Dagen and the worry that also pentup would be inflation, which you saw the yield on the 10 year treasury. Maria will be talking about inflation and higher wages. You want to be talking about higher wages. Dagen we are talking about it today. Maria i think also you make a good point in terms of insane pentup because he did say this is going to be cumulative. This tax plan is going to impact a lot of industries over the longterm it is interesting when asked about rollback and regulations he said yes i speak to my friends in media, telecom, theyve seen the impact of a robot. We havent seen it in the banking sector. Doddfrank hasnt seen a change, but we havent seen it in the banking sector. Thats a huge runway of growth. Hard to deny with reality. The inside of that and Everything Else in terms of now, is there a shift in the administration in terms of how theyre addressing business in the economy and are you seeing a moderation for this president all kind of plays into the bigger picture. The way he approached immigration and now hes getting hit pretty hard by his base on that then he was on some of the cable news shows last night. Ending terry shift in the Administration Outlook in terms of how they vote on economies, politics and business is a big question. Dagen is just going to say and coulter called it the lowest day of the presidency. However, this is what donald trump has been doing all along and everyone ignored it. The New York Times tried to make that meeting about his Mental Fitness and he was trying to prove to the American People that he was stable. That is literally how they couched out. I just think that hes making deals have not said hes been doing all along in the Mainstream Media focusing on Everything Else but the economy. Maria good wednesday morning, welcome back, im maria bartiromo, thanks so much for joining us. Wednesday january 10th, top stories right now 6 30 a. M. On the east coast. Lastminute lifeline for daca, judge blocks decision to end the obama protections for thousands of immigrants who entered the country illegally as children. Ruling came hours after President Trumps bipartisan negotiations on this issue. This should be a bipartisan bill. This should be a bill of love but also has to be a bill where we are able to secure our borders. Tremendous number of people and drugs pouring into our country, in order to secure it, we need a wall. The Border Security agents, the ice agents, we have to give them the equipment they need. We have the close loopholes. Maria details this morning as the president bring it is art of the deal to daca, plus how the new ruling could ill pact negotiations going forward. Markets hit record high yesterday for the 75th time since President Trump took office, pretty incredible. Up half a percent. This morning we have a pullback underway. Markets are pulling back from record highs, we are expecting markets to open down with dow down better than 100 points and nasdaq down 30. In europe this morning, similar story. Stocks pull bag back. And in asia overnight, markets closed mixed as you see here. Shanghai the winners up quarter a percent apiece. Can we get a patch for the patch, microsoft that micro ship is slowing down computers and keeping closer eye on apple this morning as details as french officials have launched investigation in battery scandal the news sent shares soaring yesterday. Take a look at kodak up 48 . Walmart customers getting more than than they bargained for. The the video as bats invade a Texas Walmart store. Wow, okay. We are going to show you what happened when the bats came in right near the refrigerators at walmart. All that coming up this morning, first top story this half an hour, late last night a federal judge in california temporarily blocked the Trump Administrations decision to end the obama era program, protects 700,000 who entered illegally as children, the search for permanent solution for the socalled dreamers. When this group comes back hopefully with an agreement, this group and others from the senate from the house comes back with an agreement, im signing it, i believe i will be line signing it. Im not going to say, i want this or that, i have a lot of confidence in the people in this room that they are going to come up with something. Maria joining me to talk more about that mike short, mark, good to see you, thank you so much for joining us. Good morning, maria, thanks for having me. Maria when the group comes back, i will be signing it, he will sign whatever they give him or insist that theres funding for border wall included . Well, maria, i think we have been very clear about several things that we want with daca deal that are necessary, one is Border Security, first and foremost we have just said not just from political perspective, a border wall is necessary to them to secure the border. We want to end chain migration and tend visa Lottery Program, those are three requisites that we need to solve the daca program. Maria what about the ruling from california judge basically saying the president cannot stop the Dreamer Program while this is continuing to be debated, the final judgment until that final judgment is reached the program is continued and those already approved for daca protections and work permits must be allowed to renew them before they expire, thoughts. Yeah, lets keep in mind a couple of things that the circuit courts have already ruled obama decision was unconstitutional and they were taking action because congress didnt act, they know that what they were doing was not constitutional. The ninth circuit you know is consumed of leftwing judges in San Francisco. They have overruled in higher courts just like they were with the travel ban, we expect the same scenario, we will continue to move forward and look for a solution and legislative fix to daca, we need a legislative fix to solve. Maria you think that this is a distraction . I think this would be appealed and continue to move forward in trying to find legislative solution to the problem. Lets keep in mind chain migration and visa lottery. The two incidents we faced in new york which a terrorist ran over five individuals and killed them, he came here via chain migration. The individual who im sorry, he came in visa lottery and brought other family members. The new york city subway came on chain migration, it is time that we end those programs for the safety of americans, it is also time that we secure our border, democrats have voted time and again to build a border wall, they did in 2006 with secure fence act including Chuck Schumer, 54 democrats voted for building a wall in 2013, the only reason they are opposing it is because donald trump is president. This isnt about politics, its time to leave politics aside. Maria politics are all over the tweets coming out of Chuck Schumer, marc, what do you say to Chuck Schumer who say this is on twitter yesterday, the Trump Administration wants to cut back smart Border Security measures to pay for their wall. Why cant we reach a deal on daca, because donald trump insistence on in effective and absurdly expensive border as part of any deal. Chuck schumer has voted for the wall, he voted for the secure fence act. Maria exactly. The president has made the case that in many cases its better that we actually have fencing so we can see through the other side of the wall. These are things Chuck Schumer has voted for. Its all political. Its not about policy. It is necessary to prevent on so many drugs coming into the country right now. Its only about politics, maria, and time we get a solution to the problem. Maria we have seen sound bites from past president s from bill clinton to george w. , how far is the president willing to go, are you willing to keep this up that you are not going to do daca deal without funding even if it means the government shuts down . Well, maria, theres no reason the government should shut down over this, a budget should have been in place four months ago to fund the government, the white