That news taking 50 points a off of the dow industrials, mornings with maria begins right now. Maria top story iran striking back overnight, iran fired over a dozen missiles at two bases in iraq housing american soldiers, so far no american casualties have been reported in attacks, the president tweeted overnight about the attack, he writes this, all is well, missiles launched from iraq, assessment of casualties and damages taking place now, so far so good, we have the most powerful, wellequipped military anywhere in the world by far, the president write, i would be making statement tomorrow morning, we will take the statement for you. Joining me right now ceo anthony, here this morning onset campusreform. Org and dagen mcdowell, kevin oleary. Lets get your reaction this morning to the showdown with iran and what you perceive as irans goal here. Hi, maria, good morning to the team there, you know, what has happened is we essentially took, if you think of thises is a chess match, we took the queen of iran off the board, soleimani was moving in southwest asia, middle east, leveraging terror attack, attacking israel and attacking u. S. Interest and we killed that man and this is a man that, you know, killed some of my soldiers with penetrators, the roadside bomb that is he created and employed to kill over 600 of our soldiers, im glad hes dead and he needs to be gone and, you know, when we took the queen off the board they moved upon and if you think about it, maria, this is a country that was able to shoot down two moving drones, was able to precisely target the Saudi Oil Field and destroy that and they cant hit a stationary airfield in barracks and i think this was intentional miss, take the queen off the chess board and they are very, very concerned because Iranian Military as big as it is no where near match for us, we have b52 bombers and diego garcia, we have b2 bombers, we have an entire fleet of air force and navy, air power, the great 82nd airborne on the grounded there and marines, so i feel like this is a victory for the president , i feel like the foreign minister saying that we are done is a diplomatic overturn, i think next should be diplomatic move. Maria they had such precision with saudi oil attack and no precision here, we want to do something to save face but we dont want war, we dont want to impact any people on the ground, any real troops and thats whats happening here, so what does that mean, you think maybe this brings them to the negotiating table, real quick . I think they could be tricking us all, it would not be beyond them, the enemy always gets a vote, it would not be beyond them to do head fake then pull a spectacular shocking thing. If youre killing any americans, ive got 52 targets lined up and all this talk about cultural sites, its well known, maria, that when iran declared some of their Nuclear Sites, they labeled them as cultural sites, that was just President Trump saying, hey, we get it, theres no way that that we would bomb any of those cultural sites, i think he was just trolling iran a little bit saying we understand what youre doing and so, yeah, i think the next thing is, this president and his administration has been very good at leveraging the elements of national power, diplomatic information, economic, tighten the screws on the economy, continue the Information Warfare that hes so very good at. We use the military as we need it in a precise way. Maria really good point. I was not aware of that. The cultural sites, quote, unquote, some of them actually Nuclear Sites and the president perhaps was trolling them, general stay with us, we have a lot to talk with you, we want to get reaction from the pentagon, lucas is there, good morning, lucas. Good morning, maria, defense secretary esper said before the strikes yesterday that iran had vowed revenge for President Trump killing iranian commander qassem soleimani. We should expect that they will retaliate in some way, shape or form through proxies as they have been doing for how many years and or with by their own hand, we take this one step at a time. Officials say no u. S. Hurts were hurt inside iraq, 15 iranian Ballistic Missiles launched from iranian territory, one hit in kurdish control, Northern Iraq for Iranian Missile fail today reach their targets, 15 iranian ballistic missile, 11 traveled to reach out assad, they were fired 5 30 p. M. Back here on the east coast, irans foreign minister said two iraqi bases were chosen because thats where u. S. Special Operation Forces were based, officials tell me no u. S. Patriot or antiballistic defensive missiles directed alassad and erbil bases, the president expected to make an announcement later this morning, military assets in the region including the u. S. Harriet truman in strait of hormuz and diego garcia, they are not sent to qatar because they would be target for Iranian Missiles, maria. Maria lucas, back with general and team in new york, going into this, general, i spoke with secretary of state mike pompeo on sunday on sunday morning futures and he said to expect an attack on one of our bases if not some of our bases, the possibility of iran retaliating against the u. S. Bases in that region, listen to this. Should we be concern in terms of retaliation on any bases that we have in proxies and partnerships of iran . Yes, maria, we think theres a real likelihood that iran will make a mistake and go after some of our forces, military forces in iraq or soldiers in northeast syria, we have many troops in the region, it would be a big mistake to after but we are preparing. Maria so general, what now . We had two packages maria going after this thing before this happened, one package was to respond if there were american casualties which there werent were not, thank god, and to hit all 52 of those targets, one package was to wait and see and so we now wait and see and i think what we want to do here and im sure what the president and his team is preparing, some type of diplomatic oversure, we want you to stop exploring terror, be like japan, Nuclear Power but no nukes, no nuclear weapon, we want you to stop oppressing our people and get our way to protect vital interest, people, property and embassies and the free flow of oil. Maria we want you to start acting like a normal country from iran. Maria according to lucas terrific reporting we will be doing bomb Damage Assessment later this morning, potentially we will hear after the president speaks so no u. S. Casualties but still an assessment of the damage done by the missiles, the allies in the middle east that have long called for a tougher american stance on tehran have been noticeably quiet, now talk about the gulf monarchies of saudi arabia, the united emirates and qatar, what should we hear from them . Thats a great point of Battle Damage and assessment and we need to see what happened and need to make sure there are no casualties and just get the confirmation, but, you know, the gulf states and even some of our european allies need to come out and be unified here, theres a real strategic opportunity to get tehran to the negotiating table which is where we want them, we do not want a war, President Trump does not want a war, we will not have a war in iran and all the fanning of the flames on the left, so irresponsible that they cant even stop politics at the waters edge, they put it in their koolaid and drink it and its just ridiculous that we are having these types of conversation within our own country much less with allies in the region. Dagen i really want to quickly point out something because people ask how did we be here, we got here because of the Iran Nuclear Deal in part, one of the huge failures in that deal not just funneling tens of billions of dollars into terrorist hands in iran, cash but also in money that was returned also in business that poured into iran, but the failure in the Iran Nuclear Deal to ban these very missiles, the way that the language was written in the Iran Nuclear Deal was that they were prevented from developing the capability of developing Nuclear Weapons but left opened the door for the development of these missiles, these missiles being fired right after the deal was inked with death to israel, death to america written on the side of them. General, could i ask you a question more immediate to soleimani issue you brought up, you called him a queen, this guy has been around for many administrations and never targeted before because he was a proxy player, he basically used other foreign nationals as you pointed out to kill americans, other nationalities, and yet no other administration considered taking out a proxy player, secondtier player, this is a change in policy, as an investor i say to myself, theres other proxy players are we going take on strategic basis, this is new, why . You have soleimani as designated terrorism, completely legit and legal for the president to do this in iraq, that not withstanding for the attacks that he was planning it would have been irresponsible for the president not to conduct this strike, we would be having the benghazi that i think the left is looking for had we not done this, there was a good chance of that and so why not do it is what i say, why not come out of this and disrupt the commanding control of that proxy network that is really orchestrating all these attacks against the United States, against saudi arabia, against israel, why not do it and why not have some backbone, you know obama wasnt going to do it because of what dagen just said, this year, 2020 first requirement comes out of it that they stop export weapons, not that they ever did, 2020 first requirement comes up, 3 years from now they can start importing centrifuges and Ballistic Missiles again, the 5 years, 10 years to these people, i spent a lot of time over there, its a new york minute to them and they laughed all the way to the bank on this one. Maria right, until the u. S. , President Trump took the u. S. Out of the nuclear deal. General, good to see you this morning, thanks so much. Thank you. Maria quick break, markets, futures searching for direction this morning after iran missile attack on u. S. Talk, talk maria welcome back, futures are flat this morning from news this morning, now down just 26, s p 500 is up 4 and a half, and nasdaq futures up higher by 9 points, we are watching markets, new developments this morning in the deadly crash of a boeing 737 in iran, Cheryl Casone on headlines now, good morning, cheryl. Cheryl good morning, maria, ukraine suspended flights to iran after Ukraine InternationalAirlines Flight went down in tehran, killed all 176 people on board, this is a boeing 737 800 not a max jet left iranian capital on the way to ukraine, no americans on board, the head of irans Civil Organization says he will not give the planes black box to boeing, we got statement from boeing, they are in communication with customer which would be obviously the ukrainian airline, we are looking at bowing in the premarket, dow would be positive if it wasnt for boeing, the to be down 2 , taking as much as 50 points off the dow and opening bell, well, just hours before former nissan executive carlos goshn is set to speak in lebanon his lawyers are calling out automaker, nissan was trying to prevent goshn from basically conducting a merger between nissan and renault, goshn obviously will be talking at 8 lock eastern time, his attorneys also blocking japanese prosecutors from using a search warrant to see the computer he used while out on bail in tokyo, you can see carlos goshn again, News Conference live, 8 00 a. M. Eastern time today, maria, obviously its going to be i think fascinating to hear from him in his own words today. Maria sure it, thank you so much, cheryl, one of the big stories of the morning, i thought it was a good oped on enough disgrace to go around in terms of japan and carlos goshn, look from the beginning you heard on this program that this was a coup, carl goshn was trying to merge renault and nissan and the japanese government did not want one of its jewels to be owned, have a superior power, the larger shareholder being a french company, i suspect we will hear that, i told everybody that i did speak with carlos goshn over the weekend 45 minutes to an hour, hes going to outline what he seems as evidence today, hes going say that he has documents that indicate there is implicating japanese lawmakers, japanese government officials in terms of wanting to take him down to stop that integration, to stop the merger. What i find so fascinating about the situation, goshn is overnight put the whole japanese legal system on trial too, because i never as an investor ever considered japan to be so in some ways barbaric, why would they put him in solitary confinement for 100. Dagen why would they follow his wife to a bathroom. Maria carol goshn told us she tried to take a shower, i was about to interview carlos goshn in the middle of this, he was to come to us live, while we were about to do interview all the japanese prosecutors and and government officials show up at his apartment and take him away, they wouldnt even allow carol goshn to take a shower. That makes me worry about place to invest in. Maria yeah. Stay with us, a lot to come right here. Liberty. Liberty. Liberty. Liberty. I am not for ignoring the first sign of a cold. Maria welcome back, we are looking at resilient market this morning, take a look at futures, complete comeback where we saw dow industrials down 400 points, we are looking at a decline of 10 points, s p futures are actually positive, they are up 7 and nasdaq futures up higher by 14, well off of the lows following iran missile strike on u. S. Forces in iraq, joining us to talk about this Security Director head of u. S. Gregory, gregory, good to have you this morning, let me just point out that the Company Service disabled veteran own business dedicate today capital markets, thank you for your service to the country and what youre doing, why do you think we are not seeing much of a reaction from investors this morning . We see this over time, resilience, markets ability to basically waive off issues until further clarity and here were seeing some of those cases, if you look at market action, resilient, dow down 200, we finished up on the day, if you look at markets very resilient, we focus on the rate market and if you look at 10year rates, 10year u. S. Treasuries which is the bunch mark globally, last