Resident trump wayne and yesterday on the protest. Saying this. To the leaders of iran do not kill your Protesters Thousands had already been killed or imprisoned by you and the world is watching. More importantly the usa is watching. Turn your internet back on. Let reporters roam free. Stop the killing of your great iranian people. The u. S. Blaming the attack on iran. No group has claimed responsibility yet. To you first. I just told up this New York Post. The protesters wont trample them. They call it a real enemy. With iran admitting that it downed the ukrainian airliner and this is the response in the streets. A lot of the outrage comes from the beginning that they denied that they have done it. I think the people knew they were being lied too. It reminds me of prior to the fall of the berlin wall. I think this is one that is good to get more and more attention i think the world should be watching and stacked one thing is when the treated adversity. He hes speaking directly to those people. Before we got some of the later news we saw about 45 of the people supported the actions. As things are evolving and we are given no more and more about the background here and what really happened i think we will see more and more support for the president s actions i think thats can be a good thing for the president and a longterm. Obviously, the economy is taking a beating a lot with our trade barriers. The key here though is for the world to see them shoot down civilians many of them iranians some asked cats from canada. This doesnt look good. As i can get any sympathy from around the world. In terms of additional sanctions that were announced by mike pompeo we will hear from him later this hour. Maria interviewing him. Did the economy is already so weak its something akin to a great depression. Its expected to contract for the third year in a row. By roughly nine and half percent. Those sanctions have dramatically have devastated the iranian people. The price of oil. It got up to 65. It is down to 59. There is a surplus of supply for oil. So anything episodic in the middle east or iran doesnt seem to be having an impact. Thats good for the u. S. Now they are protesting the regime and that is a big difference. Here we will see more and more support from whats happening over there. This is a humanitarian crisis in many ways. At something that should be what draws us together. As the crisis regime created. This is something a lot of people were calling out. One of the most influential voices on twitter with everything from the media to the rescue of elephants. I digress. Hes talking about people on the right in the left had used what is happening in iran whether its the downed jetliner and now the protest for their own political benefit. He seen eve sent eve got to focus on what is going on. And what happened with that airliner. That thats what you have to focus on. Many people on the left online are ignoring whats happening on the ground they want that downed jetliner. In the downing of the airliner. And it was collateral damage. The plane went down because of what trump did. I think the democrats really if they make this into a political game. They are cns and theyre saying its out right outrageous. I dont think in the long run it will play well for them. I think we have to look at and say this is outrageous whats happening over there. And we have to do something to stop it. I think this case the president is right. They funneled money directly into the hands of the terrace regime. That is something that we talked about on this program. Investors are waiting for this china trade deal. Maria sat down. And with Steven Mnuchin and ask him about some of the concerns that parts of the deal could be lost in translation. Listen to this. There are concerns this morning that the language has been changed in translation why wasnt the English Version released to the public. I dont know where that rumor started. We had been going through a translation process that i think was really a technical issue and in the language it will be released this week. I think this is the day of the signing. We will be releasing the English Version. Its a very extensive agreement. I think the situation with china is progressing. And given sometimes there is can it be some missteps this week we will hear more about the biennial reviews. We will see agriculture finally benefit. Thats a big story into in terms of the harvest. Even though President Trump subsidize 25 billion. That will be 30 billion dollars more into the midwest. As probably good for those midwest states. We will see movement here. A lot of people said it was impossible. China would never make a deal with the president. They were over promising that this was never gonna happen. I took it will be a big win for the president. Is that can happen in the more fatalistic the opposition gets i think it lays the foundation as ken pointed out for constructive discussions in the future not falling into this titfortat nonsense. Hopefully takes uncertainty off the table. Moving to the second stage. Plenty of time line to timeline to move the ball forward. That you get this uncertainty lifted. Is that a great question. Im covering the banking industry. The Capital Markets underwriting. We are still in the negative column but the December Numbers for the ceo confidence was up to the low 40s and into the 30s. Ceo is going to be doing more equity fund raising. I think the sentiment is we are intrigued by it. We are more confident but we will see. There is still a little tension out there but as the year goes on and earnings look positive this year i think you will see that you have to invest in business. I think theyre a lagging indicator. The indicator for Small Business very positive. In addition to all of this. They are also worried about the election in 2020 is like what executive due to the business environment. They can start spending. My in a lot of the conversations they say i dont know what happens if its Elizabeth Warren or Bernie Sanders that will win. 200million on advertising. Its coming up the front page trade wars with china. Not a big one. Is not as devastating as many people might have expected. Today is the first day on the job for the new ceo. You are planning a big event this one say the signing ceremony for the phase one deal between the u. S. And china is this the same deal you told us about at the end of last year. Pretty we now editorial page writer, what do you make of this mechanism. I think its of focus. There is accountability there to what is promising its really important. Overall this is a really good news for the trade economy. And then in addition to that some of the technologies and the it. That is a real things. Tough stuff i have. This is progress. We will hear from him at the bottom of the hour. Washington and beijing actually beginning a new dialogue in the journal they perfect soon reforms. We dont want to necessarily take china at its word. Someone who doesnt necessarily live up to those international obligations. If they violate one of the provisions. They had one of the snapback terrace. That is certainly the hope. Been strong against china on some of these things to hold it accountable. It has acted in bad faith 70 times. Its encouraging to me. There is a resolution process set up. They had thought about what happens. I think they really need to see that followed up with actions especially