The president talking about the usmca at one point, saying of that, we need the usmca to be voted on. If it is voted on it will pass. The timeline appears to be shifting a bit as the white house had initially had an october, an october time frame when this could potentially taken up. Doesnt matter as far as slowing, contraction of the economy. Economy, easy to have a managed economy. China is a managed economy instead after free economy, when you have a manufacturing economy. Were told a large pores of that will be paid out almost immediately to two ohio counties using this money for treatment, getting people into programs and assisting firstresponders as they deal with this crisis. Again, summit counties, they are just typical examples of what these drugs have done throughout this country. Reporter a trial is not off the table. Walgreens was a fifth defendant in this case. They did not reach a settlement. They join a separate group of defendants, rite aid, cvs, walmart and target. What lawyers for plaintiffs are hoping, that trial and todays settlement will pave the way for other plaintiffs that could still go to trial. I think you will see the next trial move much, much quicker, the next one, much, much quicker. Everybody is continuing on two tracks. One track well have juries ready to answer questions that they need to. Well have another track to get the help in these communities they need all over the country. Reporter ideally lawyers for the plaintiffs would like to see a large settlement with the 2600 remaining cases as opposed to individual trials or individual settlements but so far, neil, those negotiations for a settlement have been unsuccessful. The third category are human beings injured by addiction to these products. This is the settlement of one case in one category. This is a bellwether case. What is a bellwether . 2800 lawsuits filed in federal court. The chief justice gives all of them to one judge. The lawyers pick most typical case. Plan to try it ask jury questions, to use answers questions to settle the rest. Turns out it was not tried because it was settled. They will pick another case to try that one to get specific answers from the jury. Here is the walgreens defense, why they wouldnt settle. We answered, we responded to lawful prescriptions. We delivered lawful of amounts of medications pursuant to those lawful prescriptions to patients who their doctors were entitled to them. Were not the guarantor that the prescription is okay or that the patient will not misuse the drug. How can we possibly be liable . That is good question a jury will have to answer, unless walgreen wants to cough up type of dollars today. Neil opioid makers being targeted, 400,000 who lost their lives as a result of opioid abuse or whatever, or overdoses, what is their culpability . Well the, when the manufacturers pay some cash as they did today, they do so without finding liability. If jury ordered them to pay cash that would be a legal finding as a matter of law, they are liable. That could be used in another case against them. Which is why theyre reluctant to go before a jury. Is this case worth 260 million . Probably not. It is not worth that the billions the plaintiffs asked for. It is also a lot less than what a jury might have awarded. So its a typical settlement where no side is fully neil here at the tune of 60 million doesnt go to people injured. Neil that is my fear. It goes to the government. They can help programs to help people injured or pay overtime or build a public library. Theyre not obliged to spend particular way. Neil when they police the dispersement of funds, do they do that with the federal level and getting into tens of billions who polices where that money goes . Nobody polices it. Nobody polices it. As long as it is not used for a corrupt it can be used for any governmental purpose. One of the people grady ran in his report showed a count administrator what they plan to do with some of the money. They can take the rest of the money to pave highways if they want. Where do you see this going next . The business has more than tripled since we purchased it in 2007, when we closed on the transaction. Frankly weve had our best year ever. Most importantly we have another 30 some hotel deals, another 11 casino deals actually happening, not potentially happening. So things are really good for the hard rock brand right now. Neil for hardline gaming popping up, in areas near where you are, how does that play out . A lot of people are in the business. Were in the hard wok in Atlantic City and other jurisdictions i think personally in the next 10 years that will have a dramatic change to the gaming industry in general, whether las vegas, maybe macao to a lesser extent. If we look at big markets for companies not focused on Online Gaming i think that could be a strategic error. Neil i should disclose our Parent Company is dabbling in this. We understand. Neil obviously a take on the economy. That is important for you. You look at the numbers. They still look good. Look at Consumer Sentiment numbers. They look good. Earnings right now look good. By and large theyre beating estimates theyre still early. How do you see things going . People look at Market Recovery and economic recovery thats a little long in the tooth, impressive, but we have a long economic cycle. How do you tell people hey, one of these days . First thing we focus on our ratings. We have Investment Grade ratings from