Huawei parts and various particulars there. That will freeze up fast. No more extensions. That is the push and pull on stocks right now. Meanwhile this issue of the on going hearing right now, inspector general, many others on capitol hill, whistleblower i should say, where all this is going, sentiment built to the conversation with the ukrainian leader that the president had back in july. A lot of people are looking at this 1998 feeling all over again. House democrats are pouncing on the whistleblowers complaint. It was House Republicans in 1998 were zealously going after impeaching president bill clinton. Impeached him in the house. Went nowhere to the senate. Survived that and had a good post presidency. They did the party out at that time from the white house did recapture the white house a couple years later. Markets were throughout back then. More of a little bit after roller coaster ride. Blake burman is here. Reporter almost simultaneously President Trump sent out a tweet that democrats in his view are trying to destroy the republican party. He urged republicans to stand together. The argument from the white house today is coming from press secretary Stephanie Grisham and she is trying to make the case that the whistleblower complaint illuminate above what was in the memo of the call released by the president just yesterday. Here is her statement. Quote, nothing has changed from the release of this complaint which is third hand account of events, cobbled together press clippings all of which shows nothing improper. The white house will continue to push back on hysteria and false fairtives peddled by democrats and mainstream media. President trump will continue to work hard on behalf the American People as he always does. However the complaint leads to many questions for this white house. The whistleblower complaint that white house officials were deeply disturbed what happened in the call, between President Trump screen right, president zelensky screen left. And white house lawyers were trying to determine according to the complaint how to treat the call. According to the whistleblower white house officials locked down all records of the call and were directed by white house lawyers to take the transcript off the system where it normally would have been stored and put it on to a different system that deals with more sensitive material. Now the whistleblower alleges that has been done before as well in this white house with other calls. Here is from the whistleblower complaint, quote, according to white house officials i spoke with, this was not the first time under the administration that a president ial transcript was placed into this code level code word level system solely for the purpose of protecting politically sensitive rather than National Security sensitive information. Nancy pelosi, speaker of the house picked up on that this morning and described it as an improper movement. The complaint report as, quote, repeated abuse of an electronic records system designed to store classified, sensitive National Security information which the white house used to hide information of a political nature. This is a coverup. This is a coverup. Reporter this is a coverup as you hear from nancy pelosi. Neil, we should point out this is a whistleblower complaint. We still do not know the identity of the whistleblower is. Director of National Intelligence testifying up on capitol hill this morning says he doesnt know who he or she might be. Neil . Neil thank you very, very much. Blake burman at the white house. Obviously these crosscurrents as well as is this progress in the trade front, is there not progress in the trade front. Whipsawing the markets. The dow down around 113 points. Still within a percent or two of alltime highs reached in the end of july. Lets get the read on all of that from the acting director of National Intelligence Joseph Maguire reacting to the transcript, just listen to this, how he was spaining explaining this. I just make sure, foreign, well have the president of the United States not talk to foreign leaders or we should just publish all the transcripts because that is what is happening here. Ranking member somebody is leaking this. Likely coming from the agencies that you oversee . Ranking member, no, that, sir im not saying you dont know the dissemination of these calls is supposed to be sacred, right . But this is now the third time. Im not aware of this ever happening before. Of contents of calls like this getting out. I really dont know, ranking member. Im not aware, i dont have the numbers to, just seems to me though it is unprecedented. Neil that of course is Joseph Maguire, the whistleblower not coming before congress right now, but the basis of that report goes Something Like this. That the whistleblower described information from multiple u. S. Government officials that the president is using the power of his office, quoting here, to solicit interference from a foreign country in the 2020 election. Now, that was why he moved and reacted the way he did, were told. That brought us to where we are right now. Former u. S. Attorney guy lewis on all of that. Guy, that was the justification for trying to get the word out. Do you buy that justification . Neil, im always skeptical, i hesitate to rush to judgment and i think it would be wise for us as a nation, as the American People, i would caution. I like you, like a good reporter, i looked at the whistleblower complaint as well and not only is it second and third hand sourced, second and third hand information, the whistleblower says that i have no whistleblowers word, i have no firsthand knowledge of basically any of this. Some of the other sources, the new york times, washington post, politico, abc news interview with george stephanopoulos, im not saying, some of it could be true but that is the source of information contained in the complaint. So i think we ought to take a step back here and proceed with a little more caution. Neil i readily agree with that. Help me out as the lawyer here understanding what is going on here. Is it unusual in this case for the white house to have made the call, lock down all the records related to this phone call and any communication between ourselves, that is the white house, and ukrainian authorities, in this case the Prime Minister of ukraine . Great great question. Clearly the white house is concerned as it should be about the president S Communications with foreign leaders. This isnt the first time, this isnt the first time that an actual conversation between the president and the leader of another foreign country has been leaked illegally and improperly. Mexico neil youre right. Very first one, day after he was sworn in as president , i mean call with a former Prime Minister of australia leaked out to the world. He wanted to know what the heck that was about. Obviously he is protecting himself or the white house in general saying weve got to make sure we have everything in hand but is that act alone questionable, or even illegal . I dont think it is illegal. And sure, you can ask why, i think the answer is clear and straightforward. There were at least a dozen or more people that were on this call. And strangely, strangely only one person decided that this was so improper that he or she needed to put it on paper. I would also point out, the contents, frankly this entire little episode has been looked at by the department of justice, not just bill barr but career people and the matter was referred to the fbi and they didnt even open up an investigation on it. There you go. Neil let me ask you quickly i wish we had more time. Youre very helpful here. We talk about a quid pro quo, if you take the leap of asking to something, linking it to Something Else, in this case aid. That does not appear to be the case here. It might be in future revelations but we dont have that. Phone calls and transcripts of those calls. But if there is no quid pro quo, asking for that information or details on an opponent, what he was doing when in this case he was the Vice President of the United States, is that a quid pro quo, in other words, is a foreign leader providing that information to the president , promising to