A memory regard from 1 of the early vote devices was not loaded and normally that would be caught by checks and balances within a county which is the reason the secretary feels like in this particular case this it wasnt discovered until we did the audit. Maria more than 1600 of those ballots were for President Trump while 865 were for joe biden. This as the president sounds off on what he says is unfair aspect of the recount. Stock is trading up in premarket trading, its up better than 12 and a half percent at 1459. 55. Cheryl good morning, what a quarter for home depot. This is a dow compon. The stock is up more than quarter percent right now. Double beat. The earnings per share 306, the company came at 318, more than 20 year over year. Revenue, 32. 04 billion, again strong beat that came in at 33 billion. 24. 6 was the quarterly same store Sales Numbers, thats impressive. Also we were only looking at 15 year over year for same store sales, this is the stay at home trend, this is the fixing up your house because youre stuck in your house. I want to give you this, the average ticket was up 10 , thats another incredible number and finally as the senate back to you, they are investing a billion dollars in basically the people of home depot, the workforce annualized permanent compensation enhancements, they will try to move from the temporary workers to permanent workers and enhance through a billion dollar project now the money that theyre throwing into the frontline workers which i think is very important. Again, the stock was higher, its not going into the red, maria, big numbers for home depot, we are waiting on walmart right now, back to you. Maria i wonder if its the expenses that are turning investors off or drill down, home depot shares down about two third of 1 , cheryl, thank you. Joining me to talk more about markets and investing right now is er shares founder and chief investment founder joe, ryan payne and Senior Writer at the wall street journal, Jon Hilsenrath, great to see you, guys this morning, thank thank o much for being here. Great to be here. Maria stock is down. Right, theyve been their revenues are up from last year, this is not really a surprise for many of the analysts because they have been strong Second Quarter now Third Quarter record profit, record earnings, i wouldnt be surprised to see the stock tick up through the end of the day. Its flat, but this is a very strong, very powerful news. Not a surprise because theyve been doing this all year long. We will see retailers come out later this morning. We are seeing strong results so far this month. They are up 25 year to date and this month they are up 5, 10 and kohls is coming out later this morning is up 22 this month although we have to recognize they are still down about half year to date. Maria yeah, i mean, retail giants walmart and kohls will certainly give us a good window, they are reporting thirdquash earnings in about an hour. Jon hilsenrath, the consumer has held up well throughout this, isnt this right . Jon absolutely. Theres what we have pinned up demand. A lot of people have been stuck in their homes, they havent been going out to eat and they have savings tucked away and also massive infusions from the federal government earlier this year. If you kept your job in the crisis youve probably been saving more money and spending to do. If you lost your job, of course, youve got challenges. You know, i think the big question for me is what happens going into Holiday Season. Id love to hear what our other guests have to say about this because the whole Holiday Season has been disrupted. I would think we are not going to see these, you know, crazy black friday lines forming outside of retailers after thanksgiving. Maria yeah. Jon i think theres pinned up demand but how do people go out and express pinned up demand. Probably big for Online Retail all over again. Maria great analysis, jon. Joel, what are your expectations there . What do you think the American Consumer does in this Holiday Season as jon made a point about long lines . We are seeing retailers coming up with prechristmas sales, they are doing a prior to thanksgiving and already trying to take away some of that some of the demand that is being pinned up as your last guest said. We are probably going see walmart with blowout earnings with sales. Theyve been doing it all year. Kohls which probably had the weakest to have 3, home depot, walmart and kohls, kohls will be coming out very soon. They did a very good job in terms of borrowing against revolver, they scaled back inventories, right . They are taking away the feed lines in terms of working capital, they took out inventory for future periods so they wouldnt have excess inventory. They are positioned well for cash but, you know, sales are probably not going to be a strong as some of the other two that we have talked about. Maria by the way, weve got october retail sales coming out this morning, big day for retail. Thats 8 30 a. M. Eastern. Economists are expecting 5 tenths of a percent gain for retail sales in the month of october, ryan payne, impact on markets, is that priced in right now, what do you say . Ryan i think it would be another surprise if it comes in better than expected. At this point we are all assuming retail is really good and the American Consumer loves to spend. Im not quite sure that thats going to drive markets in a big way but i would expect it to be a good number and i think that bodes well for the economy going into 2021, so im liking what im hearing so far. Maria joel, final word from you in terms of allocating capital, you want to buy the market after we saw new records . We are very optimistic and bullish to rest of 2020 and going into the First Quarter of 2021. The moderna news is bigger than pfizer news. It doesnt have to be chilled and can be transported to other pharmacies, normal refrigeration and a product thats a gamechanger. Unfortunately for many of the retailers that suffered it may be too little too late. Im bullish for next year small caps and u. S. As well. Maria thank you very much for weighing in. Joel, check out morning mover, cosco on the rise after declaring a 10dollar special dividend. Cfo says the payout is due to strong Balance Sheet. It will cost the company 4. 4 billion. Cosco is one of few retailers that have stayed open throughout the pandemic, the stock is up better than 2 . Officials in georgias floyd county discovered more than 2600 ballots, netting nearly 800 additional votes for President Trump in peach state. The problem due to Election Officials neglecting to up load a memory card from a ballot scanning machine. This comes as michigan rejects an appeal to void their Election Results ahead of expected certification and the Trump Campaign faces a hearing this afternoon in pennsylvania. They allege voters were held to a different standard depending on if they voted by mail or in person. Joining me right now the opinion writer for the wall street journal jillian, great to see you, jillian, thank you for being here. Thank you for having me. Maria georgia news does not give anybody optimism that everything was fair and square in the 2020 election, whats your reaction . Im really glad they are doing a recount here and doing it by hand. This is important for restoring americans confidence in the electoral process. I think georgia is a model for doing it right in some senses. You know, i think this is less about some of the legal challenges. Its challenging on margin where its not likely to change the outcome of the election, but i do think what it is is an opportunity to look at whats gone wrong, look at irregularities that have happened in some states, pennsylvania is the one that springs to mind and make sure that Going Forward we dont have those kind of a mess. Particularly with mailin ballots, we set a precedent now. We need to make sure that with our elections all americans can have confidence in it even if their candidate doesnt win. Maria but, jillian, what about what we are seeing here in the broader election and these claims from the trump team. Rudy giuliani and Sidney Powell have joined me multiple times and they are zeroing in on the software made by smart maddoc where they say the software was manipulated and changed trump votes into biden votes. Listen to Rudy Giuliani on sunday morning futures. I can prove that they did it in michigan, i can prove, there were witnesses. Every one of the states, we have more than enough illegal documented to overturn the results. Not only did they use a venezuelan to count our ballots, they didnt allow us in key places. They didnt do it everywhere, they did it in big cities where they have corrupt machines where they will protect them. Maria jillian, whats your take on all of this . Its important to have transparency around the elections. The technology concerns, i can see why theres concerns. In pennsylvania where you had one republican poll watcher being turned away, social distancing rules weponized them to keep republicans at a goodies tans from the ballots, thats concerning and then you have the normal shenanigans that happens in cities like philadelphia. This is a state thats known its called, you know, the cash that you put out, campaigns will way to democratic city wards that will go out and get out the vote process, you have the Campaign Cash circulating on election they. Things like that undermine confidence, undermine the publics perception that this is a Fair Election and the lawsuits are about looking into what happens here. And making sure that we have confidence and should be done the right way. Maria but is it being done the right way in georgia ahead of the Senate Runoffs . Both of the Georgia State senatorial seats are up for grabs this january, that could dictate control of the senate and dictate what American People feel in terms of the policy impacting their