fitch, moodys standard poors. Our Balance Sheet is strongest in the industry. Neil that is unprecedented hat trick level of support from all them. Never happened before in the gaming hospitality industry. Neil right. That is number one. We look at potential correction or recession that may occur. We know were not in a scenario we have to be worried about restructuring debt. Inevitably it will occur. Its a cycle in the economy. There has been a lot of positive things based upon the trump administrations changing of regulations, tax cuts, Corporate Tax cuts. They were very beneficial to us. But as you start lapping those numbers it becomes more difficult obviously to grow the business. Neil do you worry if he is not reelected, someone takes his place reverses all of that . I think moderation is a good thing. Going in one direction either side too far obviously creates, you know a little bit of a challenge. Neil sounds like a very nice way of hedging . It is difficult. Franklier were not just a u. S. Based company. So what happens with brexit really matters. What happens in barcelona or china, frankly in process in japan those things are very important. Yeah, we drilled down on the ways an Means Committee in several hearings in fact, Union Representatives from the auto working, workers industrial to many others applauded lighthizer, the chief negotiator for trump, and the president for putting better standards for workers, worker rights, union organization, right to strike, worker conditions, safety, i mean we have twice as many labor provisions in this agreement than we had in nafta. And the labor provisions are in the corpus of the agreement. And nafta, they were in a sidecar deal. They were virtually unenforceable. We all want enforceability here. You know, he had been talking to reporters and talking to cabinet members to say the economy is doing fantastically well, this as a lot of other countries are not doing fantastically well. We are seeing a lot of things going on from slowdowns to protests. We are an investment haven. The president has stuck to that and is not letting go of that. Lets get the read from mark hamrick, hitha herzog. You want to keep this going, you want to keep me going is the president s argument, right . The problem for investors is, although that statement may be true in a sense, the s p 500, the Largest Companies that are publicly traded get almost half their profits from outside the u. S. So investors need the rest of the world to do well in order to keep the momentum and earnings we have seen. Neil what do you think of that . Thats absolutely the case. We look at, for example, how growth is slowing in the United States. The new york fed right now puts the estimate for q4 growth 1. 1 . No doubt the slowdown around the world is having an impact, particularly on these International Corporations and we know Business Leaders are really having trouble seeing through the fog and what they can see doesnt necessarily give them a great deal of confidence. Neil to your point, they should talk to consumers who arent nearly as doom and gloom. Not only should he not i mean, he should speak to the consumer but he should talk to people in local markets. If you think about the United States economy, you have to look at how its performing state by state as well. Look at alaska. Vast natural resources, unemployment is at 6. 5 . This is from a study. When you look at california, on the other hand, which is the extreme, they have had some insane growth since 2017 so its really across the board. You have to look at that, too. Neil alaska is more like an oilrelated phenomenon, right . Alaska, well, yes, thats an oilrelated phenomenon for sure. But we are also looking neil california, they are just as high as a kite. California, we have to talk about the tax situation which is a different story. To your point, though, its really, we have to look at whats happening in the local economy. Neil one of the things the president has always argued and he brought it up again, that, you know, you could criticize a lot of whats going on but between the regulation cuts which you were early on to say that was the precursor of the tax cuts which benefited a lot of companies, the rap against that is its hard to make these year over year comparisons now because we are going back to a period where there was also in effect, so now its going to make tough comparisons. What do you think . Interesting. I actually think 2020 is going to be a better year than 2019. I really do. You start to look at some of the trends, there are green shoots out there. The manufacturing index, for example, seems to have bottomed about five months ago. The tenyear treasury yield has seen a slight uptick, a little more bullish, and i think the benefit of tax cuts, too often gets measured in the year or two after they are implemented. Tax cuts create more incentive which is the key to capitalism. Its a longterm phenomenon. I think im bullish on the economy and stocks longterm because i think the tax cuts are going to have a longterm impact. Thats absolutely a good point. Its a Ripple Effect. People dont understand this, to your point, takes a long time. When people talk about the changes in consumer spending, were not talking about month to month. We are talking about a year and a half to two years out. So i dont know if 2020 is necessarily going to be a good year for the president per se, given Everything Else thats happening, but in terms of