get information back to the president , is that your quid pro quo right there . I dont think in of itself, i do think you have to put the call in context. Right. July, middle of july. The whole russia thing was winding down. He is clearly upset. He being the president , is clearly upset with the origins of this the russia investigation. Multiple people are looking at it. Neil right. The former, so there is an ongoing investigation. Perfectly appropriate for the president of the United States, president to say, hey, we want your cooperation. We think you may have some information and lets work together. Neil all rig. Guy lewis, thank you very, very much. I appreciate it, my friend. By the way Kevin Mccarthy on the wires, republican leader in the house saying of nancy pelosi already saying there are Impeachable Offenses here, mccarthy saying it is already decided against impeachment. Im different from the speak of the house. I will wait on the facts. Investors are sort of on pins and needles on this. Back and forth. They dont like anything disrupted. They enjoyed the run under this president , whether they like the guy or not. Investors at the time of the clinton impeachment, they dont want it disrupted then. They dont want it disrupted now. Immediate kneejerk reaction. Worse things look, more problematic for the president , maybe for the timebeing worse they look for stocks. Lets step way back on all of this, charles payne, bestselling author. Also popular host of here at fox, get his gauge. You know, your show is about making money and a lot of people are afraid, they chase the president down, charles. They wont be making money. Where is this . That is a fear if there was disruption or we got to the level of a true constitutional crisis that required to the removal of the president. Neil do you think were getting there . I dont think were getting there im not an expert. I went through the transcripts. I would hope any kid center court downtown in new york city would need more evidence to prove that they did something wrong than what people are trying to say here. There is a lot of assumptions there. Were is assuming that the ukrainian understood this and this was inferred and i think our legal system, i know impeachment is more of a political process. Our legal system has more checks and balances. That is the reason we have greatest country in the world. That is what weve seen so far. The market is anxious. There is certain anxiety, every time we come to the the alltime highs, how do you catapult above that . It comes back to the two situations, trade situation and federal reserve. They havent become tailwinds. The moment they become tailwind were off to the races of the as they fluctuate back and forth, were getting back into earnings season, theyre just a whole bunch of question marks over this market right now. Neil i have always argued, charles, sometimes the environment in which a impeachment process begins is as crucial as the impeachment process itself. It didnt help matters for richard nixon. We were in the middle staffing nation, runaway oil prices with the oil embargo. Then the economy dramatically slowing down. That was not a great backdrop for a president who was in trouble anyway. Right. Neil fast forward to bill clinton, you had the internet boom going on, the economy soaring, jobs coming fast and furious. I always argue wall street is not red or blue. Theyre green. They love making a lot of it under bill clinton and making a lot under donald trump. They dont want that disrupted. The people debate what trade deal will look like. Wall street doesnt care. Neil exactly. They can check that box and move on. They will not even look at the details. Oh, it is done . Great. Lets rally the market. Neil uncertainty is the worst enemy. Right. Neil uncertainty of the president , uncertainty of this trade deal even though we got promising comment of those who presumably know about them progress is being made. It is interesting, last 24 hours i have seen something i think is interesting. President trump is still playing hardball to a degree. Comments on huawei today, not extending those waivers. Neil thats right. And yesterday america putting sanctions on five Chinese Companies for taking iranian oil. That is hard ball. What we see in the last 24 hours of china . Foreign minister said they dont want to play game of thrones. They know america is number one. That is okay with that. That goes 100 against made in china 2025. We heard this morning that china is willing to buy two million tons of soybeans going into the next meeting. Next year if things go well, they will buy 30 million tons. In other words their olive branches and neil they made overtures before. To say, hey, well sank your Oil Companies a month ago or year ago they might have retaliated. Having said that i have friends saying that the peloton bike changed their life. Switch gears for a moment, pardon the pun or dont pardon it if you like, talk about ipos in general, what weve seen so far this year. They have been looking at these companies saying if youre not profitable it is tough to pay up for them. So well see if peloton ends the first day on winners or losers lift, neil. A lot to get into, greg but i wanted to pick your brain on this slow motion but apparently move motion in the right direction on the china trade talks. If were to believe what is out there, that the chinese committed to buy more soybeans we havent seen it in the volume the administration seems to be talking about with the soybeans purchases. Later in the day i guess we get the exact particulars. What are we to make of that . I think the atmospherics, neil are getting a little bit better. Maybe we bottomed out. You have to be realistic. I think there are several months to go before they iron out these many issues. It seem as little less acrimonious so i will take it. Neil let me go to the originally agreed topic, i wanted to pick your brain on that, greg. The tum melt in bidens poll numbers. Elizabeth warren ahead of him nationally and in some key states what is going on . Well i think she is running a really Good Campaign with a good staff in iowa an elsewhere. I think there is a growing perception among democrats who like joe biden who think he lost a couple miles off of his fastball and i think he continues to slide. The key issue obviously could Elizabeth Warren win . Is she so polarizing beating donald trump is unlikely . If she could convince democrats she could win a general election i think she has a decent shot to be the nominee. Neil interesting you raise that because one of the reasons i heard advanced for the markets advance yesterday, maybe playing a part in the comeback from the worst levels is not only china trade but the process that joe biden will not be a nominee. Idea being revelations of this investigation are such that he gets hurt, the president survives, he is pitted against Elizabeth Warren, that is an east pickup for the president. That is how theyre interpreting it. What do you think of that . I think there is some truth to that we could argue all afternoon the merits of the ukraine story. I think biden and his son hunter will always have some cloud of suspicion over them. There will always be a narrative about them that is not favorable f it does wind up with Elizabeth Warren, i just see a lot of states where she cant win. From Electoral College standpoint, biden would be the biggest challenger but he may not be the one running. Neil amazing. My friend, good catching up. Thank you. What is going on here . It is facing a perfect some. Well see what happens. Well see if the market finally takes the bite out of them. We should point out when amazon in its growth mode, it basically had positive cash flow, right . It was not making money. It had positive cash flow. We dont have, wasnt in debt like netflix. Neil right. What we had with netflix is really interesting. Its a great company, dont get me wrong but its financial foundations are shaky, okay . You now have competition from disney and everybody else who will take them on. You now have, you have them losing subscribers, u. S. Subscribers in the latest tally. On top of that you have a lot of debt and what they essentially do they borrow a lot. They also have offBalance Sheet obligations. If you talk to short sellers about them, the guys that bet the company is going down, its a growing number of them, they have all these offBalance Sheet things are always problematic. Im not saying it is enron, dont get me wrong but always a warning sign if your debt is not consolidated totally or mostly on the Balance Sheet. Neil could mean people charging a lot less, apple what is that, 4. 