Dagen francis . Francis what do you think is priced in the market, if we see selloff, where do you see substantial support . Mark yeah, great question, a quite of bit is priced in the market. Typically the market tends to move up about 4 months in advance at the end to have recession and by way of saying move up on a sustainable basis and so right now the rally off of the march 23rd lows would imply that the economy would see the end of the recession perhaps as early as late july, maybe august of this year and that seems pretty optimistic given everything that weve already sort of alluded to and that to me suggests that some vulnerable to the fact that recovery, even if states are allowed to reopen it wont percolate level of activity that is sufficiently strong for corporate earnings to grow well enough to afford a multiple that is now being priced in equities that implies 20 times forward multiple on earnings that are expected to come not in 2020 but rather in 2021. So when i think about what levels you might test if we do get a full back, certainly much would be made around the case that we could see a test of those march lows. Thats draconian to me. It takes a lot to shape 700 points from the s p 500 at this point in time. Theres a lot of support in there, almost in 100 point increment, 2000, big figures here, but nonetheless at the various levels you see various points of support that you expect the market to release, which pause that which make and stop look around and perhaps allow at the level for economic information and perhaps therapeutic response from the Healthcare Companies to catch up to equity prices. Fauci speaks confidentfully and and i like hes taking optimistic tone. Everyone wants to have successful vaccine so we can return back to normal as soon and as quickly as possible. If we have vaccines that are available late fall, maybe even early 2021, i think thats going to make the process a lot easier because what the vaccines do is they bring up immune system to a level where its prepared to deal with covid19 where we do not see devastating strain so far. Dagen businesses are beginning to reopen like requiring face mask and installing plaxyglass. I took my dog to the vet, you approached the door, you call, they come out and take information while they are Wearing Masks and they take the dog, you dont want into their facility at all and the doctor calls you while youre with your puppy, they allow you to walk back out and then you get your dog. Its about decreasing the possible risk of transmission and, dagen, i will tell you the most common place of this transition takes place is in crowded conference rooms, big events, so those are the ones that are going to be really taking the heaviest toll for the next 6 months because those are the ones that are going to have to be cut short or at least changed in the way that we follow our normal policy. You had the essential businesses open and they just look at that and say, well, if those businesses can open, why cant more businesses open and wouldnt that actually reduce the crowd density because clearly people are not going to stay at home, they are in their cars, they are out, theyre actually looking for things to do, so if you allow more businesses to open it will reduce the crowd size which is inherent danger. Mike yeah, dagen, this has to be taken on a casebycase basis because each state or even each city is experiencing different sort of stages of the covid19 pandemic. In new york city where its fairly trending down and thats why we are starting reopening process and in los angeles they are extending their restrictions because cases continue going up and theres no one size fits all solution. I do think that we desperately need to start opening up but we cant do it without a strategy in place, without knowing what we should do because if we reopen too soon and we are starting to see our hospital rooms get overfilled, icus get overfilled, thats going to put us in a place where we will reinstitute measures and nobody wants that. Dagen do you think doctors state and local levels that are by the way as news alert as dog owner, the dog parks are open, the dog runs are open in new york city for the Hudson River Park system, they opened last weekend. You have to wear a mask and, you know, keep your distance, but like the dogs are having a blast. [laughter] mike yeah, absolutely, dagen, again the whole part of covid19 virus is that we are not going to stop it from affecting people. Its going to go up, cases are going to happen but we have to remember by in large when someone gets sick with covid19 theyll do just fine. We cant treat if its a deadly virus and everyone that catches it will do horrible. Thats not why we implemented the Safety Measures. The reason because everyone was getting sick to quickly that it was going to break our Hospital System to the point where our hospitals couldnt care for regular patients and we couldnt have that happen so, yeah, we will have dog parks open, stores open, people will catch covid and we will figure out how to deal with it. The important part we dont do it too soon because if everyone gets sick at the same time thats where the problem arises. Dagen before we go, i want to mention, i want to get your insight into this coronavirusrelated its a link illness thats showing up in children. 