Its just all coming as an avalanche like two or three a day but now the names are huge. Al franken a u. S. Senator, the oldest serving democrat in congress and of course now, the interesting part, the more aspect of this rather is taxpayer money being used as hush money for it all. Right social media is now calling it shush money. The fact is everybody was wondering if this avalanche would just affect hollywood right . Well clearly its in every industry and industries where theres a significant power and significant money at their disposal, so were seeing this now. Its not a surprise especially since we also know congress has a list over about the last 15 years where weve paid about 15 million in shush money. Charles 17 million. Tammy its 17 now . So this is where we know that for every year money has been paid out to accusers quietly. We still dont know the names on that list which means there are many more that would come if women of course apparently nancy pelosi says they signed non disclosure agreements but i think as weve seen in these other cases that might not necessarily be adhered to because of the nature of this kind of volcanic eruption of accusations and situations. Charles of course, it was only a few weeks ago where democrats were demanding republicans ask roy moore to get out of the race, liz and of course, i havent seen an elected democrat demand that al franken step down and its early for coniers, but we havent seen that either so what do you make of the idea someone not elected yet on 40 year old charges is being demanded to dropout of the race where now you have two sitting formerly higher respected senator and congressman who are in serious hot water and yet theres not a lot of pressure on them. Its pretty embarrassing moment all around. In fact i found liz warren sort of dance around this question today. Someone asked her, do you think that al franken should resign and she really couldnt bring herself, liz warren the great champion of womens rights and movement and so forth could not bring herself to say yes. Its all about politics charles and it should not be about politics, this is not left and right this is whats right and wrong and in the case of franken , you know its just the beginning i think of people coming out to make these accusations, and in the case of roy moore, at least you have the opportunity there of alabama to make their decision and my guess is i always think voters are pretty smart. My guess is they will make the right decision in that case but to leave these other two in place and particularly this offensive thing of taxpayer money being paid out, its pretty abhorent. I think there needs to be a clear message sent by the hill and by especially the women on the hill to say enough is enough none of this partisan crap that were seeing going on right now and excuse my language but thats what its coming down to. When it comes to the roy more instance were seeing democrats calling for roy moore to resign but yet were not see ing it when it comes to al franken and all of these other sitting senators, so i really think at this point in time this is happening with republicans too. Trump should be saying roy moore should get out of the race but he doesnt want the liberal there instead. We need to say enough is enough as a country. Enough is enough as women because for years Sexual Assault has just been swept under the rug and now all of this is coming to light is really expos ing the dark underbelly of media, of politics and Sexual Assault in general and how this has been so pervasive in our culture weve just turned a blind eye to it. If i could just add the president is moving on lizs point where it is appealing to the fact these individuals in alabama will be voting and thats an argument that you can make about people having to make that choice but let me also just say that this is clearly nothing new. Their movement has been flawed, but yes indeed. Of course we want it to change but the fact of the matter is to expect the democrats, women or men, to suddenly find their spine and be against this when theyve been the ones who facilitated it for 25 years but how can we as republicans stand there and say this that its hypocritical if we sit here and say they did this but now its the president but to understand the real nature of the animal and what theyve been doing for a quarter of a century. I understand the real nature of the animal to be Sexual Assault and we expect the president to do that right now, we cut back on democrats and say the same thing with the clintons , but why dont we change that . Charles i am not calling for that but what im saying if it has been investigated an proven theres been wrongdoing then i think at that point there needs to be a larger conversation here and clearly what were seeing are multiple instances of this with the same person, so i think at this point, when were looking at these settlements where taxpayer dollars are being used when were looking at multiple women coming out against one person, clearly there is a pattern of behavior theyre with that specific individual that should be looked at and should be treated as such charles hold on for a second liz before you jump in i want to let the audience know about the congressional nonaccountability act so youve got congress which can already illegally trade and do things we dont do. They can give us obamacare but they dont take it. She was asked about al franken after saying bill clinton should have resigned and she danced around that because now we have ethics hearing which go nowhere. I think the long term dynamic here is that it is a generational framework of those individuals will have to be swept out at one point and elect new people and that understand what the difference is and re make this government and when we talk about the swamp this is part of it. Charles the federal judge permanently blocking President Trumps executive order on sanctuary cities, which would have withheld federal funds from those cities protecting Illegal