Hold back, saying gleesons interpretations contradicts precedent and lacks a sound basis in the constitution. Sidney powell writing an even harsher critique of gleeson, accusing him of conducting a wrapup smear against flynn that demonstrates the difference between a d. Of prosecutions a department of prosecutions and a department of justice. Powell concluded in her argument that the only lawful action left for the court to take is to dismiss in its entirety the case against general flynn. And more breaking news from the department of justice, they are now recommending that lawmakers strip away all Legal Protections for big tech giants including twitter, facebook and google. Those protections fall under the section 230 of the 1996 Communications Decency act, a law supported and defended by republicans and democrats a alike for decades. Under that law big tech the companies have found safe harbor from any lawsuits arising from usergenerated context or their decisions to censor what appears on their platforms. In other words, they have had the best of all worlds, big tech and social media. Finish the Justice Department now says its time for change, partly because, quote criminals and other wrongdoers are increasingly turning to Online Platforms to engage in a host of unlawful activities including child sexual ec ployation exploitation, selling illicit drugs, cyberstalking, Human Trafficking and terrorism. The president has been wanting to bring this suit for years. He campaigned in 2016 against big techs awesome, immense power. Last month President Trump signed an executive order directly addressing the partisan activism of social media platforms calling their censorship practices one of the greatest threats to free speech. And those practices practiced primarily against conservatives. It is a view shared by attorney general william barr, and heres what he had to say last week on this matter. I think there are, clearly, these entities are now engaged in censorship. And they originally held themselves out as open forum where people could, third parties could come and express their views. And they built up a tremendous network of eyeballs. Market power based on that presentation, and now they are acting much more like publishers, because theyre censoring particular viewpoints and putting their own content in there to diminish the impact of various peoples views. Lou how powerful is have those platforms become, big tech, how powerful has it become, only the federal government has sufficient power to be a countervailing influence against those platforms and those tech firms. Social media has a clearcut bias against conservatives. Conservatives have long chained about their complained about their blatant bias whether on the part of twitter, facebook, google. In an astonishing development yesterday, an activist group linked to the left wings labour party was partly responsible for google threatening to block ads of zero hedge and the federalist. Nbc reported, as it turns out erroneously, a story in which it claimed google had banned ads of the federalist over policy violations found in the comments section of stories about recent black lives matter protests. Nbc says those policy violations were compiled by the center for countering digital aid and shared with google. The federalist ads, however, have not been blacklisted, nor band by google. They have been warned of a possible suspension by google of those ads because of the policy violations they say in its comments section. Google effectively now in control of a substantial portion of the federalist content and its revenue. Thats only one example of big techs giant and evergrowing power. It is obvious that big tech and Silicon Valley intend to exert even more of that power over Americans First amendment right and not less. James baker, the former fbi general counsel involved in many ways and levels with the deep states efforts to overthrow the president , has now been hired by twitter to act as their deputy general counsel. This is the same man who helped craft a fisa warrant to spy on the trump campaign. Who will now be involved in defending twitters decisions to, quote, censor and factcheck the very same president. Facebooks Ceo Mark Zuckerberg says his social media plans to get four Million People to register to vote this year, zuckerberg also defended facebooks decision not to factcheck political ads saying the best way to hold politicians accountable is through voting. Big techs foray into politics is nothing new. Between 200518, the likes of microsoft, google and facebook, and amazon, spent a half billion dollars or more lobbying congress and sending money to candidates on both sides of the aisle. One senator says that should stop. Hes senator josh hawley. And today he has introduced a bill that would allow users to sue big tech. His bill would put companies on notice for the users legal fees and require them to pay 5,000 fine. Senator hawley, however, doesnt seem confident his bill will pass. I mean, i hope that, i hope well be able to debate it and vote on the floor of the senate. This is obviously something that the president , being censored by twitter, effectively, the federalist being deplatformed by google yesterday, this is of pressing importance. Lou well, his concerns and skepticism are well placed. And the pressing issue of constraining technology oligarchs and their trillions of dollars in market power and influence