It is a wellestablished immunity, paul, dates back to 1971, an opinion written by william republica renquist, been reaffirmed in nine administrations and both parties, fully case law. Ittheres a group of people tht see the president every day, he communicates with them, the 1971 opinion says the president is a coequal branch, he cannot command that members of congress appear before him. They cannot command he appears before them. I want to emphasize one more point. The reason the president has a strong position, theres another form of absolute immunity based upon 1989 opinion, he went on to be a chief judge in the fourth circuit. That stands for the proposition that National Security information, no matter in whose hands it is, cannot be shared in a compulsory fashion based on something more venerable than 1989. We have two ill communitie twog together. Paul does any of this change, the immunity change because its part of an impeachment probe, which is a core power of the u. S. House . Its an interesting question, never been litigated this way. I would like to think that even though its impeachment power, impeachment does not reshuffle the separation of powers, both of the immunities are anchored in the president s status as a head of a cured ne cured net br coordinate branch. I dont think so. The house lawyers are not very sure of their position, its been a surprising thing where they withdrew the subpoena directed at mr. Cuppermaperman, boltons deputy, they then p went on their own to the judge and District Court and asked the judge to dismiss the case. Doesnt sound like they want to litigate this matter. Paul thats what i want to press. Judge richard leon basically threw them out of the court as i understand it and said sorry. Does this mean hes going to rule on this . I believe if the case would go forward, i think he would rule on it. Among other reasons, the letter that was sent to mr. Cuppermans lawyer, chuck cooper, basically indicated were with drawin drae subpoena now, but well resubmit it. If its going to come up again, might as well do it now. My fear is that the democrats are not serious about litigating this, knowing, am, they might lose, b, its going to take a long time. Theyre going to stick an article of impeachment, accusing the president of obstruction. Paul if thats the case, if they drop the subpoena toss hav subpoenas to have people appear, either time or they think theyll lose, how can you have an article of impeachment saying the president obstructed if you havent litigated the issue. Excellent question. In my opinion, the answer is no. I heard a statement from House Democrats indicating that the mere fact that President Trump ordered mem people not to testis evidence of obstruction. Appalling. Theres another set of memos that stand for they say it can never be bad or unlawful conduct. Paul lets turn to the new york tax case where the District Attorney in new york subpoenaed the president s accountants for the president s tax returns, president has resisted that claiming he has immunity from investigation for private acts before he took office. The Second Circuit court of appeals this week said he has to turn those over. The president is going to appeal. How strong is the president s case here on this tax case . More difficult case, paul. Let me say a couple of things. First of all, its a carefully written opinion, unanimous opinion, Second Circuit pointing out that the sitting president cannot be indicted but can be investigated like mueller investigated him. Whats the big deal about investigation . A couple things. First of all, it is investigation, i hate to be formalistic by state. Theres less federal control if any over the possibility had that the documents would leak, the testimony of accountants might leak. Its not obvious whats the rush. Does anybody believe who is listening to us now that this investigation is not about its really an investigation into some tax return matters, this is not an investigation to get trump. What were learning why the t sitting president cannot be indicted. Is it something that impedes the president s ability to function. I think we have to accept that in the current environment it does. Therefore, theres a famous paula jones case where the Court Allowed the Supreme Court a allowed the civil case to proceed against president clinton. The problem is, a lot of this is not popular in the democratic paul with the democratic party. Bloomberg is thinking of getting in here because he doesnt think the other candidates are up to beating trump or he fears theyre not. Do you agree with that or is that just a rational to get in . I think thats a real worry. I think that a lot of mainstream democrats have voiced that, particularly with Elizabeth Warrens medicare for all plan that shes released now. A lot of them have said, even Hillary Clinton is saying i dont know that that can get passed. The question i think for bloomberg is why is his response to that getting in. If he thinks that the mainstream candidates who are already in the race are not doing good enough, he could take Amy Klobuchars finance director doortodoor and raise money. He could create a billion dollar super pac. Paul have you met Mike Bloomberg . He always thought he would be a great president. Only i can fix it, thats maybe his thought there. Paul kim, i want to talk about the executive point. Bill brought up his record as mayor. He does have executive experience, far