on the first instance of it. They were dealing beijing a major blow. They commend themselves against the chinese encouragement. The journal writes about this today. Alongside the protests in iran. Two importance of freedom. That is exactly what it is. I had been frustrating covering the hong kong story. You need to respect chinese culture. And that may be a democracy is incompatible with the chinese culture. I think he won three of them with the cowboys. So i cheryl hes a good man. Dagen i know how good the Cowboys Organization was to Charles Hailey. See . Remember this moment, cheryl. Cheryl i know. Dagen a weekend of protests raging across iran with the nations leadership admitting to accidentally shooting down a ukrainian a airliner last week that killed all 176 people onboard. The Trump Administration announcing a swift new round of sanctions on iran. Maria sat down with treasury secretary Steve Mnuchin and those sanctions were exactly where they began. Maria i mean, how much farther can you go and what do you need to see from the Iranian Regime to actually take these sanctions away . Well, with the new executive order, we have very, very strong authorities now across all the Industries Including in this executive authority, it gave myself and secretary pompeo the authority to target additional sector as needed. And this is all really about cutting off money, oil, sales, other revenue that would be funding their terrorist activities and their Nuclear Weapons development. So we continue to roll out hold out for humanitarian transactions with iran. They expedited all the waivers, as relates to the Airline Crash investigation. And we dont want to target the people of iran. We want to cut off revenues that are going for bad acts. Maria and yet there is a Real Partnership developing and deepening between iran and china. Actually, i should say iran, china and russia. Lets stay with iran and a china for a moment. As you know, the expectations are that 50 to 70 of irans oil exports are flowing to china. Why is china allowed to go around these sanctions and do business with iran, 70 of their oil and gas going to china. Well, maria, let me just say, weve cut off probably over 95 of the oil revenues so theres a very small amount of oil revenues apand your and yoa big component of that is china. Ive sat down with the chinese officials, they flew in a delegation to meet with us in the state department to talk about this. They cut off all of the state companies from buying oil and were working closely with them to make sure they cease all Additional Oil activities. Maria so you are pursuing trying to get china to cease all activities, because theyre obviously giving iran the money and iran is using the money to support terrorism, if 70 of their oil and gas is going to china. It is 70 , maria. Let me say its 70 of a very, very small number. Maria okay. And china is subject to sanctions like everybody else. We actually sanctioned some of their shipping companies that were involved in the oil and we will continue to pursue sanctions activities against china and anybody else around the world that continues to do business with them. Maria what about france . France is doing business with iran as well. What about the nato countries including france that seem to be continuing their relationship with iran, even as the u. S. Pleads with them not to, promising sanctions. Are we going to see secondary sanctions . The europeans are adheres to our primary sanctions, again, as we roll out additional sectors, they will be cutting back activities in those sectors. But the europeans are complying with our primary sanctions, because they would be subject to secondary sanctions and they understand that. And even in the case of instaks, we warned that they may be, depending on how they set it up, they most likely would be subject to secondary sanctions as well. Let me emphasize, humanitarian transactions are available. Were setting up a swiss channel to handle that. This is not about attacking the people of iran. This is about, as the president said, making sure that iran stops their terrorist activities and making sure that they never have Nuclear Weapons. Maria let me move on to china. You are planning a big event this wednesday, the signing ceremony for the phase one deal between the u. S. And china. Is this the same deal that you told us about at the end of last year . It is. And let me just say, ambassador lighthizer has led a very, very large team a across all the different agencies, almost every single one of our agencies have been involved in this. And this is really a historic transaction. Now, its not everything. As we said, there will be a phase two. But this is the first time weve had a comprehensive agreement with china on technology issues, agricultural issues, financial services, purchases, and has a real enforcement mechanism. So this is a big win for the president. Maria the last time we spoke about this, looking at this deal at the end of last year, we were expecting there would be a snapback provision in there where if china does not keep its promises, if they lie as they have for so many times to so many different parties, that the u. S. Would be able to snap back tariffs in place. Is what that still in it or has that been changed through translation . No, thats still in it, maria. Theres a real enforcement provision and if they dont comply with the agreement, the president retains the authority to put on tariffs, both existing tariffs and additional tariffs. Maria what about the a a agricultural buying . Thats another question. There are concerns that the language has been changed in translation. Why wasnt the English Version released to the public so that we could understand specifically whats in this deal, were 48 hours away from signing, people want to see the English Version. Was it changed in translation . Maria, let me first say it was not changed in translation. I dont know where that rumor started. Weve been going through a translation process that i think we said was really a technical issue. And the language will be rehe leased this week released this week. I think its the day of the signing, well be releasing the English Version and people can see. Its a very, very extensive agreement. Maria you expect the chinese to buy 40 to 5 5 billion of ago cull 50 billion of Agricultural Products from the United States. I do. Its 200 billion of additional products across the board over the next two years and specifically in agriculture, 40 to 50 billion. This is a big opportunity for our farmers and some people have questioned whether they can produce it and the president said theyre going to buy more land and produce plenty of agriculture. Dagen secretary of the treasury, Steven Mnuchin with maria. Ken, your reaction to the interview. The embargo is having a hume impact on iran oil huge impact on iran oil. Its an interesting twist on china. China is a huge net importer of oil. Well see china pivot to russia. Pipelines are going from russia to china. Iran is in a difficult position, theyre off the planet. Humanitarian is the only thing really going into iran. So somewhere there has to be a recognition that if their people are going to benefit and really enjoy whats happening in the rest of the world, theyre probably going to have to make adjustments. But oil, i think, agree with the secretary is minor relative to what china is taking from there. Its