the economy, i think it might there miebt a little more neil you mentioned the president. He did something he rarely does. He reversed himself on the whole g7 thing, holding it at his club next year. Thats unusual for him to respond to pressure. Also, to try to work more closely with those who think he overdid it with turkey and the syria troop withdrawal, either slowing it down or keeping the troops at least nearby in the neighborhood. That is unusual for donald trump. What do you make of that . Those are two things that are almost hard to put together. Unusual for donald trump. Unusual for the unusual. I dont necessarily mean to make that in the sense of a humorous statement. I mean, you know, think of the seriousness of the issues that were involved with that whole process, where essentially people were saying, you know, this checks off the violation of the emoluments clause box, right, and so while the president neil he argued it didnt. Of course he did. Yes. The other part of that is, you know, i think you want to choose your battles and if you want to hand an issue to your opponents or those who are pondering, lets say, in the senate with respect to undoubtedly going to get an impeachment issue to have to decide, that one was a little more clearcut than some of the others. Neil the republicans thought it was clearcut. They were the ones telling him hey, mr. President , this, we cant agree. That was really the whole g7 thing and the fact he was hearing it from more and more republicans, he couldnt hold them out, humiliate them online, there were too many. It looks like the Republican Party finally drew a line in the sand when it came to this emoluments clause here, and i think that when President Trump saw that, this was his i dont necessarily think the president sets a lot of boundaries when it comes to the Republican Party. I think this was one he had crossed and he realized wait a second, i need to somehow retract this a little bit more or fix the situation, because im definitely going to start losing some of my base constituents and support. Neil you know, his argument has always been to leapfrog and i think mark kind of touched on it, where this impeachment fight is going, its looking increasingly like they will hold a vote on impeachment in the house and its very likely the president will be impeached now. It may be all one party but where it goes in the senate, probably not far, but you never know. Handicap that out for us, what you see happening. I think its clear to most people, certainly those that voted for donald trump the first time that this has been from the getgo a bunch of nonsense. There was never any evidence of collusion with russia. People can read his phone conversations with leader of ukraine. This has all been a means to try to stop donald trump, right. Neil sometimes he keeps giving them ammunition, right . Sure. I think to your point about what was happening at the country club, look, it would have only been a violation had he made money from it. Im sure at some point, they would have dug and dug and dug and found some receipts somewhere, no matter how small, that went to the club that wasnt accounted for so visually, yeah, it was bad. But the one thing that bothered me the most actually which has nothing to do with impeachment was his decision on turkey and the kurds. I have never quite understood that. We had advisers there, the kurds have been so great for us, they have been battling next to us on and on for a long time. Neil he said theyre not that great, overrated militarily, they didnt help us. I thought that was a bad decision. I didnt agree with that at all. He was wrong. I dont know what was behind that. Neil but the fact hes reversed on a lot of this stuff tells me that he can dial it back. Sure. A lot of politicians have made bad political decisions globally that they have rebounded from. Neil yeah. Mark, when you step back and look at the markets and look at how we do by comparison, i know you cant ignore whats gone on in the rest of the world but these fortune 5ed h ee e500 comp 500 companies do a lot of business overbroad. When they are telegraphing concerns about the state of the world, concern about trade, im not saying they are all like christine lagarde, who will take over the European Central bank and the u. S. Is botching its role as global trade leader and global leader, period, but what do you make of that . In terms of our standing around the world, obviously i think this is a difficult time for u. S. Standing because the issue of turkey and isis is a great case in point where not only do u. S. Military personnel feel abandoned but im sure there are conversations with allies that are saying what the heck or worse, you know, what are you doing, what are the strategic objectives and why were you not more aggressive in your communication with us in terms of a strategy. Thats not insignificant when they think about levels of perceived uncertainty being relatively high now compared to other times in recent history. Neil it does seem noteworthy. You reminded me theres a disconnect sometimes we in the media obsess over, pundits and the rest, take nothing away from you fine people, but average people just look around and see the environment, see job security as a reason to go out and spend this holiday season. Estimates are pretty strong. You were reminding me the National Retail federation, 4 plus over the last year. So theyre not focused on this stuff. Is