You know, she put her Climate Change plan out yesterday and hopped on private jet and her plan will be Carbon Neutral going forward. If sanders wins New Hampshire there will be panic in hillary land. What is more likely, Bernie Sanders is weakening hillary enough that strong democrat that can beat hillary will get in. Whether Elizabeth Warren or john kerry. Trish she is shaking her head, no way. I dont think so. I think Elizabeth Warren knows and knows well she is in much better position where she is right now. So, you know, clearly Bernie Sanders and donald trump are both tapping into something which is this washington establishment fatigue. They represent the opposite. Weve talked to a lot of economists and wall street shops theyre saying quarter point rate hike, thats it. Weve been reporting that for months now. The talk on wall street is what is going on in china, whether china basically, chinas slowdown will give janet yellen pause and the word were hearing is no. If chinas economy continues to stagger and the markets continue to face headwinds that still will not be enough reason for Federal Reserve to stave off a rate hike. Trish but, jon, look at what, i mean the china situation, it has a lot of investors spooked and this is one of the reasons why we saw some challenges to the market earlier this week. And last week. Does she just shrug that off and say im not worried about it . It is so important to me to get off of zero . By the way, i agree it is important to get off zero. We shouldnt be on zero for six plus years but will that cause her to move . When you think about anything overseas you have to think about the channels which that travels to the United States. With china the very important channel is commodity markets. Were seeing renewed downturns in a lot of Commodity Prices because china has been a big consumer commodities and it has too much capacity. So that is a problem for the fed. The fed wants to see inflation get to 2 . It has run below 2 for more than three years now. And if they see more downward pressure on commodities, that could give them some pause. But you know they have tended to describe these commodity price downturns as temporary affairs. They look past it when commodities were going way up and theyre looking, trying to look past it when they are coming down because they cant go beyond zero. Trish you could look at it as a positive for the American Consumer because it looks like they are getting more money in their pockets each week. Right. Trish that is another debate. Phil flynn, i want to bring you into this, were were seeing Commodity Prices weaken significantly. If fed has a rate hike, that jon thinks they will, i dont necessarily think so but does that make commodities go down further because that makes dollar much stronger . Actually would feed into the deflationary fears were seeing in the rest of the globe. One of the concerns about the fed is the biggest fight is to fight deflation. What were seeing in china is beginning of new round of deflation that could spread to other parts of the world, that is going to be a big problem. Ill tell you what the fed funds future traders are pretty much in ire camp. Theyre not convinced that the fed is going to raise in september. In fact they barely believed that there is 51 chance that the feds going to be able to move. December is a long time away in the mind of fed funds futures. Much better chance that the rate is in december. If we continue to see Commodity Prices get crushed, it will be hard for the fed to hit inflation rate and hard to justify a rate hike at that point. Dollar strengthening story is such an important one. Were seeing currencies trading where they were during the asian crisis in 98 and seeing that in asia and indonesia. Wall street journal says the dollar will continue to strengthen and commodities continue to get stung here. Trish look, the dollar is going up so it will maybe that european vacation easier. Protesters taking to the street in more than 50 cities around the country calling for an investigation into planned parenthood. They want to strip the agency of government funding. Planned parenthood receives 500 million of your taxpayer dollars every year. Well sparking this outcry, the disturbing undercover videos from the center for medical progress showing planned parenthood employees allegedly discussing the sale of fetal tissue for a profit. The group releasing a new documentary web series today, which featurest a former technician whose company was partnered with planned paint hood. This woman describes how she was hired to harvest body parts from aborted babies. Listen to this. I thought i was going to be just drawing blood, not procuring tissue from aborted fetuses. The main nurse was always trying to make sure that we got our specimens. No one else really cared but the main nurse did, because she knew that planned parenthood was getting compensated. But you look at these videos, and its clear that if these people are working for them and they are engaging in what we seem to be seeing, which is a negotiation