100 children in new york state alone experienced symptoms of this inflammatory condition prompting new York Governor Andrew Cuomo to prioritize testing for children showing symptoms. Similar cases in connecticut, kentucky and washington state. Its similar to kawasaki syndrome, so whats the treatment . Mike the treatment for this is really making sure that the children are tested early and quickly so we can identify that it is, in fact, the syndrome thats going on. When you have a highly inflammatory state like, this it can cause multiorgan failure rather quickly but at the same time we must know that just because this is happening in the select few children, this is not happening on a mass scale, when kids get sick with covid19, they do much, much better than adults and even adults are not suffering not by in large, 90 do really well and children even better. This is happening rarely but this goes to show that we do not fully understand how the virus affects children and we need to not think that children are completely safe. Theres still side effects and still some unknowns with the virus and out of the 48 children that have had something similar with this inflammatory state, 40 of them had medical complexities that were high, other underlying issues, so we think that could be a possibility, but we are still investigating and i think thats why we havent made any decisions when it comes to kids. Dagen not to put you on the spot, but coronavirus cases in the United States, whats the overall death rate at this point . Mike thats a highly debated topic, we think its circulating around the 1 mark. Once we see asymptomatic cases, seem today drop somewhat. In tend when we count, still higher than the flu. Dagen 1 , thats ten times higher than the flu but lower potentially with the people who, done, the asymptomatic cases. Dagen so massachusetts stay at home order is in place until may 18th, roger, what are your plans for reopening . We will be very cautious about it and we have plans in place. We have the person who heads up our sort of inhouse health department, if you will, as an epidemiologist and former Public Health official, so what we are going to be doing probably screen line menus that can be executed fairly quickly, again, the thought is that the occupancy will be down a fair amount. Theyll be social distancing and one of the things we are looking into frankly is a fogging mechanism to fog every restaurant before it opens to make sure that all the viruses that could potentially be there can be eliminated. Some in the senate not okay with it even as pelosi touts thinking big. The Federal Reserve bank told us to think big because Interest Rates are so low. The low Interest Rate and the prospect of access to credit has bolstered the stock market. We intend to use those low Interest Rates to bolster the American People. We must think big for the people now because if we dont, it will cost more in lives and livelihood later. Not acting is the most expensive course. What youre seeing in the house, nancy, is not something designed to deal with reality. But designed to deal with aspirations. This is not a time for aspiration allege subluxation. Im trying to read through all 1800 pages, but first glance, look, weve done a lot already. We need to figure out what weve done is working so i would be a no on this package. Dagen well, heres a little interesting tidbit in this 1800 page bill. There is a it includes a repeal of the state and local Tax Deduction cap of 10,000. This is a tax break for rich people, period. The salt cap rate, 33 billion in 2018 from those earning more than 1 million. So nancy pelosi is putting her, boom, stamp on a tax cut for the rich. Yeah, its a giveaway. Look, that tax was not particularly popular a couple of years ago when or the salt tax provision was not particularly popular in 2017 but i think it has performed as indicated and for a state like texas that doesnt have a state income tax there was always a question of why are you subsidizing higher tax states from lower tax states. So from a texas perspective, the salt provisions of 2017 made a great deal of sense. Look, but thats been one of the things theyve been trying to get at ever since. And youre quite right, people who will be benefiting are not the people at the lower ends of the income scale, its going to be the people at the upper ends dis and what you might have to sacrifice long run. That helped pay for the Corporate Tax cut and the individual tax cuts. Mike lee, nancy pelosi, the democrats were trying to use the rising deficit against President Trump and the republicans before the coronavirus pandemic. But now theyre saying rates are so low, weve got to borrow, borrow, borrow. When does this become a problem for the market, for the at least the bond markets . The United States, the 12 month deficit through april was 1. 9 more than 1. 