And federal Officials Say an amtrak train traveling 80 miles an hour, in a 30 mile an hour joan, derailed zone derailed in washington state, which seems to be the cause. Engineer may have distracted by the presence of an employee in training next to him, well have latest on deadly derailment. Our top story tonight, republicans moving closer to delivering tax cuts to President Trump before christmas. The house this afternoon approved most sweeping tax rewrite in decades along party lines, that legislation hitting a glitch in senate, which means house will have to vote on legislation again tomorrow. Fox news senior producer for capitol hill, chad, live now on capitol hill with la labor lay , what is this socalled glitch in senate they had to deal with causing house to revote . It is not a glitch in most conventional sense, but what happens is house and senate have to be in alignment, approve the same bill, the senate lives under a special set of budgetary circumstances that house does not. They have been considering this tax bill under a special process, budget reconciliation, reason, they are doing it, is to avid a filibuster, otherwise it would be need you lost me at hello. Short answer, bills are not in sink. Lou they do not say the same thing. They will not by en of the night, to get something to president s desk u house and senate have to sync up. I asked Vice President pence, if this was a problem, he said no were good. Lou and not a problem, what does that mean for Senate Passage of the legislation tonight necessary to get into alignment tomorrow with the house and their revote . This is not costing them any votes, there will be a maximum 99 senators voting, 50 yeas, waiting to hear from republican senator jeff flake. He was a yes when they voted on bill in late november, we have not heard from him, before i came on air, more information about timing were expecting speakers on floor until about 11 00. That is how many speakers have booked floor time, then a procedural vote, it will get tossed. Then a final vote will start around 11 30 with final result midnight, and Vice President pence will be here, he is to preside, not to have to break a tie they will have odd number of senators voting. Lou one show host glitch, is a cinat parliament. We appreciate it. Thank you. Were looking at after 10 for this vote. Close to midnight. Lou well, lets all get ready. Here we go. Chad thank you so much. And time. Lou first guest, says that todays vote will put americans one step closer to more jobs, bigger paychecks and fairer taxes, i am joined now by top tax writer in the house, and he is congressman kevin brady, chairman of the house, ways and Means Committee, i get to say congratulations to you again, were getting one more in, it looks like. Because of what i shamelessly call a glitch in senate with revote in the house tomorrow. Yeah, lou, thank you. And if there is anything better than voting for tax cuts once it is doing it twice. This is not a problem, i think senate will deliver on its promise tonight. Well do this tomorrow, and head to president s desk, but this as you say, a major change in the horrible tax code. Were pleased. Lou and this is as you know, mr. Chairman, this is a big deal for a lot of reasons, not least of which in addition to money that will move to the middle class by the most favored outlook and analysis, 23 of the cuts to middle class. That is important, because the president talked about middle class tax cuts here. Alignment with small, and corporate america, i dont see how anyone at this juncture at least, could possibly say anything other than to the about this economy, it is going to continue its historic ascent. It is. This is all about getting the economy going. It has picked up since President Trump became president. But we think it could do better, every Economist Says it will be that old slow growth of last 10 years unless we change. That is what this tax reform is all about. President trump he said, he pledged im going to deliver tax reform this year. He is getting it for the middle class, for small businesses. You will see american jobs coming back home. I credit President Trump leadership working with us in the hughes and senate with us in the house and senate. This is a simple alga rhythm to examine, your insistence that of house leadership on tax cuts, as American People ask, because he ran specifically as president on that issue. The algorithm, what is different about this, and any other year in which a republican have been in charge . Donald trump. And we have seen this economy move from obama new normal of less than 2 , to now two consecutive quarters of 3 or higher, fourth quarter, has us at 4 economic growth. That that has got to take the most skeptical and nasty and venomous of the left who attack him, kind of back on their heels. You would think, lou. I am sure that will not stop them. This is today was about a one simple question. Who decides . Who decides who spends that money you work so hard to earn . We chose you to do that rather than washington. I think that is why left is fighting so feverishly against this. If you get to decide how to spend your money, then they cant, everything changes in washington when that happens. Absolutely, you are a big reason tha for that change, whee you expecting that revote tomorrow to be ready to move this. I would