Texas, as an example had three days in a row with record hospitalizations. Watch that you have more cases like arizona and arkansas and other states. You mentioned new york, which is epicenter of the outbreak here in the u. S. The Governor Andrew Cuomo did indeed threaten to reverse some reopening that has started here in new york if safety rules are not followed. Then just moments ago at a News Conference he was holding said the numbers so far in new york stayed, continue to move in the right direction. Here he is. Were hitting a new high, which is really a new low but in this case, low is good. The lowest number of hospitalizations since this has started. Amen. The lowest number of deaths on the threeday average since this has started. Connell with that said, como says the state received 25,000 reports of reopening violations with a highest number coming in from manhattan, and also out in the ham tones with people partying over the weekend. Hamptons. That restaurants and bars are ignoring rules on social distancing. He is warning them to get their act together otherwise he could reverse things. The numbers are improving so much so, that cuomo said, one of the concerns, people from other states will start traveling into new york, bring the virus back in with them. The exact opposite what were hearing. It continues to be a riskoff day marketwise. The usual suspects are getting hit, cruise lines, norwegian, carnival, Royal Caribbean down significantly today. Retailers are taking a hit as well. That is what weve seen on the days when the market pulled back although the likes of target bouncing back along with best buy and airline stocks, also ones weve been watching. I said earlier that there are some other concerns, neil, working their way into the markets in addition to reopening talks. One of the things that started to come up when you talk to invest source is the Political Landscape and improvement some have seen in the polling for democrats, not just in the race for the white house but more in the race for the senate where the odds have moved up maybe the democrats might take back control of the senate. That seems to be working at least to some extent in the Market Sentiment as well, adding to uncertainty. The numbers stretched credibility the entire time. I view it as a Significant Development theyre now admitting there is a spike in beijing. They have taken real pains to protect beijing even when they have been opening up other places. They have been trying to insulate beijing. That is the seat of power there. I do think that is significant. My heart breaks for countries like india. You have People Living hand to mouth, unimaginable poverty, right on top of each other that will be a real challenge as it begins to spread in the developing world. People are there making choice, do i risk coronavirus or do i risk starvation . Thats a problem that their government will really have a hard time handling. Neil you know, it could be just me, i know all could have stated where there have been a spike in cases so much so that at least two of them, i believe utah right now among them along with oregon i believe, are scaling back planned reopenings or phases because of it. But by and large, that is something that other states seeing similar spikes are not doing. So what are you hearing on that front . Well a couple of things to keep in mind here. That is very important. Were also seeing more testing capability. So of course the number of cases are going to rise if youre able to identify them. Reporter you know, it is really senator tim scott from South Carolina thats leading the charge for the republican side on this he believes there can be a bill, that both democrats and republicans can agree on that the president will sign Going Forward. Democrats unveiled a bill that would ban chokeholds t would also ban noknock warrants for drug investigations. It creates a National Database on Police Misconduct and makes lynching a federal crime t ends qualified immunity for officers. On all of these things, the republicans have big issue with the last one. They do not want to end qualified immunity for officers, saying it would make it harder for good cops to do their jobs. We still are one nation under god and the legislation that were working on actually reinforces that by getting the information necessary to improve the outcomes within the Law Enforcement community and the communities of color. Were looking at training, whether it is deescalation training, make sure officers go home and so does the citizen and were looking at misconduct. So that we expand make sure that we have characterdriven officers in every single precinct in this country. Reporter and senator scott doing that interview with you this past weekend. Now he believes that he can have his deal, his bill finalized on the senate side at least by wednesday. And then move forward with it. Edward lawrence in washington on that. You probably heard of some tragic news over the weekend where an Atlanta Police officer fired fatal shots on a black man, rayshard brooks. He was subsequently fired immediately. The investigations are ensuing. Darren porcher joins us, former nypd lieutenant. Lieutenant, good to have you back, although circumstances like these, my friend. Thank you. Neil wonder what you make of this . It does seem very, very different than the george floyd case. Having said that it reignited all these passions yet again, i guess on both sides. What do you think . Well, when we look at the shooting that happened with mr. Brooks in atlanta, that was a tragedy. I will stand and state this was justified shooting. We had an incident where mr. Brooks was asleep in a drivethru, people called 911, look we cant patronize the establishment with the person asleep in the drivethru. Cops subsequently respond. They have mr. Brooks conduct a field sobriety tess. It was clearly determined he was intoxicated behind the wheel of a motor vehicle. So as a result, mr. Brooks is, come somewhat resistant. The officers attempt to handcuff him and mr. Brooks is able to overpower one of the officers and remove his taser. Mr. Brooks, mr. Brooks runs away, if you notice in the wendys video mr. Brooks turns and aims the taser towards the officer and engages it. When i say he engages it, he pulls the trigger. When you see the illumination of the taser that clearly lets you know that that taser is actively being used. The range of a taser is 15 to 25 feet it was clear the officers were within purview of 15 to 25 feet when mr. Brooks engaged the taser. As a result the officer shot him and he subsequently lost his life. One of the things that people have brought to the discussion is, why was Deadly Physical force used when a taser would be deemed as non, a nonweapon that would commit to Deadly Physical force . A taser can, we understand the difference between