9 trillion, Second Quarter borrowing will be nearly 3 trillion for the treasury department. Is she right or wrong . Well, look, what Something Like this would do would not only be just an outright political sham in the middle of a crisis, but youd further along the japanifica tion of america. When people look at it and see deficits and ballooning debt and think hyper inflation, the problem becomes japan where you can never grow and the rich stay rich and its impossible for people without assets to acquire assets. I would be interested to hear the congressmans reaction to that. When chairman powell spoke to the republican conference, i dont think we got the same message that apparently the democrats heard on their visit with him. I thought the approach was more like, look, weve got to save some things right now, weve got to preserve the fundamentals of the economy so we can grow in the future, but if we can grow in the future, then the problems that the Additional Debt were taking on are manageable. If we dont grow or the debt becomes unmanageable, then thats big trouble. But the message i got was not that just keep spending because theres no penalty. Obviously, there is a penalty from continued spending. Dagen one other thing in this 3 trillion proposal, and i said even before this, this is House Speaker pelosi gasping for relevancy because she was essentially iced out on the more than 2 trillion in early aid that went out because that was handled by secretary mnuchin, the white house and the senate republicans. It does it keeps that 600 additional unemployment benefit increase that came from the federal government, it keeps it in place until january and you already have roughly half of all u. S. Workers are earning more on unemployment than they made in their jobs and many Business Owners as the economy reopens, as states reopen, are having trouble bringing workers back because theyre making more at home on unemployment. How would this exacerbate the problem of a nation trying to reopen if you extend those extra benefits from july to january . I think you correctly identified, clearly well have a workforce problem. Its already im hearing about it at home from people who are trying to kind of bring things back online, that it is hard to entice someone back when theyre earning more on unemployment. There is an end point to that right now. Middle of the summer. If you extend that past the first of the year, you just delay the eventual reopening of the country that much more. Look, theres no way in the world that we can print or create enough dollars to completely replace the entire United States economy for the rest of this year. We have to get the engine of the economy spinning again and if we dont do that, if we dont do that, there is virtually no way we can appropriate enough money on emergency or supplemental basis to do that. Because ironically dagen speaking of reopening, hows the reopen going in your district in texas . Its phased. Its obviously been taken in stages, i guess three weeks ago they allowed for elective surgeries to be scheduled in the hospitals which was critical because the hospitals had zero cash flow and they were empty. Weve done this to try to protect the hospitals from a surge of patients. The surge didnt happen. Now the hospitals were going were literally dying on the vine, so thats been critically important. Certainly traffic i continue to go to my District Office every day. We have a reduced workforce so we can all socially distance. But the traffic counts just from what ive seen look like some mornings its pretty much back to normal. You go to walmart and lowes and, yeah, its getting pretty crowded. Heres the thing, though. President trump, what he did in the state of the union message, he outlined an economy that was robust, that was going to deliver for all sectors of the economy. Speaker pelosi stood behind him and ripped it to shreds. Shes been the speaker for the worst economies of the last 20 years. I dont know why we would trust her to try to get us out of this one. It seems like, dan, this is what elon musk and his brother were saying who is on the board, is that the state was fine with it but it was bar barr crates buren Alameda County who were trying to big foot on their business. The county was continuing to restrict tesla where if you go five, six miles away, you could have manufacturing. And that was really the frustration not just of musk but of investors, in terms of freemont not opening. Every time, every day they cant open is cash burned. Do you think that happens . Lower cost and less regulation would certainly benefit the company. Theres two different ways to look at it. Is that going to be another manufacturing hub for tesla, also the cyber truck they talked about potentially in texas where they produce that and it just comes down to right now, you know, musk and tesla had significant momentum and obviously covid19 pandemics been a significant head wind but restarting the engines are key, especially given what theyre doing in china as well. Dagen how elon musk has reacted to the shutdowns and particularly what Alameda County was up to, it is really made a lot of people across the country in red states Pay Attention to him. Does that actually give a halo effect to the brand . Does it attract attention even potential car buyers, that werent otherwise there for a tesla . Well, i think it speaks to the musk not just in the factory, but outside in terms of what hes