is one that at this point only the federal government, as i said, has the power to constrain. U. S. Trade representative Robert Lighthizer today on capitol hill, testifying before the house ways and Means Committee today. He dismissed any plans for the United States to decouple from communist china. I think that was a policy option years ago, i dont think its a reasonable policy option at this point. So, but i think that you will see supply chains come back as a result of u. S. Policy including the kinds of things that you all did in the tax bill but also with the regulatory space that the president has done as well as the tariffs that we put in place. Lou well, the trade representative using ambiguous language. If he was intending to assert whether the peoples republic of china is meeting its obligations under the phase one trade treaty, all he would say with any specificity is that they are, quote, on track to meet their obligations. Not that they are doing so currently. And in declaring that decoupling from china is not a policy option of the Trump Administration, that statement is clear in its implications; namely, that the United States is, as of right now, has no so lilings over what nations it will do business with, nor under what terms. Practice even worse, it can be interpreted as saying china will decide whether we do business with china irrespective of the number of americans they choose to infect with the deadly virus and without warning. It further means the United States has no so lilings, perhaps no stomach to hold accountable the communist chinese for the deaths of more than 100,000 americans when president xi chose not to warn the world of the deadly contagion it unleashed six months ago. In other words, it is not an overstatement to say the Trump Administration did not have a good day on capitol hill, nor did america. In an editorial today, the wall street journal joining the chorus of globalist elites in asking President Trump to increase the number of Foreign Workers in the United States, claiming those workers are what this economic recovery needs despite the fact we have more than 40 million americans right now unemployed, who have lost their jobs because of that china virus pandemic. The wall street journal used the tired canard that Foreign Workers are needed because americans just wont do jobs like picking produce or processing crab. The journal also used a 2004 study timely, isnt it . A 2004 to claim that limiting h1b visas actually reduces Employment Opportunities for american workers. That is hardly an established relationship or correlation and certainly not a cause. Steven camarota of the center for Immigration Studies once did a 2016 study by the researchers from the university of notre dame, ucberkeley, a study that found, quote winning additional h1b visas causes at most a moderate increase in firms overall employment and these h1bs, therefore, substantially crowd out firms employment of other workers. And that, quote, there is some evidence that additional h1bs lead to lower average Employee Earnings and higher firm profits. Ah, were getting to the heart of the thing, arent we . And according to the center for Immigration Studies, Foreign Workers who have received a nonUnited States College Degree have roughly the same literacy skills as our American High School graduates. So when people tell you we need their skills, you might think about this next element. In math americans with a College Degree are far more skills than immigrants with a foreign degree. All ignored, of course, by the advocates for more guest workers, h1b visas and so forth. On wall street today, stocks finished mixed. The dow down 170 points, the s p 11, the nasdaq gained 15. Volume on the big board dropping to 4. 6 billion shares today. Crude oil down 2 percent to 37th of 0 a barrel. Lou former National Security adviser john boltons betrayal of the president he served goes on. Today the New York Times reported in his new book bolton claims the radical dems should have looked into the president s dealings with turkey and china during their sham impeachment inquiries. Bolton alleged President Trump tried to curry favor with turkish president erdogan and chinese president xi by intervening in several investigations. Its only in paragraph 20 of a 21page story that the times does report bolton doesnt know exactly what happened [laughter] at those times, in those episodes, nor was he sure they were even, well, offenses. But they still, he says, should have been investigated by house democrats. Thats the level you can expect from this little literary masterpiece of john boltons. Heres White House Press secretary kayleigh mcenany, her response today. What i would note is this book is fulled of classified full of classified information, which is inexcusable. Former National Security adviser john bolton should know all too well that its unacceptable to have highly classified information from the government of the United States in a book that will be published. Its unacceptable. Lou unacceptable, but its ongoing. Joining us now, former congressman, Jason Chaffetz, also fox business contributor. Jason, good to have you with us. Thanks, lou. Lou what do you make of john bolton and his encouragement of the sham impeachment to look into things he doesnt even know about . Im terribly disappointed in john bolton. He was supposed to be the career professional who could come in there as an adult