small. Dagen coming up, stunning statistics show americans head to work sick. The study showing the top reason for showing up sick, too much work to stay home. Joining us now, associate professor of rehabilitation medicine at the nyu scon schoolf medicine, dr. Debbie. Whats your take on the study. I didnt take it too surprising. I think people feel a lot of pressure to work, especially to come in, if theres a lot of load at their job and they dont want to transmit to other people. One of the other reasons they gave in the study, they felt a lot of peer pressure. This is a survey, people felt like if their boss was going to work, they didnt want to take time off, and they didnt want their coworkers to feel like they werent sick and some didnt have sick leave so they couldnt take time off. 40 said they did it because they didnt want to use a sick day. Im wondering if the trend in business is to lump our days together and say use them however you want to need to, sick days, vacation days, leading people to say im going to go in when im sick so i can take another day of vacation. As a healthy day. I think thats fair teach other studies show that for every 1 increase in the job force, or the employment rate, theres a 16 increase in terms of the flu related illnesses. So if we look at it, maybe employers should be telling people to go home because otherwise other employees get sick and then you have this whole thing skyrocketing. Dagen you mentioned this, so more jobs could mean more flu. There was a study showing a 1 increase in employment, as you pointed out, means a 19 hike in flu related doctors visits. It comes down to the managers and even from the top, down, what the ceo, make sure you tell employees we dont want you at work if youre sick, particularly with the flu, which youve seen around new york city, around the holiday season. Exactly. The fields that are most affected seem to be retail and healthcare. So retail makes sense that if youre touching doorknobs, hangers, all kinds of stuff, maybe there will be more spread. With healthcare, as people get sick, they come in and healthcare workers get sick as well because theyre not immune. Fofor employers, maybe they can set a better example or be more strict. For employees, you may not have as much control. Definitely hand washing. Those industries, you cant work remote. If youre in the knowledge business, certainly you can do most everything at home. Even if youre not feeling well. So unfortunately, healthcare is one of the areas you just sometimes have to come to work. Dagen right. I want to ask you this. Will drinking green tea prevent us from getting the flu. There was research in china that found out people who drink green tea are more likely to live longer. S theres a lot of evidence behind it. I dont know if it fits with our culture and society. Theres evidence that if you have green tea more than three times per week, it can help against heart disease, stroke, cancer and other immune conditions of. The main danger, it has a lot of caffeine in it. If you have high Blood Pressure or other issues, it may not be the best for you. Otherwise it seems pretty safe. If you wash your bacon down with green tea, it upsets the balance. Dagen it has to do with maybe people who drink green tea have Good Health Habits in other aspects of their life, its not just theyre drinking but also what theyre eating. Most of the studies were done in china. The lifestyle may be different than it is here. Dagen good to see you, as always. Dr. Debbie. You say it perfectly. Prince williams said he hopes his family can reconcile, saying, quote, i put my arm around my brother all our lives and i cant do that anymore. Im sad about that. Meghan markle also reportedly signing a voiceover deal with disney in return for a donation to a wildlife charity. In fact, you see this, prince harry was caught on an open mic pitching meghans voiceover work to bob iger at the lion king premier last year in july, again, done for charity, done for an elephant charity. Lee, what do you make of all this . It obviously was in the making for quite some time. It wasnt like it just happened one day. They have been thoughtful about it. The royal family is playing catchup. I think Prince Williams statement, where he said i cant put my arm around brother harry anymore and a im sad about that, i thought it was a good response. Futures are looking to the plus side to start the week higher. 53 point gain on the dow futures, this after stocks closed to the downside on friday. The dow did cross 29,000 before reversing course for the week. All three major market gauges were higher, the nasdaq the standout, gaining 1 and three quarter percent. In europe, markets are hovering near the flat line. We are slight gain on the ftse 100 in england. Little bit of red in france and germany. And the u. K. Unexpectedly shrinking the u. K. Economy ahead of the key general election. In asia overnight, markets mostly higher, the nikkei in japan closed for a l holiday. House Speaker Nancy Pelosi expected to deliver the articles of impeachment finally, what to expect from the senate hearing, the senate trial, what it means for the democrats who will have to come off the campaign trail. And skipping dating websites and app as, one billionaire wants to use a trip to the moon to find his perfect match. That story later in the hour. Here to break it down with me this morning, pollster, author of persuasion, lee carter, cfra director of Equity Research, ken leon an pwc partner, Mitch Roschelle. Its been a hot hour many we have two more. Buckle up. Lets talk about really quickly, looking at the yo futures here, earnings season, what are you watching . We start with the banks tomorrow. I think its actually going to be surprising to the upside for the banks. They did he see i see in the foh quarter the yield curve steepen a little bit, a lot of m a activity, a lot of Trading Volume because the volume was so hot. The banks are a barometer for the u. S. Economy. It is really about the key driver, the u. S. Economy. Banks also are benefiting as well finally Interest Rates are not going down. Thats going to help earnings. But its also about the sentiment, what do these ceos from jp morgan, from citigroup and wells fargo have to say about the outlook for 2020 . We think its going to be good, especially coming off last week with the strong jobs report. Dagen speaking of that, Maria Bartiromo will be interviewing jamie dimon of jp morgan at the jp morgan healthcare conference, its the healthcare conference, shell get inside into how healthcare and pharmaceutical companies are doing. Corporate profits are still expected to drop for the Second Quarter in a row. It will be the annual Earnings Growth will come down to the smallest in three years, but investors are still betting on what . Because you still had the s p hitting a new alltime high on thursday. My take on this, the fed at worse is on the sidelines but also were seeing that its an expansion with a low inflation. If we have inflation below 2 , its the expansion of the multiples. The valuations. Banks are cheap relative to the market, to the s p 500. Thats getting the a attention of invest hers investors. The banks did do better last year than the s p 500. The Fourth Quarter was the many momentum that started. I actually think that guidance coming from this entire earnings season is going to be the most important thing. To listen to the words of ceos about the future, about their plans for investment and their plans for hiring. I think that continuation of creating jobs is going to be important for 2020, going into an election cycle. And also especially when you look at the quality of the jobs numbers and also the middle class is growing and were seeing an increase of households that are off subsidies from the government because of a strong economy. Thats benefiting really the consumer markets overall. This is going to be a terrific dagen i said this, that the wage gains for the bottom earners are growing faster than even for the middle tier of americans and even the richest americans and wages have risen at a 6. 