tactic, for compensation for these fetal body parts, doesnt there at the very least need to be an investigation . Youre wondering to yourself, they say there is no profit that is being made but it certainly sounds as though she is willing, maybe, willing to take a little on the side . Well, i would highlight three things. One, north america. North america had a record profit for any quarter. Secondly, i would highlight our ford credit operation which earned over half a billion dollars, and thirdly, i would note asiapacific which had a record for the Second Quarter and a lot of that driven by china. Even in europe, which was near break even, i highlight that because we are on the path to profitability, and it did allow all the good news to flow through to the bottom line. Trish you mentioned china being a highlight, globally as you go around the world and we contemplate just exactly what kind of situation were in, whether it be in europe where theyre dealing with a significant debt crisis and slowdown there, or whether it be china where every day were getting news of more problems, where do you see potentially that weakness coming from . In terms of china, in china we see still a strong gdp growth of probably about 7 , but in our industry what were seeing is the fact that the government is making a transition from an economy that was more exportoriented, investmentfocused to one thats more focused on the consumer, consumer services. So theres going to be some road bumps along the way. Clearly, were seeing some volatility, the stock market issues affecting consumer confidence, but overall we do expect longer term that were going to see very strong growth overall in the economy but also the industry in china. Already the biggest in the world. Trish thats been very much in focus for investors as of late. Let me move on to the f150. The cost of it, pretty significant, you know, for a pickup truck. What is it that makes this pickup truck so much more special that people would be willing to shell out in the vicinity of 60k . Well, we have a broad range of offerings in f150, so we can go from the mid 20s all the way up to this new limited which will be coming out this winter. One of the things we certainly see is consumers love their pickups. And so theres a lot of people that want to have the ones that are more, with more content, more features from the lariat all the way up to this limited that we just announced. Trish i understand youve even got massaging seats in that one, so lots of little tricks on that pickup. Finally before i let you go, fiatchrysler has been in the news with a big recall, 1. 4 million vehicles that are vulnerable to hacking. Finish thats the concern. Wired magazine was able to hack into these vehicles, and its a real concern right now as we see this transition into the connected car, people are wondering whether those systems are vulnerable. Trish i mean, is this legal, what shes doing . Generally, its not legal. I say generally because shes attempting to find some ways around landmark legislation called the Civil Rights Act of 1964 which as amended prohibits a public accommodation, somebody that opens their doors and says to the public im open for business, come here, give me money and ill give you the service or good that im selling, prohibits public accommodations from saying no to people on the basis of religion, creed or nationality. So somewhere among those three would be the people against whom she wants to trish well, theyre a religion. Shes directly saying if youre part of this religion or i think youre part of this religion, youre not welcome. She says she has the right to do this because the bureau of alcohol, tobacco, firearms and explosives gives her discretion. This is all being done in the name of safety. Well, it gives her discretion to exclude someone from a shooting range who she believes would be inherently untrustworthy at the range, that they would be dangerous to themselves or others. But she has to make that judgment on the basis of the unique behavior of that person, not the religion of that person. And the reason for that is the federal statute going back to 1964 that prevents discrimination by the government, in public accommodations or in housing, based upon religion. Dr. Jasser, whom we know, makes a very good point, this is essentially unenforceable. What is she going to do, interrogate someone and decide, well, your religion lets you in, but your religion doesnt let you in . Trish trish weve got some breaking news, the nfl has upheld the fourgame suspension of patriots Quarterback Tom Brady brady. This, of course, was the wells investigation, it was conducted, and out of that investigation we saw things like cell phone records between some of the ballboys going back and forth, and it certainly seemed to implicate tom brady in all of this. The nfl suspended him with four games, he appealed it, and now the nfls saying, guess what . Youre out. Heres one of the reasons he lost the appeal. He lost the first one with ted wells, a dear friend of mine and, in candor, a superb