more executive experience than anybody else in the democratic field. And in that sense he would match up pretty well if he could get the nomination with donald trump. Well, and thats right. Look, bloomberg is right, there are some real concerns about this field. Hes concerned that joe biden who is supposedly the centrist candidate now is struggling to raise money. I think theres very legitimate fears within the party that an Elizabeth Warren or Bernie Sanders are simply too progressive to be elected. So he comes in and hes got the money and the wherewithal. Hes also feistier i think than some of the people in the field. The real question, it goes back to what bill said, is can he actually get through the primary contest. And i think hes got just as many marks against him in materials of doing that as he does things going for him. Paul well, and on that point, bill, you think the democrats dont mind when billionaires are funding their candidates, but already youre seeing the criticism from the warren camp and others saying we dont let another billionaire buy the election. And so the billionaire status, remember, he built bloomberg, a highly Successful Company that made him very, very rich in a at filled a need but its a double edged sword with democrats. A lot of democrats dont really like the private sector. Right. Well, look, i think there is a niche that needs to be filled because its hard for working class joe biden to support billionaires but if you look at the comments by jamie dimon, saying theyre trying to Elizabeth Warren wants to punish people who are successful. As you sort of allude to, i dont think Mike Bloomberg would be shy about his achievements and his [ laughter ] and his success. Its notice surprising that Mike Bloomberg feels that no one else measures up quite to Mike Bloomberg. It will make for an interesting debate. But i think there is an opening in the democratic party. Yoke this person i dont think this person can win, to say we dont want to punish success. First is the new taxes. There will be a medicare employer contribution, essentially that seems like a per head tax per employee. Thats supposed to raise about 9 trillion over 10 years. Paul thats a tax on anybody who works for a big company that now provides health care and that would be middles class. Right. Exactly. Theres also shes talking about raising the Corporate Income tax back to 35 . Applying it as a global minimum so if you make some profits in a jurisdiction where the rate is lower you would pay the difference. The second group is sort of waving away costs, administrative costs will be lower she says. Were going to pay doctors at medicare rates which some analysts say is about 25 less. Paul 110 of medicare. Hospitals will get 110 paul right. Thats 25 less than private insurance pays right now. She says were going to really slow the growth of medical spending and if it doesnt hit 3. 9 theres going to be automatic rate reductions, who knows what that means. And so analysts have looked at this, say theres waving around and assuming that costs will go down without really explaining how its going to what and how its going to happen without hurting Peoples Health care. Paul shes has a fallback in there. She says if nub of this works to add up to the way i hope it will then were going to impose global budgets and essentially y rationing. Paul s kim, whats fascinatig about the political reaction to this is most of its been negative, not just from us who are free market types, but a lot of democrats. They have really hit this very, very hard, not just competitors but people on capitol hill, nancy pelosi, without mentioning Elizabeth Warren, suggested that medicare for all isnt what she would support and a lot of senate democrats. Did warren make a mistake in being so specific about all of these details . Yeah, its a huge mistake. Because i think what youve seen happen here, paul, over the last couple of months since the start of these debates is democrats stepped back from the Health Care Cliff and said whoa, we have hundreds of millions of americans who like their private insurance. This is not a good political position for us. And we dont want to be on the medicare for all train. So bernie and Elizabeth Warren have been out there continuing to do it. But by being so specific, Elizabeth Warren has put in stark relief just how high that cliff is because its not just a question of taking away all of this private insurance which would be unpopular. Now we see what it potentially does to corporations and to the economy and it is a tax on the middle class and those are all things that even progressive democrats understand could be a bridge too far. Paul i guess, kyle, though, her response would be, look, im honest. Im going to tell you that im going to fight for this and if we dont fight for this were not going to get anything and all you guys who are shying away from this, you lack the courage of your convictions. Elect me, i may not get all of it but ill fight for as much as i can get. I dont think that really plays. She was saying the only people that will pay more taxes under this plan is billionaires, with a b. Democrats are saying this is going to raise taxes on a whole host of people. It opens up a rich vein of attack, trump could do it on, what this would do to the health care system. She says were going to cut the prices of brand name prescription drugs by 70 . Third november in a row as i look at it