1 annual clip for workers over 25 without high school degrees. That is much, much faster than those with a college degree. Its really incredible whats happening in this country in terms of the inequality gap shrinking. I want to move on to our top story this hour. Erupting protests in iran, turning violent. Hundreds taking to the streets of tehran over the weekend, following the countrys announcement it had accidentally shot down a ukrainian aircraft last week, killing all 176 people onboard. President trump weighing in yesterday on the protests, saying this. To the leaders of iran, do not kill your protesters. Thousands have already been killed or imprisoned by you and the world is watching. More importantly, the usa is watching. Turn your internet back on and let reporters roam free. Stop the killing of your great iranian people. This as a rocket attack targeting an northern air base wounded four Iraqi Service men. No group has claimed responsibility. Joining us now, tennessee congressman, chuck fleischman. Congressman, good to see you. What should the u. S. Do now and in the days and weeks to come . Well, i think first of all, the president and the United States are doing exactly what we need to do, monitor the situation very closely, make sure that we communicate effectively. Theres an olive branch right now out there to the iranian people who for decades have lived under a radical oppressive thecracy which has been detrimental to iran and if world and freedom always lives. I think people of iran ultimately will want to be free again under a new type of government. So messaging, encouragement, and a monitoring of a very dangerous situation. Congressman, good morning, Mitch Roschelle. One of the things that was disturbing was some of your colleagues on the left sort of politicizing whats going on in iran and trying to place the blame on the administrations doorstep. Whats your take on that and do you think that that sentiment is going to continue or will people come to their senses and realize that this is a bad regime that the world would be better off without . Its a great point you raise. Some of my colleagues to the left have politicizedded everything from impeachment to iran to the kitchen stink the o the deinstrument of the country and to their party right now. I was in that briefing. I thought the government did a good job, the president s folks did a very good job. But at at a time when they jumped on this and tried to politicize it, the very next day we saw the horrific outpouring of International Support as it should have been for the people who were killed on that airliner. Think about this. They knew they shot it down in iran. They denied it until they could no longer deny it under the sheer facts and international pressure. So its time for our friends on the left to stand up and say we need to be americans first, have one cohesive Foreign Policy and get behind the home team, the United States of america. Dagen i want to turn to the impeachment battle, house Speaker Nancy Pelosi is expected to finally hand over the articles of impeachment of to Senate Majority leader Mitch Mcconnell this week. Heres what former white house chief strategist steve ban bannn said to maria. Maria youre calling on President Trump to do what . Tell nancy pelosi when you deliver it and we have a trial and after im acquitted im going to have the state of the union, not until then. President trump has a great saying, no games. This is all game playing by the democrats. Its got to be brought to an end. They forced her this week to deliver them. Thats why i think this trial, he ought to go big. He ought to demand witnesses. Theres no witness on the other side of mulvaney, nothing they could say thats that big of a deal. Dagen your reaction to steve bannon . I would say this. I saw Speaker Pelosi on one of the other sunday talk shows give a very exhaustive interview. When youre speaker of the house, you represent the entire house of representatives, not just democrats. The partisan debacle that became the impeachment fiasco and afterwards she held onto this has really hurt the fabric of our republic. I worry about our future based on what she did. So i would say this. All she kept coming back to under questioning was he will be impeached, he will be impeached for history. Well, i think she feels that she got a notch on her gun. She really hurt our great republic. She hurt a great president who is doing a great job. I think she hurt her party in the process. So i think when President Trump comes to that state of the union and i will be there, cheering for him, but more importantly, cheering for america and the american people, a great, robust economy, all of the promises get and promises made that weve seen from this administration. I think the democrats have taken a decidedly wrong turn to the left. As mitch has said. And its going to hurt them and hurt our party and hurt their party, rather. Dagen real quick, though, i watch the polls regularly, the real clear politics average, yes on impeachment and removal, 47. 2 , no is actually higher, its 47. 4. So its almost dead even. In terms of the polls, less than 10 of republicans back impeachment. Yeah. I mean, its completely divided on where we are. The problem that the democrats are having right now is they dont have the support after all of this time, all that theyve put forward, all of the effort, all of the drip, they still havent moved the needle on impeachment, polling really hasnt changed. In fact, support has decreased for the democrats. I think thats going to be a real problem for them. Then now youre layering on iran, youre layering on the economy, youre layering on these issues and youve got a weak field of candidates right now without a message except that we cant afford to have four more years of the president. Dagen message weakened by nancy pelosi sitting on the articles of impeachment with no, well legitimate explanation for many americans. Congressman, good to see you. Thank you for being here, congressman chuck fleischman. Iran seeing violent protests after the government add Police Departmenteadmitted to shootia passenger jet. Rick leventhal is live from jerusalem, covering the story. Good morning, rick. Reporter good morning. The demonstrations started as candlelight vigils but things got heated over the admission from the government that it shot down the passenger plane and the regime responded with force, the police in riot gear sent demonstrators running from tear a gas canisters at and a bullet at tehran university, Freedom Square and beyond. Some civilians were shot with pools of blood on the ground. There were 16 iranian students on board the 737, knocked out of the sky on wednesday. Ththe