and be the National Security adviser. But ive got to tell you, the antics and the ranting and raving that hes doing in trying to publish this book to line his own pockets at the expense of National Security, thats just not acceptable. And you know one thing i want them to go back is and look at, lou . Its amazing how john bolton leaves, and now we have the very competent Robert Obrien as the National Security adviser, and guess what . We dont have the same type of leaking that we did when john bolton was the National Security adviser. Remember all those calls that was going out the door, the information that was going out to these media sources . The New York Times now has more bolton information. Maybe were looking at the source of those, at least something they should look at in terms of the leaking. Lou its an excellent point. And bolton has a lot to answer for, and the list gets longer every day. He is an extraordinary, extraordinarily disappointing, petty and vindictive person. Its just, its sad to see what perhaps he always was, but certainly what he has become. Lets turn to the pompeo meeting. Why are we being kept in the dark about what the chinese and the secretary of state are meeting about . This is annoying as hell, as you might guess, to someone who works in media. Well, i dont know exactly what theyre going to be talking about, but i have a great deal of trust in secretary pompeo. There are a lot of highlevel talks that need to be happening. I gotta tell you, i dont like what was happening on capitol hill today. That did distush me. But i think we need disturb me. But i think we need to see what the result of these pompeo meetings are. I think dialogue is good in general, i want good, strong dialogue back and forth s and well see what comes of it. Lou well, lets take a look at what was happening, and part of it happening with the u. S. Trade representative, Robert Lighthizer, who has been the lead in these negotiations. He and secretary mnuchin with the chinese. He said that decoupling with the chinese is not a policy option for the Trump Administration. Your reaction to that statement. Well, thats not what the president campaigned on, thats not what he did for three and a half years. The president took the very reasonable stance and said whats fair with china is going to be fair with us. Its got to be fair, its got to be reciprocal. And if theyre not going to play fair, then, hey, were not going to allow you access to our markets. I think that is a reasonable approach and something that hes taken a pretty good hard line and stance on. To back off of that in some obscure hearing on capitol hill sends the wrong message to the chinese, to the u. S. Personnel and people like mr. Pompeo. I dont know if this is planned for by the president , but it seems like mark meadows, the chief of staff, needs to have a little discussion with mr. Lighthizer, what happened there on capitol hill. Lou well, it looks like if he lighthizer has had a record of saying exactly what he means. The extends what he said the United States is no longer a southern nation. Were incapable of making a sovereign nation. We will not be holding anyone accountable for the death of 100,000 americans, the infection of two million more. Were no longer a sovereign nation and might as well turn over a sword and surrender to the chinese. And i am not i hope you understand indulging in hyperbole here. This is absolutely devastating to the base, what was said by lighthizer on capitol hill today. Oh, it was. It was totally foreign to the policy and the position and part of the reason a lot of people voted for donald trump in the first place. So well see where it goes from here. I mean, i e was just reading stories today about some illicit cash, some forged 1 bills that were just flooding into our markets. Again, the source being the chinese. Well see if that plays out and if that is true, but the secret service is working on that as well. So add that to the ongoing and long, long list of things and issues and problems and challenges we have with the chinese. We should take a tougher stance and negotiate a right position, not just hay down and die lay down and die in front of the United States congress and say, oh, well. Lou yeah. It seems to be exactly that, jason. Lets hope that you and i are both wrong about that. Were going to have to believe our lying eyes and ears to this point. Jason, thanks so much. Good to have you with us. Jason chaffetz. Wed like to hear your thoughts. Share your comments. Follow me on twitter loudobbs and like me on facebook, follow me on instagram at lou dobbs tonight. Lou the communist chinese continue to ratchet up their aggression throughout the pacificasia region and specifically now over the skies of taiwan. Two of chinas aircraft, the j10 and x8 there you see them entered taiwans air space today and were chased away and warned by taiwanese fighter jet es. This is the fourth time that china has overflown taiwan air space over the course of the past nine days. A top Peoples Liberation army general recently said china could take taiwan by force and must, quote, resolutely smash any separatist moves by the nation of taiwan. Mike pompeo e is in honolulu, hawaii, to meet with chinas Foreign Affairs head. That meeting scheduled for 3 p. M. Eastern. We have received absolutely no information about todays talks being held at hick am air force base, no details of the agenda of the talks