house budget in congress, should complete september 30th, we are now in january and the democrat position has been that we are not going to fund the troops, we are not going to fund the National Security needs of the country, we are not going fund all the federal workers until we get a daca solution, theres no reason why those two issues need to be tied together. We are anxious to solve the daca, why the democrats want to shut down government hopefully we dont and get a solution in the next ten days. Maria what was senator feinstein tried to do yesterday, would you sign daca and deal with security later, did the president understand that she was trying to get a daca bill across without border wall, he said, yeah, yeah, we want to get a deal done not recognizing, i think, what she was actually asking. Well, i think that chairman feinstein has been a constructive voice in a lot of the discussions and we have high regard for her but certainly a lack of trust, maria, to say lets just do one piece and come back and do Border Security when you and i talked about the fact that they voted multiple times for Border Security knowing that they can authorize without appropriating the dollars to go do it. We want to make sure that the dollars are appropriated and we actually make that theres a physical barrier on the wall. Maria you think a deal happens in the next week . Im confident we will get a deal, maria. Maria Border Apprehensions are down 40 for the first year of President Trumps term, this is apretty significant number, what do you think is behind this . I think that theres a couple of things that are behind that, one honestly is the reality that you have a president who is sincere about securing the border and recognition for brave men and women on the border doing their job and interior enforcement and in many cases enormous price to pay for people who are human traffickers who bring individuals across the country and then and then if we are doing our job, they are return and theres a sense why should we go through all challenge, human risks, the health risk, price risk if we are going to be sent back, theres a reality that the administration upholds maria the idea that theres a new policeman in town, that the apprehensions are going to be much closely watched has actually stopped people from even attempting. Thats exactly right, maria. Maria marc, let me ask you about the florida decision, people are wondering why the administration has told florida that it will not consider new oil and gas drilling off the state of thats a backtrack, we know, on plans that he wants to expand offshore drilling all around the country, why not florida in. Well, keep in mind, the administration is anxious to make sure that Americas Energy dominant, its why most recent tax relief package, the decision there is one of the secretary of the interior is making and i think its more appropriate for me to allow him to answer the questions about florida specifically but we have relieved a lot of regulations to make sure that america is able to harvest its Natural Resources and you will continue to see the administration to do that. Maria does he have the governor of florida didnt want it and pushed back and the president agreed we dont need to do it off of the shores of florida. Theres a lot of local politics involve there had in florida, theres no doubt. I think that thats one that the secretary of interior is going to have more information for you, maria, about the decisions they made. Maria marc, good to see you this morning. Thanks for having me on. Maria coming up battery battle, demanding answers from apple after company admitted to slowing down older iphones. Watch your head, that could have been the warning at Texas Walmart as bats were spotted flying around the store. More of this dramatic video, back in a minute. Maria welcome back, President Trump receiving credit for getting north and south korea talking again. Cheryl casone with the details, cheryl. Cheryl south korean president moon jaein thanked trump for bringing the north back to discussion. He also down played any notion that the talks could hurt the relationship with the United States. Microsoft warning that Software Patches slow down from personal computers and servers, Companies Say that fixes for security flaws microchip could degrade performance. Shares of intel, by the way, down 7 , excuse me from just one year ago. And then theres apple facing new questions about its battery slowdown problem both here and abroad, republican senator john thune of south dakota wrote letter if hes considering a rebait to customers and in France ConsumerProtection Agency says that its opened investigation into apple for potential deception, apple acknowledged that slowed performance of iphone as batteries aged from prevent devices from powering off. Obviously consumers think its for other reasons. Trouble in apple store, store evacuated yesterday after an iphone battery overheated, slightly injured one apple worker and after all that here is the stock, maria, its slightly lower in the premarket, well, up down 1 almost, but 172. 70, a lot happening with apple this morning. A lot in the news, back to you. Oh, my gosh, i didnt tell you about the bats. Bats flying around and you love the video, this is insane, look at the Walmart Grocery store in texas, shom shoppers ducking for cover, others taking out cell phones to film what we saw, look at this. They did serve as distraction for shoppers, walmart says they are aware of the incident and working to correct the problem. Here is walmart stock, up nearly 47 over the last year, back to the walmart, maria, youre right, i forgot to bring you that one, thats probably my favorite story of the day so far. Maria all right, cheryl, thank you, i have your back, dagen, lawmakers into this apple slowdown, you know, we have been talking about a new Regulatory Environment for the tech sector, youre really seeing it when you see the fines against players like google but the apple story is about something different. Dagen we do not need lawmakers looking into this issue. Apple, again, Companies Act in their own best interest and if they think anything is hurting the brand, hurting the customer, i just cant dont they have Something Better to do with their time . Maria when we were talking about people saying apple need to do something so that the phone is not addictive to children, how about the parent taking the responsibility and saying, get off the phone and youre not allowed to use the phone. Its great to have the phone because then they dont bother you. Of course, youre right. Maria blaming apple for getting addicted to the phone. I mean, of course, of course. Dagen apple has had Parental Controls available to parents ever since it launched the app store almost ten years ago, so apple has always been on this, now you have pension fund banding together saying, we need more for the parents to protect the children, no, you dont, actually its called being a parent. Even for the adults they have i started using it myself, you cant get text when youre driving. Thats a cool feature. Maria good analogy, actually. Dagen they want more of that. Jana and new Corporate Responsibility i admit, listen, i had to just upgrade from my 5 maria you were on the 5. You finally have the 8. I finally stepped up. I noticed mine i couldnt get the upgrades, i admit i had to upgrade a little bit. Maria i had 6s and upgraded to 10. You like it . Maria youre used dagen goes off. Maria constantly. My grandson maria i have to speak to him then. We will take a break, kodaks new focus on crypto currency could bring life to brand, we will check it out next. Im a concrete mason. I had severe fatigue, became diagnosed with hodgkins lymphoma. He was a good candidate for immune therapy, which is allowing his immune system to attack the tumor. Learn more at cancercenter. Com maria i dont know how it works. Tell us where is the money, you know, who is getting paid and who gets the benefit, does