Immigrants, the Justice Department vowing to overturn this ruling, arguing that President Trump lawfully used his executive branch powers. This as the Justice Department asked the Supreme Court to fully reinstate President Trumps travel moratorium after the ninth Circuit Court of appeals allow for impartial implementation of that moratorium earlier this month. Is this just more judicial activism, it seems clear to me that the relitigating this stuff over and over again and i thought it was pretty clear that President Trump had certain powers in the executive branch . I think there are two sides to this story. On the one hand this is always the risk that president s of any party face where they try to push ahead on a policy through executive order and they dont wait for congress to enact the policy that theyre seeking and on the other hand we have seen an enormous amount of pushback in the courts from liberal groups, from liberal jurisdictions who sue over President Trumps policies and unlike in the very First Executive order the travel ban executive order that trump rolled out during the early part of his presidency which you could make an argument that it was arranged and not legally airtight and they exposed themselves to a legal challenge this is a more thought out policy its something that they sought to do from the beginning of the administration and what its doing is trying to enforce laws that are already on the books, so this administration is confident they are going to prevail. Charles john as a former federal prosecutor should they be confident . Well i read the decision and President Trump has a legitimate beef about the sanctuary cities because theyre violating federal law; however the executive order unfortunately for him is unconstitutional in two respects as the judge failed first of all, it imposes a limitation on spending which only congress can do only congress can condition spending bills and second, it encroaches on the sovreign power of states under the tenth amendment. I think the judge got it right and it is a nonconstitutional order. Charles i find amazing tammy all of a sudden progressives care about states rights . For eight years they tried to exceed all of the rights to the federal government and the king in the white house and now all of a sudden these issues become states rights. It is also offensive to the average citizen these sanctuary cities that allow Illegal Immigrants particularly those with criminal records to prey upon ordinary citizens whether Illegal Immigrants or native born. Obviously for them its situational ethics so theyre not rooted in any kind of principle. Here of course the president s lawyers are arguing that all he does in this executive order as has been mentioned is asking the agencies and those who work for him to apply the law, as it exists, and when it comes to constitutionality there could of course be an argument that if you are in fact breaking the law by breaking federal law, then that is the thing that trumps of you will the nature of the argument so this look, i think the president should welcome this getting another element getting the Supreme Court because these are positions just like with the executive travel order that he has every right to take and these are measures and i think that we do need the Supreme Court and higher courts to confirm that. Charles while we wait for this to be hashed out guys late this afternoon a report saying that ice now planning a nationwide operation will target foodservices chain over these undocumented workers. Now apparently tammy this industry has at least 9 of the workers undocumented. This will be huge but people have been talking about this kind of action, everify taking this into your own hand the courts wont help you enforce the law at least let ice do their job. Thats it this is existing law about having agencies in Law Enforcement apply the law. It is a message to business that we can do business and we can get everify but weve got to be able to make sure theres law and order one of the major reasons why the president was elected was the promise there would be the rule of law that would return and this is an example of that. Charles john do you have any problems with this . Well this is unsafe ground because this is exactly what a president is responsible for doing and theres no constitutional issue there. I want to say one thing ironically the judges position is exactly what conservative scholars have been arguing about for about 25 years which is putting limitations on president ial power and putting limitations on the federal government to coerce states. The probe stems from prior complaints at harvard intentionally limits the number of asian students or admitted back with me to discuss vince, ive got to tell you, you can certainly say that its at one point these are affirmative action programs where nobel in fact perhaps even necessary against a racist culprit culture , but weve come to a point where the people are being penalized who deserve to be in harvard and other schools. Vince right so when you have two students and a student that is overperforming the other there should be no question, that would be the student that harvard an elite institution like that would want to take but theyre forced to instead assess the racial characteristics of the students applying to their institution. As you noted going back to the 1960s when affirmative action was first installed it was done to be a temporary measure but here we are in 2017, it still exists and now you have a situation where sort of an interesting spin has happened in that Asian American students have disproportionately benefit ed all of a sudden from this and now, theyre being held back because of these affirmative action policies. Its totally twisted and on its head and time i think colleges and universities are called to assess students based on their merits rather than skin color. Thats what were going for in the first place. Charles i also believe that even before you get to the