Maria big show this morning, joining the conversation fox friends, pollster and maslansky partners lee carter and chairman and ceo john peebles. Great to see everybody this morning. Great to be here. Maria you heard it here first, usmca is coming to the floor, House Speaker nancy pelosi announcing that House Democrats have reached a deal with the Trump Administration on the trade agreement, the pack likely to be approved by congress after the new year, the senate might not take it up until after the impeachment trial, President Trump and nancy pelosi weighed in yesterday as the impeachment battle raged on simultaneously. The Silver Lining of impeachment and witch hunt, thats the reason they approved usmca, thats okay with me because they approved it and they are very happy to have it. Theres no question, of course, that this trade agreement is much better than nafta, but in terms of our work here it is intimately better than what was initially proposed by the administration. Maria i think both sides are happy that a deal got done but i dont know about it being indefinitely better when she first got it. These are incremental changes that the democrats made but everybody wants to take credit. Of course, of course, i think they had to and they also knew they could be the obstructionists, they had to say at least they had to put something forward that was something and get credit for it, its important for democrats to have at least said we are not just focusing on impeachment, we are also doing this. Maria they had to, they went home to 31 districts, those are the districts that President Trump won and they want to get reelected in 2020. Dagen only takes 19 seats for the republicans to take back the house and also about the president ial election, by the way these are changes that could have been and should have been made before now. Maria bingo. Dagen took them over a year, it did, to make incremental changes. This was a win for labor unions in the first place, it very much help union workers, 75 of the value of completed car or truck has to originate in north america to qualify for dutyfree treatment, 45 and average of 16 an hour, that didnt change that was one of the most incremental changes, its also about apresident ial election, Hillary Clinton lost the noncollege white collar vote, led directly to President Trumps victory in the electoral college. I think its so important about pennsylvania, wisconsin, michigan because thats where democrats really arent polling well in impeachment and i think they felt the pressure in the states on this issue. Dagen they dont get the win for this. Maria thats right. Dagen President Trumps center piece items that he campaigned on, im going to tear up nafta, he did it, theres another one in place, this is a victory for the president , like him or not, the democrats are trying to take credit, they wont get it. Yeah, i think that your mention of voters in pennsylvania, wisconsin and ohio, i think also minority voters especially africanamerican voters will supply this as well, thats a reason if you look at it, that was trumps margin, beyond his margin of victory in michigan and i think now with the democrats not having a single candidate of color on the debate stage coming up this month, its a real problem for this, this is supposedly the party of inclusiveness, now theyve lost all candidates of color. This issue, trade agreement affects minorities in the country as well, they the ones most likely to be getting jobs in the Manufacturing Industry as well. Maria although andrew yang did make debate. Just so, by the way he has no chance of getting the nomination, i mean, i think that the Democratic Party is in very serious danger of becoming the party of obstructionism and thats why they needed this trade agreement to get done because they cannot be going before the American Public on impeachment only and being the party of nontrump, say no to trump no matter what and put the countrys business on hold, the country has to move on, closest full unemployment since keeping statistics, those are real issues. Maria i want to get to ig report and what barr said, Hillary Clinton is apparently the leading top choice for democratic voters in the Harris Harvard poll, you saw that, that was pretty incredible. It was pretty incredible. Maria democrats want hillary to run, i guess. Whats that saying is democrats dont have a sure fire winner, you dont really know who the front runner is going to be, biden in the polling is doing the best right now, i dont think hes necessarily the one winning the hearts and minds of folks, i think people are saying hes the best of the pack, i think Elizabeth Warren people are really talking to ideas and people reacting to her, i think whats happening with Hillary Clinton being out there in the front, basically saying we dont have the best candidate right now and shes better than what weve got. I think voters arent really focused. Dagen Julian Castro qualifies for the debate as well. Well, i dont think the democrat right now know who is going to be the candidate because, you know, people are not focusing on this race. Maria you want hillary to enter the race . No, absolutely not, i think the best candidates out there for the Democratic Party are biden and Elizabeth Warren and cory booker. Maria how does the ig report change all of this and impeachment trial, Inspector General Michael Horowitz will testify later this morning one day after House Democrats announced two articles of impeachment against President Trump, attorney general william barr weighed on the ig and the role the fbi played investigating fisa abuse, watch this. They not only tell the court that what they had been lying on was completely, you know, rubbish, they actually started pulling things to bolster the report, well, we talked to the sources and they appeared to be truthful and what theyre truthful about is that the dossier is false, so thats hard to explain and the core statement in my opinion by the ig is that these we are irregularities, these omissions were not possibly explained and leaves the possibility to infer bad faith. Maria which is why john durham has now called his investigation a criminal investigation, they mislead the fisa court, omitted exculpatory evidence and this is all from william barr, reaction to this report . I think the democrats need to move on, to be honest with you, they need to move on from impeachment; they need to move and focus americans are not tuning to nuances right now, they are getting frustrated because the economy is moving along, they want more people to be included in the rising economy and thats their focus, opportunity not this kind of nonsense here and makes the democrat appear like sore losers. Maria did you want to say something, go ahead. Dagen i was going to say that the democrats are moving ahead with an impeachment which according to many constitutional scholars theres no crimes to that. Bill barrs was utter indictment by the cia, by the democrats, i encourage people to watch. Maria why is james comey all over the news wire saying that now im vindicated which is extraordinary to me. Dagen because he is a spotlightseeking, selfpromoting peacock maria he has to get in. Youre just back from San Francisco, i have to get your take on this. Over eating giant oracle is saying good buy to silicon valley, hosted open world conference for years in san fran, moving the conference to las vegas instead of San Francisco, the travel association blaming the move on high hotel rates and major homeless epidemic in the city, walk around the streets of San Francisco and you can get an idea of whats happening behind the scenes, don. Its shocking, they normally have it a large Convention Center in San Francisco and surrounded by that Convention Center are hotels and i happened to be staying in one with my family and we have done a lot of business in San Francisco and i couldnt recognize the city, i mean, people are defecating on the sidewalk, people are laying across the sidewalk where you have to step over people who are passed out, drugged out, there are needles everywhere, i mean, it is not a city that is going to promote tourism and no one is going to feel safe walking around, we walked, theres a beautiful monument or memorial for Martin Luther king, jr. , and we walked through that and felt uncomfortable, i mean, it is a very serious issue and, in fact, the politics have shifted, San Francisco super liberal but theyve elected a much more moderate mayor, solely to deal with this homelessness. Maria because its very hard not to look at the liberal policies that are behind some of these big cities and blame things like open borders, blame the fact that its a sanctuary city on some of these issues because if you look at San Francisco, look at la and homelessness there, look at new york, dagen. It is a travesty what these leftwing leaders, i was going to call them names and im holding my tongue have done to the citizens of these cities, of these areas. Because, again, what it is, its hardest on the people who cant afford it. Its hardest on the people who need to who are running Small Businesses and shoplifting is no longer a crime, you get attacked on a subway platform because the subways dont even show up or run and the attacker doesnt get arrested. Maria yeah. Dagen the rich people who make all the decisions who drive all the decisions in places like San Francisco are new york, they get to get on their private jet and go to europe on vacation, they get to live in their house with a wall around it with security guards. Its the people who actually have to go to work on Public Transportation who are not safe, who are being abused by the politicians and that is part of the huge pushback that youre seeing across the nation. Maria not to mention, theyre not supporting the cops, the police are getting milk thrown in their heads. Also enrollment in Police Academies is declining because people do not want to risk their lives and not be appreciate it. Maria i agree. Extreme disparities of income, San Francisco has become a city that extremely expensive to live in and so you have the very rich and those who are very low income living in San Francisco. Maria dont forget something we said over a year ago, 3 quarters of inmates in reckers island, what is that going to do . Dagen businesses are struggling and new york and they ask me all of the time, why is that happening, people wont come here and people are moving out and its the administration of mayor de blasio and the governor of the state that is doing it to you. Maria bingo, wait to inmates to be released in january, i on the expect this to get worse. We have to get your expertise, don, across the country, saudi arabias first day of trading, the saudi aramco deal, more history being made, the yankees finally land garrett cole signing the former astros pitcher to contract, wait till you see the numbers, back in a minute. Maria welcome back, tragedy in new jersey to tell you about, shootout left Police Officer and 5 others dead yesterday, Cheryl Casone with details, cheryl. Cheryl yeah, two gunmen leading police on a chase, gunmen dressed in black, carrying highpowered rifles, they called Police Detective in a cemetery before flee to go kosher super market, shooting spree and 3 bystanders dead, suspects shot and killed and all of this was played out in many new Yorkers Television screens, individuals targeted jewish grocery store. Worlds largest ipo, shares of saudi aramco soaring in debut after 3 years of delays of trying to get to market, 1. 