99 . Apple has absolutely no debt. Neil yeah. Were talking about financial foundation, very shaky. Will this now be the comeuppance for netflix . Is it finally going to hit the fan . Listen there, is a point where the market doesnt let you borrow anymore. Rubber needs to meet the road. Amazon in their growth mode, everybody talks about this, there are two stocks out there people talk about hitting the skids at some point. Tesla is one, based on its foundations. Declining apartments of government subsidies, you know, very erratic ceo. Netflix does not have that. Elon musk is, lets just say very unique. In his approach to stuff. You know, demand is all over the place. Debt, they have high debt levels. That is one stock. Netflix is the other one. One of these, there will be a day of reckoning for one of these soon. This might be it right now. Neil so the days of making a quick buck on streaming services the obamas had, seinfeld, some of these others are those over . I dont think so. I think the competition is forcing people to step up to the plate. You know i have friends of mine who are out in hollywood who are producers. They have small production companies. Theyre doing very well right now. A lot of people looking to buy content. Content is a big thing. Content is king. Neil do people graph state to services more of them than they used to be cutting the cord because it is so much cheaper . There is a crazy Business Model out there. You cut the cord, hurts cable providers controlling some of these things. There is competition for content right now. So, listens its the wild west. If you produce content right now, neil, we should start a streaming channel. What do you think . Neil im wondering what it would be . Well just talk. Neil breaking news . You drinking a pumpkin spiced latte. I think people pay a lot of money for that. Neil all right. Maybe we can get the president finally on the show because im going to ask him . You know, just incredible. Much stirring the pot. Stirring the pot. We can straighten this out. Neil get you on board. Charlie gasparino, thank you. By the way, a highspeed chase, low on battery. So a tesla patrol car runs out of juice in the middle of the chase. Can you imagine that . Oh the bad guy gets away. Neil maybe a promising sign. A source close to negotiations saying General Motors is reinstating Health Care Coverage for 48,000 striking workers of the Grady Trimble has the latest and what it could mean. Grady . Reporter were at the Renaissance Center where General Motors headquarters. The latest negotiations doesnt pertain to these workers. As you said their Health Care Coverage. We first told you last week General Motors decided to stop paying for Health Care Coverage for striking workers. That forced the union to pick up the tab. It also caused workers to lose their vision and dental insurance during the strike. It caused a lot of confusion too. While we dont know if there is effort to save face or a sign things are going in the right direction but General Motors issued a statement about reinstating the Health Insurance coverage. Gm has chosen to work with our providers to keep all benefits fully in place for striking hourly employees. So they have no disruption to their medical care including vision, prescription and dental coverage. Now the uaw not exactly thanking General Motors for this move. It is something they think should have been done all along. Here is their statement. It should not have taken stories about uawgm workers who face losing cancer drugs or postponing their surgery dates for gm to see their workers as human beings, not pawns on a chessboard. We are told as far as those contract they go shuns go, the two sides closer than ever to reach a deal. The talks were told have moved up the chain to top negotiators. Whether that means a deal is imminent the next few hours or the next few days thats not clear. Neil . Neil thank you very much. Grady. Neil there must be something to the meatless craze. Golden arches, mcdonalds is looking at plant based beyond meet burgers. They were being first tested in canada, some of the markets around the country, take this nationwide, potentially worldwide. That is helping beyond meat stock, surging double digits yesterday and continuing today. Former mcdonalds ceo ed rensi. I guess this trend is real, it is palpable. Im wondering what does it mean for mcdonalds . Does it steal from existing beef burgers or what . I dont think so. I think it will be a great addition. It takes people who vetoed visits because they are vegan or vegetarians, this gives them an opportunity to have a burger. I am confused why they want it to taste like hamburger and not get a vegetarian offering. They are doing something brilliant. Plt, plant, lettuce, tomato. I think it is wave of the future. It is not glutenfree, that has fallen off a cliff like a rock. Neil they do taste like the real mccoy. Youre quite right the appeal is tasting like the real mccoy. Not like the old days people who were, into this were perfectly willing to accept something that tastes like cardboard. This does not. I think the technology in the food science is going to enhance the taste and the dietary benefit of this thing. One of the things they want to watch out for, how much assault theyre putting into products and how much facts theyre putting into it. Weve been selling the impossible burger at fad brands the last three years. Very wellreceived by the consumer. It gets rid of a veto option if you will. Neil people come in precisely for the alternative burger, than those who say i will not buy the regular beef stuff ed has, im going to buy this . One of the things you have to look at this in category of restaurants, for example, mcdonalds has north of 75 of the business going through the drivethrough. You have the whole new delivery option. Youyou technology is catching un the restaurants. I think you will see a lot more former closet eaters being able to buy this product because they are truly vegetarians. Neil youre probably right about that. You mentioned technology. Steve easterbrook, the guy who runs mcdonalds is very big on that. Humanless drivethroughs. The argument it is better for accuracy, better for speed, better for more customers coming through more often, what do you think of this whole trend . I think it is absolutely essential, particularly in the delivery side that all these restaurants are going to. The sophistication of the systems, facial recognition voss modulation, voice recognition, they will make the Customer Experience a lot smoother and easier. I use apps driving down the highway. Restaurants are geofenced. You put my favorite meal in. I pull in. All the credentials are in the iphone. It is automatic. I dont have to see anybody. I eat and run. Neil youre not doing that while driving, ed . Of course not. I have my hands on the wheel, my face on the highway. Neil i gotcha. I wonder a lot of craze started with technology, but it dovetails with the hike in the minimum wage. Im not being cynical or jaded about it. But im wondering if a lot of establishments, wendys has been modernizing operations to rely on fewer human beings this was borne of that higher wage necessity. What do you think . The full employment trump created in the company, the available of help in restaurants is shrinking fast. I see the wage component is going up and line item p l. Youre looking 15, 16, 17, 18 an hour, opening bid and you still cant get employees. Technology always accomplished what is forced by the restaurants for full employment. I think it is here to stay. Many solve of these things in california, av 5, contract employers, dig employees, if you will be treated as if theyre fool time employees. With the change