pocketbook, im talking about higher taxes, the Green New Deal, all of these things that the extreme left wants to push through if the democrats win theyll be able jillian the takes could not be higher. Maria exactly. Is it safe . They just found ballots in georgia. Jillian yeah, i think this is really important. In georgia in particular the stakes couldnt be higher. Youre absolutely about being backstop of run away progressive alleged. If democrats control the senate, youre in real trouble. This is full steam ahead and its really important that going into this race, this is litigated and conducted with transparency. Maria all right, jillian, thank you very much for weighing in here. Maria welcome back, major progress being made on the covid19 vaccine, both pfizer and modernas treatments reporting over 90 effectiveness rate, efficacy rate as the country grapples with undecided president ial election. The wall street Journal Editorial Board out with new oped saying trump, biden and covid19, thats the title. Editorial board writes, Success Stories of Covid Response but theres a serious risk that the biden team will default to instincts and reimpose a culture of bureaucratic control that restricts new medical advances. Joe biden vehicles on speaking on the vaccine news yesterday. If the fda gives authorization to the pfizer or Moderna Vaccine, will you get vaccinated . I wouldnt hesitate to get the vaccine but i also want to set an example and but i wouldnt hesitate to get the vaccine, in fact, dr. Fauci and these two organizations whether moderna or pfizer who have been extremely responsible conclude that it is it is safe and able to be done. Look, the only reason people question the vaccine now is because of donald trump. Thats the reason why people are questioning the vaccine, because all of the things he says or doesnt say, whether it is truthful or not truthful. The exaggerations. Maria Jon Hilsenrath, your reaction. Jon well, i think whoever is in the white house in january theres a huge incentive to get this vaccine out on to the market because the economy hangs on it. Its not just peoples health. You know, obviously we we want to control this health crisis, but the economic crisis is also on the line, so, you know, i think one of the lessons of this whole affair is that, you know, the fda approval process would be improved if its sped up. You dont want to throw out, you know, the Gold Standard testing that goes on with placebo drawn trials and the process should be moving faster. Its in the interest of our health as a nation and of the economy. Maria yeah, and ryan, thats one of the things that President Trump did as a way to mobilize these Pharma Companies to move faster. He took away red tape in the fda, deregulation was one of his tools to get the economy moving overall. So if we go back to tightening up regulations, does that slow down progress on the vaccine front . I mean, absolutely does but i think the cat is out of the bag here. Im with jon here. If you look at it from an economic perspective, you look at it from a health perspective, the fact that we are able to take the safe 3 trial and truncate it from 3 years to a couple of months its so remarkable and you start looking efficacy and how effective they are, its phenomenal. I think its huge for the economy and i think thats going to keep the pace up moving forward. Maria all right. Lets take a short break and come back. Go ahead, jon. Final word. Jon i think one of the Big Questions is what lessons did government and the fda learn from this whole process, how can they truncate this and if we found better ways to get drugs to the market safely and more quickly. You know, this could be one of the Silver Linings in this crisis. Maria yeah, great point. Quick break and president ial promise. Bringing our troops home. President trump plan to go reduce troops in both iraq and afghanistan to a new low. Only 2500 troops in each country before january 20th. Right now there are approximately 4,500 u. S. Troops in afghanistan and 3,000 in iraq. Joining me right now is fox news senior strategic analyst general jack keane, general, good to see you this morning, thanks for being here. Your take on bringing the troops home, reaction . Jack well, the president certainly made a decision not to pull troops out of afghanistan which certainly he wants to do and i think in the judgment of his advisers and what he concluded himself is based on whats actually happening in afghanistan. One, we have negotiations going on but no progress. We dont have a cease fire which is what normally takes place before negotiations begin. Maria yeah, all really important points, general, you think that there should be a core force on the ground to offset these evil forces, isis and others who are still there. President trump reportedly asked top aides to authorize military action against iran and the nations growing Nuclear Program last week. He was advised not to take action by several senior advisers arguing it could lead to broader conflict in the region. An iranian spokesperson says any u. S. Move against iran will face strong response. General, connect the dots here, whats happening in iran and the president wants to take action and your feeling that we need a core group on the ground in iraq and and afghanistan. Jack yeah, what is actually happening here, maria, is that the the un watchdog nuclear agency, iaea, socalled has reported out that the centrifuges and uranium has increased so much dramatically in iran, way beyond the limits to have nuclear deal but not at the threshold of a weapon. Nonetheless, a dangerous pathway. The president has asked for options on that and those options, you know, could be a military strike likely in coordination with the israelis, it could be a cyberattack which we have done before, by the way, admitted by the director of Cyber Command that they conducted cyberattack with the iranians dealing with the election prior to the election in the United States. It could be covert operations. The centrifuge facility mysteriously blew up a number of months ago and missile facility blew up and a number of sites throughout iran that have mysteriously been put on fire, have blown up. Yes, covert activity could be taking activity we think likely by the israelis but also by americans. He has a range of options and we know hes not going to conduct the kinetic strike but we dont know what other options the president is selecting to deal with the iranians. Maria and, of course, john ratcliffe, director of National Intelligence told us that iran was attempting to meddle into our election as well. Iran is against donald trump, thats for sure. General, good to see you this morning. Good talking to you, maria. So come january, we are going to work quickly with congress to dramatically ramp up healthcare protections, get americans universal coverage, lower healthcare costs as soon as humanly possible. We want every single american to know, if youre sick, if youre struggling, if youre worried about how youre going to get going to get through the day, we will not abandon you. That is a promise. Maria that was joe biden speaking out last week on the Affordable Care act commonly known as obamacare. Came the same day the Supreme Court heard virtual agreements against healthcare act challenging protections of preexisting conditions and premium subsidies. The court to announce decision on constitutionality on late spring as joe biden has made health care a key issue in his campaign. My next guest is considered key architect of obamacare as well as massachusetts romney care. The author of jumpstarting america, coauthor Jonathan Gruber. Jonathan, good to see you this morning, thanks for being here. Jonathan thanks for having me, maria. Maria where do you think this is going in terms of the Supreme Court, jonathan . Jonathan well, look, we have to start with the fact that literally every expert including the lawyer who is brought previous cases against aca think this is a stupid case, it really has no merit, and fortunately look like the oral argument supported that at least 5 justices or at least key justices Justice Robert and kavanaugh agree that theres simply no reason with regards mandate to taking down the whole law based on the constitutionality on the mandate. Based on the arguments the court case will go away and aca will stand. Im feeling pretty good about that. If it doesnt, aca is in big trouble, as long as republicans retain control of congress, its going its going to be hard to replace aca. Maria what about those people that have insurance through their company, 180 Million People who have private Health Insurance and they dont want that to go away . Well, thats absolutely right. So basically if you think about the way that the Affordable Care act is really intertwined with our Health Care System in many ways. As we discussed before, maria, it does play a small role. The employers have offer them real insurance coverage, not coverage that, for example, has annual limit so they go to hospital stay and end up with huge bill. With the 180 million americans the Affordable Care act didnt much affect their lives, whether it goes away or not will not have a huge impact on their lives. For those people the real issue is how do we control healthcare costs. Maria so how do we control healthcare costs, thats one of the most important issues i agree with you. Its a really critical issue, maria, and Neither Party has a brilliant answer on it. Its hardest issue given the 12 years of battle over the Affordable Care act. Ironically that was the easy part, coverage of spending money. Cost control is about saving money. That is as you know the hardest part and it means revamping a system where a lot of parties have a vested interest in not letting it change and thats the fundamental political challenge that we face and try to control healthcare