9 trillion, this makes it more valuable than apple, microsoft, ipo to raise more than 25 million, chevron back in this country taking major hit, the company get a charge of at least 10 billion due to oil prices for oil and natural gas, the glut of energy really that is tearing the country, chevron may also sell shell gas projects and project in canada. Then there is this, new york yankees signing cole to 9year contract. The contract, maria, averaging out to cool 36 million a year because you know when the yankees spend so much money on players it always works out for them. Im not being serious when i say that. Maria big numbers there, quick break and markets searching for direction this morning, a lot of trade headlines to go over, investors keeping closest eye on any news of china trade front, those details in terms of those tariffs going into effect this sunday, we will see if anything happens to revert that, then it is the time of the year, the Time Magazine, person of the year, we will release the choice of the person of the year this morning, who is on the cover, we will tell you about it coming up. Maria welcome back, so much news to hit market this is week, we are waiting on any news out of the u. S. China trade talks, stocks finished down slightly yesterday in shoppy session, investors are paying close attention, each bid of news sending markets in different reaction, we are waiting on usmca and twoday Federal Reserve meeting which we will hear from the fed today jay powell, yesterday i spoke with commerce secretary wilbur ross about a potential deal with china. The important thing to get a proper deal with china whether we get it the day before december 15th, the day after or the week after, much less important than getting the right deal. Maria i think what he was trying to say is the fact that theres speculation of tariffs coming up and going down, he said we will get the right deal before we agree to any of this, joining us to talk about impact on markets, National Security chief Market Strategist art hogan. Thank you so much for joining us, how important is a china deal, what about usmca, give us the focus for investors . The most important thing is u. S. China trade, we saw at the beginning of last week, slippage, its imperative that we get something done and i think that both sides are getting close, the separation between what china would like to do and what we would like to have them do is not that far apart. Usmca is really not making as much as they should. Much more important trade partners and this has been going on for more than a year. One and a quarter trillion dollars of trade versus 500 billion with china. Much more important. Its a great deal, the senate probably picks up at the first of the year and they talked about putting it off but getting that established also tells markets that we can actually get trade deals done. Larry kudlow will join us, he will say 200,000 jobs created as a result of usmca. Dagen here is my prediction, i think itll be higher, closer to 300,000 over a period of time. Maria wow. Dagen it would at roughly 3 quarters of 1 percentage point to overall gdp. If we talk about the drag of the trade negotiations, some of the drag, a large part of the drag has now been removed and we are also we talked about the unions benefiting from this but also the farmers are going to benefit handsomely, usmca expected to increase agricultural and food experts by 2. 2 billion or 1. 1 , small increases in u. S. Dairy poultry, wheat and alcohol exports to canada, more sugar, also coming into the United States from canada. Maria is there a play on that, art, do you want to buy certain groups as a result of the trade situation . Its interesting, one of the plays is pharmaceutical protection, this being put in place, thats brand new. Exactly. I think thats important, the Auto Companies are getting a boost from this, its probably net positives, but in large part, i think dagen is right, its a lot of the food and ags, the stocks get a lift here and probably at the time dagen you mean its the natural cycle of people who bought a lot of automobiles. A lot of demand and our cars are lasting much longer than they used to. Maria 10 years, you keep your car for 10 years at least. We are using less energy, when you put the pieces together, why is oil has been sort of stuck in 50, 650dollar change, as a globe much more efficient and thats the nature of the beast and we are good at finding oil in the country. Maria my car, i dont drive a lot, but i have a car since 2006. [laughter] maria i think i only have like 50,000 miles, thats how little i drive. Dagen i know what you need for christmas. Im a car person, i love cars. Maria whats your take on the fed, is that going to Impact Real Estate in any way, 2day policy meeting today, widely expect today keep Interest Rates steady, i want to get your take on that first give us your take what the rate has done and what its done for the economy. Its very important for the real estate industry, relied heavily on debt especially on jobgenerating activity which is construction and development, so our business is doing very well because projects tends a lot better with lower Interest Rates, thats one of the things that we will see going into 2020 thats going to keep the economy moving along, if you look at the markets where people and companies are moving to out of the hightax states like out of new york, out of california to places like tennessee, florida, North Carolina and other business friendly environment we will see more growth because those markets dont have enough capacity right now. Maria yeah, i want to talk more about real estate across the country. Art, what are markets going to do when the fed comes out and says we are not cutting rates, we are on hold for a little bit which is what we are wildly expecting. Theres a presser after every meeting now and the presser is 80 of the questions and overnight repo markets, we just dont understand, theres been liquidity at the end of the year. Its hard to explain jay powell will do a great job but, you know, i would guess that 8 out of 10 reporters are going to have them repeat the same thing over and over again, this is why we are in the repo market, we think we figure this out come the First Quarter of next year, we will probably not have to do this. Maria bottom line, would you buy the market today . Absolutely, we have to nafta 2. 0 and phase 1 china deal and all happening in realtime, we are heading in the First Quarter in strong position. Maria 2020, bring it on, bring pit hanging in the plans, Boris Johnson faces tight race, Prime Minister election tomorrow in the uk, what you need to know, the irishmen by the numbers. Netflix finally releasing how many people actually watch newest film, i think you know how we feel about it, its going to surprise you who actually watch and dagen will not surprise you at all managing ty . Maria welcome back, british Prime Minister Boris Johnson campaigning hard ahead of tomorrows big election in the uk, Ashley Webster in london this morning with the very latest, ashley, its going to be quite a day tomorrow with that election. It certainly is, maria, good morning to you, yes, its the final day of the 5week Election Campaign in the uk, Boris Johnson using a lot of visuals as we know this morning he went out on milk deliveries up north of the country, yes, i can deliver milk, there he is with milk crate. I can deliver brexit, he was door to door, get brexit done, jeremy corbyn, if you look at polls, its tightening a little bit, if you do average, conservatives right now at 43, liberals 33 , this is all about seats, if this polling correct that would give the conservatives a small majority of 28 seats but plenty for Boris Johnson to get the brexit deal through, get out of the eu and start doing trade deals with the United States and others, so lots at stake tomorrow its a pretty much a choice like it is in the u. S. , maria, capitalism versus socialism, if Boris Johnson could be big for donald trump. Maria sounds like a pretty straightforward answer, capitalism versus socialism. Ashley you would think. Maria yesterday wilbur ross told me that right after the brexit situation takes place, the eu and the uk going to be first up in terms of dealmaking with the United States on a trade deal there. So we will be watching that, of course, Ashley Webster in london, thank you, sir. We want to turn to impeachment inquiry, that continues, House Democrats are bringing articles of impeachment against the president officially, the deal on usmca viciously announced, you heard it here, President Trump reacted last night. They announced impeach rent and an hour later she announced that shes going to do usmca, you know why, its a huge deal and plays down the impeachment because theyre embarrassed by the impeachment and our poll numbers have gone through the roof because of her stupid impeachment. Maria in fact, impeachment is losing popularity, the majority of americans oppose to impeachment President Trump. Rob, great to have you this morning. Thank you so much for joining us, what do you think the democrats are