Well, dagen, i think the markets have basically, i had a naive approach on the situation, if you look at the markets, they havent been affected much but if you get into all of the gdp stuff that can probably come out of this, then that probably lies ahead, if it continues at this point but if you look at everything that comes in a manufacturing, supply chains, everything airlines, to tourism and the whole thing, i think it guesses into the whole market. Recognizing that the bond market seems to have been rallying of late, how do you position a portfolio right now in the perhaps likely event that the Global Economy begins to slow as a result of a coronavirus . Well, i think that you have to you have to do like we currently have which is a portfolio that has quite a bit of income in it, you know, we are little late in the game and the utilities and reads and we own them, we own quite a bit along treasury right now, if you come in with new money its different than it is now. If you think thats happening, i think you have to have liquidity in some form of another and i think people have barely low liquidity in general, i think they do, but if you think thats happening and the only way to get defensive, not many sectors that you with own as you get general market rate. Dagen some expect this would have relatively small impact on the markets, im talking about the virus. Its interesting, i talked to manufacturing that have small things that you wouldnt think about that theyve gotten information that, hey, thats going to be slower for you to receive things, things like pieces that go in machines that one part came from china, certainly it would impact textiles, furniture, but i think what happens is the supply chain supply chain, their stuff goes to another country and then it goes and then i think thats whey people have a hard time figuring out right now. It would have an impact, for sure. Sure, democrats that are in trouble and on the ropes in november are willing to compromise, unfortunately theyre in a position where theyre not able to tell the speaker no im going to vote this way or that way, we is that true in the impeachment phase, there are a lot of democrats who hated to vote to impeach the president , arms were twisted, they said ive got to do this, its a leadership issue and so i think youll see come closer to november youll hear from a lot of democrats who are campaigning on all their wins, working across the aisle, its amazing how the close you get to november the more democrats you will find say that are willing to work with democrats. Congressman, you mentioned compromise, one to have things that could be on the table for compromise and larry cuddly mentioned it the salt deduction, a lot of the members of the house that ive spoken to that are in the northeast or in california really thats a big issue with their constituents, do you think in the compromise spectrum talking about the salt deduction may be part of the equation . Andy mccabe is not being indicted for a very discreet fact pattern which is simply the leaking of information to bolster information during clinton investigation, thats it. That has nothing to do with fisa and the initiation of russia and and any other potential misconduct that andy mccabe may have engaged in, thats a narrow discreet fact pattern. It could actually be that hes cooperating with john durham or looking or a suspect in the john durham now criminal probe, is that right . Well, hes certainly somebody that john durham would want to talk to. Dagen joining us ohio congressman, brad, congressman, good to see you, what do you make of your former colleague trey gowdys comments and decision not to indict andy mccabe . I think hes right about the prospect that theres more to come out of this realm. Well, apparently thats not the case like some people like mccabe, you look at what happened with papadopoulos, he got a date wrong and hes prosecuted. You look at roger stone and this was basically a noncrime that they were investigating to begin with and then you look at flynn and even the fbi said that he didnt intend to lie but was prosecuted. He lied and he lied about the lie and nothing happens. Quite frankly i dont know how they will get their reputation back if they dont clean up their own house and maybe in this situation they fear that if you go after this particular set of lies then youre going to have to talk about the Clinton Foundation even more, maybe they dont want to go there. I dont know but theres a lot of questions that need to be answered on this and i do think that mr. Gowdy is right that theres more to come. Congressman, good morning, Mitch Roschelle, is it possible that with the durham investigation ongoing that hes either cooperating with durham or other offenses would be picked up as part of durham investigation . They may very well be the case, you raise a good point when that stuff happens, we typically dont know about these types of things until after they play out. Maybe a situation like youre cooperating and we will let this go, we have more to do. Lets be clear that there are some wrongdoings out there and i think durham will continue to investigate that. Dagen interesting, though, because based on what jim comey, his what he said about what andy mccabe did, they didnt line