costs. Maria let me ask you about georgia as control of the senate will be decided by those two runoff elections in january, jonathan. If both democrat candidates win, the Democrats Gain control of the senate, what do you see happening in terms of health care . Jonathan if Democrats Gain control of the senate, joe biden has laid out 3 things he would like to get done. The first is expand generosity of the subsidies on the exchange, while im a big believer in aca exchange, they arent generous enough for people who are low income. You can spend 20 of income on health care if you are on the exchange and so biden would end that. He would make generous and he would make them available with subsidies to everyone. Not just those below 4 times the poverty line. Thats not politically controversial. Thats just a budget issue. Republicans i think dont want to spend the money, democrats willing to. So thats simply itll happen if democrats control the congress and wont if they dont. Maria yeah. Go ahead. Tell me about the public option. Go ahead. Yeah, so the public option, maria, i call them public option light and public action heavy. The public option lite is advantages on exchange. Without federal government regulated rates to providers, lite and heavy. Heavy is having Something Like medicare that regulates the way providers are paid. Public option lite, the big advantage of it it offers more competition on the exchange which is good but most importantly it offers a route to bring coverage to millions of americans who would be denied insurance in states like georgia and texas and florida with the federal government offered to pay 90 to have costs of covering lowestincome citizens with insurance, but their state legislatures have turned it down selfishly. Thats the big gain there. The public option heavy, thats another step, that would involve regulating rates and that would be opposed. That would be opposed by insurers, it would be opposed by providers who might be worried about getting lower rates. Thats going to be a heavier political lift, im not sure having 50 in the senate is enough. I think thats going to be more of a battle. I think its very important to remember. Maria jonathan, we talked about this before. Go ahead. Jonathan very important, theres two aspects, regulating the rates but offering a route to million lowincome americans who have been really just spitefully denied Health Insurance by state legislators. Maria spitefully . Come on, spiteful. Jonathan the federal government said to florida we will send you billions of dollars toover to cover lowincome in your state and the rest to have country says we will send you money, florida, to cover lowincome citizens and florida saying no, how can that make sense. Maria i know who is upset about it business. Thats one of the reason that is they had to pull in money on other things like raising salaries or investing in it or r d. Jonathan maria, you and i agree. Im so glad that you like my business and business can spend more r d, but this is a separate issue, this is literally the federal government saying we will no, i can imagine voters in other states. Maria lets be clear. We dont agree on everything. Jonathan, we dont agree on everything and we agree on some things and im glad that youre here today. We will talk soon. Jonathan gruber, we will be right back with the morning buzz. Are you frustrated with your weight and health . First up going once, going twice, sold, somebody spent a total of 170,000 on a rare license plate number that was up for auction. The o10 was first used in 1902 in the uk and highly sought after by classic car collectors. Really cool stuff, jon, would you dish out this much money for an old license plate . Jon oh, no, i certainly would not. I have a hard enough time just getting myself new shoes, but but i think, you know, for states this is great news. I think they should Start Marketing their license plates more aggressively because theyre scraping for cash these days with with retail sales down so much, so maybe this is a way for them to get their hands on some money. Maria good point, ryan, what about you . When youre a car collector these things are really important and its priceless. What to expect, coming up. Markets are lower, futures indicating a decline for the dow industrials this morning as we await october retail sales at 8 30 a. M. Eastern, right now, the dow industrials down 157 points, nasdaq is up 30 points and s p 500 lower by 17 and a quarter. A record day on wall street yesterday to start the week off, the dow finishing at the alltime high in nine months, boosted by the positive news of modernas phase three vaccine trials. Dow industrials up 470 points at the close yesterday, nasdaq up 95, s p higher by 41. Its a big day for retail this morning, home earnings posted a double beat. Were waiting walmart and kohls. Well get the numbers moments from now and well bring you them. Kohls is hitting the tape right now. Cruising into the future, the new plan to get people back into the ocean after months of staying docked. And holidays in a digital world, zoom helps you and your family out if youre planning on a virtual turkey day. Its making a buzz this morning. Mornings with maria is live right now. European markets this morning look like this, there we are looking at declines across the board. Cac is down 13, dax index down 37. In asia overnight a mixed story, pretty much fractional moves across the board as you can see there. Right now we have breaking news, we want to get to. Walmart and kohls are out with quarterly earnings. Right to Cheryl Casone we go with the numbers. Cheryl walmart, we have got a double beat on our of hands and Digital Sales really taking off for this, the stock is up 1 right now. The estimate for earnings per share was a buck 18. They came in at 1. 34. So a strong beat on earnings. Also, the revenue, another strong beat for walmart. The estimate, 132. 23 billion. 134. 7 billion. They came in. Digital sales, get this, i guess im not surprised after the last quarter, a jump of 79 for ecommerce sales for walmart. And comparable sales up 2. 7 year over year. International sales coming in with a jump of 1. 3 , theyve been divesting a lot of International Operations we should add. Same store sales for walmart, a jump of 6. 6 . If you take out the fuel component, its better. 7. 1 . Remember, walmarts been going into healthcare, going into pet care. So some of the places that they seem to be seeing growth. Also theyre talking about covid related expenses, this is as weve seen this with a lot of retailers, seeing a jump of covid related expenses, 600 million. Walmart crossing the tape, they are saying right now in the press release, they think new customer behaviors will largely persist, thats the question mark. Do people continue to digital shop, online shop and do pickup. Let me get you to kohls, 13 decline in net sales, this is not a good story for kohls. The estimates was for a loss of 44343cents a share. They gained a penny. Revenue, 3. 86 billion for the estimate for revenue, 3. 98 billion they came in. And also of i want to say, one ill give you one piece of positive news on kohls. Theyre going to reinstate their dividend in the first half of 2021. Anybody that owns that stock right now you will take it. But that is the story on both of those. Big retailers, weve got retail sales at 8 30. Another big retail story coming up then. Back to you. Maria its interesting that the surge in demand for those essentials at walmart seen at the peak of the coronavirus carried through, throughout the year, and 79 surge in online, big stuff. Cheryl, thank you so much. Time for the word on wall street as we watch Retail Stocks trade up and we get reaction to those earnings. Joining me is editor and publisher, dennis gartman, mark lusheni and great to see you both. Mark, let me kick it off with you, get your take on walmart and kohls, Third Quarter numbers, what do you see in terms of the consumer driving the economy right now. The consumers been doing a fantastic job, in spite of everybodys suspicion that because of the huge effect in the labor market it would be quite weak. Aggregate retail sales have recovered fully and are at alltime highs and hopefully will be reaffirmed this morning. You continue to see the dichotomy within the retail space in terms of the haves and the have notes. The haves are the walmarts of the world. Its a hyper market. It has a broad portfolio of products, working very well in this environment. And its ecommerce initiative which it invested in hugely some years ago is paying off with big dividends, with that 79 growth that you referenced. Kohls on the other hand because its largely a brick and mortar franchise that didnt do as well early on and has yet to catch up in the ecommerce initiative is paying the price of the bifurcation thats taking place in retail. In the aggregate, i think the consumers well positioned to continue to spend. Obviously we would like to see another stimulus package to really fortify the ability for the underemployed to continue to do that as they work down their savings that they built up as a consequence of the fiscal transfer from the cares act. But nonetheless, it speaks i think very highly, particularly with walmarts comments about the persistence of the spending pattern they expect to continue to see as evidence that the consumer is pretty well endowed. Maria so mark, from an investment standpoint, weve got those october retail Sales Numbers coming of out in 90 minutes time. Were looking for a fivetenths of a percent gain september from october of. Do you want to buy Retail Stocks or retail etf or do you want to look at this move as reason to buy the whole market . Because the consumer is representing the broader economy . Perhaps a little bit of both. I think its undeniable, youre right, because the consumption drives 70 of