kodak get a lot out of this or photographers, thats the real business. Understand theres two announcements, kodak associated with photographers have more control over Creative Work and when a photo is used, the technology of the block chain allows for Greater Transparency about where things are, the Mining Equipment kodak putting name, people who buy that equipment, essentially rent it for two years will have to share half of their profits, kodak is saying or agreement is saying that they will get guarantied hundreds of thousands of dollars a month but the truth is that mining gets more difficult over time. I feel like when we hear its quick to write it off. Remember long island ice tea changed its name block chain. Block chain to try to make money. Its different. This is based in something real. Yes. Something about the potential for the technology. Absolutely. And Bitcoin Mining is a way fundamentally to create a bitcoin transaction, you need mining, another party who is competing for a reward in bitcoin to actually process that transaction. Now the problem is right now more than. 1 of all electricity, despite how small a market this is is consumed by bitcoin already. Maria wow. What happens in the future . Dagen i was going to say thats one of the things people crypto currency skeptics are calling for people on the left who are up in arms about Global Warming and Climate Change where are they on this issue that ultimately that crypto currency markets will feel pressure from them. On a personal level, if youre renting the Mining Equipment, who is paying your electricity bill . Yeah. One of the benefits the photographer now has a documented copy right of their photo, thats a big thing, a lot of these are being used in entertainment websites and they are not paying the photographer, the use, a lot of lawsuits, this will help the photographer be able to claim it was theirs, copyright. Block chain is not just about currency or exchange, its about decentralization of accuracy. Thats why people say it could revolutionized democracy, medicalrecordkeeping and other arena. Maria interesting stuff. Susie, thanks so much. Thank you. Maria we will be right back. Stay with us. Maria welcome back, good wednesday morning, thanks so much for joining us. Im maria bartiromo, it is wednesday january 10th, top stories right now 7 00 a. M. On the east coast. President trump giving the American Public the firsthand look at the art of the deal. Commander in chief allowed the press to film bipartisan negotiations yesterday on immigration. It was at the white house, the administration was dealt a blow following the meeting after a federal judge in San Francisco blocked this decision to end daca. White house director of legislative Affairs Marc Short weighed in the last hour. The ninth circuit as you know is consumed of a bunch of very liberal leftwing judges in San Francisco. They have been overruled in higher courts just as they were with travel ban, we would expect the same scen scenario to unfold. We need a legislative fix to solve the problem. Maria more on immigration battle this morning. Another victory for President Trump, the markets are on fire, the dow closing at record high yesterday, this is the 75th record high since this president took office. As you can see, very strong performance, this morning, though, we have a pullback underway, futures showing the markets will open lower this morning, pulling back from alltime highs yesterday, dow industrials down 117 points, the nasdaq down about 40 points, thats twothirds of a percent lower on the nasdaq, in europe similar story, we have stocks being sold, although ft just moved in positive territory, its up twothirds of 1 point. Dagen mcdowell, Connell Mcshane and bob. Im bringing my own cup. Maria its not expensive enough Starbucks Coffee. Many, my god. [laughter] dagen i want to hear the story. Maria all right, we have a lot to talk about this morning. President trump pealing back the white house curtains giving the public rare glimpse in bipartisan negotiations on Immigration Reform, yeah, it was raw all right he held firm on Key Campaign Promise to build a border wall and he forced both sides to publicly lay their cards on the table. All while tv cameras were rolling, they were there capturing the entire meeting, watch this. Im appealing everyone in the room to put party before party and sit down and negotiate and having the democrats in with us is absolutely vital because it should be a bipartisan bill. This should be a bill of love, we have been talking about daca for a long time, i have been hearing about it for years, long before i decided to go into particular sign of work. Democrats are for security at the borders, there are obviously differences, however, mr. President on how you affect that. When we talk about just daca, we dont want to be back here two years later, you have to have security. I will take the heat, i take all the heat you want to give me and i will take the heat off both democrats and republicans. My whole life has been heat. Maria 55minute coverage comes days after tellall book sparks debate on the president s mental stability. Nicholas johnston, thanks for joining us. First lets talk about the meeting yesterday, your reaction. What tau great episode of the trump show for the white house, thats exactly sort of the image that the president wanted to show being in command of a room, negotiating the details, setting needle between the both republicans and democrats, thats exactly what our reporting says a lot of people in the white house say they see President Trump day in and day out, pushback on wolff book, i dont know if they planned, this but a perfect way to respond to allegations. Maria yesterday dian feinstein came up and said, look what about the a clean daca bill and the president said, yeah, we want to get the daca deal done, was it just really all for the maras or was there actual negotiating going on in front of the cameras . Thats a perfect point, there was a lot of talk in this meeting that didnt move the ball at all. Maria of course not. Mitch mcconnell said the spending bill is separate from daca, Chuck Schumer followed him, no, the spending has to include daca, we are no closer to a solution on this either shortterm or longterm today than we were before the meeting. The president got hit, i think, its interesting by his own base last night to some degree and obviously he pays attention to that kind of thing, lou dobbs maria dobbs was upset. I checked right before i was about i asked you this question and he hasnt, he took his tweet from last night that he september at 7 00 oclock at night and pinned to the top of his profile so he wants everybody to see it, the one that says that our country needs security of border wall to be part of daca move, hes trying to say to his base, listen, im not giving up on this wall, im not selling you guys out. Maria he needed to do that because of diane feinstein. One part of that meeting that made me stop when the president started talking about comprehensive Immigration Reform. That gets conservative republicans heart attacks because you start talk what happens with skilled worker visa and immigrants who are in the country illegally separate from being brought here as children. Thats when these kinds of proposal collapse when the republicans are in power during the bush years and i think a lot of trump sort of America First supporters who are focused on the wall were not happy that hes talking about comprehensive reform. They want to see security first. Dagen this is going to require that both sides give something, correct . That if youre going to get any movement on immigration and the daca issue it seems like and i might be off by this, because of the court ruling on daca trying to essentially keep it in place that it might give congress more time because, again, thats supposed those protections are supposed to expire in march, but both sides are going to have to give something on this and i think