night we traded into 170, 10 basis points lower and right now unchanged and general coming out of last year, 150 to 2 range. They dont care about what happened overnight, not one basis point of concern. Maria it doesnt shock me, if its not going to impact the earning story f its not going to impact the broad back of the economy, investors are not going to trade on it, they dont care. Dagen more rational than world war iii chicken littles. If there was a missile or the idea that these would calculate, the bond markets would have blown out. Dagen we are now number 1 oil producer in the world, we are now the swing producer, we are very close to being a sustainable net exporter of petroleum products. Keep in mind here too, one critical variable, we had equity markets that were melting down, we had a very bad backdrop in terms of central bank policies, the fed actually tightened again in december into that, credit spreads, kevin, to your point were blowing out, very bad Fourth Quarter for the banks, very bad Fourth Quarter for markets, this time last year we had the pivot, global Central Banks piling in, a ton of liquidity, we had the midcycle adjustment and we had ambulance Balance Sheet expansion and if you look at equity markets over the last 10 years, in particular from september when the fed started to expand Balance Sheet to now, the correlation is very, very high, the dynamics this year relative to last year although weve had some geopolitical events theres still a big backdrop. We have the resiliency in the markets with iran news, how long do you think the resiliency lasts and 2020 gets closer and looks like we will have a warren presidency, Bernie Sanders presidency, do you think markets slow down at that point . If you look at dynamics right now we are clearly priced for a trump victory, theres not a question in my mind. The dynamic can certainly change as we get clarity on the democratic field and we move forward in the coming months, right now thats clearly maria we will see, markets sell off if investors believe that policies will be changed dramatically and they will be changed dramatically with the Bernie Sanders presidency dagen in terms of monetary policy, liquidity in stocks is best in 2 years, the fed has expanded by 30, up 30 in the last 4 months if annualize it. So from september through the end of last year the feds Balance Sheet is up 400 billion, currency in circulation, the chairman referred to that when he made announcement, right, the fed had catchup to do just based on natural expansion of plans sheet, some of that was dedicated towards the funding markets, hiccups in september, getting past yearend, the fed will have work to do this year, its likely to be less related to benchmark rate and more likely to be related to the plans sheet. When the dividend yield to the same company that issues credit, is higher than what you pay for, you pay under 2 on the credit, that has not ever happened for a long period of time. If you go back to august and you look at extreme in the marketplace, 30year treasuries that traded inside of 2 , alltime lows, inverted yield curve, a lot of talk of recession and the negative yielding pool of assets globally was at 17 trillion, right, so we are at 11 trillion and thats still a lot. It clearly influenced the u. S. Market in august and now what we have seen is alleviation of the negative yielding asset pool and we have seen alleviation of the yield curve as well. I want to know what the banks are doing with all of this money around because Asset Managers under tremendous pressure, going to zero in terms of commission and the banks are seeing, they are the deposit takers, what are they doing with all of this new money slashing around. Return on assets are decade lows, its not so great with them either. Maria thats my point. Asset manager is under pressure. Gregory joining us there. Coming up markets completely reversing course after iran missile attack on u. S. Forces in iraq, we are watching all morning, dow industrials now positive up 15 points, the latest with mornings with maria, stay with us. Maria welcome back, breaking news, iran strikes back launching more than a dozen missiles in affiliated basis in iraq, fox news rick in jerusalem. Maria, missile attack was not surprise to u. S. Authorities, they did take defensive actions, there are no reported u. S. Casualties which is obviously great news but irans Supreme Leader is still talking tough saying he slapped america in the face and the ball is in the court of the white house, 15 Ballistic Missiles fired by iran overnight at two military bases used by u. S. Forces, 4 missiles failed in flight, the other 10 struck alassad, facility visited by the president last christmas, base from which Coalition Forces often launch drone attacks, in iran people celebrated in the streets waving flags down and morn minister tweeted iran took and concluded proportionate measures in selfdefense under article 51 of u. S. Charter, targeting base which cowardly armed attacks against citizens and we do not seek escalation or war but will defend ourselves against any aggression, if the u. S. Retaliates iran warns it will hit more targets possibly here in israel where Prime MinisterBenjamin Netanyahu said he who strike at us will receive a dead ly blow. Importantly, no u. S. Casualties on the ground in iraq as a result of the Iranian Missiles. Thank you, rick levanthol. Maria general, you were with me, come to the negotiating table or dig in here, what do you think about the strike that somebody was saying move to safe base, yes, you know, put these bombs in place but not hurt anybody, not impact the troops just to safe face, whats your take. Yeah, maria, i think this is what the escalation looks like. I think we restored deterrence once again by President Trumps move and taking down soleimani which was completed unexpected, it was a stunning surprise to the iranians, as i said earlier in the week i believe that this is professional associates for 2 years and also personal friends, he did all of this execution of irans foreign adventures and foreign wars, i believe at that time when that took place that we had an opportunity and the opportunity was to reach out to them and Start Talking to them about a general framework for negotiations and if they want to do it covertly and secretly, thats fine, if thats too much political heat for them to be able to do that publicly, i believe that even more so now, when you think of what was available to them, we have 80,000 troops in the area, we have ground bases, naval bases and air bases, all were u. S. Troops dominate the spaces, they attack two iraqi bases which houses some u. S. Troops, the largest base that houses troops in iraq is balad and close the other iran and they did not attack the base because likely that would have been certain u. S. Casualties if they did, so i do think that, listen, they had to retaliate, theres no doubt about that but they did about as minimalist of retaliation they could possibly do. Now people are making a big deal that it came from iran, well, listen, they did not want proxies in charge of this retaliation because they afraid they would go nuts on them and they wouldnt be able to control them, they fired the missiles themselves, they have better missiles in terms of proxies on rockets and they did not want to delegate something as serious as this, retaliation strike after solimani and let the retaliation strike get out of control and the fact that they fired it, while its the first time in years from iranian soil an attack has been made an not been driven by the proxies, i believe its more significant in the sense that they absolutely wanted to control the outcome. Maria yeah, really fascinating stuff, i mean, so what becomes the response from the United States, on sunday secretary of state mike pompeo joined me and i asked him then about the possibility of iran retaliating against u. S. Bases in the region and now theyve done so not impacting any lives so where does the u. S. Come out in listen to pompeo on sunday, sir, watch this. Should we be concerned in terms of focus is on retaliation on any bases that we have in proxies of iran . Yes, maria, we think theres a real likelihood that iran will make a mistake and go after forces whether military forces there in iraq or soldiers that are in northeast syria, we have many troops in the region, it would be a big mistake for iran to go but we are preparing. So general, the u. S. , its the next move here, the president will be speaking this morning, what do you expect the u. S. move to be now . Well, first of all, i think we have indicateors indicators from last year that the iranians have used provocation to put pressure of the United States to back off on the sanctions, started when where he shooted american blown, tankers, Oil Production facilities most notably the largest one in the middle east and the Saudi Oil Field, by the way with high degree of accuracy i may act and attacking u. S. Bases, attacking bases where u. S. Soldiers were housed ten times and the president did not respond to any of those except through offensive cyberattack but no kinetic attack and it wasnt until the 11th one that he responded, i didnt agree with all of that to be frank in full disclosure but nonetheless i think it absolutely gave him far more legitimacy when he attacked soleimani. Obviously he can go back and hit launch sites from which the rockets came, he can hit oil refineries, et cetera, that would just continue the ladder of escalation if he did that, i believe the ball is in his court, he has 3 objectives, one no Nuclear Weapons, two, get rid of the Ballistic Missiles the Delivery System for the Nuclear Weapons, 3, change your behavior, your aggressive and malign behavior in the region, he now has an opportunity i believe to move to discuss those objectives with the iranians which have been strategic objective all along. Is there any chance that the u. S. Forces get pushed out of iraq . Well, certainly thats on the hands of the iraqis but i dont think we actually saw the real feelings in what took place over the weekend. 170 something members that showed up, even the among the shiite, maria, hundreds of thousands shiites demonstrated for weeks against the iraqi regime and the iranians backing of that regime because its in effective, its corrupt and the quality of Life Experience has gone down not up. Despite maria i thought that somebody elses hands were on that in terms of the vote, i think you make a really important point, well, look, we are waiting for the president to speak, we are getting more information then, general always a pleasure, we appreciate your insights this morning. Good talking to you, maria. Coming up markets have reversed hours, we are looking at higher opening for the broader averages, despite missile attacks, we are watching markets all morning, keep it right here, stay with us. Back in a minute. For your worst sore throat pain, try Vicks Vapocool drops. Its not candy, its powerful relief. Ahhh vaporize sore throat pain with Vicks Vapocool drops and try new vapocool spray. And when you open a new brokerage account, your cash is automatically invested at a great rate. Thats why fidelity leads the industry in value while our competition continues to talk. Talk, talk maria welcome back, futures higher this morning after the iran Missile Launch on u. S. Air bases in iraq, you know the market initially sold off, we have seen complete reversal this morning and now we we have a fir tone, Senate Republicans are signaling that they are ready to move forward with the impeachment trial, Cheryl Casone with details, cheryl, what a story. It really is, maria, Mitch Mcconnell said he has enough votes to go without witnesses, this this is despite request from nancy pelosi and House Democrats interview on sunday morning futures senator Lindsey Graham said lawmakers will move on without her. What i would do if he continues to send articles as required by the constitution i would work with senator mcconnell to change the rules of the senate so we could start the trial without her if necessary. Maria how soon would you move to change the rules of the senate . Days not weeks, what shes doing is bad for the country, bad for the senate, keeps us from getting on where the business of the American People, denies the president his day in court, the founders never envisioned youd have a speaker do Something Like this. Can he recall cheryl again Lindsey Graham on sunday morning futures, cnn reached a settlement in defamation lawsuit from kentucky student, High School Student standing close to native american man, nathan phillips, both at the lincoln memorial, cnn outlets depicted nick and classmates as racially insensitive at the time. He filed suit against cnn and they have settled, dow to show profit 1. 