chants of death to the dictator and calls for the eye toayatollah to step down met wih a violent response. The sanctions and row tests have put iran under great pressure and forced them to negotiate. I dont care if they are negotiating. Its up to them. But dont have Nuclear Weapons and dont kill your protesters. The president did not say what he might do if they do. Also yesterday, remarkable images of most demonstrators in a large crowd avoiding stepping on american and israeli flags on the street. Walking on the colors has been celebrated by the Iranian Regime since 1979 as a sign of disrespect but yesterday the people chanted the u. S. Is not our enemy. And we just got video of damages at alassad air base which was hit by iranian missiles last week, hours after they shot down the plane. No one was hurt in those strikes. U. S. Officials say theyre open to talks with iranian leadership in hopes of finding a peaceful way forward. Dagen rick, thank you for that reporting, rick leventhal. You be safe, my friend. Coming up on mornings with maria, weve got the Oscar Nominations out at the bottom of the next hour. And a looking for a girlfriend for space, one billionaires eccentric proposal ahead. And target surging, the rel tail giant retail giant trying a new strategy that seems to be working. Details ahead. You dont want to miss any of it. Dagen cnn making a deal concerning back pay. Cheryl casone has the details. Cheryl yeah, dagen. The Cable News Network agreed to pay a record 76 million in back pay, according to the National LaborRelations Board. The network terminated the contracts of unionized camera operators back in 2003. The nlrb says cnn didnt try to bargain with employee unions before replacing those workers. At least 300 people are expected to benefit from the settlement. Goldman sachs staffing up bigtime in china. The Bank Planning to double its staffing to 600 in five years. But goldman under ceo David Solomon is going to not pursue expansion in china unless the communist government opens up its financial markets. Im going to stay with lsu. A terrific quare back. Dagenquarterback. Dagen you wia smiths good side. Go tigers. Coming up, crime in focus, bail reform in new york sparking concerns about an increase in criminal activity. You heard it here first. Marias been talking about this for more than a year. And now the crime wave. Plus, a heartwarming moment, one young cancer patient getting cheered on. Well show you, ahead. Must put aside the alienation. Get on with the fascination. The real relation. Dagen welcome back. Focus on the new bail reform law in new york state. Just this weekend, two repeat offenders both out on the street making headlines in new york city. One man allegedly pulled four heists at Chase Bank Branches in manhattan between december 30th and january 8th. And then was cheering that he was out and another man arrested friday for aggressive pan handling had been previously released despite allegedly attacking two women last week including slugging one victim in the case and kicking another victim in the head. Joining me now, fox news senior judicial analyst, judge andrew napolitano. Maria bartiromo has been warning people about this. Its not just new york. I have probably done thousands of bails, typically when youre assigned bail, you sit on the bench and the police bring in hundreds of people. Youve got five or six minutes per person. And youre basically trying to decide theyre innocent until proven guilty. What is their criminal record. Who have they harmed. What is the evidence against them. What is the likelihood of conviction and what is the likelihood theyre going to come back, if you give them a reasonable bail. These are all things you have to decide on the spur of the moment. In new york, if the crime is not one of violence, you may not give them bail, meaning they walk out of your courtroom without anything to induce them to return. So this bank robbery, you say to yourself, how could a bank robber possibly be bailed out. The guy robbed four banks in one day. He didnt use a gun. And he didnt threaten violence. He used a note. And because he handed the tellers a note, its considered a nonviolent crime and, therefore, hes entitled to be set free irrespective of his dagen the governor, Governor Cuomo is so gutless, he didnt even mention this in the state of the state address. The law is horrific. New jersey has a bail law, theres a presumption that the person being arrested should be freed but the judge can override the presumption on the basis of was there violence, is there a criminal record, is the person likely to return if i dont give them bail. In new york, there is no presumption and the judges have no opportunity to override the bail. In the case of the guy to punched people in the nose, thats not the bail law, thats poor judgment on the part of the judge. You do not let a homeless person who is attacking people and has been arrested for the attack and caused injury, knocked two teeth out of this womans mouth, you dont let that person free without bail. Dagen heres my prediction. You are going to see we saw that Police Officers were directed by the manhattan district attorney, cy vance around the mayor of new york city to stop arresting people last year for simple assaults and things like shoplifting ahead of the bail reform. Youre going to see, unless they make changes to this, a rise of vigilante justice like bernie getz with a gun on the subway and the rise of organized crime because shop keepers and merchants in the city will have to pay for protection because people are coming in you go into a drugstore, you go into a pharmacy, you see the prices are already much higher for things like bought else of water because bottles of water because shoplifting is so rampant. They are not arresting people. Kick you in the head, dont get arrested. Kick you in the head, if you get arrested you get a ticket and you get released. Its repugnant. We may return to an era that hasnt existed in any of our lives in new york city where the mob or groups of mob officers are pro mobsters are providing more protection than the police. Its the law is so wrong. And theyre officers to uphold the law. Its preventing them from doing their job. Dagen can they change the law . The pressure on Governor Cuomo right now is extraordinary to adopt the new jersey model which presumes no bail but gives the judge discretion to do the right thing. To your point about mobs, it comes at a price. Its not theyre not doing it for free. The price of water went up. Lets say it went up 25cents a bottle. Thats used to pay for protection and this is not exactly a contract for the protection. Theyre going to show up and say you want protection, its going to cost you more this week than last week. This is going to create an illegal Cottage Industry of thugs who are doing what we pay tax dollars to have the police do. Dagen theres one job of government. Its to protect people. Its to keep the people of your city, of your state, of your country safe. I think youre going to see a significant change in this law before easter. The public has had enough already. Its only the middle of january. The laws only been in effect for two weeks and these are Horror Stories that have been visited on people. Not to mention the closing of Rikers Island in new york city. Theres a series of things. Is this a political angle or is this just black and white . There