Is this to sort of tell republicans, hey, if i cant get you onboard, ill get them onboard, or is this a legitimate move to sort of find a bipartisan middle ground . Oh, i dont think theres any middle ground here. Democrats, with the exception of these three senators, have made it clear they dont want to pursue the kind of tax reform President Trump is hopeful of. He wants, for example, to cut rates across the board including for the top 1 not because the wealthy need a handout, i think we can all agree thats not the case, but because most or many Small Businesses file as individuals. He wants relief for businesses that employ under 500 people, lets say. This is the way hes going to deliver it, and the democrats have made clear in the letter they sent to the white house they will have none of it. So these three are the only ones who didnt sign on to that letter. He can make some progress with them and bolster the, you know, twoperson advantage they have in the senate. He needs these three. Charles but speaking of business, delaware roy, theres this sense deroy, theres this sense that the republicans are over a barrel. Because you think about bannon, for instance, steve bannon, the nationalism, economic nationalism, and populism. And to me, it feels like theyre not going to get everything they want this time. In fact, you know, they tried to foist, in my opinion, border adjustment tax on the american public, that didnt fly. That went nowhere. Charles whats going to happen this time . This might look unlike anything we thought when a republican was sworn into office. I think if they sell a 15 Corporate Tax rate which is something we very, very badly need charles can we honestly get that, and would that be negotiating against yourself and waste time . Should they cut straight to the chase with something that both sides of the gop, both sides of the gop aisle can agree on . [laughter] i think we ought to sell 15 Corporate Tax and focus on the fact that if a company doesnt feel the need to go to china and expand here, thats a populist benefit because that means people who could charles what happens to conservatives . Today the audience [inaudible conversations] our National Debt finally cracked through 20 trillion today. This is not going to make it easy for Freedom Caucus members to go with any kind of tax that even if you are a believer in supplyside economics will increase the debt initially. No question about it. The 20 trillion is just a huge, round number that is going to grab everyones attention. On the other hand, the only possible way that we can meet our obligations, our Social Security and medicare and medicaid obligations which are basically growing out of control and outside anyones expectations is through growing the economy. And already were seeing an acceleration, the most recent numbers are over 3 for the second half. Thats really good progress. But the only way were going to grow beyond that is through tax cuts. And i agree, the Corporate Tax cut thing is very important. Were not going to do 15. Ryans talking 22, 23, my guess is thats reasonable. Charles you say thats way too high. What i hate to see republicans do is negotiate with themselves. They should hold out for 15 , and at 4 30 in the morning say, all right, well do 18. You dont say 33 the 22. 5, the republicans need to hold a hard line and only cave at the very end if they must. Charles speaking of populism, theres a report out today Median Income last year finally hit a new high since 1999. But i looked through the numbers, and the midwest is still down. The heartland is still down. Theres a big movement thats saying, hey, how about we dont tax people who work hourly wages. In fact, i want to talk about a tale of two taxpayers. Youve got someone who worked their way through medical school, now youve got someone whos making money on Capital Gains. They make the same amount of money, but when its all said and done, the person that busted their butt, theyve got 200, 300,000 in college debt, they end up paying a 34 rate, and the person that inherited the money pays 14 . This kind of stuff is angering the same people that voted donald trump into office, liz. I think thats true, but its not just people who inherit money, its people who have worked a long time and invested and are enjoying the fruits of their retirement through Capital Gains and interest income, dividend income, i should say, which has a lower tax rate. That is all purposeful. If they want to change it, they can change it, but you cant just say, well, you know, theres no value in investment. Thats why those rules are in place. However, all of that kind of stuff is up for grabs. That is something that the tax reformers could go after. There are a number of orr things too as you know that have been talk about like state and local Tax Deductions and mortgage interest and stuff. Some of these things can be targeted to bring down the advantage, if you will, that the wealthy have. And my guess is well see some talk about that. People are frustrated about low income, es incomes, the way to do it is economic growth. Yes. Thursday afternoon at 3 00, the house is going to gavel out. They just came back a week ago, theyre going back on vacation. [laughter] i think its unbelievable. I dont know what paul ryan is doing. The house of representatives is going back on vacation on friday and all of next week. And all you hear about is how this is no time for anything, its