up, so jim comey potentially if this had gone to trial would have refuted what andy mccabe was saying, so that was thats right. Dagen interesting part of that story. Lets move on key point. Dagen lets move onto urge the attorney general to resign. Employees signed a letter calling for attorney general to step down and report unethical behavior following the justices decision to propose sentence reduction for roger stone. Congressman, what do you make of this . Again, this is just a sentence recommendation. Right. I think theyre making a big deal over nothing and curious where were the prosecutors when james comey came out and read off Hillary Clintons list of crimes and then said no reasonable prosecutor would take up this case. Well, he certainly pleased Loretta Lynch because it took her off the hook and Hillary Clinton off the hook, where were the prosecutors then, why werent they saying then, you to business to take this on and say that, and in this case to attorney general barr, you cannot look at the sentence that roger stone got and compare it to other crimes and the punishment that people are getting across this country, it just doesnt add up and i think he has every right to raise the question. One of the things that im curious about is people are concerned about politicization of the doj now, dont you this this adds to the perception that they would release a letter like that theres clearly partisanship . Former employees, are they all so well connected at this point that they can act in mass like this, its amazing to me and certainly speaks volumes to the type of club that may exist out there in our agencies and to me it is political, they shouldnt be involved either, arent they doing exactly what theyre accusing barr of doing, getting involved in a situation where they dont belong. Hes very much staying in his lane, he very much knows who he is and would target audience, target audience is Hillary Clinton voter who didnt get her elected last time, the people that are more reasonable, he knows hes not going to get Trump Supporters and not get bernie bros, i dont think its a smart strategy, i think its a very safe strategy, and i say that carefully. I dont think its one thats going to win or get people that excited. Ive god to say bloomberg has been alienating farmers with those comments and African Americans with those comments and Hillary Clinton has been alienating people for the past decade, its awful, its off putting, i dont think this is a good idea. Theres always a why now, when anything appears like this i always ask as a journalist thats the only question you need answers, why now, so if his voters, if hes talk about Hillary Clinton, hes talking to the educated women who voted for her, so this came out the very day the Washington Post had a long pexpose about the treatment of women within the company that he still owns roughly 88 of, the booklet of Michael Bloomberg quotes, some of them sound like jokes but extremely sexist, language and behavior. Yeah, the why now in that is a very good point, is he just trying to win over women but the other thing thats important to look at who is endorsing him, where is the energy and momentum, you have Something Like this leaked and you will say maybe Hillary Clinton will endorse them, maybe i need to give him more of a serious look, these kinds of thicks give people a reconsideration on bloomberg, a lot of people say theres no way he will buy his way into the election, this makes it seem like a more legitimate campaign in some peoples eyes, not saying everybody, some people. Turning to Harvey Weinstein trial, jurors to start deliberation after intense closing arguments thursday and friday, weinsteins defense team say that prosecutors created alternate universe which strip women of common sense and argue two accusers of the case are opportunist, prosecutors saying that accusers have made massive sacrifices to come forward publicly. Joining me now law and Crime Network host jesse weber. Thanks for having me. Dagen what do you make of the closing arguments and where the jurors will start deliberations tomorrow . There were fiery closing arguments from both sides and prosecution presented strong case, what they did very well in closing was explain away some of the questionable or problematic behavior of the accusers and really the thing that stuck out for me and im wondering if it took out from the juror, because a woman goes to dinner with Harvey Weinstein or hotel room or goes to his apartment doesnt mean that shes looking for sex and doesnt mean that shes looking to be sexually assaulted but, but defense showed its riddled with doubt, i think this is a complicated case, a tough case for the prosecution, i expect the jury deliberations to continue probably into the end to have week, maybe into next, we might see an acquittal, we might see a hung jury, thats my expectation given what ive seen from both sides, ive been there almost every day, me who have the benefit of analysis, im even torn. Dagen one thing that the defense tried to do is brought in former friends of the weinstein accusers to try and poke holes in their story, were those convincing . They didnt want to be there, they were forced to be there by subpoena, when you the witnesses what gain do they have testifying against