where republicans lost more of the big elections than they won. Whats going on . Theres a mixed bag on election day. We were ph my firm was workig with the attorney general in kentucky and below the governor all the statewide offices went republican. I was also doing the lieutenant governors race in mississippi where for the first time in the history of state we have every statewide elected office in the state. So virginia was not necessarily good news. But it was a very close election going into it. We only if they gained one seat in the house, one seat in the senate, they were going to get control of those two bodies and the governor in kentucky had one of the lowest job Approval Ratings in the country of any of the governors. So he had his own problems even beyond what were seeing with the republicans overall. I think the big surprise that im seeing in the data right now, we just did a Georgetown University battleground poll and saw the intensity of the voters. 15 points higher than what we usually get at this period of time and it was across the board. Republicans, democrats, and independents. Paul i want to focus on that turnout because that intensity led to really increased turnout in kentucky, up 50 from four years ago. Matt bevin got Something Like 180 or 90,000 more votes than he got four years ago but the democrat got 300,000 more votes which is extraordinary in an offyear election like this. This suggests to me that democrats are really on fire to come out and vote. And that is normal for what we always see in an election going into an election is whatever the outparty is, usually thats where the intensity is. But we also have the intensity of republicans and the big surprise, theres three groups. One is independents, one is minorities and the other is the out party, all being equally intense to the democrats, being the out party always having that intensity. Paul let me ask about another trend that weve been seeing for i think he three elections in a row which is that some erosion in the suburbs for the republican party. Its not just in virginia, its not just washington, d. C. Suburbs anymore, its the richmond suburbs, hampton roads, if you look at the philadelphia suburbs, republicans got their clock cleaned in local elections. This is a trend were seeing in a lot of places, kentucky, louisville, lexington. How big a problem is that for republicans and whats causing it . Well, it is a problem and were looking at the gender gap being the worst weve ever seen as a party. Now, ive always been a big believer that the gender gap is more of a racial gap and a married gap but thats where you see a great example, where white married women that we usually win by 20 points in the National Election were actually trailing at this point by 4 or 5 points. Paul wow. Theyre a group that many of them did not participate in 2016. They began identifying more as independents than republicans and came out and voted in 2018 and voted very, very democrat. Paul well, that suggests to me, ed, that this is partly a reaction to President Trump and the tone of his campaign and our poll, the president s Approval Rating among College Educated women, white women, was 34 in the recent poll. Thats really, really bad for the president. And the reason why again, where i talked about it being a married gap as opposed to a gender gap, the reason why i dont focus so much on College Educated women is thats where youre looking at a higher incidence of single women, more specifically looking at those married women and youre very right, its a reaction to the president s persona and its really a message we had in our survey to the president that the same women that hes losing with and has lost support of, when you ask them job approval on the economy, on jobs, on taxes, hes in the high 50s, low 60s. With that very same group of women. So the key is a little bit less of the personality that theyre not responding well to, and a lot more talking about the economy that some days you see the president doing, other days he seems to fall into the trap of his persona. Paul step back a bit. Were a year out from the 2020 election, how well is the president positioned for reelection in your view . Its tough. Obviously, youre going to look at states that he won somewhat surprisingly to some people, but wisconsin, pennsylvania, north carolina, ohio, florida, all of those states are very, very key to him and right now he is upside down in all of those states except for florida against a generic democrat. Now, thats looking at the best case for the democrats. But if you look at why he is trailing right now against some of the candidates like biden, he is upside down by somewhere between 11 12 and 15 points. Even in those states hes upside down. Thats where he has to fight back. Where hes really facing this is where youll see change over the next year. Not his job approval but his favorability has not changed the entire administration, the entire three years. He has remained at a 55, 56 , not only disapprove or unfavorable, its strongly unfavorable. But thats where youre going to see him with the ability to drive up the opponent and we may be facing a campaign much like 2016 where a large portion of or segment of the electorate dislike both candidates, both President Trump and the democratic nominee. But i think that what President Trump is missing here, what needs a lot more attention is the intelligence as expected off this. Aspect