that that was on display yesterday as well other than it being, you know, some sort of show that the president is a stable leader. I think the Court Ruling May take a little bit of the pressure off. This is being litigated every which way and so as i think marc short was on the program, theres not a judicial solution to this, it has to be legislative and i think the key things we are looking at is where they draw the lines, how much security and border funding and wall construction is enough for the republicans to say we have what we wanted and how much is there for the democrats to say we have enough that we wanted, it wont be a complete solution for the issue, manager that pushed it into next year, past the midterms and thats what we are looking for, where the lines are being and the worry right now with eight days to go, im not seeing where those lines are yet. Dagen quite frankly, people on the far right arent going to be happy unless the 600,000 dreamers and 11 Million Immigrants are rounded up and kicked out of the country, lets be blunt. President trump has never given any indication that he we wanted to send dreamers back to their home country. Maria right. Lets move onto white house chief strategists story, he stepped down as executive chairman of Breitbart News yesterday following the public fallout with President Trump, breitbart announced bannons departure on the website, steve is part of legacy and we would always be grateful with contributions and what he has helped us accomplished, bannon said im proud of breitbart team has accomplished in building out of world class news platform, exit after explosive quotes published in the Controversial White House tellall book fire and fury, what do you make of this in. What an incredible political suicide in just perhaps the past ten days, as recently last week bannon was still talking about President Trump about possibly running Reelection Campaign and telling friends that if trump didnt win he would run himself, now, that is all over, he lost connection to all trump allies, President Trump is calling all around friends, pick me or him, trump or bannon, lost financial backing and platform at breitbart. Does he still try to be player in 2018 campaign . We have seen reporting that he may start political nonprofit but the presence of bannon is much smaller, incredibly smaller, almost nonexistent ten days ago than the book came out. In the pr category, what would you advise him to do, he has put himself in death spiral here and i dont know if its recover nbl the shortterm, does he do a pullback or go quiet for a while . Maria he didnt deny he said it. While he was in the white house. Maria is it possible and i know people are arguing whats true and what isnt true but then hes actually in the white house with his job as chief strategists and hes trashing the president s kids . That shocked us when it came out. [laughter] we didnt see that coming at all. I will say about steve bannon hes no shrinking violet. Remember what happened in alabama, he went against the president s wishes, i will certainly look for him to see if he can wrap financial backers, chinese billionaire who is currently in exile in new york and if hes trying to raise money, trying to launch a new platform, i dont see bannon shying away from this debate. Dagen what about the number one nationalist in the administration is out and out of a job, meantime President Trump is going to the biggest global ist in some ways, that was the one thing in the Michael Wolff book, theres a lot of stuff thats been questioned, journalistic ethics and whether some of it was completely made up but if you think about it, nicholas, one of the main arguments is kept going back to this jarvanka term versus bannonites. With the moderation of immigration versus the bannon wing, is there something to that . Thats a really good question. The way we describe it, the globalist and the nationalist, the America First crowd and the javanka, gary cohn crowd. Remember, stephen miller, he is still there driving a lot of policy particularly in immigration. 15 minutes before i sat down in the chair in new letter, dont look for trump to go to davos and say things like other people say, he will bring the same message he has brought everwhere. Maria you think hes going to communicate the America First message in the face of all of those globalists . I think he would love to do that, International Bankers and all of all places at switzerland and gave campaign speech. Maria he wants help on terrorism, he wants their help on north korea, so look at how the un speech he gave, both of those kinds of things, everyone, everyone here puts their country first, but that doesnt mean we cant work together, i think thats the message he will bring. Dagen dont expect the apologist that president obama expected him to be, giving speeches about the United States, expect President Trump to poke a lot of those globalists in the eye, not literally. [laughter] maria but thats also why hes loved by his base, by the way, hes not afraid to poke, hes not afraid to push back, he said it in the sound bite, i will take the heat. Dagen he didnt need steve bannon to tell him how to connect with the people in this country who were forgotten. Maria that was his economic message. Thats right. Maria nicklaus, good to see you British Airways ditching declining seats. Paying more for coffee cup in new measure taking place at some scar bucks locations, yeah, youll pay extra for the cup, coming up. How do you win at business . Stay at la quinta. Cheryl House Majority whip Steve Scalise plans to return to the capital as soon as he can after surgery is completed, hit by bullet in the hip chattering bone and damaging several internal organs. Now the gunman was shot and killed at the time by Capital Police at that scene. Well, trouble on a disney world rail train, one of the doors, the red line popped open midway through the ride, they were on the way to epcot theme bark, the incident happened on saturday, it removed after repairs, no one injured, disney shares slightly lower but theres the oneyear chart of disney for you. Well, if you fly on British Airways dont expect to be able to lane back and relax at least on shorthaul flights in an effort to cut ticket prices, they are removing reclining seats in economy on 35 planes later this year, theyve stopped providing free food and drinks to passenger in economy, drawing complaints that they are becoming basically a budget airline, they will keep reclining seats obviously for the longhaul flights. Meanwhile starbucks customers in london may be complaining soon as well, starbucks will be charging coffee lovers an extra 5 cents for cups as part of latest echo friendly plan, they are hoping the new lurks atte levy encourages customers to bring in reusable cups, all the money raised will be donated to environmental causes. And lets bring you back home, on this side of the pond starbucks introducing first new expresso in 40 years, the blond expresso, new drink is supposed to be a smoother, sweeter expresso, its in stores now, starbucks up 2 from a year ago, maria, theres the oneyear chart and i have to say, you werent here, maria, so i tried it without you, im sorry, but it was actually lovely and i always get the blond, you know, coffee in Starbucks Coffee anyway and this is the blond expresso, a little bit lighter. Maria im not sure how i feel about the cups and 5 cents extra, we have so Many Companies paying thousand dollar checks to people to employees and to raising wages and trying to pass on the savings in tax plan and you have starbucks charging more for a cup, what do you think dagen . Dagen people overseas might put up with it but as opposed to the blond expresso, i kind of like the sour yet strong brunette, expresso. One of the mistakes that people made is the impact tomorrow will have huge cumulative effect and im surprised that people have uncompetitive tax system will be good for america. You will see companies doing things