going to do seeing this kind of population response that the majority of americans dont want this to take place . Well, like the majority of americans, i do believe that the impeachment exercise has been a total sham, its design today basically take away from the fact that democrats have done absolutely nothing at all for the American People, and we saw it for the last 3 years, i think the democrats will continue to double down on impeachment because literally all they have, they dont have any plans to help the American People, they dont have a very strong message going in 2020, so they are going to double down on this because its all they have. Maria yeah, pretty incredible, don, you see things like this dishonesty that people see through, even nancy pelosi yesterday saying, the usmca bill that President Trump first brought us was a nonstarter, we had to change it all, nobody believes that. I mean, people are seeing through this. Yeah, i think they are focused too much on optics right now, i think impeachment seems to be the best issue they have, look, normally as they say, its the economy, stupid, we are at the closest point to full employment, so the economy is moving along, we will see wage growth going into 2020 and so its very hard to unseat an incumbent president if the economy is humming along because whats the alternative . Where dem are pushing things right now socialism versus, you foe, capitalism which we just talked about. Maria but also the shaming of it, you have a different idea than the democrats have and you get shamed. About 3 weeks ago i had on sunday morning futures jeff, democrat congressman from new jersey and i said to him, congressman, are you going to vote on impeachment and he said, im a no, listen to what jeff told me then, this was about 3 weeks ago and then i want to tell you what happened to jeff vandrew, watch this. How will you vote . I would imagine that i will be voting no, now, i always, you know, if theres nothing new, something we havent heard, something that really rises to the level of treason or, you know, a high crime, that would be different, but we dont see that. Maria okay, so that was on november 7th on sunday morning futures, so about a month ago, i called jeff vandrew to come down, they shut him down, i have to stay under the radar right now, my speculation nancy pelosi said to jeff vandrew, zip it, stop talking and telling people youre a no, is that right you get shamed if you have a different idea . Its such a hopelessly partisan thing but they are not getting all the votes on the left, so you have even democratic congressmen and women realizing how much of a sham this is, they dont want to become vulnerable in their district. Maria go ahead, dagen, you were about to say something. Dagen i it is evidence that the democrats layed out impeachable offenses, you have to break down the polls and look at an average of them, you have to look at how the republicans feel, how independents feel and how democrats feel. Democrats all along have we wanted to impeach this president , there were articles written in vanity fair for, for example, talking about right after the election talking about impeaching President Trump because of the Trump University was a fraud, number 1. Number 2, the percentage of republicans supporting this is now below 8 . So, again, youre defying the will of the voter and now the narrative, if you Pay Attention to it from the democrats, from the likes of congressman steve collin is clear and concise evidence that are clear so the American People can understand them. Maria attention, stupid. Dagen americans have the expansion, we might be raw but we know right from wrong and we can spot a phoney before he ever says his first word. Maria takes me back to the obamacare situation where Jonathan Gruber said we had the public not knowing anything so that was on our side. Joe biden secured his lead among the 2020 hopefuls in a number of recent national polls, rob, i have to get your take on this. Quinnipiac survey leading among democratic voters, however, Younger Voters seem to have the socialist bug, 18 to 34yearolds are supporting senator Bernie Sanders, rob. Oh, boy, we have a lot of work to do in order to kill the idea of socialism in this country. Actually i do a lot of work on College Campuses in turning point usa and its all about pushing the idea that capitalism is good because socialism is being sold to young people right now but when it comes to joe biden, i will say like ive always said before, he will clinch the democratic nomination because the road to the democratic nomination goes to older africanamerican voters in the south, they are comfortable with joe biden, he was the Vice President under the first africanamerican president , they will lead him to that nomination. Ive always believed this and i think that these numbers bear it out. And when it comes to Bernie Sanders and young voters being for Bernie Sanders, thats all about this push for socialism that is being pushed on Younger Voters, look at Bernie Sanders taking voters with ariana grande, cardi b doing videos. Maria hunter biden, joe bidens air force 2 going to china on an official business with joe biden and then coming back with a billion dollars in his pocket for fund for his fund . They understand the 60,000 a month that he was getting from this barisma Ukraine Company and he had no experience there . So my take on that, maria, is that people arent paying that much attention right now. Theres a lot of people who dont live in the world that we live in but when biden becomes nominee it becomes more clear. I would not give african africanamerican voter. I think cory booker and Duval Patrick are serious threats, if booker does well in iowa, i mean, biden will get surprised in South Carolina and Duval Patrick has got a good shot at him in South Carolina, he loses South Carolina or doesnt win it decisively africanamerican voters will look elsewhere. Hes not said one reason why africanamerican voters should support, 5 debates only as if i was number 2. President obama will not endorse anybody until primary is over. Maria he endorsed justin trudeau. I cant believe that Duval Patrick has a shot. The same people when i was on obamas finance committee in 2007 were saying he didnt have a shot against hillary and i remember hillarys advisers telling me they hate today see me left behind and with this train going when hillary was going to win, how are you guys going to win it, they said we will win it with 48 of the africanamerican vote, im like, oh, this is great because obama got them because theres no way once africanamerican voters see an africanamerican candidate right on their issues, then they they are electable by winning in iowa or new hampshire, they will take a whole look. Maria walk away. Whats that . Maria walk away. Thats black voters leaving the Democratic Party in general. I have to push back on corey booker and Duval Patrick, i think cory booker is a weak candidate. He has only gotten a bump because harris dropped out. Theres no reason why any candidates should win right now because they dont have a story. Narrative that joe biden has is sellable . No. Okay there, you go. Africanamerican voters should vote for joe biden, im all ears. Maria im all ears too. Rob schmitt, we will be right back invested at a great rate thats 21 times more than schwabs. Plus, fidelitys leading price improvement on trades saved investors hundreds of millions of dollars last year. Thats why fidelity continues to lead the industry in value while our competition continues to talk. Talk fidelity. Talk are ready for cartridges another school year . What does cyan mean . Dagen bad luck given history of brando, basically you paid 2 million for, well, luck that will not favor you. Maria ouch, on capitol hill today the boeing whistleblower is testifying, Cheryl Casone with the details on that, cheryl. Cheryl t going to be explosive, maria, former boeing employee to tell lawmakers he warned managers about safety issues with boeing 737 max before two deadly crashes but ed pearson says overworked employees and recommendation that boeing temp. I lay shut down production at a plant outside of seattle were ignored. Next hour time will be announcing 2019 person of the year, we have President Trump is on the short list, House Speaker nancy pelosi, the ukraine whistleblower is on that, plus teen environmental greta and then theres this, we cant stop talking about it, netflix breaking from policy, they released the streaming numbers for irishmen, saying the movie has been viewed by 26 million household and expected to reach 40 milliondollar in first 28 days, the movie, though, maria fell short of another netflix movie we talked about, burn bird box with sandra bullock, that happened last year, maybe the point of this when its 3 hours long nobody start it because they dont have time. Maria i turned it off after 20 minutes. Im sick and tired of the violence, i cant take it anymore. I dont want to see the killings, i dont, im over it. Dagen i dont think you counted in the number, this is according to from our trustee producer, netflix only counts, accounts that watch at least 70 of the movie for 3 and a half hour film, you have to watch obviously the majority of it. 2 and a half hours of it. Maria our audience know how dagen and i feel about this, have you guys seen the irishmen in. I did, reminds me of the democratic field for president right now. [laughter] talented actors, just, you know, incorrectly cast and probably, you know, their best days are behind them. Not a good story to tell . Dagen too old. Im getting ready to turn 60, im hopeful that theres life after 80. Maria it is that time of the year, we will try it again, the countdown to 2020, we are looking ahead to new years resolutions as we always do, the top trending diet, dr. Mike is here with some advice. the enchanted disney fine jewelry collection. With exclusive bridal styles at zales. F[ dramatic music ]ing ] ahhhh ahhhh elliott. So we took our worst vice, and turned it into the dna for a better system. Materials made from recycled plastic woven and molded into all the things we consume. We created bionic and put the word out with godaddy. What will you change . Make the world you want. Maria welcome back, diet trends making their mark on google, the company releasing its most