former friends and testimony really hurt accusers, at least at the very least raised questions why they were coming forward. The defense is saying, these women as you said are coming forward maybe part of movement, theyve lawyered up with gloria alred and portray personal lives for the public and the world at large to get maybe a financial incentive, a lot to ask but at the same time the more they struck at the credibility of the accusers, thats the whole case right there. Dagen i want to bring to celebrity lawyer Michael Avenat avenatti accused of extorting and jury found him guilty on 3 counts for trying to extort nike in exchange for evidence of Company Misconduct over College Basketball recruitment. His celebrity client Stormy Daniels posted a statement, im not surprised his dishonesty has been revealed on grand scale, avenatti brought a defamation lawsuit against President Trump on daniels behalf. Lets just follow on this, there was a viral video that went out about some people in the media on other networks who basically were fawning over this avenatti person and avenatti was there with plenty of material, listen to this. He had his bail revoked because he was accused of trying to hide money . Trying to hide more money involving a divorce that hes going through. The total collapse of his life is extraordinary, frankly, i feel kind of snuckerred because i took him seriously. I think we all, you know [laughter] this guy was the darling of the media. Dagen not here. Darling of the liberal media, now buyers remorse about im. As an attorney, this is not what youre supposed to do, this isnt michael clayton, this isnt a guy who is supposed to betray the confidence of his client and use it to his own advantage, when i saw his story and when i saw him being indicted, right then and there i said how do you feel now, the fact that he was convicted and the fact that the jury didnt buy his defense and this is the least of his worries, he still faces charges out in california, this is a shame, its a shame and im saying as an attorney to see this going on, this is now how they are represented and i think he was a bad representative in all of 2018. You lose your sight, hearing, morality and dignity, when you hate President Trump so much that you think that this man is a good person. Lets not forget they. Talking about that he might be able to take trump on in 2020 dagen the holy spirit. He was second coming, the people all slobbered over Michael Avenatti, when you look at viral video with media figures fawning over him, this is why people do not trust the media, this is why people dont trust media types because we see what happened with avenatti. I will quote general, we might be raw and brash but we know right from wrong and we can spot a phoney before he ever says his first words. Meantime, i i want to ask you about one more thing before you go, we have been talking about this all morning, viral video of the passenger getting her seat hit from the man sitting behind her, shes talked about, we will talk to her coming up, legal action maybe against the passenger or the airline and the airline, would she have a case . Well, let me tell you she has it on video, what better evidence, the airline if they didnt provide proper safety protocols in place, are they looking at liability, can they control the passenger like this, its really on him and on him that shes got this captured and he didnt do anything to spark this, it wasnt like he was defending himself. Her crime was she declined her seat. Everybody should get hit. Reclining of seats is a crime. I should have been hit thousands of times. You know what the planes feel like, they dont feel so great, her claim against the passenger is much stronger than against the airline. Dagen i think delta ceo actually said you need to ask permission turn around and ask permission. Dagen no, no, wrong, no. Who is going to say yes . For him to weigh in on this kind of an issue, i cant imagine that that hes in the last row from the plane from what i can tell in the picture, on those kinds of planes, the reclining is about 2degrees, i think he had other issues. He was stressed but you dont do that. Yeah. Agreed. Dagen it was a short haul flight, i know those jets, very small jets, you cant suck it up and be a human being for an hour, how long was the flight, an hour and a half . This is the man that was aggressive, that was aggressive behavior and i think think personally that the Airline Staff should have intervened. What did he gain from this . She was going to be there for the next 2 hours of the airplane. Dagen if you stand up and start making a fuss and raise your voice on a plane inflight, clink , clink, they will put zip ties on you or tie you to the seat. When you see hm get out there on the campaign trail more and more and more, this is somebody that obviously doesnt like dealing with people, we are going to see that and we are also going to see like you said a steady drip of more clips like this because weve got, you know, decades of bloomberg being in the public life. Something else thats also really important, somebody who doesnt like people, you can almost always tell whos going to win the race by the person who seems to be having the most fun, by the person who really seems to like the people.