41 a share, walgreens have been ordered to supply 14 years of opioid data as part of major lawsuit, major drugstore chain says they are to be held responsible, we are waiting on the earnings from walgreens. We will bring them to you as we get them. Maria quick break, we are watching markets edging higher after Iranian Forces fired in u. S. Maria welcome back this morning, weve got reaction from lawmakers reaction to the strike from iran, Griff Jenkins live from that angle, griff, good morning to you. Griff things are moving fast and the whole world is waiting to hear from the president , if you go to campaign trail democrats have been blasting the president for handling of the situation, take a listen to this. Mr. President , you have to explain your decision and your strategy to the American People, thats your job as president , mr. President. This is a reminder why we need to deescalate tensions in the middle east. [cheers and applause] the American People do not want a war with iran. Griff maria, there was ominous warning from only candidate Tulsi Gabbard who has seen combat in iraq. It would make the iraq war look like a picnic compared to the devastation and the destruction that would be caused by going to war with iran. Griff meanwhile republicans are rallying behind the president saying hes doing the right thing and operating under full authority. It was act of war by a regime for the last 40 years, cancer in the middle east, when they say they want to destroy israel, they are not kidding, the president has all authorities to respond. Griff so we wait to hear from the president and hopefully from Speaker Pelosi as well, maria, youll remember we expected perhaps to have a vote on a war powers resolution today unclear whether or not thats going to happen plus photoop at 11 00 a. M. , maybe we will learn more, maria. Maria all right, griff, Griff Jenkins in washington, a lot of reaction from the candidates this morning on all of this and in particular joe biden. Dagen Vice President biden is walking a fault line with this because as the wall street Journal Editorial Board writes today he is wrapping himself in president obamas iran policy and that very policy and the Iran Nuclear Deal is the reason that we are here today with the billions of dollars funneled to the regime and funneled to terrorist forces within iran number 1, and number 2, they did not stop development, did not ban such missiles that just attacked american bases in iraq, the wall street journal writes, he came down against soleimanis raid and middle east chaos, hes making his bed and its going to be a very, very uncomfortable place to be for Vice President biden. Maria here is a country, kevin, that could be one of the richest countries in the world given their resources, given their oil, yet the word is according to officials, they get the money and they just give it to terrorists and support groups like hezbollah instead of investing in the country and the people. They cant help themselves, we need to give the American People all the details when president obama was in office, when all the drone attacks were going on, we didnt see much of the same call from transparency from Vice President biden at the time, interesting to see the shift in tune there. Also interesting to see 2020 candidates on the left throughout the week, they were hoping that there would be escalation, hoping that something more to go on and say look what President Trump handled this, look how where this got us into. Maria like a year ago they were hoping for a recession, we are watching markets, edging higher despite Iranian Forces firing as bases in iraq, next hour right here Liberty Biberty cut. Well dub it. It is wednesday, january 8th. Your top stories right now, 6 t coast. Global markets were rattled overnight as Iranian Missiles fired at air bases in iraq which housed american troops. Iran says it does not seek war despite these attacks. No reported casualties. President trump says he will deliver a statement later this morning. We will take you there live. Markets have completely recovered from losses overnight. The lows hit after the news broke of the missile attack but the dow has now it is flat. It was positive a few minutes ago after coming back from a 400point selloff. S p is up 6, nasdaq higher by 16. Meanwhile, safety in oil and gold, gold is rising again this morning. It is up as you can see, a third of a percent. Its up about 7 . It is above 1,600 overnight. But it has pulled back from that but people are seeing gold as the safe haven in all of that. Crude oil is negative, at 62, 58, come back from a rally there. Global markets take a look at european indices, where we are seeing pressure. Here too, off of the low, fq100 down 2 points, cac in paris down 1 point, dax index in germany is higher by 14. In asia overnight, red across the board following the news of the missile attack. The worst performer was japan, nikkei average down 1 and two thirds percent. Breaking news this morning, a showdown in the middle east, iran fired missiles at air bases in iraq. Those air bases house american soldiers. Lets get to Lucas Tomlinson at the pentagon. Lucas. Reporter President Trump gave the initial battle assessment damage in a tweet. Quote, all is well. Missiles launched from iran at two military bases located in iraq. Assessment of casualties and damages taking place now, so far, so good. We have the most powerful and well ebbing kind military anywhere in the world by far. Irans president responded a few minutes ago in a tweet, quote, general soleimani fought against isis, et al. If it werent for his war on terror, european capitals would be in great danger now. Our final answer to this assassination will be to kick all u. S. Forces out of the region. Last night, 15 short range missiles were launched from inside iran. No u. S. Troops were hurt inside iraq at the two bases. Officials tell me 1 0e hit the alassad in western iraq, four missiles failed to reach targets. Some missiles traveled 300 miles to reach alassad. They were fired at 5 30 p. M. Iran has over 2,000 Ballistic Missiles in its arsenal. They say the bases were chosen because thats where u. S. Forces are based that carried out the drone strike that killed qasem soleimani. American Missile Defense systems are located elsewhere in the middle east. President trump is set to address the nation later on this morning. Maria lucas, thank you. Lucas tomlinson joining us as the pentagon. Joining us now, military expert, retired general colonel, daniel davis. Thank you for being here. Thank you for having me. Maria your reaction to what iran is trying d to do here. No casualties, yet firing at our bases in iraq. The president will make a statement in a little bit. We will take it live. What is your reaction . We dodged a bullet last night, sotospeak, in that there were no american casualties. I thank god for that. Its important to point out were not out of the woods yet and we have to be very careful. We had within the last couple hours, we had some of the militia from the Shiite Militia in iraq who also lost some people in our attack when we killed soleimani, theyre saying okay, iran did its part, now its our turn. The threat to our troops and to our civilian personnel throughout the region is still very real. But the other issue that we cant lose sight of is before this happened iran announced theyre done with the jcpoa, with the iran deal. Thats going to raise tensions even more. Cabbot phillips here. Do you think this is all we should expect from iran as a response or should we expect more attacks in the future coming . The Iranian Regime was very careful last night, very quickly after these missiles were launched to say this is it. Were done here. Were not going to do anymore. We slapped america in the face. We retaliated. But as long as nothing else happens, were done. Unless we get hit again, then well go back. I think theyre signaling, look, way are not looking to escalate this. We dont want war anymore than you do. We should take advantage of that. A lot of people dont like this, but what we should do, and what ive been advocating for many months, is we need to withdraw our troops from iraq and syria because all they do right now is endure Strategic Risk for us. They have a target on their back. Theyre not providing any security for the United States. If we get those troops out of there, we take away a big portion of what iran even could do and it puts us in a stronger position. Can i ask you about the ordinances being used here. Im fascinated from the technology side. If im a soldier on the ground in iraq and im being shot at by what looks like cruise missiles, am i being defended by Better Technology somehow . Is there a way we can knock these things out before they hit any bases . You talk about the risk of having troops in the region. But my assumption as a civilian is our technology is better because that seems to be how were doing war fare today, who has the better tech. Is that the case. Dagen i can answer that. Lucas tomlinson talked about this. We have antiair Missile Defense systems throughout the middle east but they did not intercept any of these missiles and none of the Defense Systems are located at the two bases that were hit, alassad and erbil in Northern Iraq. That raises the question, why not. If we have this, why dont we have all these troops surrounded by this technology. Thats certainly a question. I will point out that some of these Missile Defenses are anything but fool proof. They can help, but they cant knock everything down. First of all. And if its other kind of missiles, the cruise missiles which iran has, which they didnt use, which is probably also important, we cant shoot a lot of those down. Theres not a lot of defenses against some of those. Thats something weve got to watch out for. Dagen we have more than 2,000 missiles in irans arsenal because they were not banned in the 2015 Iran Nuclear Deal. Maria thats the point. Dagen iran and soleimani now dead and quds forces and the revolutionary guard, they have money, billions of dollars in their coffers to Fund Terrorism throughout the region because the Iran Nuclear Deal. Are you saying they are using our missiles they bought from us to use at us. They have missiles that werent banned in nuclear deal. Where did they get them from . A lot of them are indigenously produced. Some were purchased from russia and china. Even some from north korea for that matter. The important thing to point out, we cant lose sight of here, this is in the context of the maximum Pressure Campaign where we said we want to reach a negotiated deal. President trump came into office saying he wants to get rid of the jcpoa and have a better deal. Weve got to accept this. If we want to make a new deal, we have to offer iran something where they can come out with any kind of a win. Right now, we only want to tell them what they cant do and thats not going to get us an agreement. Dagen in terms of propaganda, iran is claiming a win. Iranian state television was saying earlier that 80 american terrorists were killed in the iran missile strike. Maria thats just propaganda. Its not true. Why do we believe there are other claims this is the only attack theyre going to do. Why should we assume theyre being honest . Maria ro rohani said overnigt the final answer will be to get all troops out of iraq. The president is weighing he said yesterday, he was weighing with drawing u. S. Troops from iraq. Listen to this, sir. Its something ultimately i want to see. We dont want to be there forever. We want to be able to get out. I didnt want to be there in the first place, to be honest. Were there now. Weve done a great job. 100 of the caliphate is gone, which is isis. We have thousands of isis prisoners. So i think weve done a fantastic job. Eventually, we want to be able to let iraq run its own affairs and thats very important. So at some point we want to get out. Maria what about that, Lieutenant Colonel . Oh, yeah, im strongly in agreement with that. I mean, ive been advocating that for a long time. Too many people want to keep the troops there just to keep them there in case we need them for something. President trump is dead spoton that they have accomplished their only militarily attainable mission theyve been given since obama sent them in there. Trump said get rid of isis, get them out of there, caliphate, get rid of them from rakka and mozul. They succeeded. Now its time to get them out of there. There is no mission theyre doing that can be accomplished. All they are right now is a target. I dont think President Trump wants that. Maria good to see you this morning. Thank you very much for your insights. Thank you. Maria quick break and then were watching markets this morning a after irans Missile Launch at u. S. Forces in iraq many were live from baghdad when we come back. Then this, carlos ghosn is speaking out today, holding a News Conference this morning, his first Public Comments since fleeing japan. Well have that for you live. Stay with us. Back in a minute. Look like foodies. Would you like to try our trashy back ribs . Oh, that sounds great. Talk, talk maria welcome back. We are awaiting a News Conference from former nissan chairman carlos ghosn, expected to begin in just under an hour. Ghosn is in lebanon this morning. He fleed japan. His lawyers are charging that nissan was trying to prevent ghosn from more closely int clog the company with renault. Joining us right now from tokyo is pete landers. Peter, its good to see you this morning, thanks very much for joining us. One question is, is the japanese judicial system and the fact that they are digging in, they have an arrest warrant out for his wife, carol ghosn. Whats your reaction to all of this and how safe do you think carol and carlos ghosn are in lebanon . I think theyre safe in lebanon but if they were to go to another country, especially the United States, they could perhaps be extradited to japan because japan and the u. S. Do have an extradition treaty. The arrest warrant for carol ghosn and of course theyre looking for carlos ghosn, ever since he escaped, their actions against the couple make it more difficult for them to travel outside of lebanon. Maria earlier in the week i reported that i spoke with carlos ghosn over the weekend and he told me that he has evidence, documents that will indicate that this was a coup, something that ive been saying certainly since this started. Do you know of any documents, do you know of any evidence that you can share with us that will prove that the japanese government was against him better integrating, merging renault with nissan . We havent seen those documents yet buts thats certainly the highlight of the press conference coming up is will he show any such documents. There is quite a bit of evidence come out already that people in nissan were upset at his plans to combine nissan and renault and that that was probably a motivation for them to start an investigation into what they call his financial wrongdoing back in the spring of 2018. So i think maria how much damage will this be to the japanese government . The other thing carlos ghosn told me was he is going to name names. Hes not going to do facesaving. Hes going to name names, government officials who he believes is behind this takedown of him. I think thats exactly right. And japan is very worried that this is whats going to happen. Hes going to name names, names of government officials in japan, who perhaps were involved in going after him and we even understand that the japanese government is going to respond very quickly to that press conference, i think because they are worried about the global reaction. Maria how are they going to respond . They already have an arrest warrant out for his wife as well, carol ghosn joined me on this program back in april and we spoke about whether her husband would actually get a fair trial in japan. Thats what this is all about, thats why he says he fleed. He wasnt expecting a fair trial. Listen to carol ghosn a