was a political angle. The people pushing it are hiding under pillows. The people pushing it were hard lefties who felt judges werent comcompassionate enough. A judge has to be one part compassion but one part do the right thing under the constitution and under the laws. Dagen the wall street journal writes and editorial about it. The subhead is new yorks reform is freeing violent offenders who will harm again. The wall street journal is correct. Some of the terminology in the statute like what is violent and what isnt, did the skin break, did a bone break, did a tooth break, short of that, the violence is not considered violence. Slap me in the face, thats not thats an act of violence. Under the statute, its not. Dont slap me. [ laughter ] at least not on the air. Some of the folks behind some of these repugnant antisemetic attacks in new york had been folks who had been released without bail. Yes. Dagen the woman who attacked the jewish woman in an antisemetic attack was released and then she turned around and did it again. Within a matter of days. This is the slap example. The statute defines that type of he behavior, believe it or not, as nonviolent. That is contrary to all reason. Dagen right. Again, you mark my words, the rise of vigilante justice and the rise of organized crime, because people have to pay to protect for protection because the Police Department and your mayor and your governor dont care about your safety. Judge napolitano thank you. Its primary the governor. This is a statewide. The legislature needs to change it quickly. Dagen great to see you, always. Well take a break. A look at the big week ahead, check it out. Maria this week on mornings with maria, tomorrow, we are live in San Francisco with the biggest banker in the nation, jamie dimon is here. Dagen theres nothing more devastating than pediatric cancer, cheryl many thank you for that. Cheryl you bet. Dagen thank you for the tears and the smiles. Lets move on to jobs, in focus. The lay r bor Labor Department g a deregulation taking on the obama era joint employer rule. Joint employment occurs when workers have two employers like a franchise and then the Overarching Company or a Company Using contractors. The Obama Administration moved to dramatically expand joint employment which some estimate cost over 5 billion a year for businesses. My next guest is out with a new op ed in the wall street journal this morning with acting white house chief of staff, mick mulvaney, making labor rules rational again, writing this. By removing uncertainty for these businesses and their workers the rule also benefits the economy more broadly. Every dollar lost by business to vague or unnecessary regulation is a dollar less for creating jobs, increasing wages, funding Retirement Plans or lowering prices, smart deregulation is good for the american worker, business, families and the economy. The coauthor of that right here, u. S. Secretary of labor, son of former u. S. Supreme court justice, eugene sc calia. I stepped on your words. Tell the viewers why the rule change, explain it and why the rule change would benefit potentially everybody in the country. Its an important rule. As you said, the joint employment is the idea that a worker can actually have two Different Companies that are responsible for paying minimum wage, paling payin paying overtg records. That sometimes happens, if somebodys working at a particular work site and the company there is closely supervise whack thaing what that worker sop vicing wha supervt worker does. The employers have to make sure everything is done right. Thats costly. And what the Obama Administration did was tried to really push out how many different circumstances two Different Companies were on the hook for all those employment responsibilities and it has to do with wage, hour obligations, thats what we focused on. During Obama Administration that were looking at union rights and that circumstance too and that can be costly. Dagen why did you need to do this now . There was already a National LaborRelations Board action that was similar to this, and also that the Labor Department early on in the Trump Administration issued guidance on the joint employer rules. Why do you need to do this now . Well, couple reasons. First, we administer different statutes than the National LaborRelations Board which has to do with overseeing Union Organizing rights. Second, we felt we needed to bring clarity and rationality to this area in the wake of confusion that had risen during the last administration. You know, the Obama Administration had put out what it called a bulletin which suggested that if a company is just responsible for overseeing payroll for somebody, just processing payroll, take that could be an employer too. Or if a worker does work on the premises of a company, then that company with the premises theyre the employer, just based on that. Thats very broad and costly. So we wanted to bring clarity and roll that back so its more sensible and less burdensome. Dagen a employer, franchise, operator, how soon would they see the benefits of this . How soon would the broad economy see the benefits of this change . Soon. March 6th is when we expect this to go into effect. It will be the law, people can rely on it. You mentioned franchisers. What this says is that youre a franchiser and you want your franchisees to for example, have a Sexual Harassment policy or have other sound, fair practiceses, that doesnt make you an employer. If youre a contractor and a you want your suppliers to be responsible stewards, just imposing that in the agreement, that doesnt make you an employer. Those companies are going to be more comfortable urging best practices by their suppliers which will help workers. Dagen lets talk about workers. On friday the Labor Department released its december jobs numbers and showing 145,000 jobs were created in the month of december with a 3 andahalf percent Unemployment Rate, thats the lowest certainly in my lifetime, in 50 years. The jobs report also showed that women overtook men in holding the majority of u. S. Jobs for the first time in a decade. Women held 50. 04 of all u. S. Jobs. We, women, represent more than 77 of jobs in education and health services, but were almost up to 14 os o 14 of logd mining jobs in the country. What can you do to continue this trend and making sure women are better represented in some fields outside of maybe education and healthcare. Part of what we can do is rules like this. Weve got this just extraordinary economy right now, as a you say. The best weve seen in 50 years, by some measures more. And one of the fabulous things about it is that the beneficiaries were seeing the lowest Unemployment Rate ever for african americans, for hispanic americans, for adult would pen. Women. These are great outcomes, continued deregulation is one important part of that. You know, in terms of womens participation, helping simply by enforcing the Discrimination Laws but also through programs like apprenticeships which can help train women to enter into professions that historically maybe they didnt, either they didnt think it was something they could do, or they were excluded. Thats a focus of ours. Dagen income inequality, the gap is narrowing because lower earners in the country, wages for the bottom 10 , the wall street journal editorial page wrote about this over the weekend, are rising faster than middle