that a good way to be . The consumer isnt focused necessarily on the macro issues. What may end up happening, again, we are talking about the Ripple Effect and many quarters down the line, is that retailers are going to start responding to that. So in the immediate next six weeks as we lead up to black friday or i think we are actually closer now to black friday, yeah, youre right. The consumer said you know what, i feel great about my job as long as im not in alaska, i feel fine. I will go out and spend. But you know, they watch the news, im sure that they are a little bit concerned, but right now, we have had three, even longer, almost five years of growth and the consumer is feeling good. I think during the retail season, this isnt going to have a huge impact on them. Neil well see. Talking up his plan for universal basic income, hoping that it catches on with the rest of the democratic field, but while some other Democratic Candidates are thinking about giving away money, they also are in a race to get money. Joe biden has taken back his place as the frontrunner in the real clear politics average of polls but hes falling short in fundraising, down to fourth place for Third Quarter fundraising totals. Biden only has 9 million cash on hand. Thats less than half of the other top tier candidates. Bernie sanders has over 33 million in the bank, Elizabeth Warren has over 25 million on hand. Biden sends a fundraising email out to supporters asking for them to quote, pick up the pace or else he says they will have to make some budget cuts. Today, Bernie Sanders is building off momentum from a big endorsement from congresswoman alexandria ocasiocortez. She made that endorsement official in a bernie is back rally in queens, new york over the weekend. The 25,000 people turned out to welcome sanders back to the campaign trail. Dueling progressive senator Elizabeth Warren is busy doing damage control after getting pummeled by biden and buttigieg at the debate last week for dodging questions about how she will pay for her medicare for all plan. So now her Campaign Says she will finally release details on how she will pay for it, something that Bernie Sanders has not been afraid to say from day one. He says taxes will go up for the middle class. Well see if warren will finally admit that she will do the same. Neil . Neil thank you, hillary, very, very much. Mayor pete is getting a lot of interest certainly in iowa, as we said here. A lot of people increasingly looking at him as a biden alternative here. Still very early, as my panel likes to remind me, but when you get indications folks like Mark Zuckerberg are quietly advising the campaign, then you have to say well, thats an interesting development. Lets go to mark and hitha. What do you make of all this, that right now following the money, which is a good proxy for where the momentum is, its mayor pete . That could change and often does. We have a long way to go. But what do you think . Thats the operative word. A long way to go. Its still 2019. We have almost a year until we are actually going to be voting. With that said, its really interesting, mayor pete doesnt like to be considered he doesnt like to be pigeonholed as he said in this npr interview he did a couple days ago. He likes to be considered a progressive. However, his stance is more moderate than anything. Hes really going up against Elizabeth Warren on this medicare for all neil if anyone can look moderate compared to her. That is true. Compare him to Bernie Sanders as well. They are on the extreme. Its interesting how they dont want to be seen as necessarily a democrat but its all about being a progressive democrat. Neil im wondering, too, the fact that more moderate elements in the party, mark, are taking on the progressive leaders tells you something that, you know, yeah, you fight for the nomination and then you run back to the middle of the democratic party, like the Republican Party ran back to the middle from the far right. I get that. But there does seem to be an early strategy here on the part of those, you know, to the point, the Bernie Elizabeth alternatives for more moderate course. What do you think . We are in the preseason of president ial politics right now. We will get to the regular season or championship tournament once we get the nominees. Neil we will have graphic packages along the way to do just that. Im sure they will be artfully done. I do think we do need to take in into consideration that a lot can change, so lets just assume for a moment that mayor pete comes in third in iowa. Does anybody remember who came in third in iowa in 2008 . John edwards. I think the more important question is, is there a change in trajectory. As frankly joe biden, is he on the verge of losing his status as frontrunner and those are questions that have yet to be answered. Neil thats a very good point about the alsorans. Jimmy carter, people forget, in iowa in 76 came in second to nobody, to undecided, so that was a big enough win because he had emerged higher than any of the established names to alter the course of history. I dont know what it would be but if you think joe biden and his people might have given up on iowa, given up on New Hampshire to focus and put all the money bets on south carolina, that could be a risky strategy. This tells me two things. Number one, i think joe biden came out far more bruised from this whole ukraine thing than President Trump did, and number two, tells