in the overtime category increasing to 35,000, all these costs are going up. Something has got to give. What will give is less people and more technology. Neil underlying economic environment still sound to you, still support i have of the, forget fastfood, just retail in general . Yeah, i think so. Im belly to belly with consumers every day with the restaurants and talking to franchisees and people like that, and theyre very invigorated, feeling very positive about what is going on in their community. In fact i was with a mcdonalds franchisee about hour 1 2 ago and theyre optimistic. Theyre putting new equipment in their restaurant. They feel good what is going on forward in the restaurant industry. Neil when you sablely to belly, you dont have a belly, ed. I know the analogy. I see where youre going. Ed rensi, former mcdonalds usa head. These trends are real and palpable. The markets are dealing with the impeachment stuff and trade stuff. Which is winning out . What if i told you both are having the same effect . After this. Thats why your cash automatically goes into a Money Market Fund when you open a new account. Just another reminder of the value youll find at fidelity. Open an account today. Of the value youll find at fidelity. Im working to make connections of a different kind. At national, i can lose the wait. And keep it off. Looking good, patrick. I know. vo go national. Go like a pro. Neil stocks are under pressure after reports that the u. S. Is unlikely to extend a temporary huawei waiver. That means it gets to be a little more problematic for a china trade deal. Thats one interpretation. Larry kudlow was saying just the opposite, saying he thinks things are looking good. Jump ball, have at it. Meanwhile, peloton is falling in its ipo debut amid profit concerns, leaving investors spinning. See what we did there . But they kept racheting that puppy up. I always said the big problem with their bikes is they didnt have something to hold hoagie sandwiches and a beer. Meanwhile, the latest calm down. Not a true story. The latest right now on whats happening online. Looking to compete with your money and how all of that is sorting out there. First, after the whistleblower complaint, will other leaders be open to talking . Acting director National Intelligence Joseph Maguire facing congress today. Lets say it has been a bumpy debut. Hillary vaughn has the latest. Reporter well, the top democrat on the House Intelligence Committee, adam schiff, decided to start this hearing today with what he calls a parody of President Trumps phone call with ukraine. Well, it reads like a classic organized crime shakedown. I hear what you want, i have a favor i want from you, though, and im going to say this only seven times so you better listen good. I want you to make up dirt on my political opponent, understand, lots of it. On this and on that, you know what im asking, and so im only going to say this a few more times. In a few more ways. By the way, dont call me again. Ill call you when youve done what i asked. Reporter acting director of National Intelligence joe ma gur was repeatedly asked why he decided not to rush the whistleblower complaint over to congress within a week. Maguire called this complaint unprecedented because to his knowledg knowledge, this is the first time a complaint involved someone neil i dont want to jump on you, im sorry about this. The president is speaking right now, leaving new york for washington. Lets see what hes saying. If its anything to do with this. If you look, i think youll see very few can compete with the things weve done for our military, for the economy. We have the best economy anywhere in the world by far. Weve rebuilt our military. Weve done so many things that are so incredible with tax cuts and regulation, and i have to put up with adam schiff on an absolutely perfect phone call to the new president of ukraine. That was a perfect call. But adam schiff doesnt talk about joe biden and his son walking away with millions of dollars from ukraine and then millions of dollars from china, walking away in a quick meeting, walking away with millions of dollars. He doesnt talk about joe biden firing a prosecutor and if that prosecutors not fired, hes not going to give him money from the United States of america. They dont talk about that. My call was perfect. The president yesterday of ukraine said there was no pressure put on him whatsoever, none whatsoever and he said it loud and clear for the press. What these guys are doing, democrats, are doing to this country is a disgrace and it shouldnt be allowed. There should be a way of stopping it, maybe legally through the courts, but theyre going to tie up our country. We cant talk about gun regulation, we cant talk about anything because frankly, they are so tied up, they are so screwed up, nothing gets done except for when i do it. Im using mexico to protect our border, because the democrats wont change loopholes in asylum. When you think of that, and ill tell you, i want to thank mexico. 27,000 soldiers, they have. But think of how bad that is. Think of it. Where we use mexico because the democrats wont fix our broken immigration system, we need their votes. If we dont get their votes, we cant do it. And the republicans are all on board. They want to fix it but the democrats wont do it. They dont want to talk about infrastructure. They dont want to talk about lowering drug prices. They dont want to talk about anything because theyre fixated on this and nancy pelosi has been hijacked by the radical left and Everybody Knows it. Thank you. Neil all right. The president is, you know, arriving in washington right now but after sort of a backandforth with reporters on this whole ongoing what did he talk about, how much did he expect from the leader of the ukraine. Right now, as the House Intelligence Committee is listening to the director of the National Intelligence, Joseph Maguire, sort of describe the events that led up to now these investigations as to whether there was any quid pro quo, you know, given here to the leader of the ukraine to investigate joe biden and then get back to me. The issue comes back to not so much whether there was a quid pro quo or whether aid was halted, stymied, ultimately that aid was given, but that he was expecting something on this investigation of joe biden and what comes up in that report or the transcripts of that phone call, according to the president , theres a lot of talk about bidens son, that biden stopped the prosecution and a lot of people want to find out whatever you can do with the attorney general, bill barr hes referring to, telling this to the ukraine president , that would be great. Biden went around bragging, this is the president , went around bragging that he stopped the prosecution so if you can look into it, it sounds horrible to me. Well, that very conversation sounded horrible to a lot of people, saying the president went one step too far and therein lies the rub. Is this an Impeachable Offense, does it meet the merits of high crime and misdemeanor, is the president looking at another very very long series of months as people investigate this, wonder if there are other phone calls and transcripts of those calls and other offers, threats, whatever you want to say, whan constitutes again, that high crime and misdemeanor that would get the impeachment ball rolling. Lets get the read from our panel. Barrons associate publisher jack otter. Republican fundraise r and kat timms, among others. Unseemly is one thing, Impeachable Offense is another. The president and his people say they are on the side of nothing impeachable going on. Right. But democrats are saying that it is different, that it isnt just about this phone call, its about his entire presidency. Even if this doesnt turn out the way that they want it to and so far, it obviously hasnt turned out the way that they were hoping that it would, theyre going to say yeah, but, and pick Something Else out. He did this, he did this, its more about the combination of things. They are going for impeachment for impeachments sake. I think they have the goal of impeachment first, then they are going to decide why after. Neil you know, im not a