done. Hes someone that talks the talk but walks the walk. I think it further to some extent emboldens the core tesla investor around musks actions. Ultimately from a car perspective, it really comes down to model 3s, getting them delivered and produced. Thats why, remember, musk has a much different view than a zuckerberg of facebook because theyre a Services Company and that continues to be a much different situation relative to tesla and facebook. Dagen really quickly, uber, dan, is reportedly looking to acquire grubhub, all stock deal potentially. You can take a look at the stocks, both are down roughly half of 1 . It would create the largest food delivery entity in terms of sale, reduce competition. What do you make of the deal . The writing is on the wall for uber. The world has changed since covid19. Glob hubit would give them moreg power and more and more, thats going to be a Growth Engine for them. Now the question is f a deal happens, what price. Also, this would be a stock deal in terms of the way it was reported. Dagen curbing crime amid covid19, more than 100 inmates have been rearrested after being released from new yorks liker island over coronavirus concerns. It comes as inmates at one california jail attempted to intentionally infect themselves with covid19, drinking from the same cup, in hopes of getting an early release. Inmates were caught on camera sharing the same water dispenser, sniffing from a common mask, and drinking hot water to boost their body temperatures. Within a week of the surveillance, 21 inmates tested positive. Joining us now, fox news senior judicial analyst, judge andrew napolitano. I want to focus on the rearrest of people release from rikers island. What do you make of that . Well, the problem is you not only have people good morning, dagen. You not only have people being released because of the question individual issue in the covid issues in the jail, the people being released dont necessarily have covid but have been exposed to it but you have the crazy situation you and i have talked about this until were blue in the face, about the bail situation in new york, where if the crime is not violent or a body part is not impaired as a result of the violence, theres no bail. This is a revolving door. Getting arrested for committing a crime, being released on bail or being released because of the covid. This is a monumental threat to public safety. In an era where admittedly crime is down because most people are staying home and are there to protect their properties but nevertheless people have to be aware of it and the police need a little bit of relief. The bail law has to change. Governor cuomos admitted that. But the legislature is obviously not in sense and that change wont come about until the pandemic is gone. Dagen i want to ask about details in the death of kobe bryant. The Helicopter Company denying denying allegations of wrongdoing, saying kobe bryant and his daughter knew the risk of dying. California is one of the few states that has a doctrine called assumption of the risk which basically means if the injured person knew the risk that they were involved in, and took the risk anyway, then part of the injury is their own fault. This is a reprehensible doctrine. Its a holdover from the preworld war ii era, nearly all other states have gotten rid of it but basically if a jury found that the fault of the crash was because of an improper pilot operation, but that kobe and his daughter had reason to anticipate this, that could reduce the judgment to mrs. Bryant. It would be would require a monumental proof. They would have to prove the lawyers for the Helicopter Company or the Insurance Company would have to prove somehow that kobe and his daughter were aware of all the risks of flying on that morning and aware of the poor judgment on the part of the pilot. So each property will have its own unique set of circumstances. And candidly, were not quite sure how long this will be in effect. At all of our large properties, well be utilizing thermal body imaging and those devices are anywhere from 15 to 20,000 apiece. A location like Atlantic City that has so many doors, youre talking hundreds and hundreds of thousands of dollars. Dagen i just wanted to point out, jim, i conlat conflated crd roulette. Im going to let kelly talk. Kelly i was wondering about that, dagen. What do you think about demand . I can see on the one hand youve got people who have lost their jobs, maybe people a little nervous to go out in public at first. But then on the other, you have people who have not been spending a lot of money, maybe, theyve been at home, not going out. And in some ways, casinos, some of the games really are socially distanced anyway. Youre not sitting that close at a black jack table because you dont want to have people see each others hands. Yeah, i think to dagens point, certainly a game like roulette or craps where you really have on top of each other, that is a much different environment. We can create safety at a black jack table where normally theres eight positions per table, were basically reducing that in half and then if a guest feels more comfortable, there are plexiglass dividers. But i think in general, the slot customer, that