think shortly after lunch. Last vote will be held on this, well go to president s desk. A big promise delivered to the American People on time. That is what he asked for, that is what we foyt t fought to do, this good for america. Lou good for america, also good for america to see Republican Party controlling both houses of congress and House White House do what you said you would do. There were points in 2017 as we know, it looked like it was going to be impossible for republicans to get together on the basic fundamental Building Blocks of this agenda. There was reason to be skeptical tax reform is why all of us came to congress, that is why we ran, we know this issue, we care about it were pago pago nat about passionate about getting the jobs doing, i am proud of our house republicans, including my ways and Means Committee members who delivers this tax reform plan. Lou all right. Chairman brady we appreciate you being with us. I say it again, congratulations. Thank you, lou. Lou were coming right back there is much more to the days Political Developments as well. Were goin going to take each oo night. President trump on verge of major legislative victory after the historic tax reform bill passes the house. New years day. America will have a new tax code for a new era of american prosperity. Lou other Major Development in Washington Center on effort to root out political corruption at highest level of fbi. They now suggest that Andrew Mccabe should be ousted amid allegations of his conflicts of interest and antitrump bias, mccabe himself testifying before the house intel, committee, behind closeddoors, fox news correspondent james rosen with our report. Reporter deputy fbi director mccabe appeared before the husihouse intelligence committe. A ton of questions. Mccabe cuts across every facets. Reporter mccabe drew scrutiny, a lose ally of bill and Hillary Clinton, he oversaw investigation into secretary clintons private server, devon nunez and his team are probing mccabes involvement, if any, with fusion gps dossier. It talks about a discussion in andrews office, that could be mccabe. Reporter peter strzok, fbi official removed from russia investigation for sending antitrump messages to a colleague. Saying one that you threw out in andys office, like an insurance policy in unlikely event you die before your 40. This sounds like collusion went the fbi. Idea that the entire fbi is full of a bunch of liberals, i grew up in a liberal household, and neighborhood, no one said, please be an fbi agent. Reporter demoted Justice Department official bruce oro revealed to have met with men remind th the antitrump dossier to meet before Intelligence Committee. Lou thank you. James rosen. Tomorrow promising to be as fascinating as today. Joining us tonight George WashingtonUniversity Law professor Jonathan Turley. Thank you, lou. Lou what do you make of this . Another behind closeddoor session with high ranging fbi or Justice Department official, where are we headed . That is a great question. I think that the positive thing here is that we are getting this testimony. Fbi tends to be cloistered and secretive. It is cultural in some cases, they are yielding in producing the witnesses. What we learn could be important to the future of the fbi and these individuals, these are legitimate concerns. If there was a political influence, not just in fbi but in these particular investigations. It requires Greater Transparency than most of the phoe fbi offics feel com comfortable with. Lou bee weve had a great numbf officials. And answers that leaders, at the very top of fbi and Justice Department are giving, were interposing office of Inspector General as a reason to not give the committee its due as oversight organization, this is egregious conduct in my personal judgment. On the part of those officials, they are saying, they have reasons not to permit our constitution to work. That is arrogance in the extreme. I tell you, where i agree is that congress has for too long allowed executive branch official to be in open contempt. They have a right of oversight, as if the igs office is superior to legislative branch in article one, i am glad to see members of congress, flecking that muscle flexing that muscle and regaining that ground. I thought it was the good when chairman nunez said were prepared to hole people in contempt hold people in contempt event if a republican administration, if that is what it takes, i thought that was a good moment to see congress act like that. Lou i concur. I will go further. I believe that chairman nunez has if you will, laid out the template for how a chairman of an Oversight Committee should conduct themselves, assertively, aggressively within the bounds of the constitution. In my opinion since last august, have demonstrated themselves and i am referring to 2016, when we started hearing from Intelligence Community about their political judgments on the candids who were running for president. They have broached nearly every tradition. And demanded standard of pro pry door on part of the Intelligence Committee, this is something for American People to put up with. What concerns me, what the committee was asking for was legitimate. They were not asking about the investigation. Facts about that as much as investigators tissue it was them not for targets. They have largely obstructed this effort