in short run like increasing wages, a bunch of stuff like that and onetime bonuses and we may do something, announce sometime later but over time that retained capital will be use today grow businesses r d, hire people, wages and over time good for america. Maria ceo and chairman jay jamie diamon, joining us now to talk more about that vice chairman kate barton. What should we be thinking about what business is focused in terms of adapt to go new rules . We are excited that it happened and now i would say that everyone is digesting it and trying to figure out how it applies to companies, Public Companies are consumed with trying to get it stated in financial statements, its a lot of work. Tell us on this part of tax plan is repatriation, you are the expert, you are the expert on this thing, what are they telling you about deploying funds that are coming back . New sources of cap tag, you will get cash back on earnings and then you also have just the more capital by virtue of the rate going from 35 to 21, those two new sources of capital, companies will capitalize on what they do in terms of how they spend, some companies will give back to employees through businesses and they are doing that trying to get that paid, so under the tax it will get deducted last year and then some of them are going to do share buybacks and some will do Capital Expenditures because of 100 bonus depreciation, i think each one will take a different tact depending on what they are and some will do m a activity. Jamie made the point that we will see some stock buyback but the good thing will be capital redeployment and m a will be projected to be a good year. Maria we are hearing m a chat, i have no doubt that we will see more deals this year and its really going to pick up, it was slow last year because of the uncertainty but you saw the animal spirits begin to take hold in the fourth quarter. Dagen what about the benefits because we talked so much even before the deal got done about the benefit to smaller businesses in this country and with the at least the cut or the benefit to the passthrough entities, what do you see happening there because the treasury is going to take a year maybe two years to write the rules for that for that tax cut which actually expires in 2025. Absolutely, for really small passthrough organizations its a good thing but anybody over 4 500 of income, they will look at passthrough, the right vehicle for them or convert to c corp. , a lot planning on what is the right choice of entity. Dagen which could potentially mean a bigger benefit to the economy as a whole because that is permanent, so you have businesses that wont be grappling with a tax break that expires. Exactly. One quick question on the individual side, i wonder whether we will see, now that this is a reality, we had so much debate before the tax plan went into effect about state and local deductions, now that its there, are we to anticipate the states react to go that and making changes in their policy, new jersey, new york . Maria we are hearing rumors that new york is trying to turn it into charitable donations. Is that going to work . Dagen Governor Cuomo talked about it. Maria he wants to sue the federal government. Theyll be Quick Reaction to Something Like that. I think theyll be a knockon effect by a lot of the states, specially the highertaxed states and employer tax, will they take some income tax and recast it in a different way. Maria as payroll tax. Thats an option. I think we will see more of that. They are already acting quickly. Are you hearing that in the major affected states like new york . Definitely. Yes, absolutely, i mean, people want them to react. Maria you wonder how the irs is going to react and will they allow that kind of treatment, changing to it payroll tax and charitable donations as oppose to actually paying taxes . Payroll tax might be something that is more, you know, substantial and so we will see, we will see what they do. Maria kate, thank you for your insights, legal twist in daca debate, a federal judge temporarily blocks President Trumps plan, what the move means for immigration negotiations coming up. A federal judge temporarily blocks the president s decision to end the obama era protections. The really came just hours after President Trumps bipartisan negotiations. If you dont have the wall in certain areas. If you dont have the wall you cannot have security. The walls and fences that we currently have are in very bad shape. We have to get them fixed or rebuilt. They bring the art of the deal to the daca negotiations. A legal dose he dealt over salacious details it in an verified document. We are taking a look at whether he has a case this morning. It was another big day on wall street. For the 75th time since President Trump took office. The nasdaq is down about 30 points. One half of 1 . A similar story although the ft 100 is up. Fractional move. They are both lower. This morning in europe. Markets closed mixed as you will see here. Down a quarter of a . That was pretty much of the trent. The shocking amount of generation xers who say they cannot afford to stop working. Alexa hits the road. It may hit a roadblock though. The new device the social media giant is using right now. Late last night. They blocked the Trump Administrations decision to end the obama era program. To negotiate a permanent solution for the socalled dreamers. He actually said he doesnt have the right to do this. You do have to go through congress. Lets assume he doesnt. That was a temporary cap. In joining us this morning to talk more about us judge, good to see. We know the ninth circuit has been poking at this this president since he took office. And here they go again. She has the same last name. The plaintiff in this case is janet napolitano. As the president of the university of california system which is the Largest College system in the United States she is suing to reinstate a program which she put in place when she was a secretary of Homeland Security. A federal judge actually said something very interesting and i was wondering how much of yesterdays 55 minutes you work in a run. Three times in their the president said i love the dreamers i want them to stay here. Guess where that showed up. Arguing that if the president of the United States is saying i want the dreamers to stay here perhaps the Justice Department and the department of Homeland Security are not that serious about terminating the program so we are going to keep it in place until we find out how serious they are. This is a preliminary ruling at the beginning of the litigation. Will it stay and play while the court litigates whether or not daca is lawful. As firm as he is when he says he change the law. So the daca program is expected to expire in march. Does this really give congress then the cover and additional time to address it and what a congressional move and change supersede whats going on in the courts. One of the complaints with sinister feinstein. Made it yesterday at that meeting that they head in the cabinet room. As we now had time. Guess what, the answer to your question is yes. They now have the time because that decision yesterday prevents the department of Homeland Security from ending daca in march. The practical effect of this is to give the president more time to decide what to do. This will play out appeals and Everything Else. Normally the Justice Department when they get ruled against like this they say immediately theyre going to appeal. I suspect because they all want a little bit more time. There are happy to take this direction to give congress some time. Not an executive order. But some permanent resolution. And then it just stays. If congress does not come to an agreement. Who well have the final say. Until he gets to the ninth circuit. Going forward the way this is written they would have to address it at some point. The opinion starts out with quoting the Constitution Congress should have the authority you think he has not taken