is more of an isolated situation. I think well be fine in those particular areas. Most casinos, even on a friday, saturday night, usually your machines are not greater than 70, 75 occupied. We certainly have capacity in order to reduce the amount of individuals that potentially could cross the line of social distancing. It may create a little bit of challenges with the specific title that a guest may want but i think overall well be fine. Whats going to happen when youre at the track on sunday in terms of procedures . Well, one things for sure, were going to race. [ laughter ] but as far as all the procedures, it is very detailed and very planned out with everything from specific times to get to the racetrack to go through screening areas to enter the racetrack and once we enter the racetrack the drivers will basically be isolated in our motor homes at the racetrack and we will not come in contact with any of our crew members or anybody from the time we get there until the time we walk out to go get in our race cars to start the event and then for the crew guy as well, theres going to be a lot of calls in place for them for managing the times that theyre together, less than six feet apart, and with all of the personal Protection Equipment that theyll be wearing. Dagen and theres not going to be, at least there are two cup races at darlington, the lady in black, one su sunday and one on wednesday. Plus, you dont get practice or qualify. How is that going to change the racing that we see sunday . Its going to be wild. You know, weve this is unprecedented times and so the time that weve been off right now has been as long, if not longer than our actual offseason and in the off season, theres a couple times that we test over the off season, before the season actually starts. So were actually in our race car before the season starts at daytona. Here, weve been off for two months and were going to go climb back in our race cars with zero practice and so im sure theres some cobwebs and some rust well have to knock off in the first new laps. Its going to be interesting. You know, i think when you do it, that repetition and racing week in, week out, all the practice that we do, you actually get used to running 20g kinds of slows down and doesnt feel very fast. But when youve been out of a race car for as long as we have and you get back in a race car for the first time, 200 miles an hour feels like 200 miles an hour. [ laughter ] and things are happening very fast. So i think its going to be its going to be interesting. Dagen thats what makes me so angry when people talk about nascar not being a sport or race car driving, im like you have no idea, to have the device on and you really and youre inches away from other cars going 200 miles an hour and you cant see. Anyway, its bananas. I want to ask you this about the competition on the track. Because nascar has a real opportunity to bring in new fans in a way like never before because this is the first professional sport that is back with a live event. And people are going to people who maybe never watched nascar are going to be watching. So what are you going to show them . Were going to show them were going to show them how we entertain our fans and why were one of the greatest sports in the world. You know, i think for people like you said that dont think that were athletes, the thing that i tell most people that kind of puts it into context for them to understand is that the inside of our race cars are usually about 130 degrees. So imagine being inside of your passenger vehicle on a hot summer day with the heater on, not the air conditioner, and youre going 70 miles an hour on the interstate which is not very fast, youre going to the speed limit. Imagine you come up to one of the exit ramps that does a 360degree looparound, just keep your car on Cruise Control at 70 and try to make the exit ramp. Things get a little more exciting, right . Youll probably tense up a little bit and things happen a lot faster. So we do that for three andahalf hours, not just one turn. And so, yeah, i think what we do is fascinating and exciting and its one of my favorite things to see a fan that showed up to a race for the very first time and see their reaction after theyve seen a race, because what we do is unlike any other sport. You know, we race at 200 miles an hour, inches apart and usually less than inches apart. We sometimes run into each other. So its exciting. Its fun. And i think we have a great opportunity to show off our sport in front of millions of americans. Dagen aric, before we go, theres two cup races at darlington and then the following weekend there will be or week, there will be two races at charlotte. Any of the number 10 team members, any of the crew members or anybody at stuart hoss, are they reticent about going out and getting back at it with the virus concerns out there . No, i think for us were just all going to be diligent about practicing protocol and keeping in mind that we want to be safe and we want to continue on with our lives. We want to go back to work and we want to go back to racing and we want to go back to putting on events for fans that tune in to tv and we want to get back to normal. So were excited.