income americans and faster than a the highest earners in this country. So those wages are growing so much faster an even particularly for people who dont have Even High School diplomas. Exactly. It was a really good editorial over the weekend, laying it all out. One data point is during the Obama Administration, the faster wage gains were among the top 10 of earners. Weve flipped that now. The fastest wage gains are among the bottom 10 . Number of different measures of how the economy is doing, its people who had less opportunity historically who are some of the really big beneficiaries right now. Dagen great t to see you. Pleasure to be here. Dagen please come back. Love to. Dagen coming up, jobs for americas heroes, my next guests Company Helps military spouses and pays tribute to a world war ii icon. It has two stars, 1300 light years from earth. Wolf kukiay, i mispronounced that, found the planet, looking through nasas orbiting transiting Exoplanet Survey satellite. This is a an you amaze ain s an amazing story. He is a junior in high school. The act to find something bigger than the sun, two stars with a powerful telescopes that nasa has. This is a nice story. Dagen this is why i miss the Space Program, when we were not sending astronauts into space and were hitching rides with russia to the International Space station. I just think it is so i encourage people, i said this before, to watch apollo 11, that the its a documentary about the moon launch and moon landing. Is it netflix . Dagen i had to pay for it. I had to rent it. Its never before seen footage from nasa and its just inspirational, even to this day. I think thats kind of whats been missing a little bit. Its a lot. Heroism, like apollo 13, even when it doesnt work, jim lovell. It gave us a point to gather together and support something together and watch and wonder together and a we dont have that anymore. Together and its as aspirational. The little picks dont do what the the olympics dont do what the Space Program did. Dagen i watched the apollo 11 documentary and i looked up the names of the flight directors during that mission and let me say who they are. What is keeping us is it regulations . I mean. A little bit of everything, so, 20 years ago the u. S. Government gave licenses to Companies Said we want you to build this cband space out that resulted in 120 million homes serviced to get tv, radio, in this space. Everything was moving along for kind of a structured transition, and people said wait a minute why dont we take those licenses away use it for public auction feed the coffers like Grocery Store getting a permit deciding they like that space too bad we are taking it so National Friction between government taking, and what should be a smooth transition, and let these Companies Make help us with the transition, that is really where Sticking Point us what does that auction cband space look like chinese are using cband space ail over the correlated able to implement 5g buildup much quicker than we are why this is so important. That is slowup i think what were trying to do is bull consensus good idea public auction do this together and lets have a smooth transition, let companies who are delivering 120 million homes worth of data and video streaming, and radio streaming let them make this transition in a way that allows them to spend the money, to refigure what their company and businesses are going to look like after the transition. Good morning to you dagen actually it is heart of the Upper East Side affluent community i can tell you anecdotally there was a store a home store the whole block across street this location target pushed it out with microstore, affluent shoppers coming to target for several reasons some examples first of all you can easily order on line pick up at store return as well the hope that is once you get in the store you buy other things, now, people that live around they are have told me they do come here, for paper towels cleaning supplies because target is price competitive, you cant get the same prices at the local Grocery Store actually 4 visitors to the target stores have an in accordance over 100,000 dollars, pretty staggering, these stores if you go inside, they are neat they are clean, compact light good music youve got exposed pipe makes you feel good about walking in, and shopping there, and they are very organized, you can find what you needed really, really quickly, now, Brian Cornell ceo of target said in november that this is all about moving into new neighborhoods tapping into new Customer Base what they are doing also opening one microstore across the way on the Upper West Side also another affluent community this is all happening in the backdrop of the retail ice age apocalypse if you will i have been reporting on this store closings left and right, pier one a name, Bed Bath Beyond another one, if you look at their stock prices, compared to targets 85 since 52week low dagen impressive. Can i guess where that is third avenue. Yeah. 70th street somewhere like that . Third and 70th exactly right pushed out gracious home never thought after 20 years would i see this happen, but target shoppers are here. Dagen you can get much cheaper sheets. Target, thank you for that report that was terrific, Jackie Deangelis what do you he make of this i cant believe i remember where that store was. Farm goods other products the u. S. Will cancel previously instituting tariffs on chinese goods, joining us now former White House Press secretary Fox News Contributor sarah saerndz. Sand snooeshz president understands what people missed talking about for decades, ultimately either china or america will lead the world economy, in this president is making sure, that it is the United States, and always will be, as long as he is president. This is a huge moment a Historic Deal china already committed to applying over 200 billion dollars, in u. S. Products over the next two years. The president is a fighter made sure he pushed to get a good deal with china i think this is a great thing for him to take into the campaign, as he modulars deeper into that. He has a great story to tell on economy and this is a big part of it i think you will see him talking a lot about it, as i hope he will. It is mitch, democrats dont like giving president a win regardless what it is, so what do you expect their reaction after he wednesday and how might the administration combat take that . Look i think you said exactly right the democrats dont want to give the president a win no matter what it is. Even if it is something really good for the country like this deal. Weve watched them knock the president every time he does something that a lot of democrats frankly had tried to do in campaign for all of a sudden when president gets it done they no, he longer want to see it happen, i think it is going to be hard for them to argue, against this, it is good for u. S. He farmers manufactures business community, and i think going to be really hard for them to come out against the president on this, issue you add on top of usmca the president negotiated got done the other big trade deal has done with japan, south korea others working on really hard for any democrat to attack this president for the better trade deals he negotiated. I think sarah this is you really interesting to see my guess they are going to minimize the impact what this is saying not enough you promised was going to