lawyer but as i have often said, i watched enough legal shows i believe to qualify. One of the things ive learned is that the whole definition of an Impeachable Offense is political. So high crime and misdemeanor could be using the leverage of your office, the presidency in this case, to get what you wanted from a lesser power, to exert influence on a u. S. Election. Others say no, it has to be far more tangible, it has to be either threatened or denied. In this case, the aid that was coming was not denied. They ultimately got that aid. That means the president is safe. I dont know where this goes but therein lies the whole debate. Oh, gosh, you know, i really think a lot of people on both sides are really tired. We just finished the russia investigation and now we are looking at a new investigation. First of all, on two parts of it, a, i wish trump had never even brought it up. Really, there was no need to even bring it up with the ukrainian leader. I really think that first of all, trump is president of the United States, one of the most powerful positions in the u. S. And the world. Hes a billionaire. I dont know why cant help himself. He cant help himself. Neil he was charged with using a foreign power to interfere in an election. At the very least, it would be problematic. So we have that. The other thing it does to the democrats, which yeah, there has been poll after poll after poll citing that clearly, there are some republicans that do not like trump, that would actually feel comfortable voting with the old guard joe biden, so what theyre doing is when this investigation goes on, its keeping joe biden and everything in the forefront so it might very well knock down joe biden, put Elizabeth Warren up, which is no friend to wall street which is going to be very scary. The same crossover voter that would have voted for biden is not going to vote for warren so basically, they put sthechthems in a really bad deal the same way they did with clinton and sanders. Then they have a zero ticket and trump is solidified really neil i heard that advanced and one of the things that comes up, you know, again and again is one of the reasons with the runup yesterday was this notion all right, if it means people start looking at joe biden, justified or not, even democrats who are running against him are going to welcome that without mentioning that. And all of a sudden, Elizabeth Warren, who is the frontrunner now, emerges as the nominee and that, a lot of investors say, guarantees this guy who i have personal differences with but has been very good for business, very good for our stocks, very good for the economy, all good for us. Yeah. I think the impeachment move is a win for trump. For the reasons you just mentioned. And really, if you listen to history, when clinton was impeached, that was not good for House Republicans. It was okay for bill clinton, frankly. Good for bill clinton. So i think neil again, the republicans took control of the white house, you know. So you could play it but i know what youre saying. I think that has more to do with what bill clinton did and also the natural pendulum in politics. One of the interesting dynamics to me about biden is you are either going to have that pendulum swing really far to an Elizabeth Warren or its going to stay the other way with trump, or theres this guy who is a little closer to the middle, left of center but closer to the middle and its going to be fascinating to see where the American People want to go with that. I think as a republican, i would much rather be running against Elizabeth Warren than joe biden. Then thats part of whats going on right now. Neil james trusty is a former Justice Department official so we wont bother him with tacky political questions. We will bother him with the legal questions that are coming up here. Is the president in legal hot water here . What do you think . Well, not in terms of any sort of criminal prosecution. I mean, the release of the phone call itself was just a giant dud in terms of criminal intent as well as quid pro quo. Neil thats assuming its the only phone call, right . If there are other calls, other transcripts, already democrats are pouncing on that. I dont know what the case is but lay that out. You are becoming a good defense attorney who says yeah, i know you got my confession on the call but what about the other calls. Neil i learned something from those law shows. See that . Where does that go, in your eyes . Well, look, the train for impeachment left awhile ago. I know there was the announcement from pelosi, then this new stuff from the whistleblower, quote, unquote, but the reality is nadler has been running that show for awhile in terms of dragging in everyone from Michael Cohen to, you know, whoever else, angry swedish teenagers. So theres a lot of people coming in, lot of information coming in. I guess its more formal now although not voted on, not anything particularly form formalistic but if they are Going Forward with it, this is another piece to play with. They may not get far in terms of the actual allegations of Campaign Finance violations or any other federal law, but i think it was jerry ford that said back in the 70s, they said whats impeachment, whats high crimes and misdemeanors, he said whatever congress thinks it is. That may be where we are. Neil quid pro quo keeps coming up and i get different definitions. One is you have to prove that someone has materially or financially benefited from such an arrangement, hence the aid that was held up or we were told in the beginning was held up, turns out it wasnt, the aid got through to the country, but the very act that the leader of the ukraine will respond and get the information that the president wanted, that is a quid pro quo, that act alone is a reward for the president for his strongarming the leader of another country, and that would be deemed impeachable. Is it . Yeah, ive heard some folks say theres an olc, office of Legal Counsel opinion, that says that this type of intangible benefit wouldnt constitute a thing of value under federal laws. Thats not what i would think. I agree with you on the premise that most likely, Campaign Assistance is something that has value under a lot of federal statutes but kind of weaving into that is the delivery, the way the exchange took place and it may or may not be perfect, as the president calls it, but it was soft. It was not some sort of moblike hitman story, as adam schiff wants it to be. It was a pretty subtle general conversation. I dont see a federal prosecutor making that as a case beyond a reasonable doubt on the thing of value and also the willfulness that the president was sitting there going i am violating federal finance laws as i say these things. It doesnt play that way at all to the objective reader, i think. Neil just seems interesting that knowing you are being questioned by an Italian American anchor you would use the mob analogy. I will let it go this time. James trusty. Make a note of it, guys. Final appearance. In the meantime, a Million Dollars sounds like a lot to retire on, right . It just depends how you want to retire. A new survey out by the retirement i think thats what its called, six 6 of 10 americans say yeah, a million bucks is enough to retire. What about the other 40 . Maybe not so fast. Depends where you are in life and what you want to spend in life as you celebrate your final years in life. Jack otter is with me right now on that upbeat report. A Million Dollars sounds like a lot, right, but if you are very very young if you are terribly healthy, 1 million is a pretty good nest egg. Neil how much its how you look at it. The 4 rule is not perfect but its a really good way to get your head around retirement. You can withdraw about 4 of your nest egg every year and not run out of money. Again neil 40,000 a year. For a millenial retiring in 40 years from now, 40,000 is not going to be a lot of money. Im never going to retire so its okay. You will have to drag me out of this building. Probably wont be hard because ill be a hundred. I dont need a plan. Thats my plan. No plan. No, look, its hard for millenials to save for retirement because a lot of them, i was able to pay off