searched terms and phrases of 2019, they include intermittent fasting, kito, its never figure what would work for you, we have dr. Mikhail varshavski, aka dr. Mike, 2020 and a new year. Thats the headline, new year, new you, Everyone Wants to set goals for themselves, the one thing i urge everyone at home to do is to set smart goals, has anyone here heard of smart goals before . Yeah. We have done it for finance, now we have to do it for ourselves, if we want to say we want to lose weight thats not a good goal, thats arbitrary, how much weight, by when, is this a realistic goal . Maria good point. Specific, measurable, atakennable, realistic and timing, once you answer all questions for yourself, youre more likely to stick to your goals and the list of top diet trends that came out from 2019, a lot of them are fad duties, they are crash diets, they will not give you longterm success, its about changing your lifestyle as a whole, making sure that youre eating whole foods, plantbased diets, plants, meats and moderation, overeating is not good for everybody. Look, i go in the no carb no sugar diet when after years of accumulating, you know, some expansion and last year i knocked off about 24 pounds and i kept off 20, i think thats the key thing and you point out the change of lifestyle, what you put into your body and also exercise, americans have got to exercise more. Maria no matter how much you exercise you cannot reverse a bad diet. If youre eating poorly dieting is important factor, exercise equally important, not only losing weight exercise helps but also sex life, cognitive abilities, exercise equally is important in my eyes. If youre trying to lose weight, most important things to cut out refined carbs like sugar, white breads, white pastas, processed foods, all of those contribute to eating more calories and calories are not nutritious, if you will keep eating those types of food expect to gain weight. Dagen i stopped eating bread this monday because i put on jeans and muffin top. Maria then you fall back and you have to go back, its hard. Yeah, its really about making the lifestyle change because instead of doing one of the shortcut that is is going to say, well, cut all the foods out maria thank you so much, we will be right back, stay with us. Maria welcome back. Good wednesday morning, everybody. Thanks so much for joining us. Im Maria Bartiromo. It is wednesday, december 11t december 11th. Your top stories right now, 7 0. Were putting a spotlight on the origins of the russia probe this morning. Michael horowitz testifies before the Senate Judiciary committee today. We will get insight into the findings on the fbi a abecauses abuses into the investigation as the house moves ahead on two articles of impeachment, looking to push it into the t senate by christmas. Big news on trade, House Democrats reaching a deal on usmca as expected, President Trump calling it a Silver Lining after the announcement of the art a kellarticles of impeachme. Mexico signing off on the deal. The senate may not take it up until after the impeachment trial, early january. Still deal with china. There could be still no deal with china. There could be a tariff truce. If you read Peter Navarros op ed on usmca and his commentary on china hes not expecting the president to lift the tariffs. Investors are wait on the Federal Reserve decisions today, the end of a two day meeting, what will jay powell say about the future and about Interest Rate cuts going forward. Dow futures are off of the lows, with the dow down 20 points, the nasdaq is up 12 andahalf points, the dow, nasdaq and s p 500 had their second day of losses yesterday following a day full of headlines from trade to impeachment. Dow industrials down 27, s p was down 3, nasdaq was lower by 5. Global markets look like this, the brexit drama continues. Its the final day of campaigning before the big vote in the u. K. The Prime Minister election tomorrow in the u. K. The fq100 is flat on the session, the cac is flat, down 1 point, dax index is higher by 40 points. Asian markets overnight were mostly higher on hopes that the u. S. Tariffs on goods from china will be delayed. That was one of the headlines from the wall street journal yesterday. But then it wa was knocked downy navarro in the white house. Time person of the year, President Trump and Speaker Nancy Pelosi making the short list along with the following, the whistleblower, hong kong protesters and climate activist, Greta Sundberg, among the short list for the time person of the year. Who will take the title for 2019 . Well tell you, coming up. All those stories coming up this wednesday morning. Joining me to break it down, fox business, Dagen Mcdowell, pollster, a author of persuasion, lee carter and don hpeebles. So much to talk about. Maria this is probably these next two weeks, most important two weeks for a year because youve got the ig report, testimony of horowitz today, weve got usmca, a china deadline coming up sunday. Fed meeting, election in the u. K. What else . What am i missing . Dagen thats enough. Thank you. Maria i think thats enough right there. Our top story right now is the impeachment and ig report, Inspector General Michael Horowitz is going to be testifying later this morning in the senate, one day after House Democrats announced two articles of impeachment against President Trump. The first order of business for members of congress is the solemn act to take an oath to protect and defend the constitution of the United States. He endangers our democracy and he endanger our National Security. Maria the president is hitting back at democrats. Heres what he said. Hello, pennsylvania. Hello. There are no crimes. Theyre impeaching me and there are no crimes. This has to be a first in history. Theyre impeaching me. You know why . Because they want to win an a election. We want biden. We want the son, hunter. We want hunter. We want schiff. We want to interview these people. We want them to testify in the senate where theyll get a fair trial. Maria joining us right now is former acting attorney general, matt whitaker. Thank you for being here. Glad to be here. Maria what did you make of that . The president seems to go dig in here. He wants a trial in the senate, he says, so that he can see people like adam schiff go under oath, hunter biden, joe biden, but Lindsey Graham has a different idea. He wants to get through with this pretty quickly. How do you see this playing out . Well, there is a little bit of a disagreement in the senate as to how theyre going to proceed with the trial. As as you know from watching it, Mitch Mcconnell will have a strong control of this process, hes not going to let it go out of control. At the same time, im certain that it will be a more fair process than we saw in the house and these vague articles of impeachment that suggest really that no crimes has been committed, that really theres a policy disagreement or at most just a dislike of the president , i think its going to the American People are going to see a much different process when it gets to the senate. Maria shes very upset about it, don. Nancy pelosi says its a very solemn day. I bet what struck me, it was very much of an aning job, acting job, i thought. Saying we dont want to do this but were doing this. I thought it was disingenuous. As a democrat, i was embarrassed. Maria do you think people see through it . I think sometimes the elites in washington dc dont understand that the American People are more sophisticated than they think and i think the American People see right through this. Every time i go back, really anywhere outside of the beltway here in washington, d. C. , like my home state of iowa, what the folks that talk to me want to talk about is not impeachment, it is things like trade, the usmca, the economy, schools, healthcare, Prescription Drug prices, all the kind of things that congress should be working on and insteads has been working on this impeachment. Maria dagen, they dont want to touch the economy because its a 50 year low in unemployment. They dont want to touch the economy, just had 266,000 jobs created last month. Dagen right. Wages for rank and file workers, for production workers, nonsupervisory workers growing faster than the overall average and income inequality is shrinking in the country. They virtually lost every narrative on how awful the trump economy is or how awful President Trump is. The narrative im starting to hear, its very carefully crafted, from a lot of democrats and their cronies in the media is that the only reason we we didnt go with bribery the in the articles of impeachment, we only went with these two items, the abuse of power and obstruction of congress because the American People, we want to keep it simple for you. Youre too stupid to understand anything complex. And i think that that is going to anger americans and voters even more, to be talked down to like that. I think the other thing theyre missing, i think theyre very much playing to their base, dont you believe . Maria yeah. Matt, go ahead. One of the things that ive been talking about a lot is the American People understand that in order to be impeached and removed from office a, which the articles call for is removal of this president from office, you need high crimes and misdemeanors, bribery, treason, as the constitution said. Nobody demonstrated what the crimes were, what the elements of those crimes were and what it appears to me is exactly what i had feared, which is that it is impeachment is whatever the majority of the house says it is and i think this is an incredibly dangerous precedent were going to regret as we move forward in a hyper partisan environment. Dagen the backdrop is the American People were lied to by the democrats, by members of the media, about the russia collusion conspiracy. And it was that ig report that despite the overall conclusion of it, as homer jenkins writes today, his shorthand version of the report is, here are 50 facts that can be explained by fbi incompetence or political bias. The American People were lied to about what was going on with collusion, they were lied to by the people in positions of power in Law Enforcement. Jim comey, you name it. They were trying to target a president ial campaign and when they couldnt prevent him from being elected, now theyre trying to push him out of offs