me that he better come up with a much more bigger subsidy package for farmers. Neil ironically, the former Vice President i think theres a similarity to the Clinton Campaign here a little bit, because you asked the question what is the Biden Campaign about. The problem for the Clinton Campaign was ultimately, im not donald trump. This is really kind of the Campaign Biden seems to be running right now. I just have a sense in my gut that is not going to cut it. Hes running a campaign on nostalgia, to your point, and exactly that. I dont think that with newer voters, especially, the Younger Voters who really want to identify and align themselves with a more progressive stance, joe biden, nostalgia isnt working right now. It could change. Something drastically different could happen in the next couple months but right now its not resonating. Neil hes the least polarizing figure as a democrat. I think you need polarizing. Neil do you . Definitely. Look whats happening with our current president. We are entering a different stage of politics. Neil you dont think dull will win it . So rivlin has now gone to his opponent to form a government and give him about a week to do so, but by all indications here, Benjamin Netanyahu has failed to form a government and will be likely stepping down in the near future. Charlie gasparino has an indication of whos going to be there. I dont know, charlie, if this netanyahu news changes the dynamics. I dont think so. I hear David Solomon of Goldman Sachs is not going. But right under them, thats where they are sending their people. Last year, they sent just local representatives. This year Goldman Sachs will send dina powell, i dont know if you remember her, used to work in the trump administration, is now a partner in the Investment Banking business. She will represent Goldman Sachs. Jpmorgan will be sending its head of Investment Banking, the global head of Investment Banking, carlos hernandez. Does it matter in the marketplace, i dont know, but from what i understand, the nba is saying it has suffered losses with respect to its relationship to china. So this once again is part of the unintended consequences of globalization, right. A lot of people dont necessarily know what theyre getting into longterm when entering into these substantial relationships abroad. I have a big number for you. Its 4 billion. Nba will not report out exactly how much money they are taking in from broadcasting games in china and all of the residuals they are making off of that. But through my research, this is the number i found so this is the type of money they could be missing out on. Neil why not call chinas bluff on it . I know 400 million or 500 million kids love basketball there so say the nba were to call their bluff, say were out of there, good luck with the european basketball league. Because the nba needs china as much as china needs the nba. Neil china knows that and always plays that card. But whats happening is the nba, i mean, they are in a precarious situation. They have to either they have to adhere to the rules of china and what china really wants them to do, or they start losing out on all that revenue. Neil but they dont change. They play tough with you and if you dont play along, they say goodbye to you. If you are running the nba, yes, thats probably what i would do but they are clearly not doing that. It raises the question what are the core values of the nba, right . Neil youre right. When you think about how Children Play basketball, children are the next consumers of basketball content, i think theres going to be a perception issue thats going to be real. Neil a lot of people, i will bounce this off of you, mike, see nike as the core of this, because nike is so influential in the nba and whathave you. Boeing went on to say that really, the pilot was talking about the software and not the actual software itself thats going into the planes, it was more simulator. This is going back and forth. But you have wall street as a whole downgrading the company. Three major firms have downgraded the stock today. You have ubs, neutral price target. Going from 375 all the way down to 323. Credit suisse even saying they are not even going to support you putting this risk into your portfolio. We take a look at the stock, though, just intraday its down, at one point today down about 4 . Its coming a little bit off of that but not much. Still down almost 13. Year to date if we can take a look at that, the stock still in the positive. We are talking about for 2019 as a whole. Earnings, though, i would like to point out, are coming out on wednesday. What we are going to be looking for is whether those 737 max planes are set to be back in the air as of january, or february, because you have southwest weighing in saying not until february. You saw these four, you know, pharmaceutical companies that are now part of this agreement in ohio, the day of the trial, to settle for about 265 million. Some are looking on this Opioid Settlement as a precursor on a national level, with all the big guns kicking in what could be 50 billion or more as part of a global settlement. What do you think . Its simply because to me, this seems much more closely aligned to what happened in the asbestos industry than say the tobacco industry. That isnt the same. But i think its going to get could potentially get much, much, much bigger. I think it could follow what happened with asbestos which is still going on.