my Student Loan Debt but a lot of my friends were not. They cant even think about retirement because they already are so saddled with debt from going to college. N neil hence the appeal of a lot of candidates who will take care of that debt for you. Think of those who had to work and pay off their debt. How do you feel about joe blow next to you who had it wiped clean and you had to work all those jobs . I couldnt go to graduate school because i couldnt afford it. I really wanted to. Because i couldnt afford it. Neil now you are a tv star. Thats true. Thats true. Neil its a moot point. It is interesting, these figures, we always debate what is enough. It depends on your age and if you are closer to heavens gate obviously you dont need as much. But its more of an issue if you are someone like kat, then it gets to be problematic. Realistically, assuming inflation and all of that stuff, you hear these figures, you will need 10 million, you will need more, it gets so numbingly high for a lot of folks they just say well, forget it. Not going to happen. Depends on where you live. Also, that is a danger that the plate of food is so big you lose your appetite. Neil never happened to me. Good analogy. Come on. Go with me here. I do think its really important for people just to take those first steps. Put some money in the 401 k every year. The younger you are, the better that growth trajectory. So whatever it is, if its 2 , 3 , get in the habit. Check the box that says next year it will go up neil a lot of companies are doing this thing, you can opt out, i get that, but i think if you never see it, you never miss it. Absolutely. No question about it. I dont know a lot of millenials my brother, that save part of their paycheck. A lot of them want to but they cant. This is reality. A lot of them cant put 1 , 2 back. Neil people dont get serious about it until their upper 30s. Until i was about 30, i didnt really understand it completely. Then i said whoa. Im going to go to australia to solve both problems. Seriously. In australia, they didnt pay off everybodys debt but they have a much better system for it, where you dont start paying it off until you hit roughly 40,000 in income. If you dip below, then your payments are frozen. You have to pay it all off but neil does interest accrue on the ones that are frozen . Good question. I dont know the answer. Neil that could be like a mortgage. I doubt that it is. But they also have a better retirement system in that it is actually forced and it is invested in the market. Neil they also dont have an ozone layer so they are frying over there. Die early. Neil on that upbeat note, its very good to know it depends on you got to know your expenses. Which you cant completely. Save whatever you can. More is better. Neil get a lot of clients like noelle, you never have to worry. We are just learning the government is doing its darndest to avoid a shutdown. We are hearing the senate has been meeting with the house and will approve an interim spending bill to avoid the shutdown. It has a lot to do with these 12 spending measures that have to be voted in unison or supported in unison. I believe about nine have been. Dont hold me to that. If you do, blame noelle. Its looking like they hope to have this all in place so that they can avoid a shutdown which could be weeks away. But they are trying to avoid that from happening. More after this. At fidelity, we believe your money should always be working harder. Thats why your cash automatically goes into a Money Market Fund when you open a new account. Patients that i see that complain about dry mouth, medications seem to be the number one cause for dry mouth. Dry mouth can cause increased cavities, bad breath, oral irritation. I like to recommend biotene. Biotene has a full array of products that replenishes the moisture in your mouth. Biotene definitely works. It makes patients so much happier. Neil all right. It could be a case of naming the guys behind this getting a little too greedy but peloton ipo is running into some resistance right now. Gerri willis with the very latest on that. Gerri thats right, so this stock coming in as you mentioned, a little lighter than we expected. It was priced at 27 to 29, coming in at 27 bang on the nose, a little lighter than we expected. 7. 5 billion raised this morning. You see the feed for nasdaq right here. It was an exciting morning but i have to tell you, a little disappointing for some of the insiders. Heres what the ceo told me. Listen. Are you satisfied with the way this came off . Yeah, i mean obviously theres some disappointment, you always want to trade up, but we are, you know, this is a marathon. We are in it for the next 10, 20 years of building one of the special Consumer Brands and influential Media Companies as we talked about of all time so we have money on the Balance Sheet to live our hopes and dreams and to delight more and more Members Around the world, so this is a very fantastic day, as you can imagine. Gerri it appears investors, especially Institutional Investors who would be buying into this thing this morning were concerned about two things in particular. The companys still posting losses. They dont have earnings. They lost 195 million in the most recent fiscal year on revenues of 915 million. There are also Corporate Governance issues as well. The Class B Shares that insiders hold, those have 20 votes per share. They offered the shares they put out today one vote per share. Thats an issue for Corporate Governance folks and a lot of Institutional Investors as well. On the positive side, the flipside of pelotons story, they have 1. 4 million members, 511,000 subscribers, people who pay 39 a month for their programming, for their special biking programming that they make every month, and as an aside here, they are taping 1,000 hours of these games, of these shows, of these classes, every month so think about that. Thats a lot. They have 102,000 digital subscribers. The bikes cost 2400 unless you pay for them by the month, then they are 58. They also have a new running machine, a treadmill, thats over 4,000. So the big question, how does this Company Survive a big economic downturn . Well, they would have to make some changes. What does it mean when you are so reliant on the consumer . Now, i have to tell you, mr. Foley is optimistic about the prospects for this company. He believes it has a long way to go, that they have a lot of verticals as they say in the industry to explore. They have done biking, treadmills, they are doing all kinds of things including running and all kinds of classes. Interesting story today. He was a fascinating interview. I got to tell you, wait and see. People down here on the floor of the new york stock exchange, they werent participating in this necessarily but they were watching, one eye open for sure. Neil thank you very, very much. You swear by this whole technology though, right . I mean, if you think about it, you buy the bike, so youve got the 2400 and you pay the monthly 39. 