few months ago earlier in 19. Youre not allowed to speak to him . No, no. Maria what are they telling you in response to why you cant even he cant even make a phone call . This is their judicial system. These are their laws and this is japan, as they say. Maria they are the Third Largest economy and they said they were a democracy but there havent been for mall charges formal charges and he cant defend himself. Do you believe he will get a fair trial . According to his lawyers, theyre not too confident because the signs that weve been seeing, no. Maria you dont think hell get a fair trial . I dont think so. I hope he will for our sake because if he doesnt get a fair trial, carlos is innocent, but, you know, his lawyers are not too confident. Maria so peter, what is the Business Community saying about this in terms of dealing in japan . Im here with a big investor this morning, kevin oleary. Would you do business in japan, knowing what you know about the japanese judicial system, before peter answers. I used to worry about going to china to do business because of retaliation and locking up executives there but this is a whole new ballgame. I never thought about the japanese legal system like the way i have now, thats probably to ghosns credit. I have another question. Whats the end game . How is he going to clear his name in beirut . How is he going to get a trial. In new york, the s. E. C. Is waiting for him. There are charges of financial malfeasance of this guy. How is he going to clear all this stuff up . I think its possible that it will never be really cleared up. Proofs there could be some kind of perhaps there could be some kind of trial in lebanon. I dont think it would be credible without evidence coming from japan you which japan would not be willing to supply. I think its possible that years or decades could go by and the basic conflict would continue. Dagen i want to point out the s. E. C. He those civil charges, again, u. S. Civil, japan criminal and they throw you in jail, the civil charges were settled with the securities and exchange commission. So thats not waiting for him. Maria okay. In terms of other courts, another thing that carlos ghosn said to me on sunday was that hes willing to be tried in any court other than japan and hes going to say that in the press conference today. Is a that even viable . I dont think its viable at this stage, again, because japan has collected so much evidence. We dont know what the evidence is. We dont know whether its good evidence. If there was a trial in any country, whether lebanon or france, you would want all the japanese collected evidence on the table and they simply would refuse to supply it. They would say before we supply that, he needs to come back to japan and face trial here. I think theres a fundamental gap in any trial that happens outside of japan. Maria youre a capitalist, peter. You were the head of the wall street journal in tokyo, the tokyo bureau chief. Did you were you aware of the japanese judicial system . And tell us how you see it, living there, given the fact theres no due process and the conviction rate is 99. 9 . So how is that fair . I was aware of it, i wrote a story back in 2001 for the wall street journal when i was a correspondent about a man who was forced to make a false confession and what i learned in reporting that story is that any person is apt to make a false confession, maybe after a day or a few hours, pressure without a lawyer present, told that your family is waiting for you but you need to confess, you need to tell us what you did wrong, any person is apt to make a confession in those circumstances. It may be a true confession. It may be something that they made up just to get out of their difficulties. Maria thats the point. Thats what carlos said as well. Thats what they said to him when they locked him up, when they put him through all of these interrogation moves, that they wanted a confession. That was the whole point. He said to me, look, they thought i would crawl away and go away and just confess. Im innocent and im not going to do that. Right. And it takes a lot of stomach if you believe youre innocent to maintain that when youre locked up for three weeks or in his case for several months. It is a feature of the Justice System for a long time. On the other hand, the crime rate is very low and its something that the japanese public is not p generally aware of because it doesnt affect most people. Maria as far as i can see, this is a black eye for japan. Thats how i see it. The storys about a man and a his resume and i dont think its going to come out looking very. Maria thats a good point. Peter, thank you. Peter landers in tokyo. Thank you for your insight. Stay with us, well have the carlos ghosn News Conference in less than an hour. A complete reversal in markets, although we are seeing a reaction to the middle east tensions on oil and gold. Take a look at gold, up 5 right now, a third of a percent following the iranian strike on u. S. Bases in iraq. Joining us right now, Senior Market analyst phil flynn. How longstanding do you think this is in the move and gold and also oil . Looks like were seeing a deescalation in the price of both of those right now. Overnight when the bombs started to drop in iran, it was risk on, oil up almost four andahalf percent. Gold was a seven year high. We seem to be easing a lot as the news starts to come in. And a i think what were seeing here is the market is now saying hey, wait a second, this might not be an escalation but a deescalation so the risk to oil supplies is going down and perhaps we dont need to build in as big a risk premium in the gold market right now. Maria are you seeing any go ahead. Go ahead. Im sore. Maria are you seeing any interest here in terms of i look at gold as a hedge. Do you think that gold being a hedge is the way to go in a market thats uncertain . When you look at the stock market, its completely come back, phil. It really has. Listen, i think gold is a great hedge right now for a couple reasons. If you look at Central Banks around the globe, theyre buying gold right now. You look at low Interest Rate environment and youve got Central Banks around the globe wanting to create inflation. You add in a little geopolitical risk and you see the type of move we saw last night. What happened to the whole dialogue and narrative about bitcoin becoming the new gold . Where are we with that . Because this last move on gold is back to the old classic i want to own something i can feel and feel the weight of, that the romans loved. Bitcoin is nowhere. It isnt. But we did see a big spike in bitcoin overnight. They did reflect the moveup in gold. But youre right. I mean, there is still the jury is still out whether bitcoin can be the new gold. We call it we used to call silver the poor mans gold. We call bitcoin the poor mans gold right now. So yeah, i mean, right now the jurys out whether its going to be around long enough to be that risk premium. We definitely did see some interest when it was premiums go up. Maria thanks very much for your info. Phil flynn joining us this morning. Shares of boeing meanwhile are on track to cut about 40 points off the Dow Jones Industrial average at the opening bell. Cheryl casone on those details this morning. Cheryl thats right, maria. Boeing shares down nearly 2 after that deadly crash. It was one of its 737s that happened earlier today in iran. All 176 people onboard were killed. This is a 737800, not a max jet. And it just left the airport in tehran, on the way to ukraine. There were no americans onboard but as you can see, the stock down more than 1 andahalf percent. Ukraine is suspending all of its flights to iran. The head of irans Civil AviationOrganization Says he will, quote, not give the planes black box to boeing. We got a statement in the last hour from boeing. They say they are in touch with their customer, that would be Ukrainian International air a line. Were following that stock today. Also, jury selection resuming today for disgraced movie mogul harvey weinstein. The judge sent at least 40 people home during the first day. After the pool was asked if they knew any victims of physical or sexual crimes and if they could remain impartial. He is facing five counts of sexual assault. Weinstein is denying any wrongdoing in those charges. This is interesting. Some encouraging numbers from the american cancer society. The cancer death rate dropped 2. 2 from 2016 to 2017, the largest single year dip ever recorded. Lung cancer and melanoma treatment advances shown as major factors in that drop. Still, cancer remains the second leading cause of death in the United States after heart disease. Overall, the total death rate of cancer has decreased 29 since 1991. Obviously, maria, 0 cancer deaths in this country is the goal. Were not there yet. Maria no. And its certainly good news. Were going to have a doctor onset tomorrow to talk about this. Dagen i have witnessed this firsthand and its incredible news where because of with just lung cancer, where you have had the development of targeted therapies, targeted therapies go after or fight specific gene mutations or proteins on the cancer or immunotherapies which broadly speaking immunotherapies like opdivo jump start your immune system to help it fight the cancer. Because of these developments within lung cancer specifically, that you have longer lives for people even those diagnosed with metastatic lung cancer or stage 4 lung cancer, longer lives and better quality of life. My mother lived for five andahalf years and she was diagnosed with metastatic lung cancer that was already in her bones, on her spinal column. And she had a really great quality of life. So the word might not be cure yet for many people, but there is hope. So if you have a Family Member who gets diagnosed with Something Like this, dont assume the worst. Dont assume immediate death. There are so many options out there. Just make sure that your Family Members oncologist investigates them and they do all the necessary gene testing when they do the biopsy from the getgo and a save the biopsy sample for later testing because there are so many developments. It is really breathtaking. So there is help. Dont give it up. Maria rest in peace, joyce mcdowell. Keytruda is a merck drug. Well talk with him next week at the jp morgan press conference. Well dig in deeper with the cancer story and where are we on alzheimers and heart disease. Good news, theres a company i invested in that is testing on how to cure l alzheimer alzheih lsd, remember that from the 60s. Maria i know merck a year ago had a failure on alzheimers and recently i read that china was coming up with anils percent drug which coming with anils alzheimers drug. Some scientists think its not plaque and maybe the micro dosing might work. Maria well be digging deep into all of this. There are tensions with iran, reaching a breaking point, the Islamic Republic fired missiles over overnight. The cyber threat, iran attacks american troops abroad and states right here at home. Were taking a look at the cyber worry next up. Stay with us. I am totally blind. And non24 can throw my days and nights out of sync, keeping me from the things i love to do. Talk to your doctor, and call 8442142424. Im but how do i know if, im getting a good deal . Truecar knows exactly how much people have been paying for the car i want. I tell truecar my zip and what car im into, and it shows me the truecar curve. This shows the range of prices people in my area actually paid for the same car. Looks like these folks paid a little more than everyone else. And this guy got the deal of a lifetime. This is how car buying was always meant to be. This is truecar. narrator before you buy a car, see what others paid for it with truecar. Maria welcome back. Breaking news this morning, iran strikes back, launching more than a dozen missiles at two bases in iraq, housing american troops. Lets get to trey yingst live in baghdad this morning. Trey. Reporter maria, good morning. Overnight the iranians fired 15 Ballistic Missiles towards and Iraqi Military base in the western part of the country. This base does house american troops and according to u. S. Defense officials ten of the 15 missiles that were fired were successful in hitting the target. One of them landed in the Northern Iraqi city of erbil and four others failed to reach intended targets. Reports indicate iran verbally informed the iraqis of the strikes before they occurred. Iranians also notified the country of finland, a neutral intermediary who likely notified u. S. Forces. In baghdad we saw extensive helicopter and fighter jet activity. A lot of military movement but no strikes near our position. There is concern today that the response isnt over. Many many iranian backed Iraqi Militia groups operate here. Despite confirmation of no casualties in the strikes last night, the iranians are claiming victory. Take a listen. Well, last night we slapped them. The military actions are not enough. What is important is that the corrupt presence of america in this region comes to an end. Reporter theres a lot of anticipation about what happens next and a number of Major Airlines who normally fly to baghdad have canceled incoming flights including royal juror e. We know the iranians are moving troops to kuwait. They are concerned what happened last night could lead to a large larger maria joining me right now is former nebraska senator, navy seal, allen and Company Managing director, bob carey. Thank you for joining you. You have an incredible legacy. You received the medal of honor. You are former navy seal. Thank you for your service to our country. Your reaction to all of this . I think theres a history here that is really important to understand. I mean, the most recent history with soleimani, we were his ally he was our ally in defeating the islamic state. Hes a military come bay taken g military force to kill americans, trying to drive us out of iraq, try to destabilize and get control of that country. I think it was legitimate to kill him because he was a military combatant. I think any effort to demonize him, say hes evil and all of that sort of stuff makes it difficult to see the history and speak to the iranian people who unfortunately are united in grieving. I think, look, they have limited options. I think its important for us to think about how do we get on the side of the iranians who