College Level perhaps parents and schools starting from kindergarten on up need to reassess the idea of just achieving, bringing out the best in people and i think if the people are forced to do that no matter what their color, race, religion any of that stuff if they say on your own merits youre forced to do that they will step up to the challenge. Yeah, and ultimately its about content of character not the color of your skin of course like Martin Luther king says and you hear in this case its interesting when it came out in august the trump Justice Department was looking into a university about its affirmative action policies instantly, trump s critics were under the microphone saying hes doing this, no its for Asian Americans and an unresolved complaint from 2015 in which dozens of Asian American groups sought the Obama Administration Justice Department to look into this and they didnt and now the Trump Administration is picking it up. Morgan sent a letter to all of the voters saying in part, we hope the day never comes when known steroid users are voted into the hall of fame. They cheated. Steroid users dont belong here, players who fail drug tests admitted using steroids or who are identified as users in Major League Baseball investigation into steroid abuse, known as the mitchell report should not get in it. Super bowls, world series, major boxing matches and one thing about the world of sports is it typically is the epitome until these performance enhancing drugs arrived on the scene. Reporter well thats correct it became part of the landscape and baseball profited off of that and baseball allowed it to go on while it was going on and then they cleaned it up and when they cleaned it up they tried to get rid of it all. The problem is a lot of the times like in track and field and these olympic sports the cheaters are ahead of the drug testing so now joe morgan sends out this letter and its interesting, its a dilemma. Are you going to punish these guys in the steroid era because everybody wants it to be clean and everybody wants it to be pure but they were part of an era that as i just said baseball profited on. We didnt keep out people of the hall of fame when they werent playing against the negro player s because the league s were not allowed in. We didnt keep people out when they changed the height of the mound because they changed the height of the mound. We didnt keep people out in the amphetamine era so now its a very difficult decision for these voters and barry bonds was a hall of famer long before he took a steroid. His performance on the field was great so i love joe morgan personally. I dont think that this is sustainable and i just dont happen to agree as we go forward charles would you put someone like a barry bonds who by the way at one point was my favorite player at, i had his rocky Baseball Card but would you put him in the hall of fame with an asterisk attached to his name. He didnt break hank aarons record on his own. Reporter well they put bud s elig in the hall of fame and he presided over the steroid era. He did a great job in growing the game but also was apart of that era. They dont put an asterisk next to the commissioners name and he watched it all go on so no i think they have to be very very careful how they judge history here and how they decide who are their friends and who arent. Charles is the hall of fame for the fans or for the players and lets not forget these same steroid using players were richly rewarded they all became multi millionaires in fact they had distinct advantages over folks who they played against who didnt use steroids so in many ways they have been rewarded. They made commercials, they lived a pretty comfortable life. What about the fans in this regard. Where do we come down in the consideration for the fan who may say i dont want to see someone who didnt do it the right way. Reporter well the fans have a voice. They dont have a vote but they certainly have a voice and i think that the fans should be listened to and i dont think youre going to find a plurality of any of it. Its interesting that joe morgan who writes this letter also supports pete rose who signed his own banishment from the game , who committed the cardinal sin, so on one hand he says steroid users you dont belong but pete rose my teammate you do belong. Theres a hipocracy in this and you cant make the rules your friends. If you dont like it nobody is for cheating. Nobody is for cheating, but it was a part of the game and i think they have to come to grips with that portion and that era of the game. How they exactly do it, do they mark the plaques, keep these guys outdo they let them in eventually i think they have to come to grips with it. Charles if cooperstown is a cathedral to baseball they need to find a way to point out the purity and nonpurity i would say. Reporter one last thing charles we dont live in the soviet union. I think what we are seeing here are a lot of liberties taken by the Mainstream Media when they cover this white house. I will say in this situation this is completely out of line. To what sarah says, this plays into trumps narrative of the Mainstream Media constantly attacking him. Newsweek did come back and edit that story, they took out the part about trump and said this didnt reflect the views of their editorial views at newsweek. I think it was smart to do, but the damage had already been done. I have seen news boards, editorial boards stand behind their writers, and this crossed the line. Charles it would have been great if they had caught it before publishing the original article saying that this is crossing the line. Even people who are apolitical feel the media has been harsh on President Trump. I think its hurting the media. Reporters in this day and age have to be careful. Their mistakes are amplified 10 times over where the president could attack you personally if you happen to get a story wrong. Thats part of their job to get things right and think things through before they hit the publish button.