99 or whatever, but if you do soulcycle, flywheel or any of the big classes, the average class is 35 to 45 and you are doing it on average two, three, four days a week, think about all the money you are pretty much saving. Once you own the bike, you own the bike. Then its just monthly maintenance. Neil would you like that interaction with the others . On peloton, you can get up and either choose a prerecorded class or you can go live. Thats the hard part. Thats the hard part, the getting up part. For the classes, where you go in person, which i have done four or five times in my life, you actually sign up ahead of time and spend the money ahead of time. When youve got to go, youre just wasting money and you will bash yourself all day for being lazy garbage, its so much easier to be lazy garbage in the comfort of your own home with no one watching. Neil but the added dimension is people, you are engaged with other people. I think they came out too soon. I think they dont know what their Global Growth is going to be like and neil they got too greedy. They kept racheting this puppy up. Theres also a lot of issues with all these companies, as hot as they are, raising so much money in the private market that they are really fully valued and in this case, i think it is a viable product and i like it and i think its a really good concept, but like uber and wework and all these companies, even facebook in the early years, they were worth so much it really wasnt worth bidding up that price. Neil in all the commercials everyone is going so fast, though. It is intimidating. Neil slow down. All right, guys, thank you very, very much. We are down 103 points right now. Stay with us. If it doesnt pass through congress, is that it for nafta . That would be a shame. I dont want to answer that question but you know how i feel about nafta. I think nafta is the worst trade deal ever made. Were moving ahead on the u. S. Mexico canada agreement. Were again hoping to be on a path, a continuing path to yes. Neil all right. Some differences about where this whole usmca thing stands right now. It was signed off on the leaders of canada and mexico and the United States, what, 11 months ago. But its up to congress to finally put its stamp of approval or no stamp of approval. Now with all the obsession over impeachment, growing fears it might not happen at least any time soon. California democratic congressman John Garamendi on all of this. He will be leading a delegation to ukraine later this week. I will get into that with you, congressman, but on this trade deal, do you think its even going to come up for a vote this year . Well, this year is the next two and a half, three months. I think thats unlikely. We have the appropriations still to do. We have a Government Shutdown that could occur as a result of a lack of an appropriation bill. I know my work on the National Defense authorization act is not yet, in fact, we are kind of jammed up there as a result of the president repurposing 3. 6 billion of military funds that were essential in Eastern Europe now being used to build a wall. So there are many, many issues. No, i dont think its going to come up this year. Will it come up next year . I think that depends upon three issues that have yet to be addressed by the negotiators. So until theyre addressed, i dont think this will come up. Neil you are looking for worker protections, that American Workers arent screwed and all that. I get that. But on this trip to ukraine youre planning, what is it about . What are you doing . Well, this trip was actually planned four months ago and we were going to look specifically at what is known as the european reassurance initiative. This is the effort, about 6 billion this year that we had allocated to our allies in europe, mostly Eastern Europe, building the facilities to address the russian incursion into ukraine. It also so we were going to look at that. In the intervening time, we have the president pulling 770 million out of that program and these are Critical Infrastructure so that our troops can actually engage if thats necessary in Eastern Europe and of course, we were going to do the ukraine thing, looking at the military support that were giving, the training as well as the equipping issues. Now all of this is caught up in this impeachment issue. The president s dereliction where he seems to have abandoned his oath of office as well as the security of europe and certainly ukraine, our own National Security, and finally, putting our elections in jeopardy neil do you think he should be impeached . I think we ought to really get into the substance of the issues that have been raised as a result of his conversation with president zelensky. Neil early reports had that he was delaying or denying aid, its not factual, that its not right, that he did ask to get some information on joe biden but that was the extent of it, is that enough, is that a high crime and misdemeanor to you . Well, certainly it would put the American Election system in jeopardy. Calling upon a Foreign Government to intervene in our election process is not illegal, its an abandonment of the fundamental principle. Is it enough . I think when we stack everything up and we get the facts, you got to get the facts out there, is the whistleblowers allegations true and theres a lot of depth, a lot of opportunity to investigate that. Neil sounds like you have already decided. If the facts play out, i dont think theres any doubt that we must carry out our constitutional responsibility of holding the president accountable for what will clearly be a criminal action, campaign laws, extortion, all of those things are out there. We would have no choice but to move forward with impeachment. Once the facts neil looking at the current crop of democratic president ial candidates, saying joe biden has not been thoroughly investigated, others say it has, not really sufficiently so, that it raises enough questions that he would be a compromised nominee. Do you agree with that, Elizabeth Warren has jumped in the polls ahead of him, thats probably indicative of this angst thats growing in the party that he should not be the guy . I dont think thats the case. The issue of biden as the Conspiracy Theory that the president put forward in his conversations and in most recent tweets and other communications, all of those things were debunked previously. Neil they actually werent, right, sir . They really werent, because by the time people wanted to get serious about it, the guy who was doing it was gone, right . So we dont know. If you want to investigate that, do you think its a good idea that it should be investigated . Well, you are starting at the end of the story. I want you to start at the beginning of the story. There was in ukraine in the 201415 period enormous corruption. Neil absolutely. And the european countries, European Union countries together with the United States and the entire United States foreign issues, both the military as well as the intelligence and the state department, all were trying to eliminate, reduce the corruption in ukraine. Neil you are quite right about that, congressman, but in the middle of all that came the issue with hunter biden and sitting on this natural gas concern out of ukraine without any background in the field, without any background in investment per se. Im wondering does that raise questions to you that his only qualification might have been that he was the son of joe biden . I dont know that that is his only qualification but neil he had nothing in the energy field, he had nothing in natural gas, he had nothing related to ukraine. I will take your word for that. But thats not an issue of corruption. Maybe you could play a useful role in what was a very serious problem in ukraine. Neil would you examine both of course. Neil got it. But i dont want you to lose focus on what is the principal issue before us right now, that is what the president has done. Thats what we need to deal with. The issue of biden will certainly play out neil examining both to put all doubts to rest . Of course. Some of that has been done with regard to biden. If theres additional concerns neil not fully done. But fair and balanced, like you said. Sir, always good seeing you. Safe trip to ukraine. We just had congressman garamendi on that hes open to investigating the hunter biden ties to the old Ukrainian Government, i say the old Ukrainian Government because everyone involved from the prosecutor and eventually the entire government, all thrown out in a corruption scandal. Were not here to besmirch the Vice President but i want to point out at the time everyone said this was put to bed, this was thoroughly investigated, i actually do research on this show. It was not thoroughly investigated. Im not threatening his path to the presidency any more than i am trying to wave off the former Vice President , but it is worth exploring and he is open to exploring that. Back with my panel. Noelle, how dangerous is it then to really get behind all of this, just to look into all of this, the sequence of events . I think this is the problem. He was in a real hot seat there, i feel for him. You were doing a very fair interview. You werent on any side of it. But you said if we are going to look at trumps involvement, then are we also going to look at hunter biden and what role he played and he said yes. Neil his qualification