economic activity. This is a litmus test of the consumer and the health thereof in terms of the overall direction of the economy which is good news. So i think thats certainly a Broader Market calculation. In terms of retail, it speaks to the economic reopening theme and those companies are getting the benefit from not only what works, the staples, the healthcare, personal products, but broad Consumer Spending whether you own individual names like a walmart which is a great anchor in a Consumer Staples space or more problemly Something Like xrt which is an etf, specialty retailers. I think both stand to benefit over the next 12 to 18 months from this resumption of economic activity, particularly as it plays in the consumer and again how well endowed they are in general. Maria so dennis, youre looking at the charts and one chart in particular caught your attention. Tell me what youre seeing based on technical factors here and looking at these charts. First of all, ive been very bullish with stocks for the past month or so and very bullish basically of banks and as i like to say the makers of stuff, the stuff that if you drop it on your foot will hurt. Ive been bullish with stocks. Given the fact that insider sales to purchases have gotten to the largest number ive seen in several years, 58 to one sales to purchases, anything over 20 to one is almost unexplored territory, anything over 40 to one is extraordinary. Anything at 60 to one is very concerning. I think its time to stop being terribly bullish with stocks. In the next month or so, can stocks be lower, can we take the s p down 200 points from where we are now, i think we actually shall. Ive been very bullish with stocks in the long run. Now im neutral to stocks in the short run because of Insider Selling has been as aggressive as it has been. Maria i think this is an important point that you raise. Insider selling and buying has been a great indicator. I was told youre seeing an alarming amount of capital leave the United States. Im wondering if people are making bets on the senate race and whether or not you aggressive progressive policies are going to get through. Then theres the Moderna Vaccine, dennis, the breakthrough boosting markets yesterday, the company says their treatment is 94. 5 efficacy rate. What impact does that have and pfizers news have on the market Going Forward, now that we understand that we may very well see a vaccine by the end of the year as President Trump has said so many times. Well, i think its not just moderna and pfizer. Theres going to be 10 or 12 or more that come at you in the next two or of three months of. In my opinion im not an epidemiologist, im not a doctor. But the amount of experimentation, the amount of investigation thats going on at universities and various Public Companies is extraordinary. Were going to have a number of vaccines coming at us, beneficial to the global economy, after the turn of the year. No question about that. Are we overbought in the short term in stock prices, yes. Is money leaving the United States, thats happening in the bond market. Yields at the back end are going higher. The yield curve is going to get wider and wider over the course of the next year or two. Maria gentlemen, great to see you both. Great info. Dennis, mark, please come back soon, thank you. Weve got much more ahead this morning. Coming up next, the election legal battle is on. Former new york city mayor, former prosecutor himself, Rudy Giuliani will join me with the latest evidence that he has on voter fraud. We will get his take on where we are with that. State tax revenue rebound outlines better than expected sales and income tax receipts in many states, due in part to an increase in withholdings from larger unemployment checks and americans continued spending habits. Ryan, your reaction . Ryan i think its remarkable that with the pa pandemic that spending has rebounded as quickly as it has. Stock market and real estate values are at an all dosh time high. Alltime high. Americans are in really good shape. I think that bodes well for being a continued catalyst here not only for the economy and the market but also for the states which obviously got hit hard initially with the pandemic. Maria yeah. The nasdaq is up almost 40 points right now. The s p 500 is down 14 and a quarter. We had better than expected earnings from home depot, from walmart and from kohls and we have Comp Store Sales also looking good. Weve got more earnings coming out and we are going to check into those stocks. Lets take a look at a home depot shares, walmart shares, and kohls shares. Because despite the better than expected numbers, actually were seeing some pressure on these stocks this morning. They are trading lower. So we will get a check on that and we will take a short break and then we are talking with Rudy Giuliani on the Election Fraud that he has identified. Stay with us. Well be right back. We want to look at markets this morning at 7 23 a. M. On the east coast. Features indicating a decline for the dow industrials as we await retail sales out in about an hour from now. The dow is down 160 points. The nasdaq is up, that rotation into technology is on once again after a bit of a break from that. Nasdaq up 40 points, a third of a percent, the s p 500 down 14 and three quarters. Three retailers of out this morning, walmart, kohls and home depot, all posted better than expected earnings. Take a look at the stocks, walmart shares are up 1 andahalf percent. Home depot shares and kohls shares are negative. Home depot down one and three quarters percent, this is off of a record day on wall street yesterday to start the week, the dow finishing at the first alltime high in nine months, boosted by the positive news on modernas phase three vaccine trials, 94. 5 effective. The dow industrials were up 470 points, nasdaq was up 95 and s p yesterday was up 41 points. European markets this morning are lower, youll see this now with the fq100 down 72 points, better than 1 . And the cac in paris down a quarter of a percent, 16 points, the dax index in germany lower right now by 35, a quarter of a percent there as well. In asia overnight it was a mixed story, fractional moves across the board. As you can see, best performer was japan, nikkei average up almost onehalf of a percent. Back in the u. S. , california imposing new restrictions amid a rise in covid cases. Cheryl casone with the details now. Cheryl that is right maria. Governor gavin newsom says hes pulling the emergency brake on reopening the state as the amount of covid19 cases surge, including closing schools, forcing indoor businesses to close or operate at a lower capacity and halt indoor worship. The state is going to strengthen the outdoor mask requirements. California has accounted for more than 1 million cases of the coronavirus since the pandemic began. Take a look at the stock in the premarket, its down a little more than 1 . It got a boost yesterday thanks to the moderna news that you just mentioned. So well watch that stock as well today. Back to you. Maria all right, cheryl, thank you so much. Stock down better than 1 . Meanwhile, we are looking at combating Election Fraud this morning, officials in floyd county in georgia discovered 2600 ballots, netting 800 more votes for President Trump in the peach state. The problem reportedly due to Election Officials neglecting to upload a memory card from a ballot scanning machine. This comes as michigan rejects an appeal to void their Election Results ahead of todays expected certification. The Trump Campaign is facing a hearing this afternoon in pennsylvania. They allege voters were held to a different standard depending on if they voted by mail or in person. Joining me now is ohio congressman and a house of intel and a ways and Means Committee member brad winstrop. Its great to see you this morning. Thanks very much for joining us. Thank you, maria. Maria a lot of people are questioning whats going on in terms of the Election Results. Is there an fbi investigation into this right now . Well, i would hope that there is. And i would think that it needs to be because if you look at whats taken place in the last four years, the American People have a clear understanding that nefarious behavior is part of the protocol for some people, not only as politicians but within our agencies which is another concern with fbi. But theres just so much coming forward. Americans want to know if they had an honest hell he ex or not. Honest election or not. They deserve to know if they had an honest election or not. No one can really understand it. I mean, if you what ive been told is some places you pushed a button but you never got to see the paper copy that translated how you actually voted. Theres so many things out there that need to be investigated. Im grateful in ohio, where im from, that it wasnt a problem. No ones questioning the election. But our system was pretty sound and every state should be able to have a sound system. You have four years to get ready for this. So theres a lot of questions and im glad that the Trump Administration is pushing forward. Maria well, i mean, look, you know, weve heard from Rudy Giuliani who is going to join me momentarily after our interview. We also heard from Sidney Powell about the smartatic software. Listen to what Sidney Powell told me on sunday. First of all, i never say anything i cant prove. Secondly, the evidence is coming in so fast, i cant even process it all. Millions of americans have written, i would say by now, definitely hundreds of thousands have stepped forward with their different experiences of voter fraud. But this is a massive Election Fraud and im very concerned it involved not only dominion and the smartatic software but that the software essentially was used by other election machines. Every state that bought dominion for sure should have a criminal investigation