of this. President trump seems to be saying wipe this off the face of the earth. It sounds like a military action. Mexico worked on verying intelligence to try to find out who the people are and root them out. Thats why the president in colombia was successful. He had a good intelligence operation. What happened under the former president of mexico is that those Intelligence Units were used to spy on political adversaries and so when the new president came in, he said im going to get rid of that intelligence operation. Im going to develop a new one. And i think one of the reasons why youre seeing this spike is that the new Intelligence Group that he has put together isnt really being effective and i think thats maybe a place where the u. S. Could help because i think intel is going to be as much or more important than actually guns going against these groups. Paul ultimately, if you want to reduce the huge money that flows through the cartels, have you to reduce the demand for drugs. You and i might disagree on legalization. What we agree on if you chase supply enforcement, its not going to work unless you reduce demand for drugs. Legalization would say that then the money wouldnt be going into the pockets of criminals. That wouldnt change the demand. It would change it would go to legal organizations that you could tax. The idea that were going to reduce demand after sort of 70 years, some people are sort of giving up on that. I dont know if its possible or not. I think what we can agree on is that the Drug Trafficking organizations in controlling these areas and we had a store ily in the journal just on friday, talking about how people who live in these areas say, yes, the Drug Trafficking organizations are the government in these areas and a democracy cannot allow that. So every mexican president , whether he wants to fight the war on drugs or not, has a responsibility to basically reestablish the presence of the state in these places by basically making the drug cartels obey the laws of tax collection, the government has to be the Legal Authority and once thats ceded to the drug cartels, the countrys gone. They seemed to have done a similar thing at lorel lori lous house. She wasnt there. She was filming and she surrendered herself. I think its overreach. Everyone wants her to go to jail and someone should say maybe thats enough. Im not saying dont punish her. You can give her a big fine, community service. First time nonviolent offender, the itch to throw her in jail i just dont see. Paul allysia, is the problem assuming you agree with bill, and i dont know that you do, is the problem here the law and the way the prosecutors are reading the statute . Is the problem the punishment may be excessive or both . I think its both. What their main charges are, racketeering and Services Fraud which is a catchall law and the late antoni scalia criticized it saying its an overly vague law. The Supreme Court over time has narrowed it and basically prosecutors had used it to go a after anyone for bribery, regardless of whether theres an actual victim. In this case, who is the victim. Paul well, do you think that she could get off then . Do you think she has a chance to actually be acquitted . I do. I think shes not terribly similasympathetic defendant whil be hard with the jury. On the other hand, i think she has a very strong legal case on the prosecuting a law that probably does not fit. Paul interesting. Okay. So i guess, kim, the idea about the victim would be they were students who didnt get in to usc because the places were taken by the two loughlin daughters on fraudulent grounds. So there are those victims in the case. Right. I think thats true. I think that by the way, paul, is the technicalities of the law side. Most people look at this and say come on, and you had Felicity Huffman who already pleaded guilty and spent a few days in jail and apologized profusely for what they did and i have no doubt a that if ms. Lov loughlid done the same this would probably be over by now. To bills point, one of the frustrating things here everyone in the constitution has a right to demand a trial and whats really obnoxious and problematic here is that you should not be punished for asking for a trial by then having additional charges brought against you, for exercising your constitutional right. And thats whats so unsay unsay here from the side of the department of justice. Paul the question would be a matter of equal justice. A wrotein response to your column, mcgern, sympathy for all the rich and famous but what about all the the guy who gets grabbed for burglary and wants to go to trial and the police slap on more charges and put him away for 20 years. So why should she get off easy . I think they have a point. If you believe that these other people, racial minorities are being charged unfairly, is the answer then to charge someone else unfairly . I think thats a really weak argument and im with kim. A lot of this is people calling her arrogant for insisting on a constitutional right. Let me point out that when Felicity Huffman was sentenced, the Probation Panel that wrote a report on it could identify no victim and no financial loss despite the claims by pros cue r tores prosecutors. One of the problems here is they that the colleges themselves make the admissions process so opaque, right, that people know its not just merit and this guy, rick singer, he figured out all the soft underbellies.