a. People on the left and members of the media are in lockstep with this in pushing this fake conspiracy theory. Maria Everybody Knows for three years i sat here, this show sat here, saying this is not true. Dont believe the hype. And the media was incredible, driving the bus on this, which is why were all interested in this Senate Judiciary hearing today. Chairman Lindsey Graham joined me on sunday morning futures to tell us what hes going to ask Michael Horowitz about today. Watch this, matt. Youre going to have Michael Horowitz testify on wednesday. Have you seen the ig report . No, i havent. But dont judge it until he testifies. I think i have some understanding of what its all about but i havent seen it. Ive not wanted to see it. I think youre going to see the system off the rails. I think youre going to see members of the department of justice and the fbi taking the law in their own hands. That statement that comey made in the house in december 7th, 2018, that everything with the fisa warrant process was proper, to suggest otherwise would be crazy, is not going to withstand scrutiny. Maria what do you expect today and what do you say about dagens comments in terms of the media, driving the bus on all of this . Yeah, well, first of all, these ig reports i was at the department of justice when the 2016 election on the Hillary Clinton server was delivered by horowitz and now weve read this. These are almost impenetrateable for most folks. Nobody wants to read 600 page was an appendix. I think this is going to frame the issues. I think theres really sophisticated people on the Senate Judiciary committee including the chairman, theyre going to be able to really explain and tease out what this is about. Fundamentally, i think the key people in this are barr and durham and how theyre explaining it which is fundamentally the fbi and the leaders and the folks involved in this fisa warrant for carter page were going to get this warrant no matter what and the basis of the opening investigation was very thin, if not so thin, and i still have not heard anybody explain to me how andy mccabe put President Trump as a target of this investigation when jim comey was fired. I think that is incredibly dang. Maria there ar dangerous. Maria there are real implications to this. Everybody on both sides of the aisle shoul should be upset by e abuse of power. Carter page has a new op ed in the journal, titled fbi spying ruined my good name. He writes my experience should be a warning. After more than a year of around the clock surveillance under fisa warrants, ive never been charged with any crime. If senators dont demand answers, theyre practically inviting intelligence agencies to use surveillance powers to target domestic political opponents. As the Supreme Court warned, the price of lawful public dissent must not be a dread of unchecked surveillance power. These are people who had the tools to use the tools that we use on terrorists against their political enemy and Hillary Clinton paid for the dossier, all of these things werent even presented to the fisa court. Youre absolutely correct. Remember, a fisa warrant is obtained to surveil on somebody that is an agent of a foreign power, they thought carter page was an agent of a foreign you power. As he points out, theres been no case assembled to suggest that. As we look at the ig report, really quite the contrary. All the evidence suggested that george papadopoulos, carter page and others were not colluding with russians and thats what the Mueller Investigation showed as well. So i think this chapter of the fbi and these people that worked on this fisa warrant, the American People still went accountability and they want somebody to have to accept responsibility for these missteps and for really a very dark moment in the fbi history. Dagen members of the media will never accept responsibility for this because this actually, despite the abuse of the fisa court, the abuse of power, you had the wall street journal editoeditorial wrote about this. You had fusion gps disseminating a fake dossier paid for by Hillary Clinton and they leaked that to the press. Then they leaked the fbis use of that dossier to legitimize it to make it seem rule. That became part of the false collusion narrative that ultimately led to the Mueller Investigation. Again, russia collusion, this s all innerlinked and mark my words, members of the media who pushed the phony story will never, ever pay the price for it. Maria i watched cnn the other day. The hosts could not even question Andrew Mccabe properly. Why . Because they didnt know the story. They dont know who joseph miss fumisfud. They have no idea what took place. They never zeroed in to the truth. They went with their narrative. You know, maria, one of the things that maria real quick, matt. Whats really gross about this, cnn had analysts on the front lines of this problem with this fisa warrant, james backer, andy mccabe, theyre paid by cnn. Extraordinary. Maria good to see you. I found it surprising, 36 of people say they no longer feel joy when shopping. Yes, i think its a challenge because what theyve said is that our survey shows they believe poor service is going to be the norm rather than the exception. I think were disappointed in the type of Customer Service we receive. Maria whats the big takeaways . Even as people go more online, 75 of the people we spoke to said they prefer more Human Interaction than less. So i think what people are looking for are more meaningful interactions, more Customized Service and a little bit of surprise and delight. Thats hard to find. Dagen has anybody ever found joy in shopping for a car . Or a pickup truck . Maria now you can, if you do it online. Online, probably better. Dagen not if youre a woman. I used to hone my negotiating skills in my 20s by going out and buying cars. I like cars anyway. I would go buy cars you challenge yourself . When katrina and i were engaged and decorating our house, i said lets do n antiqs and persian rugs. I would negotiate for rugs. And then i would negotiate for cars. I learned the negotiating skills. The best ones are dealing with car dealers because of the angle they have. Now i buy my cars by talking to the owner of the dealership and im kind of collecting cars now. I think Customer Service when i go into a retailer on the trip to San Francisco, we went into target because my daughter wanted a couple sweatshirts because it was cold and they threw the stuff in the bag, they didnt make an effort to fold it so it was wearable later. The salespeople, we were in fort worth, texas, in an upscale boutique and they didnt fold the clothes. They kind of makeshift you threw them in the bag. Maria will that dictate whether or not you go back . Absolute. Maria what about that . What is this report going to do for ford in terms of coming up with new enhancements for the customer . Today there are so many name plates, body styles, packages, its incoupl incumbent on the salesperson to get to know you, what are your needs, what are you trying to accomplish, in terms of fuel economy, and so particularly with the electric vehicles, wire trying to change that up. Mine was a ford mustang. Are people getting more political about their purchase decisions . Seems likes theres a lot about how people feel about the issues that the company stand behind. Is that playing a factor and what are you guys doing about that . I think thats really important for customers. Price, quality, convenience, service, top of mind considerations. They want to know what are the virtues of the product and what are the values of the Company Behind it and increasingly customers are trying to understand where do you stand on these hot button social issues, whats important to you. You want to know when you buy or do service with a company that its a reflection of who you are and how you want the world to see you. The more transparent a brand can be about where they stand, the more likely people will feel a sense of loyalty and connection to the company. Thats the same with employees as welch i think employees today, younger employees want to work at a place theyre proud of, want the to work for a brand they think reflects greater values and so moneys not the only driving factor. Youre seeing that trickle l down to the Consumer Experience as well, money is still the top one or is price the determining factor or is it now about what the Company Stands for . Particularly with young people, they want to feel like theyre making a difference. They feel theyre connected and proud of what the organization stands for. Check out this video. It is a nonlethal device to take down a suspect. Weve got a live demo coming up in the next hour. First our top story this half hour, big tech crackdown, facebook executives telling attorney general william barr the company will not give lawens forcement access to its messaging systems ahead of next weeks Senate Hearing on encryption. The heads of whats app and Messenger Service saying in a better to b a arr, the back door access youre demanding for Law Enforcement would be a gift to criminals, hackers and repress ive regimes, creating a way to enter our systems and leave every person on our platforms more vulnerable to real life harm. Joining us now is judge andrew napolitano. This is an issue that has come up before, when the cops wanted access to the phone of the killer in california a couple years ago. They actually got an order from the federal judge, talking about this california case, requiring apple to give the pass code. But before the federal judge ruled, they went to an Israeli Tech Company which was able to get into the phone. Look maria there are back doors you could get into but they dont want to heres the law, im holding up my iphon. Iphone. If the government wants to get in here, they have to he show probable cause of crime, meaning something in here is evidence of a crime, then they can get a search warrant from the judge. Thats the way the law works. Thats not what the doj wants. The doj wants blanket back door access to everybodys iphone in the United States. That is a profound violation of the Fourth Amendment. The essence of which is the right to be left alone. Im not making this up. This what is the Supreme Court has said. So this is going to come to a clash before senator Lindsey Graham and the Senate