a taser which can be perceived as a dangerous instrument as opposed to a Deadly Weapon. A Deadly Weapon would be a firearm. A dangerous instrument can be anything that can cause serious physical injury, death, chair, bottle, things to that effect. Say hypothetically we let mr. Brooks, because i heard the argument, his car was still in the parking lot. We can catch up with him at another time . Now we have a person that assaulted a police officer, that is in possession of a police taser. That was deemed as intoxicated. This is a clear example after danger to the community. So as a result, i think the officers needed to take the action necessary to bring him into custody. Many people would say that this was subjective but what is even more subjective the police chief terminating the officer without due process. I have investigated many of these police shootings. Often times takes hundreds of hours to make an assessment of something that happens within a radius of eight seconds. There for this officer was not afforded due process. I think this is kneejerk reaction from the mayor. Moving forward, Police Something viable commodity in our society to keep us safe. Whether you agree or disagree with the engagement, it was handled in the wrong way by the Mayors Office in atlanta as a result. Neil you know, darren, so much we dont know yet. To your point, everyone is owed an investigation will do that i was survived the officer was immediately fired, no questions asked. It does remind me of what weve seen happen again and again where mayors are the ones sort of dictating policy, sometimes to the consternation of their police chiefs. So weve seen that play out in seattle where the police chief is sort of at loggerheads what to do when the mayor says, let the sort of selfcontainment zones fester and do their thing. We saw it certainly with the Atlanta Police chief just a little surprised by the immediate move to fire this officer by the mayor. And we see knit a way in new york, of course, where the new york city mayor has this back and forth tense relationship with Law Enforcement, more or less echoing what protesters have been saying. Im wondering where you see all of this going . Well, we have a elected officials that are not allowing the social contract to come to fruition in connection with the policing that would be necessary to keep our society safe. Often times were seeing in the wake of the death of george floyd which is who are rid and diametrically opposed to officers action what happened in minneapolis. But we need to look through the lens after empirical process to insure the policing is sound and structural component is intact. When i say intact are reforms necessary . This is absolute. When we see the wakes of senate trying to move forward in connection with tim scotts bill, i think this is necessary and lawful Law Enforcement. We need credible politicians or elected officials at the forefront managing these Police Departments and understanding that the Police Executives are the practitioners. Theyre not the theorists that are being projected by the elected officials. I just think subsequently we as a public are being utilized as a litmus test on Public Safety and we need a referendum on this and we need the executives, i should say the practitioners to be at the forefront, hopefully, and im confident that the bill introduced in the senate and eventually in the house, this will create a series of reforms that can make policing much better place because it is clear that there are structural deficiencies and ultimately we want quintessential policing in our society as a result. In the capitol hill autonomous zone is one of two out comes. The mayor and police chief are negotiating behind the scenes with protesters. My sources with the spd is the mayor is willing to make big concessions, devoting 100 million, towards community of colors, activists organizations and social justice organizations. So there is the kind of negotiates route out but there is also possibility of viiv lens happening. And police requiring themselves to go in and the official advisory from the chief to her folks in the area is that, if there is a mass Shooter Event if there is severe structural fire, police will go back in to retake the area. Right now, really at times, kind of this jubilant street fair. At other times it gets tense as there are violence and assaults. Really time will tell right now, people are waiting and it is at a standstill. Connell because of that i think what some people were wondering when this zone started to emerge was, is this in line with the other protesters seeing around the country . Is it helping cause of black lives matter protesters movement . Or is it distracting or taking away from that with what is happening in seattle . From best you can tell, whats the take there . Yeah, i mean, it is, it is a volatile situation and right now within the capitol hill autonomous sown. Within the chaz there are a few different factions. Theyre fighting out to be legitimate authority and representatives. You have the more traditional black lives matter organizations. Antiimprisonment activists. You have africanamerican activists that have been longtime fixtures in the seattle activist world. Theyre trying to make this explicit black lives matter movement. Theyre fighting very hard for that. Second, you have the more radical an arc universities elements, the armed John Brown Gun Club members. They want this to be a truly revolutionary zone. They want to secede from the United States. They want kind of a revolutioncharged place. And then third, you have kind of the warlords and the mobs that have cropped up. One person simone, seen early on in the protest patrolling with ak47, theyre clearly out for a different agenda. So right now within the chaz theyre having this heated internal debate to find out who is the legitimate representative and were seeing a kind of battle between these various factions that has really no resolution as of now and well see in coming days if theyre able to rally around one legitimate authority. Connell right. If they are, and it is less radical of all the radical movements that you just described in there, what are the odds you think that the police and, or the city of seattle might actually give in here . If so, to the chiefs earlier point, if there are changes made in seattle that they might set the table, that this protest movement might have some effect on reforms and changes in policing in other parts of country . Is that possible . What odds would you put on it . I think probably the most likely of all the out comes, i think the marielly backed up and backed away and kind of conceded to the protesters in principle and i think what were going to do is a delicate negotiation. Tough keep in mind this, the demands from black lives matter are not only about the