amazing. And then theyre going back on vacation again. I find that appalling and truly disturbing, and shame on them. Charles obviously, this is a serious hurdle, because if it wasnt, it would have been done already. Tax reform . Charles charl right. Sure. Charles often we have these conversations, and the people watching the show says it seems pretty simple. Why hasnt it been done . You either have to get 60 votes including seven excuse me, five democrats who are not, have already signed on to help republicans, and thats just not going to happen, because they hate charles is there anything, the three that have dinner with President Trump tonight and two more, is there anything that could be extended . Certainly there are certain democrats out there who understand that this is good for the country . Charles lower business taxes creates jobs and generates certainly, there are two or three democrats that get that much. That might do the right thing. Infrastructure, thats probably the one thing that could bring some of those guys to the table. Charles the other side, deroy, gop versus gop. Its why obamacare didnt make it. I keep seeing a scenario where perhaps one of these groups loses out, the tuesday group or the Freedom Caucus. As i do the math, it feels more and more like it could be the Freedom Caucus. I just think the g to op desperately needs leadership. This vacation is unbelievable. These guys are going 15 directions. If youre paul ryan or mitch mcconnell, you have to be loving and charming enough so they do what you want or s. O. B. Enough that theyre scared of you. Thats what makes it so difficult to get this stuff done. And what they need to do is show up and do their jobs. I would love to talk five weeks off, show up for a week, go back and take another week off. Gabby, let me start with you because youve been all over this story, breaking news on it, in fact. And its not just that President Trump is going to visit 13 states, but hes bolstering his communications department, hes doing all the things that people felt he probably should have done to get Obamacare Repeal through. Thats exactly correct. I mean, i spoke with mark short, the white houses legislative affairs director, a few weeks after the Health Care Bill failed in the senate, and he really said that that was a complete learning experience for the president and that the white house would be looking for different ways to tackle tax reform when the time came. And it seems like thats exactly what theyre doing. Theyre channeling all their frustration into what happened with Health Care Reform into making sure that they can push for tax reform. Putting the president out on the road, dispatching Vice President pence to also participate in different rallies in states, and, you know, making sure that hes reaching out bipartisan members of both chambers of congress. Hes holding a dinner this evening with three democrats and three republicans, all three of whom are on the Senate Finance committee. So hes really making strides to insure that tax reform gets done by the end of the year. Charles and also i think, deroy, its an acknowledgment that, hey, i dont have the leadership in place. They may have the titles and the positions, but ryan and mcconnell, whether its deliberate or not, arent going to get the job done for me. Think about this, the tweets have been tamped down a lot, the bipartisan deal, a lot of people believe that is the essence of being president ial. The way President Trump and the white house handled hurricanes harvey and irma, and then this, taking control. This is a steep learning curve, but he seems to be picking up on it. Its ironic that things are getting calmer and calmer and calmer at the white house. I dont know if this is the influence of john kelly, the marine corps general whos come in as chief of staff, but things seem to be more focused. I think the twitter outbursts have been minimized. And i think trump has looked a lot more focused, a lot more in charge, a lot more in command, and i think certainly traveling to states that he carried, also a state that is mitt romney carried where you have democrat senators representing those states, those are people who could be made vulnerable, and they ought to be pressured to support tax reform. Charles yeah, quite a few, i think, gabby, quite a few democrats are in those states, you know, bill nelson, sherrod brown, debbie stain stab now, bob casey just to name a few. You want to go in their backyards, put this pressure on them and maybe give some sort of an olive branch to help them cross that line. There are a lot of things the president can achieve by going out on the road and participating in different tax reformcentered events in these states. Not to only, you know, pushing for tax reform, but also like deroy and you both said, putting pressure on these democratic lawmakers who are facing tough reelection battles in 2018, and also backing republicans into a corner on exactly what he wants to see in the tax reform legislation that comes through the senate and the house. And so, you know, hes been pushing on the road for a 15 percent corporate rate. Hes been pushing for changes to the current federal income tax levels. Anything that he says on the road is then going to be something that republican lawmakers are going to have to seriously look at as they begin to write this legislation. And so i think, you know, on a number of points its really wise for