Judiciary committee. Senator graham is very strongly on the side of Law Enforcement. There will be Civil Liberties groups there. There will be, i dont know who, somebody from facebook will be testifying. How will this play out . The government is not going to get access on its own. It may enact a statute and someone harmed by the statute will challenge it but the government is just not going to get access on its own because the constitution prohibits it. Dagen in the case of the San Bernardino terrorist and the fight between the Justice Department, the fbi, and apple, it wasnt the pass code. They they wanted apple to write software to essentially rewrite the software to give the fbi access to that phone because it didnt have the pass code. Number one. Number two, in most of these cases with information on the iphone, that data will be on the cloud and so a regular court order, a search warrant would allow the government to get access to that information. Its information had that lives on that phone that Law Enforcement, whether its local or federal, will never ever have access to it. Theres no way to get into that phone, not even for apple to get in that phone, they say. The purpose of the Fourth Amendment is to prohibit a general warrant, a general warrant is one that lets the bearer gather whatever he can find and seize whatever he wishes. The Fourth Amendment requires particularity of what the doj wants and attorney general barr went through this with jerry baker yesterday, in the interview they had, most of which was on the horowitz report but they touched on this as well. Attornewell. It is profoundly overreaching and utterly inconsistent with the Supreme Court opinions on the Fourth Amendment as we understand them today. Maria he said that the probe of big tech ending in an interview with wall street journal, lets take that sound bite so we hear what he said. Watch this. Are you expecting any kind of imminent resolution, can we expect it some Time Next Year . Id like to have it completedded someTime Next Year. I think its important to move quickly on things. Thats something i can talk about later. But these things have a cost to the marketplace and the businesses and i think at some point the government has to fish or cut bait. Heres what the government is doing. The government is conducting this enormous antitrust interview of big tech and with the sword hanging over their head, because if they do charge antitrust violations youre talking about 10 years of litigation. They demand access to everybodys iphone. Is that going to be the resolution of the antitrust investigation . That is profoundly unfair for the government to do that thats what theyre going to try to get away with. When the facebook people wrote the letter and said no, we learned theres still backbone in the country. Maria if youre an investigator, theres no way to get to that phone . There is. But the government doesnt want to admit it. Maria thats what im saying. Thats exactly what i was saying. It has every case stroke and every word. Its calmed the nsa. Even jim comey maria if you need it, they can get it. Dont mess with my privacy. The nsa would have toed a mitt they have it but they will never do that. Dagen the issue is for local and state Law Enforcement, if theyre investigating somebody who committed child abuse or who has child porn offinography on a device, they cant get access to it if its living on this device. They cant get into it. I know the Manhattan District Attorney talked about this very thing. Maria hes been on this show. Thank you so much. Cheryl casone on headlines now. Cheryl wework is working to sell off a company that it only acquired about eight months ago. That company they want to sell is called managed by q. They offer Technology Management and services. Theyre hoping to sell it to a group of investors that includes the former owner, according to sources. Wework is hoping to raise cash, refocus the Main Business after a turbulent few months. Weworks cofounder, adam newman, at the center of a verbal attack yesterday. His name came up during a Senate Hearing with the chairman of the securities and exchange commission. Tom cotton asked if the company and newman would be investigated before taking him to task over his leadership. Watch. People like adam knew man and what he did to newman and what he did to wework is the reason people in america are open to socialism. Cheryl newman wasnt there. Wework tried to distance themselves from yo newman sincee was ousted. They did as we reported several times lay off a huge number of employees and the scrapped ipo at one point had the Company Valued at astronomical numbers. Maria part of it was adam newman boosting the company. Whats your take. Ic i i think it was a lot e flowing capital. At the end of the day he had a ben fact r tor factor that mades investments. Softbank made restless investments in the company. He is one heck of a salesman. Maria exactly. You must have run into wework a lot in the real estate business. Absolutely. Who do you think the time person of the year is . Dagen i know who it is. Maria drum roll. Teen climate activist Greta Sundberg named Time Magazines 2019 person of the year. Yes. Exactly. Okay. Im not surprised, actually, that thats who they chose. Maria really. Made a huge impact on the next generation. Changed the dialogue so much this year. Im thankful its her on not the whistleblower. Maria the whistleblower would have been ridi ridiculous. In my view, it should have been President Trump. Hes moving the needle on the economy. Hes probably the most talked about person. Hes not politically correct. The reality is, its playing to a narrative i mean, is time really relevant . Again, they are the magazine is indicative of kind of the slate of candidates right now. I mean, i havent picked up a Time Magazine in a long time. Probably theres some people out there that will say im not wellread enough. I read seven newspapers every day. Dagen shes a great pick in this sense, for the voice and face of the climate fighting Climate Change, that movement. Because of her age, it makes her unassailable. You cant criticize her without being accused of picking on a child. Weve seen that time and time again. How dare people, including sundberg, lecture the American People about their use of fossil fuels when were leading the world in reducing carbon emissions. Were back as a nation to where we were in the mid 80s in terms of our carbon output. Secondly, when you take away fossil fuels and engines that internal combustion engines were using today are much better than even 10 years ago. When you take away fossil fuels from individuals, you are hurting the poorest of the poor. So you hate poor people if you are in favor of getting rid of alls fossil fuels. You are against lifting people out of poverty and thats the narrative that i think youll be hearing more of. But again, greta, an easy pick. Shes a young woman and you cant criticize her. She did have a big impact. I have a 17yearold daughter. She is sensitive to climate issues. But i dont think shes understands completely why yet because its been taught to her because of the influencers that are she mobileized on a huge scale. Maria we want to take a short break because weve got pan pans in the studio. Were launching a fast casual spinoff brand that will open next spring. Maria what kind of market are you looking at here . I think its a huge business opportunity. Weve got cities all across america. We did a lot of research on this. And a lot of people, what they told us when we asked them, they would go get their Morning Coffee and theyre almost settling for substandard Food Products at those places they go to. So we think were going to provide a great quality food and were going to be food forward instead of coffee forward. Maria dagen, can you jump in here. As you do, pass me the syrup, please. Dagen who are you taking a shot at, to that point . Is it Dunkin Donuts who you see as the biggest competitor on this . I dont think its one competitor in particular. Shanghai composite up a quarter of one percent, the hang seng in hong kong up threequarters of a percent those coming up wednesday morning to break it down, author of persuasion lee carter here fox Business News Dagen Mcdowell chairman ceo don peeples great to see you. Thanks for being here happy to have you back to talk about state of the economy real estate today. Absolutely good to be here. And we have real estate a good outlook outside new york city i think new york city Residential Market will continue to plunge in part because of mass exodus high income earners entrepreneurs out of the state of new york the beneficiaries florida texas nevada i mean nevada is going to do very well attractings people out of california, another high taxing environment, tennessee a hot market, as is North Carolina i think charlotte new jersey going to North Carolina going to continue to grow money is mobile goes where treated best. Dagen where jobs are being created, that is where quite frankly, that is where people want to live because quality of life so much better. You are right quality of life a very big driver that is pushing people out of new york city, and cost of living, and taxes, also, a business friendly environment that is what people entrepreneurs are seeking more business friendly environment clearly, new york city has become an unfriendly environment for businesses and entrepreneurs. Not looking good with homelessness issue we are talking about that more top story impeachment ig report Inspector General horowitz going to testify this morning, just one day after House Democrats announced two articles of impeachment against President Trump. The first order of business for members of congress is the solemn act to take oath to protect and defend the constitution of the United States. Endanger or democracy, National Security. President hit back last neutral night rally in pennsylvania. There were no bribes they are intreechg me there are no crimes this has to be a first in history impeaching me you know why they want to win an election. Maria joining me right now first on fox interview senate jea Member Senate finance Member Senate grishl member iowa senator Chuck Grassley thanks so much for being here. Thank you. We have a lot to talk about this morning want to get right to it first