this week is a big moment. In terms of getting some people under oath. Lou under oath, and mccabe what are your thoughts about caughts for him to be fired. The man who recused himself 6 days before the election, as we recall, having already made note of of decisions that most of the decisions that would have been in don bli conflict with h. I am not one those who called for him to be fire. There was not evidence to support it, well find out a lot about mccabe a conduct, there may come a time when we have to do, that but i think at most we have a problematic response to conflicts, slow and in my view, not very what you might say prophylactic. Instead, a lot of these officials seem comfort with them, we still have key figures with conflicts of interest in the investigation. Lou amongst them strzok. Who has been involved in a number of points of contact in clinton investigation, whether it be emails, or the decision to make a decision toic exculpate her, we have the same with mccabe. He is involved in a wide swath of these issues under investigation, which on its face seems to without question be in conflict at least in appearance and why are not our investigator agencies and officials held to highest standard . They should be held to highest standard, what we learn from this week could fill in a lot of the gaps. You know while there may be not a ground for perm nation termination, there may be ground for further separation for mccabe for any other involvement. I am surprised by the lack of professionalism which has long been the touchdown of the fbi, which has been coming out. Lou professor Jonathan Turley, thank you so much for being with us, we will be lets talk further, as we most assuredly will, as these events continue. Thank you. Lou Jonathan Turley. Joining me now matt schlapp, chairman of conservative american union, great to see you. Great to be with you. Lou lets start with, how would you have ever fancied that everything, i mean everything would be breaking President Trumps direction as we wine down this year wind down this year . Whether the special counsel, that is breaking his way because the collusion is between obama and clinton, and their acolytes, and even russia, it appears. Whether it is the economy, in which he is looking at most remarkable performance of any president in American History in his first year in office, whether it is foreign policy. His decisions his policies his doctrines are being demonstrated to have won the support of our allies and high regard of our allies in nearly every corner of the year. Yeah, and i just came back from japan, we had our first japanese sea pack. Relationship between abe and President Trump is strong. Japanese appreciates respect that President Trump is showing them, this president decided he is going for all of the campaign promises, most say, i said these we have to relen on relent on some. Donald trump is going for all of them, making a difference, in this tax bill, president had a good gut in knowing changes that needed to be made ed on th on tt of his leadership on this issue, he will be signing the bill soon. Lou you said a good gut. I understand praise of intuitive success. But, i think it is time for people to Start Talking about the mans intellect, his judgment, and in suggesting he is intuiting all of this, is say disservice to him, not by you by others this president is making tough judgments in face of a firestorm of criticism, and 360 degrees of attempted subversion of his presidency. Right, they dont think he is a legitimate or they know he is. Lou the hell with them, i dont even want to ware thei carry th. I agree. Second thing, that the intellect and insight to what arguments really are and opposition is trying to do, he has been right, after everyone complains this tweet or that tweet, it turns out over the course of the year, he has been right about major questions, i think that American People even though who were more cynical will come his way, when they see the impact on their lives. Lou yeah, if they dont, shame on them, this is emperikly a president who established his intellect and talent in administering the country. I want to add something, i think he is a good political leader, he doing a good job of leading a tough coalition of folks here, i give him great credit for it. Lou bringing both majority leader and speaker of the house in to accord is not thely th lef his accomplishment, matt schlapp thank you. Thank you, lou. Lou were coming back with more stay with us. Joining me now congressman andy biggs. I guess have you the best solution of fire mueller and move on. That would be mostiic ped expedient. What to you make of these cross currents. Well, good grief, mr. Mueller and his team, some people were trying to influence the last election, if he continue his probe for another year, he will try to influence the next election, this is unaccep unacc. This team is unvetted, fuel of bias, real bias, taking actions to undermine the election, we know when democrats were recusing President Trump of collusion it was really them, they were colluding with the russians, this has to stop. This outrageous, best thing is for mr. Mueller to go. Lou i have to think congressman, that speaker ryan should hear you surely, and those members of congress who are calling for mueller to do that. I would have to think that majority leader