him to be out there con to standpointly pushing for what exactly he and his white house want to see. Charles that is the deal too, right, deroy, that President Trump is sending a message to his own party as well. But its probably better that he doesnt go to a state where theres a republican in office and sort of threaten that person in public. But certainly, hes letting everyone know hes serious. He is not playing around. He wants this tax reform done, and this is if this is the way to get it done, we saw the hustle during the last couple of weekes of the campaign. Hes willing to hit the road, roll up his sleeves and get the job done. I think it would be a good idea to visit these states with democrats that he won and meet with Business People there and say, you know, please bring out your last tax return. Some companies have tax returns this big and let these people get up and talk about how theyre victimized by the irs and what they could do if they had a Corporate Tax rate of 15 , how many more markets they could open, jobs they could create, prosperity they could share with their community. Charles right. Gabby, the overarching theme of the trip is this is, ultimately, a jobs bill. Isnt this how theyre promoting it . It absolutely is. From the get go, weve heard this president zero in on one message, and thats jobs, jobs, jobs. I think deroy makes a great point. If wanted to go out there, President Trump, and meet with Business Leaders in these various states, that would probably be more effective than him holding a listening session with his defunct ceo council back here in washington. He can really sit down with people in communities who are driving businesses, who are creating jobs, contributing to their local economies and hearing from them what they most want to see in a tax reform bill. Charles well, certainly, President Trump has the wind in his sails right now. Hes been doing everything right the last few weeks, and i think hes going to take advantage of it. What this means likely as mueller is going to be going on for quite some time longer. The fact that mueller hasnt gotten all the documents he asked for means we are in at least four more months of this. That said we have a dramatically different tone from the white house and we had a few months back or the president s new legal team says things could he really open and enthusiastic about trying to help mueller wrap up the white house portion of this investigation as soon as he can. Thats a marked change from several months back were we heard white house spokesman calling it a charles i want to listen to the steve bannon 60 minutes and interview. Someone said to me that you describe the firing of james comey as the biggest mistake in political history. Thats probably too bombastic for me but maybe modern political history. Charles essentially firing call me lead the way for the special investigation which is the greatest threat to the Trump White House right now. What took up residence along quite honestly and in your breaking is a moment ago the department of justice Inspector General is now launching an investigation into comeys conduct. He testified a year ago under oath when asked, did you decide not to prosecute Hillary Clinton before or after you interviewed her and he said afterward. Then why is it that he wrote a statement exonerating Hillary Clinton two months before he interviewed her and all of her top aides . What the prosecutor that solves a suspect before the evidence is all in . I will tell you whats, a prosecutor who is in noncorruption and the fix is in. Charles scott a lot of criticism of muellers breadth of this. He is taking this in so many directions. Apparently he has hired a mophie of moneylaundering experts. What exactly is mueller trying to achieve here because it seems like its gone way off the simple investigation of potential influence in the election. I disagree disagree that there fixes them in. I believe we dont know what mueller and his Investigation Team have or what they dont have. He could throw rocks at the investigation and saying its going up the wheels but i have confidence this team will be responsible. They are looking at documents and the reason they have had a mafia lawyer if you will as well as a tax lawyer and others is because based on the documents in based on what they are looking at they want to follow the money and to if the Trump Organization or the campaign was tied up with business folks in russia than we know most of the time and most of all we know so far is that these were oligarchs and russian mafioso types if you will. They are just investigating. No one is being prosecuted just yet and i think the investigation has to go where the evidence takes them. Charles is that seem like a witch hunt a wide witch hunt but i do want to ask republicans in d. C. And you know them very well, how concerned are they about how far this goes . In trumps inner circle one of the biggest points of concern is that mueller will find something thats perhaps only collaterally or unrelated necessarily to russian stuff. Collateral evidence of wrongdoing that goes beyond the battery of the probe could get Trump Associates in deep trouble. Charles hang on one second because i breaking news and i want to ask a legal scholars. Justices are now telling the Trump Administration to put a ban on most refugees allowing the restrictive policy on refugees. Greg let me ask you about this. This is big