talk about what a Senate Impeachment trial will look like, what are your expectations sir . Well, when a we dont know is length, clinton was five weeks we dont happen to think this would be that long and it could be very short, but the ve least listen to prosecutors come over as members of the house of representatives to present the articles of impeachment, and the reason the president should be found guilty, and then we listen i dont know how long that takes maybe a few days then a few days to listen to the president s lawyers in defense. And then what goes on beyond that, i dont have any way of telling you. But the whole month of january, is set aside, for business that in all reality under the rules of the Senate Nothing else can go on when you are sitting as jurors, under impeachment. A host of those senators dont want to be in that room because they want toll to Iowa Caucuses we should point out right . Sometimes we wonder if that might not shorten it a little bit. There i go i spoke with your colleague senator Lindsey Graham this weekend on sunday morning futures, he said he wants to get this over with, as quickly as possible, sir, i got to ask you my view is one of accountability, and they want to see some of these people questioned because they dont believe adam schiff, Senate Republicans preparing to skip calling any witnesses in an impeachment trial. Why . Why arent you calling adam schiff, hunter biden, joe biden the whistleblower, what is the problem . Well, i think the the main reason is that we want to make sure that there is a fair hearing, on the articles of impeachment, the extent to which there is a chance that it wouldnt be close, and making a decision in other words, not very close to getting twothirds vote, maybe not even getting a majority vote. Why would you spend a lot of time when were getting very little legislation done, why do we want to waist a lot of time . Now, the point being that if a lot of things that need to be brought occupy, are not brought out because we dont call those people in, that could be more of a Public Relations issue. Maria okay. Than a constitutional issue. I understand, look you want to get business done, and you want to get business done, your entire career, and what strikes me you got so much going on this weeks, from the ig the testimony today of Michael Horowitz to the impeachment, none of it has anything to do with peoples business that is why we are getting to usmca in a minute we will talk about that coming up but sir, my view you you viewers the followed this story in terms of the cabal of individuals top of fbi and cia tried to put finger on scale take donald trump down they are wondering why chairman graham has not called people down to testify, weve got this dwrafk here web of entrapment we look at all of the informants that ran o into people like carter page george faupapadopoulos bil barr says makes it clear gi launched intrusive investigation of president ial campaign on thinist of spushgz insufficient to justifysteps taken looking at the wep of entrapment i know on your web site you have all the money that stephan was paid more than a Million Dollars over a year to supposedly write reports on china and russia when in fact it sounds like he was an informant trying to trip up Campaign Staffers of the Trump Administration sir. Well, if all of that came out, first of all, let me answer your first issue will this be just horowitz nothing else . I cant speak for chairman graham but i believe that he is going to have several other hearings involving other people to get more facts out in the ground, then in regard to halper whether it was papadopoulos or whether it was carter page or whoever you might say, all lower level people werent middle of the Trump Campaign but used as excuse, to get court orders, so that they could spy on the Trump Campaign, and the Trump Campaign was spied on, and the issue here isnt just spying on the Trump Campaign, the issue is that there is a lot of Constitutional Rights that were compromised to get reasons from the court to spy on the Trump Campaign. And if it could happen to trump it could happen to you maria, correspond anybody else in america, there are Civil Liberties are potentially violated because of the fbi having political opposition, at least the leaders of the fbi having political opposition to the president and want to go keep him from being president even after he became president finding ways to get him thrown out of office. Absolutely right i am outraged by adam schiff getting peoples phone records and sending them to the public whether Rudy Giuliani journalist john solomon, whether it is devin nunes, so that public can speculate why did he call Rudy Giuliani why devin nunes calling white house as something nefarious there are you going to suspect records will chairman take this issue up given the fact there was a major breach of privacy when adam schiff put all those phone records into public square. Not only maybe a hearing but that is going to be decision by chairman graham. Whether that will happen, i dont know. Maria you are going to take chairmanship next round . Yes, i am, if were in majority i will be chairman of the judiciary. So but right now. As chairman you will have gavel. Yes i know two years from now how much of this stuff will be relevant. Maria okay. Anyway, the issue is should a member of congress be able to get all these records without the protection ofs Constitutional Rights . And maybe we have to change the laws. To do that. Maria yes, yes okay. We will watch that sir counting on you for justice here, lets turn to the big news of the day, that is usmca. House Speaker Nancy Pelosi announced that House Democrats have in fact reached a deal with Trump Administration on trade agreement later in the day signed by officials from canada, mexico the senates might not take this up until after impeachment trial is that right . When are you expendiexpecting t up . According to the leader, that is the indication i got, because of the impeachment, and because of the holidays coming up i made a speech a week ago monday that if it dnlt get done by last friday we wouldnt be able to get it done this year my prediction has actually come goupth to get through house of representatives, that is the most important thing to get confidence in the people that eventually going to become law we have a new treat that is very good treaty with mexico and canada replacing nafta very good for manufacturing, very good for service, it is very, very good for agriculture, and also, there is a lot of things that are covered in it that a werent even negotiable because they didnt even exist data trade things like that, 25 years ago, when we first started out with nafta. Maria yeah, you know, what is so different a year later, because the president signed this with the cosigners mexico and canada a year ago, in 2018, nancy pelosi said what was firsthanded to off to democrats was nonstarter, she said she changed whole thing please explain. First of all, founded months of president having having tariffs on steel and aluminum with members and canadaed he had held up canada, mexico moving ahead we wont be able to move ahead here. By may finally got president talked out of tariffs so we can cognitive to congress of the United States, then once starting in july, there were negotiations with democrats and house of representatives, theyp werent satisfied that had to be negotiated over the last five months it was up and down, but eventually it was announced yesterday and you also when you make changes in it you have to work with mexico and canada. Maria of course. For them to accept those we finally got. It president a said a no do you think this passes . The president s desk for signage. Yeah as soon as we get done with impeachment will pass senate easier than it passes house of representatives. Why wait till after impeachment sir . Because of what we have to do. This we can next week, before the holidays to get the governments business down so you dont shut down government, and then impeachment which we have no control over house has not passed next week we have to take up under rules of the senate it cant nothing else can interfere with it so you cant take it up until after that now if we want to be here december 25, 26, 27, 28 key could probably get it done. Why should you spend christmas in washington come on you deserve a Christmas Holiday with your family, but none of the 12 Appropriations Bills have been enacted if not passed by next thursday result full Government Shutdown are we going to have a Government Shutdown sir . One of two ways we wont have a Government Shutdown one we he either have gigantic compromise at end to fund gocht through september 30 or we are going to have a continuing resolution will take us over to february. Either way government wont be shut down, in 35 days lake it was a year ago. That is good news, for sure. All right let me get you another trade deal sir because the u. S. Stands ready to slap china with another round of triz sunday two sides working to reach phase one trade deal but there are so many reports about tariffs being delayed, the white house trade advisory inactive rov side not so fast listen to him. It is president s decision i have got no indication that he is going to do anything other than have a great deal to put tariffs on. What do you want to see here senator in terms of china and United States . Conversation i had monday that i wont say who it was with, but i dont did not deal with tariffs but it would tell me that tariffs will not be imposed december 15 that we could possibly be close to agreement with china, beyond that, there is i dont i dont have much more information than that but it was also a very much a positive conversation, about reaching a phase one agreement with china. Maria i guess the i biggir issue here a debate over values isnt it senator we are a democracy, communists they have been stealing intellectual property for decades we want the rule of law. How do you do a partnership when you have got such different values between two countries, do you really think we are going to do anything more than a skinny deal something that just involves buying more agriculture by the chinese, and getting a little more access into 1. 