of the senate is hearing you and both the leaders of coming and senate with Oversight Committee, judiciary, intel, are saying, the same thing. What are we doing . Why are we tolerating this conduct . This obstructionism, this frustration of a duly elected President Trump of the united states. Iace yes, it is i is is amazio me. Were subpoenaing people in, maybe hold some of these people in contempt it has to happen, but the pressure has to keep up, were seeing that dial as turned, majority of americans, they now understand or beginning to understand that the Mueller Investigation is not fair. They dont trust them any more than we do. That has got to weigh in our favor at some point, i think Critical Mass will get there, mr. Mueller will need to go, but not just mr. Mueller, the team, i look at rod rosenstein, he needs too g and andre mccabe needs to go, jeff sessions, Christopher Ray they need to clean out the under brush of the top level staff at doj and fbi if we see that. Then all of a sudden americans can begin to have trust that this investigation should there be one, is fair. Ry right now no one sees it as fair. Lou a number of your colleagues as well calling for special counsel to investigate the investigation. At some point bie well have an amazing number of extinguish counsel special counsel investigations. It is clear that there have been actions taken that are in direct conflict with the responsibilities of anyone serving in the Justice Department of the fbi, when it comes to investigation of Hillary Clinton. We also have, i dont know how many people say, you cant guest investigate a prominent member of a previous administration. Well, why not say this out loud . They tell us that americans have two systems of just is. One for the people who are the elites, and one for the rest of us. Who do not serve in government and high office. It is outrageous, so, the Inspector General. It is not that mr. Mueller is telling us about conflicts, the Inspector General. Lou judicial watch. Right. I believe, they will say, there were many irregularities in Hillary Clinton investigation weather, that cam comes on ut. ExrifChristopher Ray told he mae would ring that bell. It was as slanted as anything could be, americans need to see that justice will be served. They need to reopen that, i think that Inspector General, when he gets done with his report, hopefully, he will tell us, what within on there because went on, we know a lot of things happened with regard to interviews and ro obstructtion f justice. Lou i would urge consideration of a law be passed, that is a law against any one testifying on capitol hill using expression unring a bell. That would be a priority in my world. Absolutely. Lou thank you so much. Thank you. Lou andy biggs, vote in our poll is from any reason that fbi director kris Christopher Ray sd not fire deputy direct or andy mccabe, now. Thank you. Lou what do you make of this . First, i want to say that that sheep dog is a tough act to follow. Lou not as like as we would like. Well the jill stein development is interesting to me in sense that i think that there is the Senator Committee and chairman burr mentions there were two campaigns they were beginning to look into evidence of collusion betweening the campaign and the russians. And i see jill stein as a sort of inconsequence alcan. Maybe this indicates that they are finally looking into those that evidence. Lou and li the libertarian candidate was also running. True. Lou not a targetrich environment. One they should look into i think would be Hillary Clintons campaign. And her involvement with fusion gps and that dossier. Lou why in the world, in your opinion, rodger, is special counsel almost everyone involved, why are they not all over fusion g progra pes. They should be. My question should, really why hasnt a Second Special counsel been appointed to look into all of the issues, demanded by house judiciary committee, that is hard to explain. Lou explain if you will, why should not Christopher Ray, fire Andrew Mccabe, his deputy, just on what we know circumstantialy about the conflicts of interest, the conduct of that investigation of Hillary Clinton and her emails . Well, i think you know based on particula text we saw in whis reverends, apparently in the meeting, and to insurance policy, it looks like you know if you were look for a face to put on the deep state, i think that mccabe would be a good candidate. I dont know i mean, from the outside looking in, it looks like the kind of thing where firing would be appropriate. The question is, how deep is the deep state . How deep is the bench, does firing mccabe really get to the problem . Lou well, the problem is deep. And broad, and much deeper and broader than any of us suspected, i think. Even two years ago. In the end well see a thanks bill that will pass both houses and signed by the president soon. Thats what voters will remember next year. And well get over these bumps which is all they are. As amusing as they are. Lou dont you find it interesting the number of times we rely upon the publics ability to forget as a basis for how history will regard our congress and our senate. Ed we are going to get a bill and it will be better than what you have today. The president and the republicans have to sell it because americans dont think it is has been fission as it will be.