breaking news coming over now. You can see the Supreme Court has largely upheld the president s travel ban because it was perfectly legal under a 1952 statute that all of these Lower Court Federal Judges misinterpreted the law thats why in the Lower Court Justices are not sitting on the Supreme Court. A whole group of people are a lot smarter than sitting federal judges. Theres no surprise here. This was entirely predictable. Charles scott, you are laughing but whats so funny . This is the purview of the executive branch of the United States government and all of a sudden you do have lower courts judges who are acting in an activist manner here. Seems like the Supreme Court is trying to clean us up. Maybe, maybe not but i wouldnt say the Circuit Courts in the federal courts are less intelligent or less abiding of the law than the Supreme Court. Heres the deal, the 1952 statute that greg talks about certainly is in place and its within the purview of the executive that no matter what the executive cannot highlight the First Amendment cannot violate religious freedoms and even those individuals who come here, they are coming here has to be reviewed under the contents of the u. S. Constitution. The lower courts found that offensive and discriminatory if you will and it could have been tailored more narrowly. Charles let me ask you how much of the u. S. Constitution applies to nonu. S. Citizens . Well, none. Hes of it does but. If you are living in iraq and have never set foot in the United States or syria or yemen or any other countries. As part of an Immigration Program to come into the United States does your case have to be reviewed in your First Amendment for the u. S. Cannot be violated. Multiple majority nations in the country and only one was on the travel ban list and if the terminate Trump Administration is discriminating against muslims how about the nine nations that werent banned from coming from the United States . Its not a charade. I can tell you the justices at the lower level didnt believe donald trump when he said it was either religious as the reason why. There was no violence or no terrorists coming from those individual countries on u. S. Soil. Charles now we are going to an area that is concerned for debate but lets bring betsy back. I understand in this dramatic reduction in the number of refugees coming to the United States doesnt have anything to do with the religious test. Obviously the First Amendment law involving how the federal government can use a persons religion to let the man is complicated. This is not a First Amendment question in my understanding. This is a question about executive power. Did the president have the power to dramatically reduce how many refugees we accept every year and im sure we could debate all night about whether or not its good policy to reduce the number of refugees that we dont have a Supreme Court ruling saying that the president was acting within his rights. The Supreme Court ruling has said when it comes to National Security the president has plenary power over immigration matters, who comes here and who is not a threat. Charles the final word, the lower courts i think we should all acknowledge have become politicized and they have become activist. They are known for their activist role more so than the role they were initially set up for her. More so than the Supreme Court . If they are politicized they are all politicized and heres the deal. Youre absolutely right the executive has the privilege and has that authority. You are right about that but theres no authority and no executive that can exercise that authority to violate the u. S. The Supreme Court is aligned a trap administration to maintain its restrictive policy on refugees and justices on tuesday agreed to an administration request to block a Lower Court Ruling that the travel ban allowed 24,000 refugees into the country before the end of october to do want to bring back our panelists whove had a chance to look this over little bit. This is yet another rejection of the 9th Circuit Court of appeals, which has consistently gotten a wrong when it comes to immigration policy in the president s travel ban as well as his limit on refugees and so once again the president to a predicted he would win once it reached the high court has one once again. Charles let me ask you, because the order was written by Justice Anthony kennedy does that give you insight into how ultimately it may play out in the Supreme Court . It does, probably 54 with the newest Justice Neil Gorsuch siding with the conservatives. He is fairly staunch conservative but kennedy is often the swing vote and the fact that he suggested that he sides with the conservatives. Charles but you are making a pretty interesting point and i want to remind the audience against these countries where the ban was imposed, iran, syria, libya, sudan, yemen and somalia, you dont have to know the religion to know that hey these are some pretty messed up places and we probably do need a much better vetting system to allow folks in from there. Theres one thing to understand about this on and now greg will correct me if im wrong. The important piece of this is that there are two different bands we are talking about the one is the travel ban that bans people from most those countries you just listed from coming to the United States but with the Supreme Court has ruled on tonight has to do with an acrosstheboard and on all refugees.