exception to this because he wants to take it and give it more time. I think the president is a master negotiator. And often throws out ideas to ten allies teen allies and draw in his adversaries he knows it saying Something Like that. Does also put a wrench into any leverage that they could of have going into the january 19 potential Government Shutdown. This is what they were using and give us the spending on military. The leverage is gone now. It is from 15 to 40 republicans furious at the suggestion about earmarks. Earmarks are the algae in the swamp. I assumed it was for just for political purposes. That is why earmarks are. At some point he said im serious. Over the russian dossier. Michael cohen is now suing over allegations about him publish in the document compiled. Enough is enough of the fake russian dossier. For publishing the lies on President Trump and me. Bus feed published the dossier just before that. They could be putting bus feed on defense to be spending all of this this money to vent themselves now. The first issue is he is the president s lawyer from time to time. He probably is. What is the standard of proof. Therefore they get to say anything they want about him unless they did so knowing i was false or with record reckless disregard. Or whether they couldnt care less about the truth. And that will come out at the time of discovery. Someone is pain but is not bus feed money. He must be a public figure which does make the standard much higher. You know better than we do. I think the statute of limitation of limitations was expired. It mustve been a year ago tomorrow with this stuff. Might as will get this and if i can. This enables him to dig into the methodology as they demonstrate that it did not publish something knowing it was false or it was not reckless in its concern. The entire transcript with one of the founders of fusion gps. Drew some rebuke. Should the senator face repercussions here. The only one would be political. She said she released it because republicans were releasing experts from it. Its a 6,000 page torture report. They were released on the floor of the senate. She released this yesterday dont go near him the smarting. The public has a right to work form its own opinion of the truthfulness not an opinion based on experts. It was spilling the beans to the trump campaign. They believe that most of it is verifiable. The clinton campaign. We still are needed an answer on whether or not it was the dossier that they used for justification. Or whether it was a drunk conversation between a 28yearold theyre trying to get the answer to that. There is some real evidence that suggests that it may have been at the justification. Hey alexa take the wheel. The Trump Administration decides not to allow oil drilling. After meeting with governor rick scott yesterday. I look at this and i think these numbers are low. Im talking all around the country and as i talk with them i realize they dont understand what is at stake and they dont know what to do. We had 17 according to this survey arent saving anything we had 49 that know that they are behind. I think those numbers are higher. Do you think the increase because the consumer was into anticipating this new tax law. A lot of it went into savings as opposed to accelerating spending in the marketplace. I dont think the Credit Card Debt that we went into 20 billion have anything to do with the tax plan what i think it has to do with his dependence. Americans had developed this appetite for debt. With this mentality of i just will get it now and deal with it later. People will be paying off Holiday Spending in july and august of this year. With to help people understand that is not your friend. It seals from you now and it makes you pay later. So get intentional with this and start to understand debt is not your friend. We have to tack it and get out of your life. This puts customers past the debt benchmark. We know what to do with debt we have to get out of debt before anything in terms of the savings plan but do you worry that this is an Early Warning sign of something to come in terms of tripping out markets. People dealing with their debt levels is something they can control. We just had a recent Interest Rate hike. Their minimum payments are to start to go up i want to encourage people to get intentional with getting out of debt. List your debts off from smallest to biggest. Coming up this morning here to practically it down Fox Business Network dagen mcdowell, Fox Business Network collin mcshane, former home depot ceo bob nardelli good to see you great show so far. So far. Yeah, weve got an hour left a lot to come. Markets this morning, Interest Rates move higher. Dagen 10year yield above 2 1 2 for the First Time Since march i love having conversation about inflation coming back, and an economy this is a really heating up. But this is a concern. Because we talk about consumers running up Credit Card Debt an indebted nation with National Debt about doubling last 8year term of president obama this is a major concern it is a concern for markets, because again, he treasury has become more attractive stocks less so makes corporate earnings worthless. Chinese story you referenced bloomberg story if true you start to ask questions people will, about at the motivations of the chinese why are they seeing our government i mean, and people will say well is any political just market biggest buyers. For sure. Maria with headlined in the bloomberg story china officials are said to view treasurys as less attractive. And that headlined sent rates up, it is if rates move up because of economy this is a growing if were talking about inflation because the economy is doing well, then let them move up that is what we want to see we want wages to go up. Dagen another are part yesterday 10year yield going up was that the Japanese Central bank would be buying less in japanese government bonds, so if you have debt overseas, whether in germany o or even japan with higher yields makes our debt less attractive you would have higher the yields go up here so that is another kind of sliver in that story. Market story of the morning, obviously you believe we will see lower opening this top story right now last minute lifeline for daca, federal judge, late last night, blocked President Trumps plan to end the obama era protection for immigrants who entered country illegally as children this ruling from 9th circuit hours after landmark meeting with lawmakers on both sides of the ill on immigration blake burman with the very latest there blake, good morning to you. Reporter good morning to you as well late in the froveng a federal judge federal judge in San Francisco ruled for the moment of Trump Administration cannot unwind daca protects roughly 700,000 people brought into this country as children, illegally, by their parents. You might remember back in september the president had set a deadline for march 5 essentially for congress to get together come up with a solution, and figure this all out. Yesterday, here at the white house, in a you bipartisan meeting, being the president seemed optimistic that those lawmakers could strike a deal. We do phase one daca, security. And we do phase two, which is comprehensive immigration and i think we should go right to it i really do, we do one then do the other, but we go right to it. Reporter freewheeling negotiations republicans and democrats played out on camera for nearly an hour, the president laid out his framework for a daca deal that includes a border wall also the diversity overseas avenue Lottery Program chain migration democrats warn immediate concern that daca fix not necessarily president s other priorities what he views as comprehensive reform. There are some things that you are proposing that are going to be very controversial. Of the and will be an impediment to agreement. You are going to negotiate those things you are going to sit down say we cant agree here give you half of that we are going to your going to