police. And right now what theyre advocating for either 50 or 100 defunding of the Police Department. That is really only the first level demand. But as you look at their demands underneath all of those, it is a radical socialist agenda. They want free college for all. Free schooling for all. Canceling all debt. Eliminating all prisons. As you learn more about it, you have to understand the underneath the slogan black lives matter, that is truism, everyone agrees on that, but underneath is radical agenda as people in seattle and around the country understand better, this is 1960s style radical marxism wrapped in a new message of kind of identity politics. More specifically the city council voted, voted on opening indoors at 25 capacity or 50 people, but positive murphy of new jersey as well as the state decided no, were not doing that and that anger ad lot of people including a heckler shared some comments on Live Television when governor murphy was on tv. He responded to. Listen to his response. This guy deserves to say what he wants to say, honestly, overwhelmingly the majority of folks get it. We make decisions not arbitrary. They are based on facts and data kristina the majority get it. I spoke to several Restaurant Owners find there is lack ever consistency when it comes to the rules. Theyre saying that the retail shop can open but yet we cant open indoors. Listen what they have to say . Hopefully the governor will wake up, us somewhere, give us some type of Indoor Dining going. So i think what is going to happen after today, there is a owners meeting going on either now or about to begin any minute now, where they are going to essentially go through the details of imposing a hyper shortened season, somewhere around 50 games. Theyre going to probably start this sometime in late july. You will have to have spring training first. Spring training will begin in july. And i think, this announcement will leak out today. I think it will be made formal, at least what im hearing from League Sources towards the end of the week but we are going to get baseball. It is going to be a messy season. Till was very short season. It will probably start, i guess if you can have spring training in july, it may start in august. It will last until probably september, sometime late september because they dont want to play it too far into football season. Listen, the socalled convenience rules, used by six states means if you live outside of your employers state for your own convenience, the employers state can tax your income. This includes new york, connecticut, pennsylvania, among other states. If you live and work in these six states you may end up paying taxes twice. The rule has been around for a long time. Its not new but it could affect 10s of thousands more people sheltering in place away from city centers. Every state with an income tax, offers a credit for taxes paid to other states but they dont always make the taxpayer whole. Arkansas has seen more than 70 hike in hospitalization since memorial day weekend. Neil do you equate that somehow in the black lives matter movement, congressman, what happened in the africanamerican man in atlanta who was shot and killed by police, brandishing a taser. And what happened in minneapolis with george floyd . Obviously when you see george floyd situation, clearly a murder and when you have an individual shot multiple times in the back, that escalates to a level of concern that i do see george floyd situation must enter much differently than the atlanta case. Here you have an individual that is actively tussling with the police using weapons, grabbing for weapons and that is a very dynamic situation and theres going to have to be just as thereto. Because shooting an individual on the back is problematic. The bottom line is i would say thats why the senate, im intrigued with the conversation were having with the senators in regards to a package that will be bipartisan, we have a bipartisan bill and there is no outreach to the republican side to put this together and we can change that hopefully when the senate gets done with the package this they are working on. One thing that is interesting, i noticed a lot of the virus sensitive stocks, the airlines, the entertainment stocks, the leisure stocks, even some of the crew stocks have come welloff their lows, whats going on here. The whole sector, not just the airlines in the cruises but what youre calling the covid sensitive areas, they have all off a lot of speculation so youre getting a lot of players that are in for a short period of time and that can boost returns, you can get a quick buck and that can enhance voluntary substantially. Its a bit different than what i would consider to be the reliable and stable way to play the next stage of market improvement and it doesnt really tell you about the fundamentals of the space. Neil it does tell you how much the virus the way some peoples minds as an economic and health issue. Im wondering when that was called into doubt that may be a spike in cases, whether its a serious bike or not, just the thought that it could delay the real openings struck me as something that wall street is very much entombed in. Neil id be curious when all the developments in protest around the country and the notion that the president has lost whatever he was making with africanamericans as a result, is that true, what are you hearing, your own views notwithstanding. What im hearing, i think there are ways in which he could handle this entire situation better and we can go down that line for line, absolutely. I think what the Administration Needs to focus on what they have been focusing on for africanamerican voters is actual result, his Prison Reform and the fact that they have local black unemployment because of the covid pandemic and the people that were supporting them will continue to support them and think this is something that could happen again in response to everything thats been going on the past several weeks has been tone deaf, absolutely, i dont think when it comes to the fundraising and when it comes to the energy of a lot of President Trumps africanamerican supporters and social media, i dont think will happen with the riots is going to deem not too much but i do think we need to see a more nuanced response in the future and i would point to the fact when people had concerns with the date of this rally being on juneteenth on friday, they push that date out of respect to a lot of africanamericans that had issues, myself included. They push that date out of that respect and i think we definitely need a more nuanced response to everything that is going on from the Trump Administration but honestly between you and i the people that are going to hate President Trump and think hes a racist or hes this or that based on this response to the right, already thought that beforehand.