lawyer whom im inclined to believe as well as losing the appeal. The Players Union has signed a collective Bargaining Agreement players to participate and cooperate in investigations even against themselves. This is not the government. When the Justice Department comes after you, you hire lawyers to resist them, but when the nfl comes after you and youre tom brady or anybody in the nfl, you have to cooperate. When you dont cooperate, they may conclude that you have something to hide trish and he thats probably what the trish did not cooperate. Correct. Trish there was a report being released this morning, i bereave by espn, which indicated tom brady may actually have destroyed his cell phone during this wells investigation, physically destroyed it because he did not want to provide the evidence. We do know, judge, that he was not willing to turn over his you know, when a person hides evidence, you assume theyre guilty. Its a natural, rational assumption. You cant make that assumption in a courtroom because the fifth amendment protects the person and allows them to remain silent, but this is not a courtroom. This is a labormanagement relationship, and its pursuant to a written agreement, and it requires cooperation. If i could editorialize, i think tom brady got off easily. Trish you know, i think youre absolutely right. I think the cheating in which he engaged, now having been upheld on appeal, was at the most critical juncture of that sport, the game before the super bowl. And the suspension should have been longer, harder and stiffer to send a message. You know, four games at his pay grade is a lot of money. Four games to the new England Patriots without tom brady is a huge loss. But the cheating in which he engaged fundamentally attacked the game at its most critical juncture. Trish you know, a lot of people said, oh, it doesnt really matter, it doesnt matter if you deflate these footballs, Everybody Knows this and maybe does happen. Im sorry, you know, if youre playing a sport and there are rules, there are rules. And if you break those rules, it seems to me there should be some kind of punishment for that. Well, there was a punishment, but i think it was, i think it was on the soft side. Nevertheless, the press will play this out that tom brady got more than a wrist slap, that tom brady got seriously whacked. There is no appeal from this. The collective Bargaining Agreement prohibits an appeal beyond the commissioner. So his lawyers are going to get in front of a camera tonight and say were going to file a lawsuit against the nfl. That lawsuit will be dismissed, and theyll end up paying the legal bills of of the nfl for resisting the lawsuit. Trish okay. But you think people are going to play this off as they came down hard on him. Goodell has, obviously, been highly criticized for his inability to come down on players he should come down on. Yes. Rice, Adrian Peterson and how slow the nfl has been to act. Now theyre out there with their sort of poster child, tom brady, very different situation, obviously, but nonetheless it really sort of gets at, i would say, sort of the character and the heart of this game well, in fairness, in fairness to the commissioner, he cannot extend the punishment. He can only maintain it or reduce it. So in other words, tom brady cannot suffer greater than four game loss on account of the appeal. So the initial decision by the nfl bureaucracy to suspend him for four days was, in my opinion, the weak one. The commissioners goal is to determine whether or not there was enough evidence to justify that. And whether not whether it should be stronger, but whether it should be lighter. Trish we should assume, judge, in fact, tom brady did do this. I think its pretty clear now. Hes going to deny it, i dont blame him, and his lawyers are going to deny it, but its pretty clear that the two entities actually, three entities that looked at this, theres the internal nfl investigation, the ted wells investigation and now theres the commissioner, have all come to the same conclusion. Trish you remember those Text Messages that were going back and forth, i dont know if we have them perhaps to show the viewers, theyre working on getting those, but they seem to me to be pretty that might have been the smoking gun that the investigators were looking for in all of this, because there was this back and forth be exchange between the guys that were handling the ball. You know, when people engage in a conspiracy, an agreement to do something wrong, and one of the conspirators takes a step in furtherance of that agreement, they dont put it all in writing. Theres little snippets here and there, and youre right, its Text Messages that usually tip the hand. A fair reading, a neutral reading of those Text Messages shows tom brady knew exactly what was going on, and he either looked the other way or did nothing to stop it. And as the quarterback of the team at this critical juncture, he had a duty not to be involved in any cheating. He cant say, oh, they cheated and i learned about it later. Thats not the way