was he was the son of the Vice President. But the interesting part here is he said but, i was like oh, my gosh, he turned it and he said but, neil, i dont want to lose sight of what the main topic is which is the impeachment of trump and what he did. Neil im not a lawyer and i dont know whether its Impeachable Offenses, whether you are trying to extract favors, get dirt on a potential opponent, not good, especially with what the president just survived, the whole mueller report. So using a foreign power to possibly influence yet another election not a good look. Neil not a good look. Just saying, you know, just go through the whole thing in the order and investigate it. I couldnt agree more. I dont understand why he would say the focus has to be on trump. Yes, trump is the president and again, i agree with you, definitely should be looked at. But at the same time, youve got biden who has warren nipping at his heels, but he is the frontrunner, could very well be the next president or at least the democratic candidate for the next president so this is just as relevant. I think anyone who is being politically honest and idealogically honest would have to agree with that. Neil you know, the issue becomes, especially when i hear and i assume it at face value when i hear journalists say this was thoroughly vetted and everyone looked into it, turns out that it wasnt. So i just thought a dumb clark kent, lets look into that. How is it hunter biden had any background in this field that warranted serving on the board of a Ukrainian National concern, no. Did he know anyone who had ties to ukraine. No. Im not saying that makes him a bad guy any more than the former Vice President a manipulative guy but it is curious and worth exploring, because those are plum assignments if you sit on the board of a major natural gas concern. Of equal value to pursue as you look at the president and the timing of his comments to a leader of another country. Cavuto, superman, i like that a lot. Neil theres only so much i can do. As a reporter, you see this and roll your eyes. Why would biden be on the board of a Ukrainian Oil company, because of his last name. I think we should have much stricter rules over what people in power in a very very important government position can do overseas. Neil this would not be the First Political family that used its name. Trumps sons, the clintons using their connections overseas. Neil your family with the otter name. It adds to the cynicism of government and it makes it much harder for them to actually do good things. Its really bad. I do want to say that on the specific question of the corruption and the pressure that was put on the ukraine to get rid of that prosecutor, that was very broadly held. Christine lagarde neil the whole world wanted it. Exactly. Its not as if that was a specific biden request. Neil the prosecutor wasnt only looking at biden and the ties there but the entire gas industry. He was being very heavyhanded about it. There were diamonds and gold found in his lieutenants apartment. Neil like theres something wrong with that. You know, but it is interesting, im not tying the two together, that none of the Democratic Candidates have raised this against joe biden, in fact focusing right now on impeach donald trump, impeach donald trump. But they have quietly got to be salivating at the prospect that maybe this is helping make the frontrunner damaged goods and helping certainly Elizabeth Warren. Not one of them has raised it thus far. I would imagine politically know what i would look for . Look at the money side of it, as always. I would love to see what Elizabeth Warren, kamala harris, bernie sanders, i would like to see what their fundraising support looks like after this. Because i guarantee you, somebody with one of the pacs that represent them is going to put Something Like this in a little packaged email and go and try to get support. Neil always about the money. I deeply admire that. We have a lot more, including not only what happened with a Certain Police car that was a tesla that lost the bad guy, but peloton and that bike from heaven i guess to hear noelle put it. Thats the risk with these teslas, right, that can happen. What do you think . I guess, but like didnt he charge it . Before he left . I dont know. Neil might have been on the final bit of juice. I guess. In all fairness, i mean, this morning, i forgot to plug in my phone but while i was getting ready, so now im only at like 20 battery. I felt like such a fool, right, for forgetting that. At least im not this cop. The guy got away. Neil what happened, had he charged it . Ralph is talking to me now. Halfcharged. You know what, though, if they were chasing somebody neil how many miles does it get on a full charge . 200 . Im surprised that the Police Department hasnt sued tesla or elon musk because they are selling them faulty cars. Neil it might not have been the case here if it was half charged. Its the wrong tool for the job. Electric buses, great. Lets get battery packs a little farther before police cars. Havent they seen the o. J. Chase . They can go on forever. Neil theres only so much you can do. But this technology is here to stay, i think. Im not a huge fan because i think problems happen, but all the major car makers from volvo to ford, bmw, offering in the case of volvo, i think another few years all their vehicles will be electric. Tesla is an incredible car to drive. If you have ever driven one, the acceleration is awesome but its just for a crucial job like getting bad guys, you might want the old reliable neil or at least a hybrid. With a hybrid, you get a little have the option. It really depends whose side youre on, what perspective you look at it from. From the criminals perspective, this was a great development. Neil looking in his rear view mirr mirror. Good fortune. But this technology is here to stay. Its fair to say its here to stay. I will be interested to see when exotic cars can give tesla a run for their money. Lets just say rolls royce, say bugati, ferrari. In that market, tesla, they have models over 100,000. Lets see what happens when some of the exotic, welltested brands get into that market and give them a run for their money with some of those luxurious cars. Neil all i know porsche has one about to come out. Neil funny you would know that. He knows everything about this. Neil he does. You go out west, they are everywhere. Well, the plaza hotel just got a new tesla as their hotel car to take people around. They got the doors that open. Neil i notice you noticed it wasnt the best western. Hanging around the hotel. Neil i just know this. Right now in new york city you can drive two blocks on a charge. Neil you dont even need a car. No, i dont drive. I cant. Im not good at it. Neil we are much better for it. All right. Having a tough time today. The bike maker, its going to be a tough debut. Im wondering what ultimately is the indictment on that, or is it just they bit off more than they can chew. What do you think the ultimate read will be . I think its that these companies are simply going to market with a full valuation and so theres no reason to neil they racheted that price up. Did they ever get the thing solved with the music, when they were using music and the royalties and all that . Neil we dont know. Were out of time. Okay. Neil other things to do like go to commercial. More after this. Imagine a world where nothing gets in the way of doing great work. Where an American Icon uses the latest hr tools to stay true to the family recipe. Where a music studio spends less time on hr and payroll, and more time crafting that perfect sound. Where the nations Biggest Party store can staff up quickly as soon as its time for fun. This is the world of adp. Hr, talent, time, benefits and payroll. Designed for people. Neil you know everyone is talking about Donald Trumps phone call. Have you ever heard of some of jfks . Some doozies were exploring 4 00 p. M. Eastern time. You might want to cover your ears. Im not even talking about charles paynes phone calls. Do not want to go there. Charles im resigning before they come out. No sense of defending them. Good afternoon, everyone, im charles payne.