or at least a Serious Investigation of the officers in the states who bought the software. Weve even got evidence of some kickbacks. Maria yeah. Shes even talking about kickbacks where the governors who took that machine and used it got benefits for their family. Look, i dont know anything about that. I do have one source, one source who told me they believe the fbi is investigating this. But ill tell you, congressman, given all of these irregularities, shouldnt we have some kind of official response from our investigative architecture . Youre on the intel committee. To tell us whether or not our vote matters . Absolutely should. Again, americans need that confidence. That was a very compelling story. I watched that on sunday. You know, Sidney Powell is someone of great credibility, being on intelligence committee, i know her work on the flynn case and for her to say that she wouldnt say it unless she knew it to be true is really remarkable. And youre right, but dont count on the house of representatives, adam schiff, to expect to have the fbi in to give us some kind of briefing on it. Thats probably not going to happen. But we need to dig into that in our side as best we can because they f there should be there should be some investigation into these things. Election fraud is one of the most serious things that could possibly happen in a free country and the United States of america has always had Higher Expectations and higher levels of trust and honesty that we could count on and we dont have that right now. Maria i mean, youve got to understand the American People right now. Were counting on the intelligence agencies, the fbi, the doj, to protect american citizens and what do we have going on here. Weve got questions around the election. Weve got questions around these Voting Machines and the software being used. We have questions around our free speech. Youve got twitter censoring people who think that if you dont agree with what they believe and their ideologies, then it must be fake news. I mean, who is protecting the American People . Is it your committee . Is it the doj . What are we supposed to think here . Well, id say it was our committee when we had devin nunes in charge. If you look at the fact that john brennan told president obama that Hillary Clinton was planning to create a scandal against donald trump, candidate for president of the United States and then president of the United States, and what did they do . Instead of investigating her, they aided and abetted the whole situation and investigated donald trump. We have a problem within these agencies that is beyond control. If you would have told me eight years ago when i first came to congress that any of this stuff took place, id say theres probably a rogue person here or and there. Ive become convinced there are many, many people that feel justified for some reason in doing the types of things that they do and it flies in the face of what our founders had in mind for this country and for what most americans have in mind for this country. One of the other problems is, maria, youve done a great job of talking about these things but if you look across the country and other media, most americans have no idea if they only tune in to one station or another, and thats a problem. Thats a problem that we have is a very misinformed population right now. But i will tell you, we know that over 70 Million People voted for donald trump and they want the answers. Maria well, im going to continue fighting for my viewers. I know what my viewers want to hear and i know they want truth. Im going to continue seeking truth as hard as it might feel and with as much pushback as ive gotten. I will continue fighting to seek truth and fighting for my viewers. Because i know what they want to hear. They also want to know more about this covid19 vaccine. Lets talk about that for a second. Major progress being made with both pfizer and mo modernas treatment reporting an over 90 effective rate. Joe biden spoke out on the vaccine yesterday and whether or not hes going to get vaccinated. Listen to this. If the fda gives emergency authorization to the pfizer or Moderna Vaccine in the coming weeks, will you get vaccinated . I wouldnt hesitate to get the vaccine. But i also want to set an example and but i wouldnt hesitate to get the vaccine if in fact dr. Fauci and the two organizations, whether its moderna or pfizer, who have been extremely responsible conclude that it is safe and able to be done. Look, the only reason people question the vaccine now is because of donald trump. Thats the reason why people are questioning the vaccine, because all of the things he says and doesnt say, is it truthful, is it not truthful, the exaggerations. Maria i mean, do you think he lost his train of thought there . And also, i mean, donald trump, President Trump has done more to mobilize the pharmaceutical industry, to get a vaccine on the market than anybody. So lets just stop the bs, okay. I mean, look, President Trump said months ago were going to have a vaccine by the end of the year. What happened . All of this critics laughed at him. So whats happening now . Were getting a vaccine by the end of november. They have delivered like never before. You know, the soonest we ever had a vaccine before was four years and that was for mumps. What has taken place is unprecedented. Youve got to give the Trump Administration kred it for this, credit for this, how they worked with the pharmaceutical industry. You can almost take any new virus and plug it in and develop vaccines, in rapid time. That is what has taken place. And the politics that have taken place with this are ridiculous. Joe biden, kamala harris, what cuomo was saying today, Governor Cuomo was saying today is almost sinful to me, maria. Theyre telling people not to take it and that to me could cost lives. Theres no doubt about it. You know, im a physician, as the doctors caucus, weve had oversight over this process from the beginning. Donald trump is not part of the scientific community. Donald trump is not part of the independent data and safety monitoring board which is the group, theyre the only ones who know who got a placebo, who got the real thing and what the results look like. Theyll be the ones that authorize an emergency use. We want to get this and get it out to the most vulnerable and to our of healthcare workers as soon as possible so that we can start saving lives and move on. And what also is unprecedented through this whole thing is the fact that these vaccines were already produced before approval. The risk was if theyre not approved, then theyre wasted. But if they are a approved we can go right into action. Thats why theres the term warp speed. This has been done right. Beyond right. You normally have 8 to 10 of you thousand people in a trial. This is 30, 40, 50,000 people in these trials and they were making sure that you had the right mix of people in the trials, the most vulnerable a, minority communities. Thats whats taking place. I will tell you, everybody in the doctors caucus has said because we followed this process, you get a vaccine and we will take it. And i stand by that. Maria congressman, what about these growing calls from a number of your colleagues who are saying, look, allow joe biden to receive intelligence briefings, even as the results of the election are being contested and being examined. Do you think he should be receiving briefings, reserved for the president elect . Well, i dont see any harm necessarily in him receiving some briefings on certain things at different levels. You know, i dont know that President Trump was awarded the same respect when he got elected. And there were things that they didnt brief him on, they decided not to brief him on which was unprecedented as well. But i think that that remains to be seen because there certainly is a lot of question. Look, we have time. We have time. I dont know that he needs to be receiving briefings right now. Lets get a little further along in this verification process and let the process play out as it should. I think that theres some unclassified things that he could be informed on but i dont know that we need to go into great detail until were a little further along. You know, we had this situation before with gore versus bush and it took 36 days before that was settled. I think this is going to take longer if what Sidney Powell had to say is correct and they can move forward with that as long as theyre not stymied by the courts and theyre give a fair trial. Maria were supposed to get certifications very soon by the states. Will they delay the certifications until the investigations play out and will this go to the Supreme Court . Well, i think ultimately it will. It should, at least in some of these cases if what theyre saying is true. Because you really have to get down to the bottom line of what took place. Again, this is unbelievable. I mean, i felt like i was watching the twilight zone, those who are old enough to remember that show. We had states coming in with results and all of a sudden it just stopped, it came to an end. And what does that tell you . Weve never seen anything like this before. So something is going on thats extremely different and, again, like i said before, you change all these rules and everything else, it makes it very difficult to believe that this is clean and fair without checking into it completely. And why theres not a paper trail on every single vote in every state is beyond me. Maria well, thats right. And you know what Rudy Giuliani said to me on sunday, hes going to join us momentarily, he said when you look at pennsylvania, election night, President Trump was up by 800,000 votes. Everybody went to sleep. They came back the next morning and it was this additional hundreds of thousands of votes that came in overnight that hes saying came in in boxes, hes