nor exactly who is attending that meeting. Its an extraordinary, an extraordinary meeting in the regard that we know absolutely nothing about what is going on. And joining us tonight and, yes, thats right, im absolutely furious about that. Joining us tonight is congressman jim banks, a member of the Republican China Task force as well as the House Armed Services committee. He introduced bills to stop u. S. Investment in chinas military as well as demanding reparations from china. Congressman, always good to have you with us. I want to get, first, your to the idea that a meeting would be held. I guess were supposed to send a thank you note to the administration that they would at least let us know that their meeting was being held. I mean, thats just really outside the tradition of u. S. Government Foreign Policy particularly, Foreign Policy meetings. Its outrageous. The public right to know is no longer a right in this country. Well, lou, what we do know is that the chinese requested the meeting. Like you, im eager to hear how the meeting went between secretary pompeo and chinese officials in honolulu. Hopefully well learn here soon what happened, what was agreed to in that meeting. But the bottom line and what gives me some comfort in knowing that President Trump has continued to get the attention of the chinese, is that they requested the meeting. Secretary pompeo there meeting with them soon. Like you, i look forward to hearing how it went. Lou yeah, i admire the positivity you express. But i think it sort of ignores these flyovers of taiwan, the aggression by china and the pla throughout South China Sea. Its becoming their lake, lets be straightforward about this. This is not a president who wants it to be said that the South China Sea was lost to china on, in his presidency. This is outrageous conduct. We are witnessing by china, period, simple as it can be. And what we are seeing at every turn whether its killing 100,000 americans, infecting four Million People around eight Million People around the world, 400,000 depths around the world deaths around the world. Theres not a single bloody damn response to any of it. Everythings just fine. Today on capitol hill telling your colleagues, Robert Lighthizer, the u. S. Trade representative, that decoupling from china is not a policy option for this administration . Are you kidding me . What in hell is there to be optimistic about . What is how in the world can we even account for ourselves being responsive to the aggression of this outrageous xi jinpingled china . Not to mention, lou, whats occurring on the china Indian Border at the moment as well. I spoke with the ambassador from india to the United States today and spoke with him about india standing up to china. Heres what he told me, he said we will not be bullied by chao that. And those china. And those are words that, like you, i wish we would hear from more american leaders for the same reasons. This is how a lou well, youve got to regime like china operates [inaudible conversations] go ahead. Lou im sorry. To interrupt you. Im sitting here thinking general milley, the chair of the joint chiefs of staff, is more concerned by making rather on knox white house on knox white house and unthrow statements and apologizing for what. Its insane, what the military has turned into. And its swamping, if you will, this administration apparently. I, i concur with you, lou, every bit of it. We know what china is up to. This is a, this is an authoritarian regime with global domination on their mind. That is their ambition. We cant turn a blind eye to it. The ambassador from india told me today they wont, they will not be bullied by china, and we shouldnt be bullied by china either. Like you, i cant believe what i heard from ambassador lighthizer today. Its not consistent with what this president has has vowed to do in Holding China accountable, what hes done recently to delist Chinese Companies from the stock exchange, to ban Chinese Students that are associated with the Chinese Communist party, threatening sanctions and tariffs on china. This president has remained tough. Members of his administration at times, like lighthizer, have been inconsistent with that message. Its not acceptable s and i cant imagine that this president is pleased with what he heard from the ambassador before the ways and Means Committee today. Lou one cant imagine it, one cant imagine that lighthizer would have ever mouthed such words. The man that i thought i knew wouldnt have. Congressman jim banks, you get the last word here. At this juncture where are we headed with china, in your judgment . Well, weve got to be tough. Weve got to hold them accountable. Thats what the China Task Force is exploring and how, exactly how we can do that. I can assure you that there are many members in the republican conference in congress who are studying ways that we can do exactly the opposite what lighthizer was saying that were doing. And how we decouple the American Economy from china so were not left to the whims of the authoritarian the leaderships ambitions to dominate the United States of america any longer. Thats what im committed to, lou, and thats what ill be focused on in the days and weeks to come in the congress. Lou this is, this is a president who is historic in large measure because hes kept his word and kept his promises and held faith with each of them. To see where he is right now when at the counsel of his