are trying to reform their country, who dont like what the regime is doing and i think theres ways to do that. Maria what should the United States be doing now . And what do you think about the approach that iran took, because they fired these Ballistic Missiles into iraq at the u. S. Bases, no casualties. Was it a move to save face, saying look, were doing something but we dont want war . Look, the greatest threat of iran is not the Iranian Military. Although they have very good rockets as we saw in saudi arabia. Theyre very capable at targeting. We know where they are. Its not like their nuclear program. Its relatively easy for us to target the sites and take them out. The greatest threat is the proxies, particularly hezbollah. Hezbollah is a they dont do anything without iran telling them to do it, without their permission. The iranians will hide behind it and say we werent responsible for that. So proxies are the greatest threat. Maria seems toe movie iran could be such a seems to me iran could be such a rich nation, given the resources and the oil. They support hezbollah. They put the money into this, into terrorism. The Iranian Regime does. Former arresteform hard liners t like the restrictions, economic, political, social restrictions that are imposed as a con consequence of what they believe human beings ou ought to be doi. Theres a lot of opposition to this regime. We have to look for the opportunity relatively quickly to get on the side of the people who want change inside of iran. I think its. Maria do you think people want to see a regime change, the people of iran. The answer is em emphaticay yes. You saw it in 2009, 2013, recently, people going in the street protesting against not just in iran, but protesting in iraq against the iranian president. Theyre a attacking bases where there are iraqis and the iraqi people dont want iran attacking and killing their own people. Maria you served on the 9 11 Commission Following the terrorist attack in the u. S. Is there a similar sentiment now . I dont think so. We knew who bin laden was. The American People knew who bin laden was. People dont know who soleimani was. They dont know what he did. They dont understand why it was necessary, why it was legitimate to kill him in this circumstance. Maria we should point out that he was designated a terrorist by the obama administration, by the un, by the eu, weve got a list of terror, rein of terror of soleimani. I want to switch gears. Its true. But he was an ally of ours in getting rid of the taliban, an ally in getting rid of the islamic state. Its important to get the full picture. With that full picture, i think we can get the iranian people on our side. Maria youve had a real debate going on within the critics of President Trump about this, impeachment showdown is also out there. Youve got Senate Majority leader Mitch Mcconnell telling reporters yesterday he has the votes to begin a trial without agreeing to hear from witnesses. Watch this. We have the votes once the impeachment trial has begun to pass a resolution essentially the same, very similar to the 100 to nothing vote in the clinton trial which sets up as you may recall what could best be described as maybe a phase one. Maria senator, House Speaker nancy pelosi as you know holding onto the articles of impeachment, telling democratic colleagues, quote, this process is not only unfair but designed to deprive senators and the American People of crucial documents and testimony. Your reaction . Well, i was there when the house voted to impeach president clinton. I was there as a part of the senate when the trial was conducted. With Great Respect to Mitch Mcconnell its not the same as occurred then. The Clinton Administration obviously opposed the effort to impeach and convict. They presented a case in the t senate against what the house, including Lindsey Graham presented. But there was no stonewall, no saying were not going to respond to subpoenas if there was a request for witnesses and documents. There wasnt in this case. Were going to get to a trial. I dont think theres anybody that believes that no matter who the witnesses are that theres going to be twothirds of the Senate Voting to convict but i do think its important to try to get as Many Americans saying this was a fair trial. Maria what about the republicans call that this has been an unfair process from the beginning, that adam schiff changed the rules in terms of yielding time to colleagues on the republican side, the republicans really didnt have a chance to call their own witnesses within the house. What about that . Isnt that where it started in materials of the republicans saying the process was unfair. Its a massively partisan process. All impeachments are political. The fact that its political, its not constitutional. Congress has the authority. Its a major part of the check and balance system. I know more than i should about this because i had to research it to try to understand what my role was as a member of the jury as part of the United States senate in 1999. So people are going to say things. In this particular case, it is odd that republicans are saying it was unfair. We werent able to call our witnesses and now theyre opposed to calling witnesseses in the trial itself. Youre going to get that sort of thing. Ill say it again. Were going to have a trial in the senate. Eventually it will go forward. I think its unlikely that there will be twothirds to convict. Maria if we get a trial, will we hear witnesses like, i dont know, the whistleblower, are we going to hear witnesses these are the people that the republicans want to he question, hunter biden. Should hunter biden there there as well as a witness . If mcconnell goes the way hes talking about, theyll open the trial. Theres a variable that when Speaker Pelosi sends over the impeachment documents maria why is she holding onto the impeachment articles. Shes not certain how the trial will be conducted. Once that begins, youre going to have votes on who to call as witnesses. Senator schumers got people he wants to call. The republicans have people. Theyll have votes. Some witnesses will be called, some wont. My guess is there arent going to be any witnesses appear in the trial. Maria they want to follow the clinton rules. That means all the senators are there six days a week. It isnt so much the clinton rules. Its really what was written into the founding documents, particularly in the federalist papers, how its conducted. Its been conducted differently. During the andrew johnson, this is more than you want. Chase was the Supreme Court chief justice and he took an active role in making decisions. I think its unlikely that will occur. I dont know how roberts is going to conduct the trial. He has a significant amount of authority to conduct the trial anyway he wants. Maria well leave it there. Well be watching, obviously. Were going to take you live to beirut right now, carlos ghosn has arrived. He is about to give a press conference. We are waiting to hear the former head of nissan talk about why he fleed japan and is living as fugitive in beirut. He told me over the weekend in my exclusive interview with him over the phone that he has documents and information to prove that this was a coup to take him down. That is why he was imprisoned in japan and that is why he fled. He said he is fleeing injustice, not a fair Justice System in japan. He said that he was not expecting to get a fair trial and thats why he had this great escape to lebanon where of course he grew up. He is with his wife, carol ghosn. Of course, the japanese prosecutors say that now there is an arrest there is a warrant for her arrest, carol ghosn. I spoke with r he her as well ae said they are very happy together right now living in beirut and they want to make sure that carlos ghosn gets his name back. They are trying hard to make the point of a coup being set up against carlos ghosn because the japanese government was not happy with his plans to merge nissan and renault. Hes also going to say this morning that he is willing to be tried in any court, anywhere in the world, except for japan, because he believes it is a rigged system. Were going to listen to carlos ghosn live right now. Joining us from beirut. They are asking people to leae the room so carlos ghosn can begin. This is going to begin momentarily to hear carlos ghosn speak about the torture that he faced as he put it to me in unfair judicial system in japan. Another issue that he said to me over the weekend, when i spoke with carlos ghosn is that he said, look, they thought i was going to go away. They thought i was going to fall prey to all of the interrogation. They wanted me to make a confession. I wouldnt do it. And im not going to do it because im innocent. He says that these charges against him are fraudulent, that in fact it was people from within nissan who wanted him out because they did not want to see a merger between renault and nissan and im here with the panel, cabbot phillips, dagen mcdowell, kevin oleary. When you look at the issues at stake, it certainly raises an issue for anybody wanting to do business in japan. I feel compassion for him as a man because he probably will never come back to the United States. His wifes an american. Theres an extradition treaty with japan. The minute she lands on american soil, theyll probably honor it, face her off to face her charges, whatever they were. Of course the japanese legal system is on trial here. People are confused with how they operate. Heres a man who fell from grace for reasons he claims are trumped up. His career is finished. Maria when he was in lebanon, they created a comic book figure out of him. There was a carlos ghosn stamp as well. This is how he was celebrated in lebanon and even in japan for a time, dagen. Dagen not being in japan and being in beirut, lebanon, he has two things. He has his freedom and he has the ability to exonerate himself if that is his goal. He has the ability to defend himself and speak his mind because that was not a afforded him when he was in japan, again, initially locked up. I dont think he has his freedom. He is never going to leave beirut. That is not maria hes got a lot of security around him all the time he told me yesterday and he does feel safe. He says i feel relatively safe, given my family. Hes a lebanese national. For a an International Man who joined a career on a global basis maria they ruined him. Youre not going to do business out of beirut. You have an american wife who would like to go home one day. Thats going to put stress on the marriage, wouldnt you say. Maria he wasnt allowed to speak to carol ghosn for a long time. Once he was let out on bail and put up in an apartment which was a tokyo watched apartment they told him carol ghosn, your wife, is going to tamper with evidence so youre not allowed to speak to her. Fast forward two years, honey, i would like to go back and visit the kids. Maria his life is entirely changed. Dagen at least he gets to be with her, at least he gets to be with his family. Theyre all here in the u. S. He has to look over his shoulder l. If he were to be kidnapped by japanese agents and delivered to a scrap niece court, the japanese court, the court would not inquire as to how he got there. Stated differently, he would be there for the rest of his life. My guess is the cell would be much worse. They would never give him any kind of bail. They are internationally humiliated by the success of the scheme that got him dagen arent we jumping ahead . Hes in beirut, lebanon right now. This is a country that does not have an extradition treaty with the country of japan and he is beloved in this nation. He doesnt have the power of the United States government behind him because he has a lebanese, brazilian, and french passport, not one from the United States. If he ends up in front of a goop niece court, theyre not going japanese court, theyre not going to inquire as to how he got there. Thats a horrible thing. Maria were going to see what he has to say. He is going to present evidence, he says, documents that show that this is a coup, that the japanese government was behind his takedown and there was no chance of him getting a fair trial. This is what he is going to say right now. Hes also going to say that he is willing to be tried in any court anywhere in the world, other than japan. That is a fanciful offer. The government is not going to try a criminal case on behalf of the japanese government. On the other hand, his statement and his belief that he could not get a fair trial in japan is a truism. Nobody gets a fair trial in japan. 99 rate of success. They do. Its absurd. And they do not have a western style. Maria just repeat that. You got the japanese has 99. 