going to talk to us about it in a minute. He said the same thing happened in michigan and wisconsin. The president was up and suddenly additional votes came in. We will investigate on our own. Congressman, it is good to see you. Thank you so much. Coming up, fleeing the big apple, the top reasons new yorkers are packing their bags and ditching manhattan. We take a look at it coming up next. A real life escape from new york, new statistics reveal more than 300,000 new yorkers have fled the city, just in the last eight months. The exodus from new york fueled not only by the coronavirus concerns but a rise in real crime. Murders in 2020 have blown past all of 2019s tally, up 38 with a little over a month left in 2020. Joining me right now is rxr realty chairman and ceo, scott rekler. You see it firsthand with the real estate market. What are you seeing in terms of commercial real estate, even residential real estate, that you can tell us tells this story. Hi, maria. How you doing . Thanks for having me. The question really is, there are people that have left manhattan and the city obviously during the heat of the pandemic. The question is how many come back. 60 of the moves that were made went to Storage Units. Of that, 90 were in Storage Units in new york city. That would imply people have left during this period of the pandemic but when things formalize they plan on normalize they plan on coming back. Another interesting fact that came out, last week there were more luxury home sales in manhattan than any time since early march and last month was actually a better month of home sales, luxury home sales than the month prior in 2019. So again, confidence in new york. The street feels more active. Theres nor energy. I think weve got to get through this fall and if were able to get through the fall and keep schools open were in a position to get to the spring and hopefully a vaccine. Maria i remember after 9 11 the city stung, it was so stunk, it was so bad, the stench of fire, and we lost so many loved ones, friends and family died on september 11th which was an incredible tragedy for all of us. I thought im leaving and never coming back. But i did. And many other people did. Youre into commercial real estate. I know a lot of people who are getting rid of space, leasing out commercial real estate. What are you seeing there . Right now, youre really in a moment of pause. Theres the companies have not returned to the workplace and so youve seen a period of time where everyone is waiting and regrouping. I think theres going to be two pieces that impact commercial real estate. Theres going to be a cyclical impact as the economys gone down and people need less space and theres going to be a structural impact, people are going to work differently than they did before. Remote of work has been shown to be viable. So i believe there will be people people will work in a hybrid workplace, maybe from home or Satellite Office a day or two a week. But the reimagining of the office place is whats going to be key. People are going to come to work because its going to be an experience, its going to be engaging, about culture building like youre seeing in retail and malls. When ecommerce happened, if you could buy it online youre not going to travel to a mall unless the mall gave you an experience. It will be the same wor thing at work. If you can work at home you will unless the Office Creates experience and engagement. Well have to reimagine the workplace, there will be winners and loser as we go forward. Maria i dont like the experience right now in new york. Its not about coronavirus. Its about security and safety. You were among the 160 Business Leaders and ceos who sent a letter to mayor bill de blasio, urged him to create a clear plan to bring the city back to life. It read that people will be slow to return unless concerns about security and liveability of communities are addressed quickly and with respect and fairness for our citys diverse populations. Have things gotten any better since then, scott . Because, look, the no bail has been a major problem, the bail reform law that Governor Cuomo and mayor de blasio put in place, putting criminals back on the street. Thats one of the reasons that were seeing crime shoot up. Yeah, listen, you cant have prosperity without public safety, to your point. I mean, you made the point on 9 11. I was in new york in 1990 and was mugged and gunpoint and i moved to the suburbs and ultimately came back because crime went down. Crime right now is a small percentage of what it was back in the 1990 ofs but theres a perception. I will say part of the challenge is getting people back on the street. We need eyes on the street. You can talk to anyone in the nypd, thats what they tell you. If you have streets devoid of people, it leaves it open for people who want to do bad things. One of the big things this mayor can do and Business Leaders can do is bring people back to new york, safely and responsibly, get them back in the workplace with every one person in the workplace he creates five service jobs so not only are we bringing activity back, were helping the Small Businesses that right now are in dire need of support. Maria yeah, Jon Hilsenrath, jump in here, 1,333 shootings in new york. Yeartodate, Jon Hilsenrath. Jon right. Theres three issues right now in the city. Theres the coronavirus problem, theres the violence problem, and then theres just the fact that people can work remotely and they dont a lot of white collar workers dont need to be in the city to get their work done and i think thats something that people learned. One of the things i want to ask scott related to this is how important is Liability Protection to getting people back in the workplace . If you manage an office, if you run an office, are you going to open it and bring your workers back if you think youre going to get sued if they come back and they get coronavirus . Is that an issue in new york city right now . Its a big issue on capitol hill. Jon, good question and the answer, question, its an issue. We have proven that we can reopen of our workplaces safely and responsibly. Weve invested tens of millions of dollars like a lot of our peers. We have 90 of our team members back increased our space, were now at 50 capacity. Use social distancing tools, compliance with face mask wearing and testing and were doing it safely and responsibly. And when i speak to the Big Companies about doing the same thing, liability always comes up as an issue. They want to do the right thing, they want to bring employees back, but they know if something happens and theyre sued, then theyre going to be liable just like 9 11. There comes moments in time when you need to have the federal government come in and protect things like this. Maria real quick, lets get ryan in here. Go ahead, ryan. Ryan i want to speak on that too because i know in my own business i havent formally opened my office in new york but people actually just want to come back. I actually have employees going to the office just because they want to get out of their apartment or they just want to go somewhere. So i think weve kind of discounted the willingness for people to actually go back to the workforce and go to a place as opposed to working from home. I think thats huge. Listen, we have our people back now and started at 50 and went to 90 of because people want to be back with their peers. Maria scott, great to see you this morning, sir. Thank you. Thanks, maria. Be well. Maria well keep checking back. You too. Well be right back with the morning buzz. Stay with us. Well, i i think it hasnt changed, since the beginning of voting took place we have to have transparency in elections. We have to make sure, that all fraud is investigating we need to make sure that recounts are completed before we declare a winner, we have to have confidence in our election system, over 70 million americans voted for donald trump, those people deserve to have confidence in knowing who is the winner before these organizations declare it we should make sure every legal vote is counted frankly our democracy our Country Demand that we have confidence in those the elections. Should we worry about Georgia Senate runoff feature state senatorial seats up for jabs would dictate control of the senate sara we found all ballots, that they say, were not counted because of human error are we going to see this again in january . Well, i think that is exactly why we have to make sure that, every vote is could understand, that we go through this process so we never have this happen again we should not loss ballots we should make sure that a every person who takes on the effort, and is part of this process, that they are vote is counted. And we want to get all of the confidence we want to investigate all we want to make sure that that process is completed, before we declare a winner i think that nothing could be more important to make sure that happens, prior to the vote taking place january 5, everything is on the line we have to make sure we get people like senator loeffler senator perdue reelected so that we have a firewall against the radical left that is pouring out of washington, d. C. If we allow those races, to go into the hands of democrats we can expect higher taxes, Green New Deal packing of courts things we can absolutely not allow, i think anybody that lives in the state of georgia that loves america wants to see our democracy preserved need to make sure they get out voted do that for loeffler and perdue. Really important stuff sara great to see you this morning. Thank you so much Sarah Sanders joining us this morning much more ahead coming up the election legal beetle with former new york city mayor Rudy Giuliani will join me live with the latest evidence of voter fraud that he has october retail sales soutd 20 minutes time we will get numbers get if impact on