it works. Trish judge, stay with me, were joined by former nfl player t. O. Jackson. Whats your reaction here to this news that its going to be upheld, that fourgame suspension for tom brady . Yeah. Im a little surprised. I thought when this first broke some months back that the appeals process would afford tom probably a twogame suspension. So im a little surprised. And, but, frankly, im proud that the process has worked in the way it has because, you know, i truly believe that this is sort of par for the course for the patriots. You know, they have a history of pushing the envelope and actually breaking rules, and im proud that the process held up and held strong for one of the star, biggest stars as it holds up for some of the lesser known stars, if you catch my be drift. You know, he makes a great point. Tom brady cannot be treated differently because hes a poster boy, a superstar on a winning team. And this team, remember, bill belichick, the coach, was fined 500,000 for cheating, and that fine was paid by bob kraft, the other than. So bob belichick, as far as we know, didnt lose a dollar. This is not a case where the owner can reimburse tom. Hes going to lose four weeks of his salary, and more importantly, the teams going to lose his services for four weeks. Theyre luckily cough gotten off this easily. Trish tyoka, youre pleased the nfl held this up. The judge was just making a point that tom brady ought to have gotten more, but they made the decision, the nfl did, to come forward with the fourgame suspension, is so that was the max he could get. Yeah. And, you know, when you look at the facts, the actual balls probably did not have much impact on the games in which were talking about. That game against indianapolis, after they changed the balls and we know they were using regulation balls, he had an unbelievable second half and really put that team away. But i think the problem is the history weve talked about before, you know . The judge talked about the cheating, 500,000 trish let me share with you both those texts that we were talking about earlier. This may have been what caused the entire issue to really explode i cant read that. [laughter] trish to really come down. Lets see if ive got a hard copy here. It says you good, johnny boy . [laughter] still nervous . So far, so good though. Ill be all right. You didnt do anything wrong, bud. I know, ill be all good. And there were even more explosive texts than this, ill tell you, because that doesnt really tell you exactly what they were doing with the balls, but there were some and were going to continue hunting for those to bring them to you. But tom brady, and tyoka can weigh in on this, when tom brady refused to participate in the investigation, he declined the opportunity to explain those texts. Trish sure. So without toms explanation of those texts, the investigator is left with no choice but to conclude that he is part of a guilty conspiracy. Thats right. And they know the process, they know the culture of the nfl. They know that quarterbacks love their footballs. I mean, they have a love affair with their balls. No one touches their balls. The backup quarterback has his, and the starting quarterback has his, and theyre separate. They have their own balls, and theyre responsible for them. They dont want anybody touching them without their knowledge, because they like them to be and feel a certain way. And to say i wasnt a part of that process in which we know the balls were at a lower psi than they were supposed to be, i think, is just disingenuous. And, again, he didnt take the opportunity to explain what that conversation meant. Youre right about the destruction. Im just looking at our fox news lower thirds. Tyoka, the commissioner found that tom intentionally destroyed his cell phone prior to the meeting with the investigator. Now, what does that tell you as a former nfl player, the investigateor would ordinarily conclude . That there were specific and explicit conversations on that phone that dealt with the problem at hand. And he wanted nothing to do wit. But, look, judge, the nfl wants nothing to do with this. Right. They want this thing to be done six months ago. They dont want because they dont want us discussing things that go to the hard core competitiveness of the game. They dont want fans thinking that, like i said before, that this is anything close to wwe. These are great athletes on the field, they want everybody playing by the same rules. Very important. While i said before rules or this infraction may not have been as bad as the previous one, its still very important because they dont want anybody questioning the integrity and the outcome of these football games. Trish stay with us, tyoka, as well as the judge, pete slager is joining us schrager is joining us as well, and we are learning that the nfl commissioner or, rather, the cmsr is saying that tom brady destroyed his cell phone. We heard reports of this earlier, before, before meeting. You know, destroying the evidence, if youre, in fact, destroying the evidence in an investigation, i