be more we know this is phase one, but i think, a lot of people are going to say this isnt Strong Enough that this is not enough and really not going to benefit all of us that sko hurt us . Do you think worthing responding or keep moving forward one of the strategies i think interesting what do you react to versus to keep backing. I dont think he has to react people can see facts for themselves, i think they can see u. S. Economy continues to do extremely well under this president , i think at the end of the day, the tweets very clear we can continue down a path having prosperity with the president who actually is fighting for better trade deals or we can go back to the way things have always been done nobody even tries to renegotiated trade deals in the way this president has done he has been tough stood up to china, when everybody else has taken pathing apeacement china iran a number of topics democrats the taken the total handsoff approach. It hasnt worked president said not on my watch we are going to stand up make sure we are getting best deals possible this is just the beginning, like you said this is phase one, there is much more to come, under this president , not just with fortune but on a number of other trade deals that he is working on, continues to Push Administration into the team around them to make sure they keep look for constantlying improving afraid with countries across the globe. I said this about the killing of general soleimani a terrorist, was responsible ultimately for taking the lives of more than 600 american servicemen he major many spreading terrorism around the middle east some people on the left simply hate the president so much that that is their starting block an they have to figure out a way whatever he does, why it is bad. To basically back up their belief that they hate the president on that note, speaking of well going after the president , hours Speaker Nancy Pelosi p finally is expected to deliver articles of impeachment to senate later this week would officially hand the reins to Mitch Mcconnell again, the constitutional responsibility of the senate not the house to adjudicate the impeachment articles or hold the trial, former white house chief strategist steve bannon weighed in on sunday morning futures about this your response. So you are calling on President Trump to do what tell nancy pelosi what. Tell nancy pelosi tell nancy pelosi when you deliver it we have a trial and after i am kwitdz i am going to come have a state of the union not until then i am not President Trump has a great thing no games this is all game playing by the democrats, got to be brought to an end end they forced her this week to deliver them i think this trial are ought to go big demand witnesses i think President Trump ought to there is no witness on the other side Bolton Mulvaney saying that is i that big a deal. Your reaction. First i want to comment on what you said about iran, i think the idea that any democrat or any person could argue that taking out one of the worlds most dangerous terrorists most vicious terrorist killed over 600 mens we know about anybody that says that is not a good thing that somehow we are less safe because of that the, it is completely naive and part of the problem and part of the reason, that the president had to make that call in the first place we should never be in a situation we are in with iran but because of the last 8 years of you appeasement we find yourselves in this situation president has to take tough action, it is mind blog to mindblowing anybody could did he have not taking a step able to do it the way we were tactical surgical management president made absolutely right call continues to make the right call being tough. When it comes to impeachment i think he has done everything perfectly laid cards out on table all america had opportunity to see there is absolutely nothing here lets get this over he with. I think we get this done i dont want to see this drag out forever i want to see it wrap up president fully have you understood indicated watch him stand in front of nancy pelosi after completely vindicate indicates give a state of the union that lays out the case, of what has happened over the last three years under this president , america is doing infinitely better than anybody dreamed would happen under this president i want him to talk about Success Story he has incredible story to tell, i think he needs to do exactly that, with a big smile on face right there in front of nancy pelosi. And watch all of america celebrate how great we are doing under President Trump. On that note do you think state of the union should be delayed until after trial or do you think the trial will be happening and over with before state of the union the tuesday after the super bowl i think first week in february. You know, i think that needs partly depends on if nancy pelosi is ever going to deliver the articles she constantly urged everyone trying to put in rj it was to get impeachment process he shoved down americas throat watched through that process sit on it last couple weeks i would like to see them get the that delivered, leader mcconnell is he fully confident going to deliver a very fair complete trial, and i will leave that in his very capable hands how quickly he processes that whether or not they can get that done, in time for the state of the union. If they have to move it back a couple days, so be it i think the great moment will be, when this whole thing is over and we get back to focusing on things that matter to americans president can go around talk about successes he had that america has had last three years. Before we go, yesterday the white house twitter account tweeted a photo first snow of the year i think about 70 degrees in washington, still up on the twitter account went up roughly 11, 12 hours ago but people on the left have lost their minds on twitter, they have lost their minds i dont know if it was a mistake, or why they did it if they did it intentionally to troll people get them ups about literally snow . But i dont know just wanted your response to that before we say goodbye. My guess is that that it is from a few days prior to yesterday they just got around to posting it, either way, i think it is a great example that we cant even agree that the first snow of the year whether no matter who is occupant in the white house it is a beautiful great photo, the White House Photo team does motivatihe amazing job gre picture i am going to 345ish i like it just because troll the democrats a little bit longer, if they cant handle celebrating snow at the white house, they really got some problems they have to work through. Dagen i saw it before i went to sleep last night, i was looking at my phone, and looking at the responses, like these are reporters upset about it some of them, i had to take an competented ryan and migraine before i we went to bed. Dagen a a little bit by birth american by choice are we forgive lus forgive lus paying so much attention. Not at all very important, cultural question, whatever an american gets involved with the British Royal family there is a problem, because americans are used to living their lives, being themselves, making something of themselves. If you join the royal family you cant do that, you lose that freedom. And that is the story of meghan and harry a cultural story frankly i happen to be on meghans side on this how about that about.