markets stay with you me all morning, Jon Hilsenrath, getting back to panel you are watching mornings with maria live on fox business. Combating Election Fraud officials in georgia george floyd county discovering more than 2600 ballots netting northeasterly 800 votes for President Trump in peach state, the problem reportedly due to Election Officials neglecting up to loaded a memory card from a ballot scanning machine as michigan rejects valley to void their Election Results ahead of the expected certification the campaign faces a hearing in pennsylvania allege voters held to different standard depending if they voted by mail or in person, joining me former mayor new york city are personal attorney for President TrumpRudy Giuliani, rudy great to see you once again this morning. Thank you so much for being being with me. Very nice to be with you, maria. Yes, we are going to pennsylvania, today. Go ahead. Tell me about that. I said we are going to argue the case in pennsylvania today really a preliminary motion to dismiss the case, on technical legal grounds, that case is a case that connected to the other 8 or 9, shows we are prepared to call witnesses to demonstrate that somewhat around 700,000 ballots were counted in secret, the republican watchers what they call them in pennsylvania literally kept in corrals locked out, some actually roughed up a little bit in the philadelphia part not pittsburgh part total number, 688,770 we will probably he get to 700,000 by the time we finish the hearing on thursday. Today really arguing the legal part of the case frankly that is case that we would like to see get to Supreme Court, so, you know, we are prepared in some cases to move, and to appeal, and to get to Supreme Court remember bush v. Gore in state of Florida Democratic court 5 2 so you are not going to win any one of these i dont want to say because of democrat judge or whatever, some of them just as fair as anybody, but, some cases, you win some cases you lose most important thing is the result this will be our first established vehicle on the way to the Supreme Court i should say exactly, the second the one in michigan, even though the certification went ahead, that case is also another vehicle to go to the Supreme Court, now we have two. Shortly we will have wisconsin, and soon georgia. Then we will have three more the ones i mentioned to you related ready to go. What a are you finding so far what do you think went on here because when we spoke sunday we talked about software, made by smartmatics, that was changing votes from trump to biden. Yes the core of the case meat of the case one that is common really in 10 cities, of which we are probably going to stew at least eight or 9 that they stop republican watchers inspectors different names different states to perform the vital function observing opening of the mail ballots if you dont observer opening of mail ballots it is lost forever only thing that identifies it signature on outer envelope when you certificate that signature, you separate the outer envelope from the ballot the ballot, you can never connect them again even if we go back find some of the signatures were wrong phony ones whatever wont be able to link the ballot the only remedied the court has is to cancel out those votes they have done in pennsylvania, in in the case the pennsylvania has in fact reversed an election, based on absentee irregularities there is no bigger absentee irregularities than failure to observer the ballot never happened before i never remember been absentee, i never respect one side excluded the other thinking to get away with it totally absurd people probably dont understand ballot counting well enough to realize what tremendous deprivation of rights this is we have no idea if 670,000 ballots were put in by mickey mouse or bidens or or democratic officer, weve got got paid money to produce a machine that can get sigdz on 100,000 ballots in a half hour. That is that is possibly what happened in michigan up 100,000 ballots the middle of the night a horrendous fraud, expands through country is isolated to democrat cities very smart to do it in cities, that like old west cities they control, where they control workers, we have a worker testifying to be true said she was taught by city how to cheat they control workers, they control to some extent Law Enforcement we have people being threatened, if they got closer than even though court order Corey Lewandowski was one of them, and control unfortunately, the courts. So weve got to get out of that, into the Supreme Court. Mo i mean who is to stop this from happening again if you have democrats in charge they are in charge of the machines you will never see republican in the white house again, i mean do you reare you saying this is systemic happening specifically in democrat cities . Who was directing it rudy . Well somebody had to be directing it it wasnt happening all democrat cities first of all, let me say to democrats you are just as good americans as honest as any republican or independent, are he morality not based on political partly affiliation unfortunately can happen in our party to, you got to realize that by now it began with clinton, he corrupted your party he showed them a way to cheat. And the cheating this year, on a grand scale, they picked 10 cities they could control if they tried to do in honest democratic city would tell them to stuff it, some of these ballots were hidden from democratic inspector, because they were so bad dont know how a democrat or republican to inspect it imagine that couple hundred thousand. So those must have been the ones that that forced the mob or something, i am kidding, i am kidding there is allegation but i think a false soura you were prosecute a prosecutor for years you put gambino family in jail, and talking about mobs, you have to prove it can you prove it . O i can prove what i just told you i can prove that 700,000 ballots in state of pennsylvania, two cities, or pittsburgh philadelphia that were put you the into the vote and no republican got to see they were deliberately excluded isnt an accident they were being pushed away never happened before, ever i dont remember every, anybody being excluded from a little absentee ballot count this is absentee blalt count that determineded very strange change in the state of pennsylvania, 800,000 votes here, maria night we went to bed as professional poll we won state of pennsylvania i can go back show you 8 years ago the state much further off than that 800,000 votes. Unbelievable. How could we lead in all five states big margins then this voter count that we cant watch turns election against it . Were not being allowed to see identifying data, on very strange ballots that took 800,000 vote lead from us that we are very, very about this not talking about dominion a National Security problem, a serious one getting worse. All right. Quick before we go, two questions. Number one where is the department of justice if this is happening isnt fbi or doj be looking at this . Where is that . Secondly do you feel you have enough evidence to you overturn the results of this election . I believe we have amassed more than enough evidence in in pennsylvania, michigan wisconsin, and georgia i believe we are at very close in nevada, yesterday we won a big victory in nevada nobody bothers to point out the clark county las vegas, board all democrat, reversed an election, the democrat in favor of republican based on irregularities in clark county voters the irregularities are the same election the same irregularities except we have more so, they got it reversed on our evidence somebody should take a good look at that. A distinction they have to recess ours quick doj where is it . You tell me, maria. I think i think they see some computers in europe i do believe that i hope. Okay. Rudy giuliani thanks very much for the update we will keep following it thank you, sir. Rudy giuliani. Well be right back. Businesses today are looking to tomorrow. Adapting. Innovating. Heard from a President Trumps attorney Rudy Giuliani gave more insight into the Trump Campaign case against voter flawed, Jon Hilsenrath, your reaction to what you just heard, let me just reiterate something he said the end of interview said he believes the computers were seized in europe i heard something similar military seized computers in frankfort, germany the question is about dominion, and the software being used what is your reaction to what we just heard . Yeah, dominion has denied that, my reaction is narrow giuliani is using and others including the president , are using very stark important words. Corruption. Fraud. Crook. These are very, very serious allegations. If it is true, if there was corruption, if there was fraud that is undermining our democracy we need to get to bottom of it if allegations are falls that is also inexcusable also under minus democracy we need to get to demeanor of that one way or the other some if some won is stepping out of line. Agree with you one hundred percent we will continue following this, are until we have answers, we want the answers. We deserve it, investors awaiting october retail sales out four minutes time stay with us could be a market o o mover. Back in a minute. Really. My first idea was in one quarter of an hour, your savings will tower. Over you. Figuratively speaking. But thats not catchy, is it . Thats not going to swim about in your brain. So i thought, what about. 15 minutes. 15 percent. Serendipity. 