mean, that may be a whole other problem. Yeah. Well, look, tom brady says that he destroys all his phones when hes done using them. And i dont know what a usual celebrity like tom brady would do, without this going on, would he just throw his cell phone in the garbage . Im not sure. He claims, and he had a meeting with the appeals decision, and it says in this report im just skimming through now, he says he does this always, this is what he does when he gets a new phone, he destroys it. They did it on march 6th, the way the wells team started investigating. So that looks very ugly. The nfl wanted to throw the book at brady all along, they wanted to show theyre tough and the golden boy himself, Tom Brady Trish was four games enough, peter . The guy cheated. He destroyed evidence, and you give him four games . I think that four games was looked at as very drastic at the time, and the fact goodell is upholding that suspension is so surprising. Look, you destroy your phone, do this in the investigation, youre not going to cooperate, theyre going to throw the book at you. I dont think any more than that would have made much sense. Trish you dont think anything more than four games would have made much sense. You know, i guess part of the heart or the root of this question is how big a deal is it that he did this. I think the judge and i are on the same page. You know, you play a game, you sign up to a certain set of rules, and you dont break them. Theres no winkwink, nodnod. You just dont break the rules. Theres something kind of unsports sportsmanlike about that unsportsmanlike about that. Tyoka, whats your thought on that . The actual game, again, i dont think it impacted the outcome of the game in which were talking about, but the problem is what you just said. The fact that you guys as fans are discussing this issue is way more detrimental than that one football game, it really is. This nfl shield that we all have been a part of upholding, its worth billions and billions and billions of dollars to a lot of people. And it all is predicated on my team has a chance to win. Every football fan around america right now feels really good about their team having a chance to win because this is one of the few leagues in which you can go from worse to first really quickly. But if theres an idea that someone is breaking the rules and then that someone is a team whos been highly successful the last ten years who, by the way, when you look at the stats, theyve lost drastically less fumbles than everybody else in the league, you get really nervous, and you dont want any part of it. I think this four games is a really good suspension, and they had to upheld it, trish, they did. They had to. Trish Geraldo Rivera joining us, good to have you here. Weve got a breaking story here. Tom brady is going to get that fourgame suspension. Weve been debating whether or not he got enough. What do you think . Well, i just left Gillette Stadium. I took my 10yearold to see taylor swift in the house that tom built [laughter] 60,000 roaring fans n this case it was little girls cheering on taylor swift. I think the offense was serious, and i think the punishment appropriate. I want the patriots to move on from here. I, you know, you can lament all you want the fact that theyve lost the first round draft pick. I think thats the most serious aspect of the entire penalty, not losing brady for four game, but in terms of long term for the new England Patriots. But, you know, i think about deflating the balls the same thing i think about barry bonds and alex rodriguez. You know, its too bad that they did these things that deviated from the norm that they committed an offense, they cheated so to speak. Not so to speak, they cheated literally. Because i think it obscures the greatness. Barry bonds was the greatest hitter ever, arod is wonderful. Theres no question that tom bradys the best quarterback of our era, if not ever, and he didnt need to deflate the balls. Let me throw something out here, because of my fellow lawyer seated next to me. Do you think its interesting, geraldo, that the new england ate rots gave up the ghost, did patriots, did not resist the loss, did not challenge the loss of the draft pick and the Million Dollar fine and left tom brady on his own . Is bob kraft saying something to the commissioner, were not going to stick by brady in this one, because youve got the goods on him . Well, what is ironic to me, judge, and in watching this were so use today the judicial used to the judicial system where theres a jurist and sometimes a jury of your peers and then if you lose, you have a legal or factual beef, you take it up in appeals court, here it seems to me that Roger Goodell is confirming the decision that Roger Goodell engineered to begin with. Im not exactly sure this curious arrangement whereby the litigator of the punishment is also the judge who approves the sentencing. You know, thats odd to us as lawyers, but it comes from the collective Bargaining Agreement which tom, as a member of the union, is bound by. I hope that they can