senior advisers, clever fellows all, or simply a direct pipeline to wall street into the oval office, i dont know. But it is, there are storm clouds over that oval office right now. Congressman jim banks, good to have you with us. Thank you, sir. Up next, the American People arent buying into the radical leftist plans to Defund Police departments. Bob woodson is the former head of the National Urban league s department of criminal justice. He joins us here next. You dont want to miss a word this man says. Yeah yyeah yeah hey, hey lou well, if ever there were a time to worry about this nation and our direction, it appears that this is one of those times. Seattle mayor jenny durkan says the Seattle Police department will not enter the zone styled at capitol hill organized protest, or c. H. O. P. , except in the event of a, quote, significant life safety issue, whatever that is. The police define a life safety issue as an active shooter, an assault, structure fire or a significant medical emergency like a heart attack or stroke. But since the radical left has taken over those city blocks, Police Response time has more than tripled in the preat this point including precinct including to socalled c. H. O. P. , so not much of what shes saying has much relevance. The radical left has been leading the charge for weeks to defund the police department. The message not catching on with the American People, for some reason. According to a politico e morning poll, by a 2 to 1 margin American Voters oppose the defunding of the police department. 57 to 29 . 43 say theyre strongly opposed to that socalled movement. Not much of a movement. Joining us now is bob woodson, former civil rights activist. Hes the founder of the Woodson Center which helps residents of low income neighborhoods. And, bob, were delighted to have you with us to talk about all thats going on. First, your reaction, if we may, to this organized protest as theyre now styling it in seattle. The leftwing activist groups. Your thoughts about the way the citys handling it, the governor handling it as well. Well, its really organized anarchy. And, but this is a part of a long struggle, lou, that goes back 60 years where low income blacks are americas silent victims, and they have been victimized and exploited by the left. Using the legitimate concerns about Racial Discrimination as the batter battering, ram, and they use the low income black as the bait, and the swim occurs when the resources the switch occurs when the resources arrive. For instance, one of the black lives matter out there in seat system is that all violent offenders, black offenders get a retrial. And what theyre advocating destructive to the very people they say theyre doing, theyre trying to help. So for blacks in these cities, actually, lou, there is a close correlation between police withdrawing from these communities when theyre covering the riots, it means there are fewer police around to protect people. And since the police are being accused of being racist, they are reluctant to enforce the laws at low income, high crime areas as vigorously as they would other times. For instance, st. Louis last summer, 4 young people 14 14 young people under the age of 14 were killed in three months. They called it the ferguson effect. The more police withdraw, the higher the murder rate goes up in the black community. So the black community, low income blacks are being injured by the helping hand of those who are supposed to be their champions. And thats what bothers me the most. Lou is it going too far to say im sorry. Go ahead, bob. No, go ahead, lou. Lou is it going too far to say that the black community, the poorest among them in our inner cities, are being exploited by the democratic activists for purposes that dont include their own safety and welfare . It is coming at the expense. Its like people being paid to solve a problem that they helped create. One of the things that was the strength of the black when slavery ended in 1865, there was a done by one of our 1776 scholars that documented that 7 a 75 of those slaves on six major plantations, 75 of the families had a man and a woman raising children. And that solid black family continued for another hundred years through virulent racism and discrimination. And up until 1965, 85 of all black families had a man and a woman raising children. In fact, under ten years of the depression from 19301940, black americans had a higher marriage rate than any other group in the nation. Elderly people could walk safely without fear of being mugged by their grandchildren. Thats because of our christian values and the nuclear family. And that has been destroyed lou thats extraordinary. In 1965 with the poverty programs. We went from 85 of families town to 30 percent down to 30 , lou. The welfare system did more destruction to black america than anything that discrimination did. And so for them to say that the problems of inequity in these cities are attributed to institutional racism is being so race being used as a ruse because it prevents us from asking more critical questions such as if racism were the culprit, then why are blacks failing in systems run by their own people . Lou as bob woodson has pointed out for a very long time. Were going to continue with bob woodson here on the other side of this commercial break. And among the many questions id like to take up with him are a number of questions surrounding his wall street