15 minutes could save you 15 or more on Car Insurance. Welcome back, good tuesday morning. Im maria bartiromo. Tuesday, november 178 30 a. M. On the east coast hour away from the opening bell, weve got retail sales month of october coming out, the dow industrials down 229 points nasdaq up 26 s p down 24. We are expecting 5 10 of a percent gain retail sales to Cheryl Casone with the number hitting the tape as we speak, october retail sales aye we are we are getting number right now in a little bit weaker than expected retail sales monthovermonth october from september, expecting a half percent gain got a. 3 gain so a little bit weaker than expected dow down 230 right now if you take out automobile component it was even much more weaker than expected looking at a number that expectation was. 6 we came in, at. 2 , another point to this that is we are seeing weaker numbers than we got back in september remember 1. 9 gain in saept retail sales very strong number marked liked it a month ago monthovermonth as well yearoveryear excuse me numbers as well strong, looking like september retail sales revised september number i was talking about to 1. 6 , a loss okay. So that is Something Else they just revised downward, september. From 1. 9 to 1. 6 revised stripped out auto to 1. 2 for september being clear september, was revised down towarded from one and a half percent, so, looks like we are automobiles getting a little bit of pressure here, and numbers really arent as strong as wanted one more number to give you yearoveryear number looking for, 5. 4 number we actually looking like got send it back to you still getting numbers crossing again, we are seeing weakness in all of this i think markets kind of reflecting it right now let me point out the market is session lows dow industrials down 2 6 points nasdaq still up, 12 points, again retail sales weaker than expected up 3 10 of a percent october versus estimate up 5 10 of a percent joining me macro mavens president Stephanie Pomboy reaction to real sales. Pretty much as expected in terms of continuation of the deceleration in momentum that weve seen we had shutdown spending and ever since then weve seen sort of a general slowdown in the economic momentum. Not surprisingly i continue i sound like broken record this idea of the new normal, you know have been aggressively counting especially in news of a vaccine, returns to normal you know intimately more that we have post pandemic going to look different from what it did prepandemic much the way after housing bubble bust each time you have one of these sort of crisis consumer and economy it shifts behavior, weve seen really manifest in consumer behave with regard to Balance Sheet last several months, since february before pandemic hit we had a 750billiondollar increase in personal income, in large part to that shares of stimulus program, also in the background, because of this increase in home prices, adding another 200 billion in income to households, refi we used to talk about back in the housing bubble days kind of going through a renaissance now, so add in personal income and refi almost a trillion dollars in income, are since february. Spending growth has declined 350 billion dollars hunkering down paying down cent credit barred balances declined 110 billion over that period, my takeaway market has been discounting referring to sort of the conspicuous you consumption nothing on part of the consumer right now suggests that is likely to happen. So i think the markets have gotten well ahead of themselves in terms of their expectations of what growth is going to look like when we come out the other side. Any thoughts on what you are seeing in ecommerce because you know you do have a very strong component of this, ecommerce we heard from walmart earlier their ecommerce part of the business was up 79 so how do you work that into your model . Continue to gain shares what size is the pie they are gaining share of in my view we clearly have seen that the retail spending pie is shrinking, and that ecommerce is just consuming a larger share of that i would expect that trend will continue. And you know one thing i would note, walmart earnings this morning, you and i talked about this a long way back that is that walmart when it outperforms is sort of inverse indicator about the strength of the economy, in so far as the walmart performing retail in general in market and particularly it is a sign of weakness because people are trading down in then that had been the case historically may be it is different now because we have done such a good job building their ecommerce platforms so that all relationship doesnt hold but something to keep an eye on because walmart has been outperforming in the last several weeks. Yeah, a good point, let me bring panel in Jon Hilsenrath jump in here. Yeah. I love arguing with stephanie im going to give you a Glass Half Full version of what sounded like a glass half empty story. Stephanie described all the money that households stockpiling away right now in form of savings, refinance i would say they came into this crisis with better Balance Sheets, certainly than they did back in 2007, 2008 i think you would make argument households have a lot of dry powder if coast does clear they are in a position to spend money i think the challenge is more on corporate side of the economy, and there is a lot of the corporate debt out there, and are businesses going to be in a position to go out and invest after all the money they borrowed just to get through this crises . I dont think the problem is households i think the challenge is the federal government which has three trillion dollars debt last year, end of a corporate Balance Sheets Corporate Investment outlook. So jon, you are going to fall out of your chair i one hundred percent agree with you. Come on [laughter] the consumer isnt the main concern my point that is the expectations about how strong Consumer Spending will be have run i feel what i think reality will be and we will have a new normal lower level spending but not like catastrophic. So with with what i would say on corporate said i think another thing market is intellectual dishonesty about if we get the vaccine it removes rationale for plan support for correspondent credit market and qe in general, so i think that could be you know good news to really be bad news for the Corporate Credit market because you are so correct, that is the force of concern here, there are massively lofrjd 1. 4 trillion zombie related, companies cant generate enough income to Pay Debt Service that is going to be an issue right now, weve got the fink in the dyc. K. Of fault by virtual of fed support that goes away once we get vaccine no longer rationale to be there, i think totally right something weve got to be focused on right now doesnt seem to have the markets attention at all i want to bring ryan in are you saying you think this recovery is weakening at this point ryan payne jump . I as well jon here, but you know do we are we going to need Government Support if economy reopens, start looking at companies Balance Sheets, then phenomenal job cutting out costs a lot of operational leverage, industrials for instance, deer cut costs like 1 15, 20 last quarters i think going to go bode well we wont need that support any more. That is the whole in the in the meantime about what weve seen is parade of Corporate Credit down grades continue apace it wasnt just flurry of down grades when economy shut down but throughout even if economy reopens, that has been downgrade right and lowest back to that 1 2 trillion dollars, debt out there, categorized Zombie Companies barely able to sustain existence so i think there has been that has been by a lot of fed support, obviously, there you are exceptions there are companies that have been able to refinance cut costs as you say, really get themselves situated position to do do well when the economy reopens the industrial you know, that is an area that were going to need. So it is not like some kind of discretionary business would i be a a little bit more wary of like Consumer Discretionary stocks versus lets say Consumer Staples, et cetera. But i just think i am not talking about anything catastrophic. My point is simply the market right now is priced for absoluteing pefr effection opening delivery of vaccine the retreat from qe without incident divided government will solve you know, the democrats pushing a more Progressive Agenda in increase regulation whatnot, and i just i have a lot of qualms, with each of those assumptions. What is your growth number for Fourth Quarter or 2021 whatever you think is more whatever you think more credible in terms of where we are your growth number gdp. I mean i guess 2021, something more in 1 2, 1 2 percent range substantially slower. Okay, stephanie good to see you as always, real appreciate it this morning. The only fda approved medicine. Proven to significantly reduce hallucinations and delusions related to parkinsons. Dont take nuplazid if you are allergic to its ingredients. Nuplazid can increase the risk of death in elderly people with dementiarelated psychosis and is not for treating symptoms unrelated to parkinsons disease. Nuplazid can cause changes in heart rhythm and should not be taken if you have certain abnormal heart rhythms or take other drugs that are known to cause changes in heart rhythm. Tell your doctor about any changes in medicines youre taking. The most common side effects are swelling of the arms and legs and confusion. We spoke up and it made all the difference. Ask your parkinsons specialist about nuplazid. Almost 98 percent of patients on eliquis didnt experience another. And eliquis has significantly less major bleeding than the standard treatment. Eliquis is fdaapproved and has both. Dont stop eliquis unless your doctor tells you to. Eliquis can cause serious and in rare cases fatal bleeding. Dont take eliquis if you have an artificial heart valve or abnormal bleeding. If you had a spinal injection while on eliquis call your doctor right away if you have tingling, numbness, or muscle weakness. While taking eliquis, you may bruise more easily and it may take longer than usual for bleeding to stop. Seek immediate medical care for sudden signs of bleeding, like unusual bruising.
