would be used in a political candidate case. I just and so these prosecutors that are willing to be so aggressive in their pursuit of donald trump in order to i guess get him and to charge him and in their hopes convict him, i think its dangerous for justice because we need to have, again, ignorance to the law is no excuse. However, you cant assume to know laws that you never thought would apply to you in the first place. This is a case, along did the january 6th case is very interesting as it proceeds to the courts. Cheryl i wanted to ask you about the january 6 case as well. The judge thats overseeing that case against trump issued a protective order and this bars President Trump from releasing sensitive evidence. The argument here is that trumps right to free speech is, quote, not absolute. What did you make of that decision by the judge . Yeah, i think the judge actually made a very interesting choice in where the line is drawn and the limits of the First Amendment. Our Founding Fathers certainly intended free speech to apply broadly. Theres limits. You cant yell fire in a crowded theater for example. However, thats the extreme case. In this case, its only the sensitive documents. I dont think the government necessarily is going to be required to identify those sensitive documents that cant be released so if im the trump team, its going to be hard advising my client, donald trump, as to how this gag order and this restriction applies but, you know, hes a candidate for president. The First Amendment is obviously on his side as it should be as he pursues that office so i would expect that this we pay be back in court fighting this and ill come back on your show to talk about it at the time but this is a very interesting order. I saw a video a week or two ago, there was a shop lifter i believe a 7eleven, he had a garbage can, is pulling stuff off the shelves, filling up the garbage can and they fought back and hit him in the leg with a stick or whatever it was and then they were under investigation, not the guy who was robbing them of their livelihood. Thats how they get paid. And they may not have the insurance that a nordstrom or target has to help them to replace the stolen merchandise. Ch.