9 conviction rate. Right. Theyre either really good at picking cases or Something Else is awry. We dont have that conviction rate here in the United States. Obviously, they pick cases that they think can win but they also pick cases where they weaponize the criminal Justice System and justice with a lower case j because its not just in order to bring about the resolution of a civil dispute. His dispute with nissan was a civil dispute t powers that be in japan used the criminal prosecutors. If im the japanese government, im really pissed. And youre humiliated. And theyre going to go after this guy fullforce. Maria is lawyers will probably introduce him here. The lawyers put out a statement, saying nissan was trying to prevent him. Lets listen in. They said in a statement before this that the company was trying to prevent ghosn from more closely integrating the Japanese Company with its French Alliance partner which was renault, something that i reported a year ago about this because a year ago i was told what really went down here that it was a coup. Ghosn said he fled a rigged japanese Justice System after the authorities delayed his trial until 2021. Carlos ghosn is going to give his first Public Comments since leaving, escaping japan and it was quite the great escape. He escaped partly in a musical box over the holidays. There was dagen it was a Security Team that eventually included ten to 15 people from different nationalities including michael taylor, 59 years of age and exspecial forces soldier known for rescuing hostage victims in collaboration with our state department and the fbi. So it was, again, they put him in it was the box im assuming they put the box in the private plane, as soon as he takes off, he gets out of the box, when they land, he gets back in the box. Maria he was seen, cctv footage released by turkey showed a figure crossing the tarmac of an airport towards a jet in turkey. Maybe hes out of the box by turkey. Maria when they landed in turkey he got out out and got in another plane to get to lebanon and i see a movie, maria. Maria for sure. Carlos ghosn told me on sunday hes been getting calls from producers and documentarians. Listen, i will sit in a box. You think really interesting the details of this the wall street journal has about the here comes carlos ghosn right now lesseisten in i want thank you for the time to be here with many this to join me. We will see [speaking lebanese]. [applause]. As you can imagine today is very important day for mae one that i have looked forward to every same day for more than 400 days. Since i was brutally taken from my world also a i knew it, ripped from my family, my friends, my communities, from Nissan Renault mitsubishi, those who comprised those companies i have not experienced a moment of freedom since november 19, 2018. It is impossible it is impossible to assess with that of that deprivation and my profound appreciation to once again be able to be reunited with my family and loved ones, today is also poignant reminder of the days precisely one year ago when i heard before many of you as well as japanese judge and prosecutors in tokyo. I pleaded my innocence constraint, by handcuffs, and bound by a leash around my waust used to law or me in courtroom i was in midst being held indefinitely in solitary confinement after several failed attempts at bail i had just spent Christmas New Year holiday alone in confinement. I hadnt spoken to or seen my family for six weeks. My only contact with them were letters shown to me by lawyers, through a looking glass. I had spent previous months in interrogation up to 8 hours a day, without any lawyers present. Without an understanding of what exactly i was being accused of, without access to the evidence that justify this travesty against my human rights and dignity it will get worse for you if you dont just confess, the prosecutor told me repeatedly. And this has been taped you can look at tapes because tapes are being held you can see how many times they came up about you know, just confess it will be over. If you dont confess we are not only going after you were going to go after your family and discover many things every day i woke up you the night i was able to sleep to make a decision do i fight for my innocence, or do i do as they say there was no end in sight those conditions remained more or less the same day after day, week after week, month after month. The feeling of hopelessness was profound every day over 130 days in detention i fought for my innocence, when i was will finally granted bail for the first time and saw the opportunity to share with you all what i intend to share today, i was to back in solitary confinement within 24 hours confinement that flies in the face of global and United Nations standards of justice. This is why today is such an important occasion for me i am not here to talk about how i managed to leave japan al though i can understand that you are interested in that. Of the i am here to talk about why i left. For the First Time Since nightmare began, ares i can defend mils, speak freely and answer your questions, it was very easy to be why i was in prison it was very easy to describe the way i was described, unfortunately not only in japan but now um going to be able to speak with facts data evidence and hopefully you will discover the truth not has has been by people accusing me or people joined you accusation or accomplices not only japan out outside japan the reality is very different hopefully today you are going to discover it with me i am not here to myself i am here to shed light on system that violates most Bank Principals of humanity i am here to clear my name to pronounce clearly and emphatically something that was interpreted as heresy in the japanese system. These allegations are untrue i should have never been arrested in the first place. First i would like to begin by expressing my profound gratitude to those who supported me during this unspeakable ordeal in face of a System Campaign by handful of actorsing to you restoring my reputation impugning my character i am grateful beyond word for steadfast love and support of my family my wife carole, [applause] my four children, my three sisters, my mother, caroles children and family, they all endured unimaginable pain they lender of my arrest solitary confinement through media they were barred from seeing me even speaking to me for months, targeted by relentless shameless, baseless media he orchestrated by japanese prosecutors nissan executives unfortunately many accomplices i think of supportive friends as well as you numerous anonymous individuals sent me letters of support when i was in Detention Center. I think of lebanese authorities, and citizens, who never lost their faith in me. They showed the world for a small country, issue lebanese people have big soul big heart true sense of righteousness. I think i think of my lawyers, around the globe who waged a valiant battle putting their career on line devoting full energy against a corrupt system that presumed my guilty from day one and was designed to break my spirit, and coerce my con fergusfession i want to human rights, global and particular in in japan fought tire less he isly against odds to improve japan inhumane system it is a system indifferent to the truth indifferent to fairness and process indifferent to fundamental you Civil Liberties accepted norms of justice i want to mention honorable man husband and father brutally torn from his world and his family on that november day, summoned to tokyo under false pretenses when he needed to stay home for an important surgery. Greg remains a victim of the japanese Justice System with no trial date in sight the 14 months after his arrest, while my plight captured headlines we and you cannot forget gregs ordeal the pain he and family enendured each day at hands of the japanese system he is punished precisely because he is honorable refused to pattern in a suspicious prebargaining agreement. Thanks to the system i think leaking of falsely informational distorted information intentional with will wth holed of information by prosecutor and nissan i was presumed guilty before eyes of the world and subject you to a system only objective to coerce confessions secure guilty pleas without evidence i have come to learn my unimaginable ordeal over the past 14 months is a result of the handful of unscrupulous vindictive individuals at nissan, the law firm with support of the tokyo prosecutor of those. It is important for me to emphasize that i am not above the law. And i welcome the opportunity for the truth to come out to have my name vindicated republicans restored i did not escape justice i fled injustice. And persecution political persecution. Having enendured more than 400 days inhuman treatment in system designed to break me unwilling to provide me even minimal justice i was left with no other choice but to protect myself and my family it was a difficult decision a risk one only takes if resigned to impossibility of a fair trial. With strings being pulled manipulated by those that set on securing a confession or conviction only goal is to safe face. The facts the truth justice are irrelevant to these individuals. This was the most difficult decision of my life. But let us not forget, that of its facing where conviction rate is 99. 4 i will bet you that this number is much higher for the foreigners. Legitimacy should not rest on conviction rate but honest truth and just outcomes it is a prosecutors aided and ai ai by the time the by vindictive lawless individuals. In government nissan a firm, republicans on global stage, it is them who are archaic manipulateive to otherwise modern country it is them who should be held accountable. The charges against me are baseless. Why do you think the prosecutors have leaked false information not press against japanese law why intentionally concealed exculpatory evidence that support my evidence why continually delayed this undetermined, 30 months after still undetermined trial date. And they extended relentlessly investigation time loon why rearrested me all my Legal Defense dwrments so intent preventing me from talking holding a press conference where i would with set forth faction my side of the story why have they spent 14 months trying to break my spirit banning me from all contact with my wife and surveying my every move . Let me before going to your question i know you have many, try to give you some answer. And i am going to follow particularly five topics. The first topic is why all this happened at the beginning why all of this happened the second is how did it happen. I am going to tell you a little bit of what that means for 14 months, third is were going to come back to four charges the prosecutor have put on me, i am going to explain to you the charges we are going to also talk about all the charges, that have been at base of what i call the Smear Campaign the prosecutor there even did not prove accusation but flying through media with many interpretations unfortunately, a position not on that, finally im going to give you words about nissan where are they today . One year later . What is the situation of the three entities. And then i will let you answer all your questions. So let me start with the first item which is why, okay . If we say okay this is a plot and this is something which have been organized why . What are the reasons for this . Well, we have two reasons. That probably many but im going to give you the main one two main reasons for this to happen the first one was the fact that nissan performance unfortunately started to decline. At the beginning of 2017. I reminded you that in have october 2016, i have decided to move myself from the operation of nissan because i signed with mitsubishi taking 34 mitsubishi needed help i moved to mitsubishi as chairman of the board future chairman i told okay. Were going to propose you coceo this is something we should say ceos are not named by the predecessor they are named by the board. They are proposed by predecessor but this is a board decision. So when people say oh, he was named by mr. Ghosn wrong he was named by the board. He was proposed by carlos ghosn but named by board when they say he was named by mr. Goingsen he has no legitimately its no factual he was voted yu namously. Nominated octobers 2016 ceo of company i moved to mitsubishi i thought now it is your turn, i promised that one day, aring i will return this company after having ben ceo 17 years after having been ceo 17 years of a company in 1999 i left either with him 20 billion dollars in cash a Company Possible growing, nowhere in 1999 become one of the top 60 brands in the world that is what you take care of this now your turn let me help mitsubishi let me take care of the alliance. Unfortunately, here as long as he performs, i didnt say 17 years head of nissan as you because i was carlos ghosn i was there because i was performing delivering cash flow dividends that is our reason to be. Unfortunately we started in 17 to see decline in performance of the company obviously, many top discussions, in 2018 another decline many talk discussions at the same time he was ceo he was responsible for it, so he had to typfind solution with a team there was nervousness in ranks of the top management that certain point in time patience would run out and change will come. That is number one. Number two, well we have to come back to the story of the alliance. You know there was a famous in france has been voted, given Voting Rights for the share hollers who have shareholders more than two years we proposed the rule we have right the law allows us if more than twothirds of the shareholders voting to pass over it was possible. The we didnt prevail because as you know the french because of a company blocked the majority of twothirds we have mosts shareholders with us not able to reach the twothirds of the shares. This led a big bitterness with friends in japan, not only without management of nissan, but also with the companies of japan this led, somehow they considered unfair that nissan who owns 15 shares in renault has zero Voting Rights french, 15 have double Voting Rights we tried to explain it we were not successful unfortunately. And this is where the problem started. Because it started teen some kind of from our japanese colleagues, not only about the alliance but also about me particularly when i have been asked before renewing my mandate, by the way, i didnt ask for. I was ready to retire before june 2018. I was asked that i was probably the best person to continue for the next step of the alliance, unfortunately i accepted this offer. And probably one of the reasons for which i am in this situation today is because i accepted this offer to continue to integrate to companies converge two companies always respecting autonomy of each he company because this is a management belief that you are going to make a Strong Company with people who are this could they are second rate citizens in Big Organization i want japanese to be proud of lines, i didnt want first, second i want company proper there was a system i proposed a system to maintain that even though i made alliance irabout about unabout eshl unfortunately there was no trust some thought the only way to get treatment nissan, is to get rid of me. Unfortunately they were right because when you see exactly what is happening today, where renault has very influence on nissan even though put nice face what is taking place you know japanese have right saying we got rid of him we get much more autonomy. Unfortunately as you know we are going to talk about the results the results deaf and hardofhearing people expected are not the one that that everybody was hoping for. So who are the people . I promise you names i am going to give you names who was top of the plot obviously, top harry part of the plot, because they showed but many other people. Toyota member of the poured was link between board of Nissan Nissan and authorities i can he talk about what happens in the government of japan i can give you names i know that. But i am in lebanon i respect