journal oped. Also i would like to ask why it is that inner cities are not more mobile. Why is one of the great characteristics of this great free enterprise, capitalist system of ours mobility of working men and women. Why in the world havent we done more to be certain that theres broader assimilation for those who need most of all jobs and opportunity . Well be back to talk about that with bob woodson. Please stay with us, well be right back. And because we dont know exactly when this crisis is going to be over and we dont know exactly when the stock market will reach its bottom, weve got to be prepared for this to last a long time. If you assume that youre out of work for nine months but you end up only being out of work for. Lou were back with former civil rights activist bob woodson. He is the president of the Woodson Center. Bob, its great to have you with us tonight, and thank you for being here. I want to ask you about mobility and how critical it is as part of the solution in terms of poverty, in terms of the opportunity that were trying to create for all citizens in this country. Well, you have to understand that any minority groups participation in the economy is dependent on the Small Business formation rate. A healthy economy generates three and a half two and a half businesses per thousand people per year. The business rate in the black community more like three businesses per 100,000 a year. Plus we do not have only 30 of the families have a man and a woman raising children. In the days of, for instance, in 1929 in chicago, for instance, you had a lot of mobility. Even in the face of redlining in chicago, south side, there were 731,000 businesses in chicago. 100 million in real estate assets alone in the brownsville section of chicago. With an out of wedlock birth of only 15 is . Is so when you have money 15 . When you have money and you have the ability to move, a great migration from the south to the north. Again, it has to do with income and family composition. Is so we have accomplished these successes in the midst of discrimination. The question is why cant we do it now in cities that are controlled by black politicians for the past 50 years . Lou yeah. Institutional racism [inaudible conversations] yeah. Lou right, right. And when we talk about black politicians, we are also talking about democratic politicians in so many of these cities where we saw so much protests turn to violence, to vandalism, rioting. Theyre democraticallyrun cities. We have programmatic, you know, efforts for years, for decades without result. What are the solutions, bob . Weve got a few minutes here to talk about the solutions. The solutions, the solutions have to to occur from within. If you say that 70 of the families raising children that are dropping out of school, it can be with 30 or not. What the Woodson Center does, we go into those low income communities x we find out what is happening among the 30 , assist them. They are the social entrepreneur, the healing agent is thes. Agents. We have examples of when you invest in those entrepreneurs, you invest in these neighborhood if leaders, you can create eye lancz of excellence. Islands of excellence. Its demonstrated when you take old values and place them, a new vision and involve the people, you can transform an entire community from the inside out as a hedge against gentrification. And so there are models, but we must invest not in those who are black lives matter is taking up 100 million in the name of helping low income people. If a fraction of that were invested in institutions welcomn their communities, we have groups like the alliance of concerned men in washington that have created zones of peace among very troubled communities. In other words, we must build on the entrepreneurial spirit that abides in all low income communities, recognize that we need to strengthen these communities so they can begin to reform, redeem and rebuild from the inside out. But we cannot do that as long as we are transfixed on race. And were saying that the cause of that despair is institutional racism. It isnt institutional racism that is retarding this, its Institutional Betrayal by those who have been empowered and trusted to lead these cities. Lou right. Thats the problem. Lou and bigotry isnt as bad as betrayal. Lou and with that, were out of time, welcome bob. But ill like to make an offer i would like to make an offer to you. Id like to take up these issues as frequently as we can have you on this broadcast. Id like to give you a portion of it every week for us to talk about solutions s and we would be slighted if you would consider that offer. Bob woodson i am [laughter] that is beyond me, lou. Just platerred. Lou well, were appreciative beyond means. Thank you so much, bob. Good to have you with us. Wewewewe right now is a time for action. Lou Jason Chaffetz tonight blasted john bolton for undercutting americas National Security. Im terribly disappointed in john bolton. He was supposed to be the career professional come in there as an adult and be the National Security advisor. But i got to tell you the antics, ranting raving he is doing trying to publish this book to line his own pockets at the expense of National Security, that is just not acceptable. Lou and thats it for us tonight. Investigative reporter john solomon, just the news. Com editor, and dr. Michael pillsbury among our guests maria welcome back, good thursday morning.