negotiate. Comprehensive means comprehensive. Maria on expect a hill Chuck Schumer indicated a daca deal needs to be tied to the spending bill needs to be hashed out by next friday combine that, with the president s demand that any deal includes a wall, and you get the reality which is that despite this kumbaya moment monday morning republicans and democrats at the white house yesterday, there is still a lot to be worked out here. Maria yeah, but blake, did they just lose that leverage in terms of putting a daca deal into spending bill because of the ninth circuit saying look daca program has to stay in place until a solution is found, they dont have to worry about thank you march deadline right . Does that leverage go away. There is litigation, to be worked out there are still lawsuits that are pending. The ideal situation here, Maria Congress comes up with something, the president wants to come up with something whether this happens by next friday, is probably slim to known political reality but both sides saying they want to do this now devil in details. Blake burman at the white house this morning to talk more about that former deputy chief of staff to president george w. Bush Fox News Contributor karl rove good to see you thanks for joining us. Before we get into substance i was intriggered about coffee earlier blonde latte. We would like to well, nardelli and i would like to order the thinning grey hair latte. Thank you karl, good to see you again my friend [laughter] nardelli tried to get me to go to work for home depot one time put me in the in the vest and had me start working customers in a store outside of baltimore. I did we got a lot of negative feedback are, [laughter] exactly said Training Program would be sustained long period of time probably not very constructive for me. Karl, let me ask you the president says he is going to take heat for immigration deal now we know what ninth circuit did saying the daca program stays in place, did they just lose the negotiating pour for the spending bill Government Shutdown deadline. I think you are right weakened it a little bit will go interesting to see if Justice Department paemz this 90sth circuit sort of outlier my sense when it will comes to immigration law, that that courts will back the president on this, we examined this very question did the president have the ability to exempt a whole lags of people from enforcement ofs immigration laws in Bush Administration looked at this question not a serious single lawyer said the president can do that even president obama admitted he didnt have authority to do this so if this gets appealed my sense is, that the District Court judge out a in San Francisco will not be sustained by higher courts, and there will need to be a fix for this, but you are right. It has weakened it between, for action on the spending bill has to be settled by 19th of january. Karl the the wall street journal editorial page rights despite pushback from biggest mouths on the right, i am not talking about you trump has the credibility with his voters to sell a legalization deal that includes security. Do you think that is true . Oh, absolutely he has great credibility on this has to get something for wall sort of touch point makes a good case that 654 miles of wall that is now up is a need in some instances in need of repair that some additional wall is needed i remind you in 2006 when the wall was authorized by congress it passed overwhelmingly house and senate, and among those voting for it in the senate rp senator fortunatelyschumer, hil clinton, barack obama then scenario joe biden then acceptable no longer acceptable experts will tell you 2300 mile border there are parts a wall is needed to effectively gain control of the border there are other Parts Technology or vehicle barriers or monitoring infrastructure is needed but absolutely parts of board that need a wall the president is going to continue to push for it if if this was not all tied up in politics, and resistance to donald trump i suspect a deal could be found. With the tweet last night only one sent out hey listen, i need to get this money in there for the wall, otherwise we are not going to do daca penned that to top of profile this morning wants to make that clear i guess to his base he definitely said instead of taking heat being to a it last night. The biggest mouth i meant an coulter. On fox news, listens to types of things i would think if you are President Trump, actually let me ask this way if you are a republican from the congress, what is more beneficial going into a midterm year if now a moderateing president maybe moving to quote unquote middle on some issues or a President Trump to shore up base really get fired up for midterms. What matters is something different. A president who is getting things done that caused people to say you know what our country is Getting Better he is resolving big issues, i may not agree with everything he is doing but moving the right direction. And this is a a little bit different than options you tossed out i think he gets there if he gets the daca issue, he is right from the beginning, declared that he has an for people brought by parents, no decision on their part now find themselves stuck here, in a status that is not very clear. So he has been clear he has been you know, are, about comfortable saying i want to get this resolved in a keeps using the word love, as he did yesterday. But but his base will support him if they are convinced he is moving right direction the touchstone is Border Security and the wall. Karl changing gears for a moment transcript was released yesterday what were surprises you read about fbi, fusion gps people within campaign what was most stunning about that. First of all, the some trump source somebody close in the trump orbit talking to fbi. It also the it was also interesting to me, that this the British Intelligence agent mr. Steele made a decision on his own, to go to the fbi with this that i thought was pretty shocking. But also that there was such a that there was such a a big gap between whether this was surfaced to the fbi, and when they then literally a interviewed him in october. Lets get back for a moment Dianne Feinstein i think really you know may have done something positive my state senior senator john cornnumber two Republican Leadership was complementary of her effort she and Chuck Grassley had a reasonably cooperative working arrangement has kept their committee less you partisan and less bitter than some other committees in the senate and she has really done damage to relationship with her chairman releasing this. Not happy with it, karl good to see you thanks so much karl rove there we will be right back. Stay with us. Paengs Patriots FansQuarterback Tom Brady revealing reality series peek later this hour stay with us. Senator rand paul joins me 8 pm eastern 5 00 in the west. 7 welcome back, the amortizeing industry looking to technology to help clients connect with customers guest says he uses state of artist to anticipate desires works with major brands including mcdonalds, nissan auto nation, ceo for you on Zimmerman Advertising great to see you. Great to see you. Thank you so much for joining us characterize the business how you use technology to draw in new clients. We use technology really on two fronts using we developed a proprietary platform able to connect with consumers five devices, smartphones, tablets desktop laptop connected televisions today we are able to really message them with area around locations when bob was at home depot vr store not the same geographically or ethnicity around the store we target around stores with messages to those devices in real time, we segmented messages. One of the big things there is we always struggled do we distribute all flyers 50 percent went in the trash the technology you have we could have a single port of entry we would advertise what we see them buying next big thing i believe dont you i believe that 101 marketing is here zimmerman