put it behind them. I expect that they will. Theres so much money at stake. But more than that, all these broken hearts of all these youngsters. Trish trevor hey, im a new england fan. I grew up in this territory, and the patriots are a big, big deal. But, you know, lets not forget they, peter schrager, had a history of this. This has been talked about before. Yeah, of course. You go back to spygate with belichick and theres always a cloud of mystery around how they skirt the rules. Football insiders will tell you the game against the ravens that was an illegal formation that was technically legal by the rulebook, but they were running something no one had ever seen before really set a lot of people off. But thats belichick. I love what everyones saying, and i think the key thing here is that the players did agree by the collective Bargaining Agreement, they could have made a point to remove that power from goodell, and time and time again, goodell throws the hammer down on these players and the agents and the union, they cry foul. But you know what . These guys signed that deal, and its good for ten years. And as long as he wants to be, goodell can be judge, juror and the executioner which in this case he very well is. Trish we have learned that the nfl is upholding that fourgame suspension for tom brady. We have also learned that, apparently, tom brady destroyed his cell phone so as to not have to provide any kind of evidence to the nfl as they conducted that investigation, the wells report, of course, which revealed some text exchanges that went back and forth between the ballboys that were handling tom bradys footballs there. Geraldo on set with me along with judge napolitano, and what does this guy do . Geraldo, ill start with you, to his marketability. He has been the guy, the clean cut, allamerican football player, married to a brazilian, stunningly gorgeous model, i mean, who lives a somewhat seemingly perfect life [laughter] hes got a big deal with under armour. Do you think it affects his ability to sell . I dont know i have a beautiful wife as well, only she doesnt have a positive cash flow [laughter] im not sure which of these superstars trish he can always fall back on that. It was interesting, as you were speaking earlier, i was in the green room waiting to come on, and i saw the roll they used of giselle and tom arriving at some black tie event, and you just look at these people, and you just go, oh, my gosh. So beautiful. And the children are beautiful. And he deflated the footballs, and im sorry, and that will taint him, but my goodness, i go back to where i started. This is unfortunate because he is the greatest quarterback of this era, and hes such a wonderful person, and hes trish why did he have to do this, geraldo . He didnt need it. Whyd he do it . Sometimes out of habit you just, you just want to get that, you just want to get that one more edge, that one more i can see the temptation. During the the days, the performanceenhancing drugs were legal, you know, barry bonds, he took it when he was legal, he just lied about having taken it and refused to answer some of the questions the feds had at the grand jury there. But i wonder if i was in high school and someone said, hey, kid, heres a pill, its legal, and instead of hitting. 275, youll hit. 325 you would have turned it down. [laughter] trish tyoka, i mean, is there that temptation . You always want to be the best, and theres a lot of pressure when youre play anything the big leagues. Trish, of course it is, and the temptation is there, but you have to make a decision. You have your own value system, and you have to make a decision in which you have to live with. And some players, we used to say it all the time, if you aint cheating, you aint trying. That was a line i heard a lot in the locker room. For me, it didnt, you know, fortunately for me, i didnt have that will to go and cross over the line, and he didnt have to do this, but to be fair, hes not the only quarterback that has thrown balls in bad weather with psi below the number. I will just tell you that right now. This is not a super, super uncommon thing. Now, again, i dont think that it had a tremendous effect on that particular game and this season in which they won the super bowl. The problem for the patriots is that this precedent has been set already. You guys talked about before about spygate. Full diss closure, i played in that patriots in which we lost. They beat us, and i respected them for it, and many years later i found out they had taped or walkthrough allegedly, and there was some footage that was destroyed, ironically, by the nfl. So this destroying of evidence, this is not the first time weve heard of that with the nfl. So theres a lot going on here, and i think the problem is as the judge said before, tom brady diseased to stare down the League Office decided to stair down the League Office as opposed to backing off and saying go ahead and do what youre going to do. Trish you wonder how much worse it might have been had he actually turned over that cell phone evidence.