4 billion population in for american companies. We get phase won in this trump four years, then if he is reelected we will get a followon agreement. Chinas economy is hurting, more than ours, and ours is very, very good nap ought to scare china that weve got a lot of staying o power they dont have we will get further agreements will we get everything we want . I think difficult to say we get everything we want. But remember was broke up in may last year because we want china to change laws we dont have to change our laws it is very important that they change their laws, so that when we go there, we have the rule of law, on international trade, just like we do particularly protecting intellectual property, trade secrets. Absolutely before you go final question here on usmca. You just said the economy is good what is usmca do for the economy tell me the impact that this is going to have. 34 billion dollars of investment in in automobile manufacturing, 174 million new jobs, getting dairy into canada that weve nafta would not allow that getting our best into canada having 50 of cars manufactured in United States, or manufactured in north america paying at least 16 dollars an hour instead of 3 dollars an hour in mexico. And 75 of the content of automobile being about have domestic content. Right made in north america. Great, senator good do you have you we so appreciate your time. Thank you very much. Thank you. And that were we could possibly be close to an agreement with china, beyond that, there is i dont have much more information, than that but it was all, very much a positive conversation, about reaching a phase one agreement with china opinion. Yesterday Peter Navarro told fox biggest he has no indication the president is going to take tariffs off the plans are that tariffs go o into effect sunday 15th is the decline. Dagen it is. Maria had a conversation. Dagen if you work in the white house you have to be careful what you say that you dont step on president s message. I think that it is into the benefit of all the American People, and also, to the president s reElection Campaign if you dont put these these tariffs in place, this weekend, because again you want the economy to keep chugging along, this these are tariff would directly hit consumer we see Consumer Prices up a little bit hotter, than people were expecting, you dont want this to happen just from a political standpoint, if you are going into reelection given how Strong Economy is. To build on that the index said number one indicator of Market Movement was when president talked about china i think he nose that where numbers coming no has to do something. Ubs u. S. Senator grassley about Economic Impact of the trade deal. 34 billion dollars, of investment in automobile manufacturing, 174 million new jobs, getting dairy into canada that weve nafta would not allow that, getting our best into canada having 50 of cars manufactured in the United States, or manufactured in north america paying at least 16 dollars an hour instead of 3 dollars an hour in mexico, and 75 , of the content of automobile of being domestic content. A lot of news in that interview that is the key story of the day, that they are going to get usmca passed. I am surprised market around the up big on this. Doesnt make sense to me it is a big win for the president big win for American People the wall street journal has a great piece talks about benefits going to get the jobs created, agriculture, differences, in pharmaceuticals all things that are impacted by this, automobiles, it is goings to impact a lot of those states that are so important to the president , too when you think pennsylvania, wisconsin michigan ohio. 00,000 jobs created as a result of usmca, by the way, you are referring to in terms of biologics, companies have patents when they introduce create jobs. Right now that patent will stay in place 10 years, under this new usmca, companies will be allowed to have that patent for 8 years, meaning after 8 years generics can come in, with competing jobs, going to be much lower in price, that was the point of that. Lets get to the economy because there is a dmoou fidelity study showso showing millionaires low view of the economy confidence rate zipping to level not seen since before Great Recession blackrock said days of extraordinary market returns are over, why are millionaires down on things. Frankly because weve had a very good run, the economy, has hood incredible run, i mean after we came out of financial crisis think about, the run weve had in especially he last three years i think a view some come to an end we are going into a down cycle and many of these people are in new york, and california. And those two economies he locally are turning into a negative direction, especially new york, so i think anyone in new york city has more pessimistic view kind of clouding the thoughts a bit i think you asked most new york city think Real Estate Market going down economy going down taxes going up quality of life going down, that is hard to say but that is a rosy picture for Economic Growth . Know more big market returns. I dont think i got to add twoments on that i dont think that is true. I dont either i think there is a good run coming ahead because good news, i mean and more good news outs there, potentially, i mean in terms of china other things i think we could have a good 2020, even better. Dagen millionaires see themselves as enemy of the left the enemy of the media if there is a problem, it is going to get blamed on you, if you if youf got seven figures in the bank number one number two left wing cities cities across the country people get wrapped up in bubbles you have to go out in rest of the country see prosper people are feeling. Bernie sanders said there should be no billionaires. More billionaires in xhooirn than america a fact should we send all to china europe have everybody else no billionaires. When billionaires move coming for your money even if a lowly he mirn air i say in jest. The way people view American Dream not just Safety Security of family, jobs, and the may gos the nation is i want to make more money however any individual family defines success, i just want the foundation to go out and live my dream and maybe build a business maybe god forbid be a millionaire. The opportunity. Only 17 of the democrats are buying into what sanders is says in the first place mostly people not going to go out even vote. People who are stopping moderates are people in charge how come tim ryan couldnt get past go what the check happened to Howard Schultz moderates knocked off the Playing Field because they are note left enough they dont have these ideas. That is because of the media. And these attacks by the Party Loyalties attacking any new ideas there he has not been one voter spoken in president politics not one voter let voters speak i think we are going to see very different when voters start speaking tellingr telling candidates what they want to hear like i think they will be surprised. A great year 2020 bring it on, so interesting, but first taking a break when we come back that is a wrap a new taser Like Technology uses 8 foolt long rope to trap target and stopping threats in tracks how Police Departments across the country are deploying this new technology, dont forget ask maria i am answering your questions Instagram Twitter at Maria Bartiromo let me know what you want to hear. On show this morning bulls on economy bulls on stock market all good. Particularly after usmca news see you 10 minutes thank you so much Varney Company begins top of the hour nine a. M. Earn we go back to usmca right now because the provision oi biologics important we want to clarify that maker we understand what has make sure we understand what changed in terms of amount of a time a company with an market their product inclusively. Dagen this is dealing with biosimilar drugs made in living cells, the push was for there to be a 10 year exclusivity period, where the biologics would be have exclusive marketing across canada United States mexico 10 years, that provision of was dropped. In the final bill. And the pharmaceutical companies were very upset about it because again biologics biosims highest cost jobs mike immunoas you pressants still protects not like patent disappearing each nation has rules to cover periods of exclusivity for these drugs if that makes sense but that 10 year protection, that was in the bill, that was one of the things that got dropped, in the final usmca, that the democrats came up with. I digress, 52 ptdz across country have got training 700 more want demonstrations what are Police Officers saying what do we need to know looking fore this everything on belt uses some form of premobilization pain compliance pepper spray if we can get this where they dont use pain stop that situation early lapd Just Announced yesterday we wrapped chief for demonstration looking for technology to not hurt people especially in crisis that there is a lot of strain right now between Law Enforcement and communities, looking for Something Like this that doesnt hurt them feedback able to end situations safely. It wraps around legs making them im mobileized. Once you push button shoots out cord 500 feet per connect wraps around arm legacy super fast blink of an eye. Do they stay immobilized. Hooks wraps around to grab clothing then it is kind of like batman spiderman things people referenced to, to stop somebody again not anything in body not hurting suspect deterring a lot of uses in fort worth california, being used more and more internationally as well Law Enforcement world over already 16 countries. It is number 10 if it hits bare skin going in a lot have these covered i have done it a fair number of times at the end of the day you have got to compare the risk so we are reducing exposure getting hurt to try to end that situation before it escalates to higher level. Perfect timing for the president , right after the impeachment announcement and right after Speaker Pelosi tried to take credit for usmca, the president opened his rally in hershey, pennsylvania. He did not hold back. In a battleground state, the president talked up the booming economy and poured scorn on impeachment. Political madness he called it. He contrasted d. C. Beltway politics with mainstream prosperity. You will hear a lot more of what he had to say shortly. And now make way for the bulls because they are on