lebanon, i respect the hospitality has been extended to me by the authorities in lebanon, in no way i am going to do anything or say anything that would make that task more difficult so i am imposing on myself silence on this part of the presentation in no way i want to show anything or say anything that would hurt the interests of the lebanese people or lebanese government so i will start there for the government. Imagined, to i toyu. Ota many people obviously, many people participating i have all names i am to main people who are involved. Persecutor i will mention some names you are going to have the people who have been from the all side of the census, like the the Lawyer Company that nissan we were using in the past and continued to help nissan even though attacking some of the advice they had given us in charge and now supporting new team so story is very long i am going to limit myself hp how perform of nissan suspicion about the next step of the irreverseability of the line, how i was arrested november 19, 2018 i didnt suspect anything i did not suspect anything i was not anymore ceo of company i was chairman i delegate, i delegate some people asked me my god you didnt look at this you did not mention this you did not suspect this. And this happened before the from u. S. And i say, you know what happened in peril pearl harbor i was in my country, that something cooked against me you tell me i didnt notice it i didnt notice it because this is true, that that it is planned, secret, it happens i was surprised. No other stage arrest i have been told. I did not know that the word was to know that i was arrested in the airplane. I was arrested in the airport i came down from airplane taken in a car i arrived to the passport they told me problem with visa took me in small room this is where i found process cuter telling me prosecutor i need to talk to you you cannot use your phone i was arrested i didnt understand what is going on, and, because i was surprised i talked about at least give to send a lawyer. Obviously, i didnt know nissan was behind it, was staged way before between prosecutor and company. This is the way it happened. From there they took me to Detention Center they took five hours between my arrest and me finding myself into tiny cell, are the collusion between nissan prosecutor is everywhere only people who dont see it may be are the people in japan. They dont see it i have been told this is perfectly legal. How i cant be legal at the same time we have so many traces so many hands on the ball, nobody is talking about that. The you dont see if you dont want to see. But the collusion between nissan and prosecutor through witnesses in that quarter of nissan who told me exactly what happened before i was arrested all the preparation, all the visits, a lot of the meeting he go that took place between prosecutors and nissan increased without something official i am not going to talk about official as i said. I was sent to the prison. And the prosecutor told me were going to arrest you for underreporting your compensation. I was shocked the beginning frankly i couldnt than us what compensation. They say we are arresting you for underreporting a compensation that was not paid to you. Second surprise so talking about something not paid to me, yes then something didnt got to board mean undecided i was arrested for compensation that was not fixed, that was not decided, and that was not paid. This is the reason of my arrest. This is the reason of my arrest i can tell you that in Many Companies there is no reason to arrest certainly not in case certainly not even offense. You know very well, some professor of Corporate Law at university consulted three weeks ago by my lawyers now that we have documents at least on charge from prosecutor again, 13 months after arrest we showed him everything we told him professor, please, tell us. He said i am quoting, it is a shame that the japan arrested mr. Ghosn for this. We asked him to write answered is going to write obviously continue to write but said a shame university of tokyo, it is a shame, that mr. Ghosn was arrested for this. So in let me talk to you and a little bit i am not going to talk too much about this 130 days in prison solitary confinement tiny cell without window light day and night. 30 minutes per day, excluding weekend because obviously, not on weekend you cant go for 30 minutes outside when a howled there is no nobody so you stay in your cell you just get your food, for example, 6 days, without any human contact during new year break. Shower twice a week, tried to ask to have more they said no, prescribed medication forbidden you can get only medicine from prisoning interrogated day and night can happen any time up to 8 hours obviously, without presence of a lawyer all is taped, impossible to talk to anyone no one speaks english french or anything when we need something important we have to bring somebody about this guy is available once a week. Presumption of guilty prevailed prosecutor from the beginning, you know, me to knowure guilty dont play games, confess everything that would happen is not to try to discovery truth it is us to try to find reason to make sure that the representation i felt from the beginning there was no interest in finding the truth, the interest trying to bring very strong case against me. Of them and sent back to prison day before press conference to stop me from speaking out interesting after the second time, new prosecutor in japan has been nominated interviewed by japan media said mr. Prosecutor why do you forbid mr. Ghosn to talk to press he said o no, we dont we dont he can talk to press. But we also can bring new charges. Which was a very simple message that okay, yes sure he can talk to the press, but we can bring new charges, stler good at bringing charges, because as you know, yesterday what a coincidence yesterday they cant put me back in prison they asked to put a warrant arrest for my wife. Yesterday. On what . On declaration she made nine months ago in front of a judge and with prosecutor. And what is the reason . They said oh we suspect she said something which was wrong. Nine months later you discovered this nine months later one day before this press conference what a coincidence what a coincidence, this is exactly the way it works. You talk, you go back to nine months separated from my wife. Without any motive. Carole has a lot of courage. After i have been referred she left the country prosecutor asked her are why leaving the country obviously, took passport, they left her without telephone they left her computer left loan in tokyo without anything she left because she was afraid when they stopped is to say oh she has something to hide they same back, four days later she flew back theying interrogated her in front of kourtz you are the with agent and prosecutor then she left very. Now they are issuing a warrant for falsely testimony nine months later let me give you an example the judge in charge, we asked him seven times to remove the ban. Over a period of nine months. Seven times. And every time, being he took the time to think, nothing changed. And then he came back by saying no and why no . Because something of tampering of evidence tampering of evidence for corral i was able to receive civil rights my kids my you cousins my friends so if intending to tamper evidence i could tamper evidence with anybody about why carole . They knew not allowing me to have a normal life they were breaking me which is interesting when she might have come you know, maybe meet from time to time under your control the question was interest interesting why do they want to meet . I would say okay how many a conference, he said about what they want to talk about. I said like of its not a human anymore. I was something between a human and animal or object no feeling a man and woman want to talk to each other i have to explain why i want to talk to my wife the answer as you know was no, i have the right for two hours, two hours you in nine months, with a lawyer present in the room and the poor guy was embarrassed. He just when said please excuse me i have to be here i have to report about what you said to your wife. That is what they are talking about. The second one to mention also i mentioned i had many pretrial. Pretrial session, the prosecutor defense and you have the judge. Three judges. Well, i was naive i thought the judge was the boss. I was wrong. The boss was the prosecutor the judge very nice guy very polite but prosecutor whatever they want when late sorry we are late we are busy asked why dont you you bring the document think say we are going to think about it then the day comes say were late not giving it. Why all this try as much as possible to delay the trial. And when i left japan i still did not have a date for the first charge did not have a date for the first charge then came with idea oh we cannot put all charges at the same time we have to finish first charge before we start the second one, so when i asked my lawyers about how much time all of this going to take, were flayed maybe fi a afrai years in japan before i get a judgment. I understand we have here he specialist in human rights, speedy trial one of the basic most fundamental rights of any human being, but of the treaty of human rights, well i was far from speedy trial on contrary i had impressions that a this can take as much time as possible, and you know with a judge being a kind of nice organizer, of the whole thing the prosecutor calling the shots, 99. 4 conviction rate all the time there was no way i was going to be treated fairly, no sign that i will have normal life or next four or five years, i can tell you, that it is not very difficult to come to conclusion you are going to die in japan, or you are going to have to get out. This was not about justice. This was as i felt i because hostage of a country that i have served for 17 years what, i dedicated my professional life i was proud of it rerevived a company nobody else before me was able to do. For 10 years they were in dirt i brought them for 17 years considered role model in japan more than 20 books of management were written about me and like this in a minute. All of a sudden few prosecutor and bunch of executive nissan say you know what this guy is a cold, cold greed that is what they say cold greed dictator. We filed motion to dismiss, accuse of the all the elements that prosecutor violated. Obviously, this motion is still being analyzed, and then, there is an endless search for new charges by prosecutor so it in a certain way you know i think we have the list. Yeah. We have here the list. Of all the prosecutor that have been presented about evidence, presented to the court asked for case to be dismissed my lawyers in japan told me you know, dont think that it will be dismissed. There is zero case in japan that whatever is the reason of dismissal the case was dismissed, people acquitted part of 0. 6 but zero case of dismissal. Let me go to accusation. The first accusation is the underreporting this is a main opposition for which i was arrested. Again amount of money not fixed, not decided not paid. What is interesting interesting facts nissan in japan, were sorry we are going to provision of a beautiful we are going to plead guilty in japan you have to pay a fine. The problem that is in tennessee where there is a lawsuit against them, they took the opposite position, lawyer said well were not guilty there is no reason there is no reason, and this document is available for you. In japan, were guilty and tennessee they said were not guilty. So this document is available where subline the key sentences i just wanted to mention this for you we will come back during the question the question and answer. And, again, there is no democratic country i know where you go for jail for this kind of accusation even if they were right. There is a resolution from the board this is about rolls of, interesting it also resolution everybody voted unanimously for a also resolution if frern director foreigner officer want to have a concept of Exchange Rate to cover income he can do it at no cost to the company. Who was present, some people you know, member of the board, member of the board, on this, no for company very good, no for the company no less for the company, again, we are return by saying what is the problem . Where is the problem . We continue, this is another one, they say ah, mr. Ghosn you do nothing. Will the he received 14. 