we inhave not had a platform differentiated than anything out there today we have a social media Activation Center open platforms twitter instagram taking conversations in and messaging back algorithms that we have built as someone saying with bob was at home depot need to up patriot did you have any get up update in real time they are delegate you everything the consumers out there today. I think bob getting at a a little bit we are so used to that in social media that we get hit instagram, for whatever reason everybody thinks i want untucked shirts the point is they think a guy wants to buy this whatever it is how are we there yet with tv to the point we take a break on this show our viewers will be targeted with things that are only interested in. How would that work . Well because we have cross pollinated social media with our traditional digital local platform target what they are talking about where they have been, onsite they have gone to, then where we target them in their home, through connected television to their smartphones, to tablets desktop laptop incredible but retailers are seeing Dynamic Results from this like they have never seen before. Customers dont have to choose i want to be on social media, i want to be on tv you are going to send it out to everybody anyway . We are going to send out only if they show if they under our trade area maria if they have interest in what we are going to send to them. Brand specific. Yeah. If you are like budweiser they send you an ad rather than somebody you dont impair. Dagen if you like budweiser you get a miller lite ad. Trying to convert, how much is too much . Because i i dont think i am loan in saying i feel bombarded advertisements because i am connected myriad ways through social media not just oneonone in person how much is too much for people . I think that, you know, issue as the industries get smarter, you are going to start to see were listening to what you are interested in we are watching what you are searching. You are interested in going to help decide to make the decision, not bottom barred y bombard with messages, what 101 marketing is about the brands we represent success in the marketplace today, it is how they have differentiated they have through hypolocal social media and traditionally positioning that tranned for memorabili memorability. Is the growth in technology in terms of where advertising dollars are going right now . More and more advertising dollars are going into social digital than before. Tv has most. Tv has the most, and listen tv is always going to be your halo it has reach you can have but complement that reach on a localized basis hypolocal, social digital formats. We want your take on tax plan quick, because we focused yesterday here is what was said in terms of what business wants to see from washington. Next things are on the administration agenda, infrastructure reform complex, there is bridges and ports and highways faa, highway taxes, state and local, but it could be done, we should do things to help the people will have the behind o he your thoughts. Interesting i believe infrastructure is genius, it will put a lot more people back to work we want to see our roads and bridges they need the work, and you know if we can put people back to work, and we can actually improve infrastructure, great. Maria rollback in regulations were so important said yesterday 13 years, the bridge to build a bridge in new jersey. Exactly. Who is going to pay for it everybody wants to spend it somebody elses money. Again, if we are putting people back to work that means more discretionary in being into the market again, i think, if it is a circle positive for putting people back in work. Thanks for joining us. Good morning thanks for having me on. Messaging is everything, i know that lawmakers spent a lot of time on television, they joined up on this program, explaining the plan but you say they should have spent more time on twitter, on social media, explain. Absolutely. We started yellow line digital to help organizations find results they need from stories at the tell online, watching this once in a generation debate about tax reform play out on social media largely, and i thought so many missed opportunities i had to write about it. Where was the biggest missed opportunity . To me one of the things haines right they didnt do good job selling, many republicans we have all spoken to agree with you, and say that was one of the big things there is no reasonth plan should be unpopular as it is in the polling but is it did i, no matter what you say on twitter anywhere else to sell a Corporate Tax cut that is what this really is really what modify beneficial part is, and maybe did they shy away from that, try to make their case that this can help individuals xyz save amount of money maybe should have found a way to sell he Corporate Tax cut good for country. Broadest issue messaging was accused you have graphics feel corporate, you you are not humanizeing it as tax reform at all. You are not using real people real americans i are not going out into the country, sending a crew getting video, and asking them to bring back and shoot it twothirds americans, get news from social media. You know, 142 million americans on facebook 69 million americans on twitter, this is the new times square greet debates unfold if having great debates again in this country i hope we will. Dagen there is no room for debate matt on social media i arguing this the way algorithms issue structured facebook platforms serve up news to us, they only send us what we already believe. They only tell us what we want to hear. They dont really the way that the social media news distribution is structured it is very hard to break through and actually get out a message to people, who dont already agree with you in the first place. This is a a great point. I think the issue with republicans in the people into aring tsupporting package didnt get effective messaging could break through walls echo chambers created by platforms when supporters are tax code push 2059 more as one of their core s, supporting the bill doesnt mean anything to americans supposedly represents 2059 dollars here family till about american gets at end of the year i had to google that find out what it meant pots taking gop tax scam no explanation simple echo Chamber Point is good it is important to use messaging that can break through ecochambers. An epic stupid hashtag for republicans if you look it up pointless. It is never too late, right, i dont think, that is question number one to, try and remedy this, two, have you been able to reach out to administration and offer some guidance here at the how they could better position this . Well, i will say ive gotten quite a bit of response to the oped in yesterdays the wall street journal, overwhelmingly positive exciting to see people that reached out to us there was a little bit of negative pushback from the more establishment firms sort of individuals working on it to be expected. I am really hoping that we can start the great debates our country deserves frankly we are good at we have a great rich legacy in this country i think debates start not end but start on social media. One thing bobs point about never being too late one thing you could do, is look at the benefits such as they are, after they occur right so somebody says, you know what i am paying less in taxes, or you know what i did get a raise because of this, then try to highlight those people after thank you know if you got the first part wrong get that part right. Yeah. A great point. Yeah. Visuals are so important for social media if you can use great optics visuals historically with tax reform bill youve got politicians tend to be men of certain age crowdeding around podium trying to get in the frame. A woman shaking her finger at people going this is the apocalypse, armageddon, again, bad optics. Yeah, especially when people get thousand dollar checks higher wages we appreciate your time thanks.