7milliondollar from nissan on four years but didnt do nothing this is accusings he didnt do nothing, we have a contract, we found we got the account about what i was doing with a with a our document signed between many will executive inside nissan, i want to trek your attention to the fact that, you know, there have been a lot of article saying ceo reserve oh, my god this is kind of secret money carlos ghosn opened a safe has a lot of cash he can do whatever he wants that is a line in the budget look at this. You can access reserve but a line in the budget if no payment no cash there is nothing at all this is one indication of the reserve. How does it go . You have the Vice President asking for the money, who was head of the region. Then he has to explain why he wants more than what is contact with base then people reviewing it agreeing on it or not obviously, you have legal. Then you have the controller then you have the boss of this fie usually is head of the operation, then there is me, why because it is reserve i have to accept that. Everything single payment from co reserve follow same procedure there is not one dollar based on co reserve with my signature on it you have all people signed on, after this after you agree on the budget line, then it has to go for the payment and when you go for payment you have many other people having to sign. Local controller local Vice President , obviously, people receiving the money et cetera, et cetera. So all these parts, talking about co reserve as special things where carlos ghosn taking money giving to family doesnt spend one minute to 4 evidence he had showing up we have difficulties fortunately now because when i was arrested they took everything from me no computer no file nothing, everything was taken so i have to reconstitute everything, everything to defend myself using some documents the prosecutor have the end to deliver to us in order to allow us to defend ourselves. We also would like to show you, can we move to the declaration of the yeah then we have a lot of statement prosecutors in japan have been lifting many people making statements never heard about that we heard about them. Because they were o bliged the Vice President in charge another one is joe peter, the chief Financial Officer of nissan another one also another chief finance minister officer covered all this area when we looking what they are sending documents are available you can adult them we make them available for those who he want to look at them so when we are looking at that what do they say they say, at least was important reason for carlos ghosn because toyota is one of the main of toyota not main Profit Center of nissan as you know the me is practically asian company, you have mercedes byou mw but practical no position very weak position i am talking about the i want to push people to say okay. Lets go on offensive we have an opportunity not only but also profit to change way we do business innovative the way we do business pushed people with local dealer that is not they dont bureaucrats trying to do we say give incentive do job for us frankly every time we did this we had higher profits, all of this is the position made by the prosecutor is oh mr. Ghosn has special ties with saudi guy and in oman so they have the kind of very cozy relationship, in fact everything we did with oman with dubai qatar not talking about that just focusing on out. H this incentives are very big which a what is interesting when you compare to people, even below the level of incentive that competitors are saying this is something you never heard about potential of middle east his very important that is what we were going after. Nissan chairman carlos ghosn delivering first public remarks since fleeing japan we are back with fox news senior judicial analyst judge Andrew Napolitano judge, he basically, called out a number of people will at nissan, the current ceo, the former cfo many board members, stars being involved, and part of the coup that he said took him down. Sometimes in cases like this people overpromise and under deliver in this case i think he delivered every promise teasing us with, in the past week, this is a compelling case of innocence he doesnt have to prove innocence except in japan doest has affirmative obligation. We got a ball game first inning, sflas home runs every 30 seconded. He said nissan board as well as the japanese government were upset that any Merger Integration between nicearound renault would be in fair nissan would own 15 stock renault would own majority have voting power he said that was behind it, by the way, that is what i said a year ago, when he was first arrested. Ghosn was Getting Compensation, he was being charged for Getting Compensation he did not disclose now we learn he never got paid. I knew that i reported that a year ago, he was never given and that it was never agreed upon with the board there is a Compensation Committee dagen. Yes, he did went through a lateist of names of people soe left nissan including hiroshi, in charge of Communications Government affairs left company last year but silent on japanese government officials said i will rhyming you silent to defer to lebanon concerned about any pressure that the japanese government or any pain they would inflict on the lebanese government clearly this is his home country has given him a harbor a safe harbor there, one other thing do i want to mention, he referenced peril harbor maintaining how did he not know what was going on he said pearl harbor aimed at offending japan also offending americans clearly i think that is one of the things that stood out for people on social media. A press release from press conference this guy is winning right now the prosecutor in japan has to come up explain as a an investor all of this isnt true ive got this is a classic a lot of explaining to do. The japanese judicial system is questionable, businesspeople journal fox business have been saying this. He accused of japanese prosecutors of seizing his defense documents named one of the promise 1998 law firms latham and wat countries in collaboration with nissan executives. I called nissan to send a lawyer not revising nissan was behind the it will also ready to step down, he didnt he was giving ceo ready to leave the company, then he was asked to stay. This its a pageturner i have to know more bring it on this is a fantastic story, this is pure entertainment. And he is really kicked it. Not entertainment for carlos ghosn solitary confinement. Out of beirut i never anticipated would happen i am impressed this is going to get really interesting, and will dominate news feeds for dwooekz being. Very, very powerful well documented as he promised he would deliver. Going to be taking questions shortly, many of the questions, will be asked how did you do it how did you hide how did you breathing . I spoke to him on sunday he wouldnt go through it with me he doesnt want to go there he doesnt want to put anybody in lebanon in jeopardy makes senses. Why isnt prosecutor setting up retort to this in next more. We probably will here i dont know if next hour but we will probably here it. Ive got to hear. It a huge embarrassment for japan now second inning he is up 15 home runs bring them onlet go i am dying to see it this is fantastic stuff so that i understand as by stander watching it looks fantastic stuff that is persons life this is not this is really for him not he has been in jail he has been barred from speaking to his wife, i know he has been interrogated for soul reason of getting a confession decided to do this every camera in the world listening to him feed going around the world his decision now game has started, so he is going to have to take it from the prosecutor next. He said i was left with no other choice than to flee. He said he was told that it would probably be five years before he actually even saw a trial he said i was expecting that i would die, in tokyo. In japan, the prosecutors are allowed to lie to you they are allowed to concoct an agreement that they dont comply with so they almost always say confess you will be free this afternoon that is a Standard Operating Procedure in japan you confess, of course, you are not free they cop confession begins a you he over 13month period consistent system. Average investor never knew this stuff, i am shocked at this. They knew it he watched mornings with maria, Maria Bartiromo from the moment this one was of arrested has told her viewers, that there is no due process in japan, and she has documented this month after month so her viewers do know that actually. Maria thank you you are watching mornings with maria you he would have known right now going to have to Start Talking about at the allocations of japan this is a damning accusation. That a would be one examine implication as investor you have to won if direct investment into japan slows down you have to question should i be reallocating away from market jurisdictions. You have a system, where a corporation can weaponize the prosecutors, to reorder a Corporate Structure unheard of in western world. A hell of a story i am impressed with his ability to to deliver it spectacular. He looks very strong i spoke to shim sunday appeared very strong to me then as well he was ready to fight, he said, they wanted me to roll over go away i am not going to do it they wanted a cop confession i am not doing that i am innocent judge and true napolitano thank you. We want to turn to all the breaking news of the day that is iran striking back watching more than a disease missiles two u. S. Baits in iraq you go housing american troops former Senate Majority leader, aring trent lott, senator good to see you thanks very much for joining us. Thank you, maria i wish i could be there in studio with you this is a very interesting day news wise. Quite extraordinary to hear carlos ghosn for sure i want to ask but business of the day i want to talk about iran i want to talk about impeachment process, given your experience here first your reaction to what has taken place, in terms of a iran retaliation. Well i think i was advised by former colleagues in Congress Wait till you get briefed on details of what happened, we need to assess, the damage, apparently there were no casualties thank goodness. But the question is how 14 we respond, and the president is going to have to meet with national Security Team he needs to talk to the big 8 in Congress Make sure congress understands what is going on, but the relationship with iran is not been good for 40 years, i i also keep in memory when revolutionary guard w Reynold Reagan was responder in iran released the hostages they knew reagan was going to take action twins them he have to deal with iranians externally i hope president and Congress Come up with right approach. About do you believe the fact they didnt hit anybody there were no casualties here i mean look when you look at precisi preiranians had in saudi arabia there was massive precision there here no precision was that just a move to safe face they did not want to affect anybody because they dont want to get into a war a america . Well, certainly i hope they dont. It you will event on what experts see it could be they dont have as good capability as they had in the past argument is being made they have got capability to be more accurate than in this attack may be that is response to say we acted, now, lets go on from there we have a lot intelligence and a lot of information about their capabilities, and what our own capability would be to respond. But i think we need to wait assess carefully where we are before we decide what to do next. Top Administration Officials including the secretary of state mike pompeo defense steak mark esper briefing both housdz of congress on situation in iran this afternoon House Speaker nancy pelosi other top congresspeople were briefed by Vice President pence via phone pelosi tweeted after the call said this closely monitoring the situation following bombingsing targeted u. S. Troops innish ensure safety of Service Members endless provocations, america and world cannot afford war this was response correct . Because provocations have been rising in the last six months by iran. Yeah, you know, i think she needs to be careful how she responds when i was majority leader he bombed a couple times called me in advance we talked on secure phone basically, asked me to be cautious how i responded, and i did that. With all the one occasion when i was very concerned about what the after action wag going to be. So Congress Needs to understand that when you have this sort of situation dealing with country like iran you need to think first about okay, what is in americas best interest measured in what you say because it will be misinterpreted around the the world tabling me back when you oversaw senate trial for then president clinton, weve got this impeachment showdown here Senate Majority leader Mitch Mcconnell, yesterday he has votes to begin the trial, nancy pelosi holding on to articles of impeachment telling democratic colleagues process not only unfair but you the to some people say that sounds really rich given what we just came from in terms of the house and how that process went. The republicans say that was incredibly unfair. Can the senate begin a trial without pelosis articles of impeachment . Well, i think probably they could. I think that majority leader mcconnell would be hesitant to proceed without receiving the articles, but i wish that the speaker would understand that the house has their role and the senate has theirs. The house cant dictate to the senate and the senate cant dictate to the house. She needs to send the articles of impeachment over. The house had their turn and let the senate decide how to act. Now, how to go forward, theres a pattern that we agreed to in a totally bipartisan way on the clinton trial. The vote was 1000 to proceed to consider the impeachment articles. We heard from the house managers, we heard from the president s lawyers, the senators could ask questions to the chief justice, who then would address the question to the person who needed to respond and at that point, we decided how to go forward. We did have a vote to dismiss along the way. Later on, we had a vote of censure which was defeated. We had a vote to take depositions in private but videotaped, three witnesses, after we had been through the first phase. So my hope would be that the senate would go ahead and pass the United StatesMexico Canadian trade agreement within the next few days. The house hands over the articles, go ahead and go through the process of hearing both sides of the argument and then decide whether you want to go forward with, you know, other actions, other considerations or witnesses. So thats what we did with the clinton proceedings and it was roundly described as being appropriate, fair, constitutional, with civility and then when it was over, we went back to work. For the American People, for the country, for goodness sake. Maria you hope that business, that business does get done. You mentioned usmca. We are expecting perhaps that passage in the snooienate this or next week. But is it appropriate for pelosi to be holding on to these articles and is it appropriate for the senate to say we will wait a few days, we will wait a week but if we dont get those articles, we are going to move forward . I do think that she has been acting inappropriately. She should send the articles over and i think she will. I think shes just trying to apply pressure to mcconnell to help schumer try to squeeze some agreements out, but send the articles over, let the senate go forward. Maria senator, good to have you. Thanks very much. Thank you, maria. Maria very busy day. Thank you so much. That does it for us. Let me hand it over to Stuart Varney and Varney Company as you pick up the ball here on an incredible news day. Stuart extraordinary. Good morning, maria. Good morning, everyone. Iran retaliates. Around 5 30 eastern time last night, 15 missiles launched from iran at two u. S. Bases in iraq. No u. S. Casualties reported. The president met with top defense and military officials at the white house, he issued a single tweet saying in part, all is well. Kind of measured response, calm response. That was his only communication, but he will make a statement from the white house this morning. We dont yet know the timing of
